With regard to the enclosed Harbor Permit Transfer Application, do you records show whether their is a
'joint owner'? Any information regarding this owner would be appreciated, so that we can obtain their
signature on the Transfer Application.
Also, the Buyer in our transaction is inquiring as to whether there are fees now due in connection with the
pier permit and whether these fees are current. Could you please advise or let me know who 1 should
contact to obtain a statement as to these figures (if any)?

I hereby affirm that I am exempt from the contractor's license
law for the following reasons: (Sec.7031d.5, Business and
Professions Code) Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure,
prior to its issuance, also requires the applicant for such
permit to file a signed statement that he is licensed pursuant to
the provision of the Contractors License Law (Chapter 9,
commencing with Section 7000) of Division 3 of the Business and
Professions Code) or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any
applicant for a permit subjects the applicant to a civil pernalty
for not more than five hundred dollars ($500).
I, as owner of the property, or my employees with wages as
their sole compensation, will do the work, and the structure is
not intended or offered for sale (Sec. 7044, Business and
Professions Code: The Contractor's License Law does not apply to
an owner of property who builds or improves thereon, and who does
such work himself or thrcuVh his own employees, provided that
such improvements are not intended or offered for sale. If,
however, the building or improvement is sold within one year of
completion, the owner -builder will have the burden of proving
that he did not build or improve for the prupose for sale.)

Sirs:
The City of Newport Beach Marine Department has received a
request to transfer pier permit 111-1024-2 for the property
located at 1022 E. Balboa Blvd, Newport Beach, California. The
facility was inspected by a representative of the Newport Beach
Marine Division on August 12, 1996.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. This requirement is in accordance with Title 17 of the
California Administrative Code.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requirements, and the conditions of the existing
permit. All structural deficiencies must be corrected
prior to transfer of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED. Please call 644-3044 to request a re -inspection.

exception to the Harbor Permit Policies
dealing with the mooring of a hydro hoist
location at their property on 1024 East
Balboa Boulevard, was presented.
Council Member Hart was excused from the
Council meeting at this time (9:35 p.m.).
It was noted in the staff report that
the applicant proposes to berth a hydro
hoist bayward of 1024 East Balboa
Boulevard. The proposed location would
violate Section 21.A. of the Harbor
Permit Policies, and the applicant is
requesting an exception to said policy.
It is felt by the staff that an
exception to the policies in this case
is not warranted, in that the applicant
has failed to state that denial would
cause him undue hardship at all, and
denial of this request is detrimental to
the best interests of the City.
It was further pointed out that approval
of this request could set a precedent
and encourage all City permittees at
street ends to make similar requests.
Encroachments into the City street ends,
such as the type proposed above, could
result in congestion and limited access
to street end beaches and water, thereby
restricting boat launching, swimming and
bathing.
Tim Paone, Attorney representing Stewart
and Deborah Carl, applicants authorized
by Tim Curll and Roger E. Riley to make
this application, addressed the Council
and explained their request. He
displayed a photograph of the hydro
. hoist at its present location and
pointed out where the hydro hoist was
located in relation to the bulkhead
line. He stated there have been no
complaints from adjacent property
owners, and as can be seen in the
photograph, public access to the water
is not in any way blocked. It is their
position that because the hydro hoist is
located so far beyond the bulkhead,
(more than 50 feet) the strict
application of the policy really
achieves no purpose.

implementing actions and policies as

Council Member Hart stated that she will
not support the substitute motion as she
feels there is a definite need for an

bridge, but realistically speaking, the
funds are not available.
Council Member Agee stated that he will
be supporting the substitute motion as
he felt it was worth "one more shot,"
inasmuch as the City doesn't really have
a time -certain to meet.
Council Member Strauss stated that
initially he was supportive of a raised
bridge; however, he cannot support it
now because conditions have changed, and
it is evident the City will not be
getting funds to do it, and if the
Council did support it, we could be

point of view of the people on the

In response to Council Member Strauss
regarding what the cost per
homeowner would be if a Special
Assessment District were formed, Mr.
Willford replied that based on a total
of 282 homes, and a cost of $600,000 to
be divided among the property owners,
they estimate the average to be $2,150
per participant. -
Mr. Willford requested this item be
continued for one additional month to -
formally talk to the State about the
feasibility of forming a Special
Assessment District.
In response to Council Member Agee
regarding the State's time frame, the
Public Works Director pointed out that
the State.is currently preparing the
_
newly revised STIP, and that is what
prompted this issue being brought before
the Council again. The decision of the
Council, he feels, should be made at
this meeting as any further continuance
could indicate lack of support for the
current project of widening the bridge
- and a very real possibility of losing
the project entirely.
Council Member Cox stated that in all
due respect to the comments made by the
other Council Members, he.did not agree
with any of them. He does not believe
the homeowners are behind the raising of
the bridge whatsoever, except the two
proponents Sandy Willford and Tom
Orlando. We are attempting to decide a
major issue here and we have only two
homeowners in effect represented. If
the homeowners were really involved and
supported this project, the Council
Chambers would be full. He doesn't know
how much evidence the Council needs to
come to good, sound, judgmental
decisions. As Council Member Heather
pointed out, Senator Bergeson has stated
that there are no funds available for
the raising of the bridge, and also, our
Public Works Director has indicated that
there are no funds available. It also
has been indicated that if a city does

- not show support for agiven project that
already has been designated in the STIP,
you might as well forget about it.

Tom Orlando, 15 Balboa Coves, addressed
the Council and spoke in support of
raising the bridge. He stated that he
participated in the survey; that the
figures quoted by Mr. Willford were
accurate to the best of his knowledge;
and that anyone not queried was counted
as a "no" vote. He expressed I his desire
to form a Special Assessment District
for the raising of the bridge.
Gary DiSano, 9123� E. Balboa Boulevard,
addressed the Council and stated that,
in his opinion, it would be a risk to
try and raise the bridge just for the
benefit of 200 boat owners, and take the
chance of losing State funds for the
widening of the bridge.
Council Members Agee and Plummer
indicated their support for raising the
bridge.
Council Member Heather advised that she
had met with Senator Marian Bergeson
regarding this issue and was informed
that the Senator was committed to trying
to obtain funds for an area in her
Imperial District, known as "Slaughter
Alley,." and therefore, in good
conscience could not recommend funding
for the raising of the bridge when one
of her areas is in such "dire" need of
improvement.
Discussion ensued with regard to the
difficulty of obtaining funds for
highway improvements in general, wherein
Council Member Hart cited from an Orange
County Transportation Commission letter
dated January 31, 1986, regarding
financing status of the 5/55 Interchange
and the I-5 widening projects noting
that "Given the deficit status of the
existing STIP; however, it is a safe bet
that no new funds would be possible
until FY 1992-93. Therefore, given
-these assumptions about the flow of
Federal funds, and the assumptions are
somewhat optimistic, it will require an
influx of funds for seven years

Chuck Hirsch, representing Newport
Harbor Area Chamber of Commerce,

Board of Directors of the Chamber in
support of widening the bridge. They
feel the widening of the bridge will
provide circulation and traffic
improvements for a large number of
residents and businesses throughout the
City; it will reduce the high incidence
of traffic accidents; it will reduce the

In order to ascertain property owner
opinions regarding the proposed cost
sharing concept, a letter and postcard
for response was sent to all waterfront
residents upstream of the Newport
Boulevard bridge. The results of the
survey as of this date are:
45% in favor of raising the bridge
25% against
30% not responding
The Public Works Director pointed out
that there are legitimate reasons in
favor of a new, higher bridge concept.
1. The existing 50-year-old
bridge would be replaced with
a new structure, thus reducing
maintenance costs and
deferring the need for
eventual future replacement.
2. Navigation would be improved
for boat operators.
3. The esthetics of the structure
could be improved.
Despite the above, the Public Works
Director then concluded that it was the
staff's opinion that the City should
support the project for widening at
existing grade, for the following
reasons:
1. The project and its funding
are currently programmed (for
Fiscal Year 1988-89), with an
approved Environmental
Document.
2. The assessment district for
property owner participation
could fail. If this should
happen, the project could be
lost entirely, or the City
could be asked to fund the
property owner's share.
3. It may not be possible to
secure the proposed additional
CalTrans funding. If this
should happen, the project
could be lost entirely, or the
City could be asked to fund
the additional CalTrans

this subject was continued from the
Council meeting of January 27, 1986, as
a result of testimony that property
owner support may exist for formation of
a Special Assessment District to assist
in funding the raising of the bridge.

- because of a letter from CalTrans
-regarding the proposed project.
With regard to the existing programmed
project, the Director of Public Works
noted that to construct an additional
northbound lane from 32nd Street to the
Arches Ramp is currently programmed for
Fiscal Year 1988-89 in the approved
State Transportation Improvement Program
(STIP)--State funding of $1,019,000 and
$1,019,000 from the City.
With respect to a proposed higher
bridge, it was pointed out that the
project would include widening of both
the bridge and its approacheson both
sides; and construction of an additional
northbound lane. on Newport. Boulevard ..
from 32nd Street to the bridge.
Construction of the additional
southbound lane on Newport Boulevard
southerly of the bridge is not part of
the proposed project.
Cost sharing of 1/3 State, 1/3 City, and
1/3 benefited property owners for the
$1.5-2 million additional costs of a new
higher bridge has been discussed. Under
this concept the funding package would

applicant .." The Applicant respectfully submits this
Application for an exception to Sections 1.D and 21.A on the
basis that the conditions at the Property and the adjacent street
end are such that an exception can be made without compromising
the goals and policies underlying the Harbor Permit Policies.
This Application concerns a 28 foot pleasure vessel moored on the
easterly side of the dock at the Property and suspended out of
the water on a hydro -hoist (collectively, the "Vessel"). The
Vessel extends ten feet, four inches beyond the Property line.
Section 1.D of the Newport Beach Harbor Permit Policies (the
"Policies") provides that "no private piers shall be permitted at
street ends." Section 21.A provides that "boats moored at
private.or public docks shall not extend beyond the projection of
the property lines of the property to which the dock facility is

connected in accordance with Section 20-C." Sections 1.D and
21.A will be referred to collectively as the "Regulations."
The Regulations are designed to preserve public access to
swimming and onshore mooring, and to preserve Harbor Patrol fire
boat access. Clearly, the preservation of public access to the
recreational areas of the beach and the bay and maintenance of
the Harbor Patrol's fire safety access are important and vital
city goals. However, under the circumstances which exist, at the
Property, public and safety access are not affected by the
extension of the Vessel over the Property line.
The bow of the Vessel is 88 feet from the street end at high tide
(when there is no beach), and 33 feet from,the edge of the beach
at low tide. The beach is 30 feet wide.
Because of the Vessel's distance from the beach, the onshore
moorings and the street end, the Vessel does not impair or
inhibit access to the beach from the street or the bay or access
to the water from the beach. The beach itself is rarely used.
It is partially bisected by a storm drain, marked with a "danger"
sign. The Vessel's position also has not inhibited the onshore
mooring of boats at the two moorings available at the street end.
Fire boat access is not affected by the Vessel's position. There
is sufficient room for a fire boat to pull along side the Vessel
or go closer to the shore, although the water at that point is
probably too shallow for a closer approach.
Because the Vessel does not obstruct beachgoers or boaters from
access to swimming, beach use or onshore moorings, or the Harbor
Patrol from safety access, an exception to the Regulations will
not compromise the safety reasons and recreational access policy
underlying the Regulations. Consequently, the Applicant
respectfully submits that the granting of such an exception for
the Vessel is warranted.

Discussion:
This application :is before the City Council.as required by.Section 5.B, of
the.Harbor Permit Policies, which states:
"5. Issuing of permits. B. Prior approval of the City Council will
be required before�t_he Marine Department may issue any permit that
does -not conform to the.Standard Drawings in the adopted.permit policies."
The applicant proposes to berth a hydro hoist bayward of 1024 East Balboa
Boulevard (see attaohed diagram). The.proposed location of the hydro hoist
would violate Section 21.A, of the Harbor Permit Policies, which states:
"21. _M_o_orriiUss. A. Boats moored at private or public docks shall not
extend eii yond the projection of the property lines of the property to
which the dock facility is connected. 11.
The applicant is requesting that the City Council approve an exception to

Public hearing was opened in connection with this
matter.
Will.iam J. McGee, 613 W. Balboa Boulevard, appeared
before the Commission on behalf of the owner and
advised that two spaces exist in the garage on
Parcel 2.
Assistant Community Development Director Hewicker
advised the Commission that although two spaces
may exist in the garage on Parcel 2, they cannot
be used independently of one another.

Floyd Blower, 1024 E. Balboa Boulevard, appeared
before the Commission to comment on the use of
the: garage and felt the garage wa-s adequate for
two cars without further alteration because of
the length of the garage.
Community Development Director Hogan advised that
the ,garage in its present configuration (15' X 23')
did not meet the Code.
Staff pointed out it was their understanding that
the garage could be made to conform to Code. Mr.
Bl.ower,.however, advised that was not so. Mr.
Blower also advised that a parking space in front
of the garage would be lost if the garage was made
to conform.
Assistant Community Development. Director Hewicker
commented on the modification which was approved
in February, 1976 to move the entry from the west
side of the structure on Parcel 2 to the "C" Street
side and the information furnished at that time
indicated that the size of the garage was 23' X 23'.
He advised that one of the conditions o.f the
modification was that a two car garage conforming`
to City standards be provided at all times.
Planning Commission discussed parking in front of
the garage and whether or not an actual parking
space would be lost through the widening of.the
garage.
There being no others desiring to appear and be
heard, the public hearing was closed.
Planning Commission further discussed the parking
and it was pointed out that if the modification
were exercised, two conforming garage spaces must
be provided on Parcel 2. As to the resubdivision,
it was the staff's feeling that if the modifica-
tion were not exercised, the condition to maintain.

the resubdivision in order to guarantee that a
conforming two car garage would be provided on
Parcel 2.
Commissioner Parker commented on the requirement
for two conforming garage spaces and felt this.
requirement may eliminate the space in front of
the garage. He questioned whether or not the
condition could be eliminated from the resubdivi-
sion. Staff advised this could be done, however;
the condition would still remain on the modifica-
tion.

Boulevard; permit # 111 1024 dated 9-10-79 to Buyer William F. and
Barbara Kroener and signed by sellers, Mary Katherine and Donald
Russell, and signed by the City Coordinator dated 9-14-79. I have
also included a copy of my check paid to the City of Newport Beach,
dated 2-4-80 in the amount of $10.00. please note on lower lefthand
side of check 11 pier tax-1024". The reverse side of the check is
dated 2-6-80 for deposit to the City of Newport Beach.
According to the enclosed information, it appears this was an error
in your department for failing to duly transfer the pier permit from
# 105 Linda Isle to 1024 East Balboa Boulevard registered to William
F. and Barbara Kroener. It would appear that I have paid for a two
year permit, since the annual fee at 1024 is $5.00, and certainly do
not owe a past due penalty of $3.75.
I hope that this will clear up any misunderstanding regarding transfer
of pier permit and payment on my part.

Dear Sir:
The City of Newport Beach has received an application to
transfer pier permit # 111-1024 for the property located
at 1022 East Balboa Blvd.
The structure was inspected onll-17-78 at which time it
was determined that the following deficiency exists.
A continuous pressure anti -siphon device must be attached
to .the municipal water service, bayward of the bulkhead,
in compliance to title 17 of the California Administrative
Code.
In accordance with Section 10-D of the City Harbor Permit
Policies, "All structural deficiencies must be corrected..."
A permit for this work must be obtained from the Community
Development Department.
Would you please advise this department when this require-
ment has been met. If you have any questions, please con-

dation of the Chief of Engineers and under the provisions of Section
10 of the River and Harbor Act of March 3, 1899 (33 U.S.C. 403), you
are hereby authorized by the Secretary of the Army to demolish existing
ramp, float and pier, and construct and install a new three fingered
slip, ramp and pier, in Newport Harbor, (Lots 12 and 13, Block 15),
City of, Newport Beach, County of Orange, California, as shown on the
attached drawing and subject to the attached conditions (a) through (v).
Notice of the commencement of the activity must reach this office at
least 5 days before the activity actually starts. Please use the inclosed
