Balboa Blvd. Dear Carol Senour, O CL4, V'Y, V-e c Io7 ` I , J,a4z 7 A recent field inspection of your dock has revealed one berthed vessel is extending beyond the projection of the property line and into the city street end at B Street. This is in violation of the Newport Beach Harbor Permit Policies which state: Moorings — A: `Boats moored at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected in accordance with section 20-C." This letter will advise you that the encroaching vessel must be relocated within thirty (30) days from the date of this notice, otherwise an Administrative Citation may be issued and penalties will begin to accrue ($100, $200, $500 daily increments). Your cooperation will be greatly appreciated in this matter. Please see the attached picture of the infraction. If you have any questions regarding the enforcement of the Harbor Permit Policies, please feel free to give me a call. This letter was sent via regular first class mail and registered mail. We have not chosen to construct one, but the practice of building this type of "sand box" is commonin this part of the bay and I feel that property owners should be allowed to build them if they wish to. For neighboring property owners the practice raises two key concerns: first, potential obstruction of view and loss of privacy resulting from plantings and construction on the fill, and second, the distance into the bay beyond the residential lot line that the fill is allowed to extend. City ordinances seem to be controlling the first concern at present. For the second, it would seem fair to look closely at existing conditions. In 1957, when the City sold the 30 foot easement for East Bay' Avenue, the purchasing property owners entered into deed restriction agreements (only recently expired), on a block by block basis, to address the above concerns. For placement of bulkheads bayward of residential lot property lines a forty foot limit was adopted, and most existing "sand boxes" comply with that limit. I feel strongly that a forty foot limit should apply to future construction in this part of the bay. There are a few nonconforming "grandfathered" situations which have given rise to some discussion of a "string line" approach to determining new bulkhead placement. My view is that this practice would lead to ragged, uneven and unattractive bayfront appearance. We would all be better served by the application of a single 40 foot limit. Mr. Senour°s situation is particularly difficult in that his home is in an unusually low part of the beach and our increasingly high high tides make it essential that he be allowed to take some sort of bulkhead.ing action.
