Contrary to what Mr. Melum may have indicated, the Department of Fish and Game (DFG) does not have a general "policy" for projects involving decks and platforms; each project submitted to us is reviewed on an individual basis. DFG personnel have examined project plans for your proposed construction of a residential 30' x 30' pier platform at 1010 East Balboa Blvd., Newport Beach, California (Coastal Development Permit Application 5-97-423). The DFG believes that this project, as currently described, would not have a significant effect on existing marine resources and habitats within the area. Therefore, the DFG does not object to the issuance of a Coastal Commission or other regulatory agency permit for the proposed project. However, should the specifics of your proposal be modified, the DFG wishes to review these changes and reserves the right to alter our position. In that letter, I asked if pilings to support the proposed platform would be located within intertidal habitat or seaward of the mean high tide line. I indicated that if the answer was yes, then written comments from the California Department of Fish and Game and the California Regional Water Quality Control Board, Santa Ana Region must be submitted. Comments from both those agencies have been received. This implies that a portion, if not all, of the proposed platform would be located seaward of the mean high tide line. However, we need to have a specific determination of this. Therefore, please submit a plan or other documentation which clearly shows how much of the entire proposed platform (not just the pilings) is located seaward of the mean high tide line. If possible, this map should also show the location of the seaward property line in relationship to the mean high tide line and the proposed platform. Please submit the items described above as Boon as possible, preferably so that I receive it by Friday, April 24, 1998. In that letter, I had asked (among other things) whether the proposed platform would extend seaward of the mean high tide line and whether there would be any adverse impacts to marine life. My recollection of our conversation was that you had indicated that the California Department of Fish and Game ("DFG") had a policy that if decks such as the proposed platform allowed wave uprush under them.(i.e., no fill --intertidal habitat is still preserved), then DFG believed there would be no adverse impacts which concerned them. Therefore, please submit written evidence indicating; 1) whether DFG still has this policy or a new policy, and 2) what DFG's particular concerns, if any, are with the proposed project. My recollection of our phone conversations also is that the City limits the size of pier platforms to a maximum of 10'x14' if they are located above tidelands. Since the proposed platform apparently is not on public property, it is not subject to this limitation. Please confirm this in writing. Finally, if any clearance letter is required from the California Regional Water Quality Control Board - Santa Ana Region, a copy of the letter should be submitted to us. Balboa Blvd. There are major obstacles concerning your proposal. First, Bay Avenue adjacent to your property has never been vacated and is therefore still a public street right-of-way. Accomplishing the abandonment of this right-of-way may be difficult considering the unique circumstances of a public right-of-way adajcent to the waters of the Bay and the community's desire to preserve these remaining areas. Secondly, the Newport Beach City Council has expressed its desire to maintain, wherever possible, existing intertidal zones on the periphery of Lower Newport Bay. Therefore, it is conceivable that approval from the City of Newport Beach could not be obtained for a bulkhead which requires fill and possible steepening of the shore- line profile. Thirdly, it has been the experience of this department that appli- cations submitted to the U. S. Army Corps of Engineers for approval of bulkheading and filling in Newport gay have been vigorously opposed by state and federal agencies ie Fish and Game, Federal Bureau of Sport Fisheries and Wildlife; E.P.A. and Coastal Commis- sion who must comment on any permit under consideration by the Corps of Engineers.
