If, at a later date, this information is found to be incorrect or the plans revised, this decision will become invalid; and, any development occurring must cease until a coastal development permit is obtained or any discrepancy is resolved in writing. RATIONALE: The subject site is located on the harbor side of the Balboa Peninsula. The.proposed development consists of the reconstruction of an existing pier and gangway within the City's Project Line. As allowed by the City of Newport Beach Harbor Permit Policy (Section V. 5, Bayward Location of Piers and Floats), dock projects within the subject area may extend up to 20' beyond the U.S. Pierhead Line to avoid the need for excessive dredging. The proposed dock reconstruction is similar in function to other residential docks in the immediate Vicinity. Coastal access to Newport Harbor is available at the end of B Street, approximately 400' east of the subject site. An inspection performed by the City determined that no eelgrass exists in the vicinity of the proposed project. Therefore, no eelgrass will be affected by the proposed project. Also, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used: The proposed development will not result in adverse impacts to coastal access, coastal resources, public recreation or coastal views. The proposed development would not prejudice the City's ability to prepare a Certified Local Coastal Program and is consistent with the land use designation in the City's certified Land Use Plan, past Commission actions in the area and Chapter 3 policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their November 14-17, 2000 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b)-of'the California Code of Regulations. Specifically, the complaint is that there is someone residing on the vessel that is berthed at your dock in violation of the.City Harbor Permit Policies, Section K. which prohibits anyone from sleeping aboard a vessel that is at a residential dock. Section K. "In those areas of the harbor where the piers and floats are bayward of residential zoned areas and are reserved for the occupants of the abutting upland property, liveaboards shall not be permitted." You were originally contacted in November of 1989 regarding a liveaboard complaint and at that time you were informed about the harbor policy that prohibits individuals living aboard vessels in front of a residence. We have received confirmation from the Orange County Sheriff Harbor Department that there is a person/persons onboard the vessel "Slaphappy" during the evenings. Please take whatever measures are required to resolve this situation and come into compliance with the above stated sections of the harbor policies. Leroy Re: Liveaboard situation at 900 East Balboa Blvd., a residentially zoned area within the City of Newport Beach Dear Mr. Leroy: This letter is in response to your question regarding City procedures in liveaboard situations bayward of residentially zoned areas within the City of Newport Beach. The piers bayward of residentially zoned areas are built under a permit from the City of Newport Beach. These permits are administered and governed by the City Council adopted Harbor Permit Policies, and by the City Municipal Code. In building a dock under a City permit, the applicant must comply with the Council Permit Policies, as evidenced by Section 4.A. of the policy statements: 4.A. "Acceptance of Provisions for Harbor Permits: It is understood and agreed by the Permittee that the doing of any work under the permit shall constitute an acceptance of all the provisions." One of the provisions of the Harbor Permit Policies, Section S.K. states: 5.K. "In those areas of the harbor where the piers and floats are bayward of residential zoned areas and are reserved for the occupants of the abutting upland property, liveaboards shall not be permitted." If, in fact, individuals are living aboard a boat bayward of a residentially zoned area they would be in violation of these sections of the Permit Policies. These violations would subject the permit holder to revocation of his permit, as provided by section 17.24.090 of the Municipal Code, Section 7: 17.24.090 "GROUND FOR REVOCATION Any permit heretofore or hereafter granted for any structure or work in the waters of Newport Harbor or the Pacific Ocean may be revoked by the City Council upon any of the following grounds (Section 7) The permittee has breached or failed to comply with the terms or conditions contained in the permit or upon which the permit was granted." 3300 Newport Boulevard, Newport Beach If in fact, the permit was then revoked, the dock would be removed and there would be no available berthing for any vessels at that area.
