My name is Tom Gey, I live in Santa Ana Heights and ride horses.
I am willing to do whatever is necessary to help Newport Beach meet water quality
requirements imposed by the Regional Water Quality Board.
I do however believe that its impractical to ask riders to dismount and cleanup
immediately after their horse poops on the trail. There is a huge difference between
picking up after your dog and picking up after a horse.
With a dog its easy to simply carry a bag and pick up the poop with one hand.
The same task on horseback is complicated by many factors such as:
1.) Dismounting and mounting safely. Many riders must use a mounting block to
mount or dismount. Its possible to distribute mounting blocks along the street,
but that means people can only ride horses where there are mounting blocks.
Many people get on and off their horses only in the safety of their yard.
2.) Carrying cleaning equipment. I clean my horse area with a poop rake and a snow
shovel, which can't be packed along on a ride. Its possible to place cleaning
equipment along the street, but again that restricts riding to streets with cleaning
equipment.
3.) Picking up after a horse requires 2 hands, which means the horse must be tied.
Riders could tie their horse to fence rails, but these posts were not designed to be
used as hitching posts. Its possible to place hitching posts along Cypress and
Mesa, but there is no space on other streets to place hitching posts. Most all
young horses cannot be safely tied, and some older horses cannot be safely tied.
Frightened horses can break almost any tie.
4.) Horses are prey animals that survive by a flight instinct honed by 1,000s of years
of evolution. A horses first instinct is to run from danger, and in an urban
environment everything is dangerous. Riding in an urban environment with cars,
skateboards, dumptrucks and leaf blowers is challenging even for the most
experienced rider. Adding the distraction of constantly looking backword to
check for poop, dismount, tie up the horse, pick up the poop creates an added
safety risk, especially for young inexperienced riders.
Some physically fit riders with calm horses could comply with the pooper scooper
law, but it would be highly inconvenient and highly restrict where we could ride. For
most riders complying with the pooper scooper law goes beyond inconvenience to
become impractical and unsafe.
Finally I want to point out that eliminating all the horses from Santa Ana Heights will
not eliminate the water quality problem in the Delhi Channel. Horses do not poop
directly into the Delhi channel, horse manure gets into the channel when it rains. Yet,
