Box 1768 Newport Beach, California 92659-1768 SUBJECT: NOTICE TO PROCEED Dear Mr. Melum: Reference is made to your letter (No. 94 -383 -BH) dated January 26, 1994 in which you submitted on behalf of Keene Jacoby at 926 E. Balboa Boulevard a notification for the maintenance dredging of 225 cubic yards of sand and silt material by hydraulic suction and disposal of the dredged material by pipeline transport to a beach reclamation area. Based on the furnished information, we have determined that the proposed maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -GS provided that Mr. Jacoby's contractor does not exceed the maximum dredging design depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW. Specifically, the complaint is that a vessel "The Sound of Silence" CF3005FA is moored on a side tie in violation of Section 21.A. of the Harbor Permit Policies, which state: 21.A. "Boats moored at private or public docks shall not extend beyond the projection of the property -lines of the property to which the dock facility is connected...". To preclude further action by the Marine Department, the offending vessel must be relocated. If you have questions in this regard please contact me at 644-3044.
