Webb, Public Works Director- (949) 644 -3330, dawebb @newportbeachca.gov Patrick Arciniega, Senior Civil Engineer (949) 644 -3347, parciniega @newportbeachca.gov Back Bay View Park Maintenance -Award of Contract No. 5892 (CAP14 -0021) Staff received construction bids for the Back Bay View Park Maintenance project and requests City Council's approval to award the contract to Kasa Construction, Inc. a) Approve the project plans and specifications; b) Award Contract No. 5892 to KASA Construction Inc. for the total bid price, including additive items 1 and 2, for a total award of $310,400.00 and authorize the Mayor and City Clerk to execute the contract; c) Establish a contingency of $31,400.00 (approximately 10 %) to cover the cost of unforeseen work not included in the original contract; and d) Approve Budget Amendment No. 15BA -027 appropriating $13,000 from project savings from the San Miguel Park Restroom project CIP Account No. 7015-Cl 002044 to Back Bay View Park Account No. 7015- C4002013. FUNDING REQUIREMENTS: It is recommended that project savings realized from the San Miguel Park Restroom project, recently completed this fiscal year, be appropriated to this project account. Upon approval of the budget amendment, sufficient funding is available for the award of this contract. Construction Contingency $ 31,400.0000 Various Printing & Incidentals $ 3.200.0000 Total: $ 345,000.0000 M DISCUSSION: At 9:00 a.m. on December 3, 2014, the City Clerk opened and read the following bids for this project: BIDDER Low KASA Construction, Inc. 2 Aramexx Construction 3 Mode Engineering TOTAL BASE BID AMOUNT $174,400.00 $178,250.00 $328,000.00 ADDITIVE ITEMS 1 & 2 $136,000.00 $114,350.00 $430,000.00 The low base bid amount is within the Engineer's Estimate of $175,000. The low bidder, KASA Construction Inc., possesses a California state contractor's license classification "A" as required by the project specifications. A check of the contractor's references indicates satisfactory completion of similar projects for other public agencies and they have recently completed two projects for the City. This landscape maintenance project includes the restoration of the meadow area which has been over grown with surrounding shrubs. In addition to the other incidental items of work, a walkway and benches will be added along the western edge of the meadow. Staff is also recommending the award of two additive bid items. The bid documents specified that contract would be awarded to lowest responsible bidder based on the lowest base bid amount. At the discretion of the City, the City may award these additive bid items to the lowest base bid. Staff recommends adding this work as it adds value and closely fits the budget and estimates. These additive items add important enhancements to the park and reduce the amount of work in the next project phase. Although, the comparison of the total bid amounts changes with the additive items, the City is legally required to award the contract to the lowest base bid or rebid the project. Staff recommends that the project be awarded at this time to Kasa Construction. Additive Item No. 1 restores the park's meadow area to the original limits. Over the past several years, the meadow has been overgrown with larger shrubs severely reducing the public views and available open space. Additive Item No 2 enhances the park entrance off of Coast Highway including opening up the landscaping with a small meadow area, and colorful native vegetation. Pursuant to the contract specifications, the Contractor will have 70 consecutive working days to complete the work. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15301 (h) (maintenance of existing landscaping) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
