SUBJECT: NOTICE TO PROCEED
Dear Mr. Melum:
Reference is made to your letter (No. 94 -383 -BH) dated
January 26, 1994 in which you submitted on behalf of Keene Jacoby
at 926 E. Balboa Boulevard a notification for the maintenance
dredging of 225 cubic yards of sand and silt material by
hydraulic suction and disposal of the dredged material by
pipeline transport to a beach reclamation area.
Based on the furnished information, we have determined that
the proposed maintenance dredging activity complies with the
terms and conditions of Permit No. 89 -211 -GS provided that Mr.
Jacoby's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1
foot MLLW.

Dear Mr. Jacoby:
The Cfty of Newport Beach has received a complaint regarding the
use of your float bayward of the above address. Specifically, the
complaint is that a vessel "The Sound of Silence" CF3005FA is
moored on a side tie in violation of Section 21.A. of the Harbor
Permit Policies, which state:
21.A. "Boats moored at private or public docks shall not
extend beyond the projection of the property -lines of the
property to which the dock facility is connected...".
To preclude further action by the Marine Department, the offending
vessel must be relocated.
