Martin and Betty A. Martin, husband and wife (collectively "Martin"); 1.02 Mark E. Krugman, M.D. and Jane Krugman, M.D., husband and wife (collectively "Krugman"); and 1.03 Chicago Title Insurance Company, a corporation ("Chicago Title"); and 1.04 Ronald H. Powers ("Powers"), ARTICLE H Recitals 2.01 Martin is the leasehold owner of the real property commonly described as 404 Morning Star Lane, Newport Beach; California ("Martin Property"). The Martin Property is more particularly described as Lot 159 of Tract 4224 in the City of Newport Beach, California. 2.02 Krugman is the owner of the real property commonly, described as 1036 Polaris Drive, Newport Beach, California ("Krugman Property"). The Krugman Property is more particularly described as Lot 155 of Tract 4224 in the City of Newport Beach, California. 2.03 Chicago Title was the owner of the real property commonly described as 1044 Polaris Drive, Newport Beach, California ("Powers Property"), which it sold on August 1, 1994 to Powers, who is now the owner thereof. The Powers Property is more particularly described as Lot 154 of Tract 4224 in the City of Newport Beach, California. 2.04 Martin and Krugman share a common boat dock ("Martin Krugman Dock") which extends, generally, in the northeasterly direction from the Bulkhead Line at the common boundary line of the Martin and Krugman Properties and is the subject of Pier Permit 0114-404 issued by the City of Newport Beach. Krugman has and shall continue to have the right to use the water space on the, northerly side of the Martin Krugman Dock which is adjacent to the Krugman Property, and Martin has and shall continue to have the right to use the water space on the southerly side of the Martin Krugman Dock which is adjacent to Martin's Property. 2.05 The Powers Property has a dock which extends generally in an easterly direction from the easterly property line of the Powers Property, ("Powers Property Dock"). 2.06 A dispute has arisen between Martin, Krugman, Chicago Title and Powers with regard to the location of the docks for their respective Properties, the location of the common boundary line between the Krugman permit zone and the Powers permit zone ("Krugman-Powers Permit Zone Boundary"), and the water space to which each Property is entitled to use adjacent to their respective docks. This dispute resulted in a lawsuit entitled Krugman v. Chicago Title, Orange County Superior Court Case No. 733575 ("Lawsuit"), and includes, but is not necessarily limited to, the claim of Martin and Krugman that the Powers Property Dock, when it was re -built following the issuance of the 1989 maintenance permit, was not constructed in accordance with the maintenance permit and did not provide the fifteen feet shown on the maintenance permit map, and, in fact, was built in such a manner as to provide approximately twelve -and -one-half to thirteen feet of water space adjacent to the southerly edge of the Powers 2 Property Dock. Powers disputes these claims. .2.07 By the terms of this Agreement, the parties hereto desire to provide for the reconstruction of both the Powers Property Dock and Martin Krugman Dock to resolve, as among the parties, the location of the Krugman-Powers Permit Zone Boundary, the location of the Martin Krugman Dock and the permanent right to use of the water space adjacent to each respective dock. 2.08 The parties have agreed on plans for the re -building of the docks. The parties are willing to proceed with the reconstruction of the docks in accordance with the agreed plans. ARTICLE III Agreements IN CONSIDERATION of the mutual covenants, conditions and promises herein contained, the parties hereto, intending to be legally bound, agree as follows: 3.01 The above recitals are referred to and incorporated herein by reference. 3.02 The location of the Krugman-Powers Permit Zone Boundary is agreed to be as shown on the Agreed Plans (as hereinafter defined) "Exhibit "A", to wit: A line extending bayward from the point at which the common boundary of the Krugman and Powers Properties intersect the Bulkhead Line north 69' 06' 04" E a distance of seventy-one and eighty-two hundredths (71.82) feet. 3.03 Within thirty (30) days following execution of this Agreement by all parties, Martin, Krugman and Powers shall apply to the City of Newport Beach Marine Department and/or other appropriate agencies for approval of this Agreement and issuance of maintenance permits to reconstruct the docks in conformance with the agreed plans ("Agreed Plans"), a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference. The reconstruction of the docks pursuant to Exhibit "A" shall be performed so as to result in not less than fifteen (15) feet of water space on either side of the Krugman Powers Permit Zone 3 Boundary as delineated in Exhibit "A". After completion of the reconstruction of the two (2) docks, Powers, Krugman and Martin shall have the right to use the water space surrounding the two (2) reconstructed docks as follows: A. Krugman shall have the permanent, exclusive, right to use the water space between the center line of the reconstructed Martin Krugman Dock, and the bayward prolongation thereof to a point seventy (70) feet bayward from the bulkhead, on the one side, and the Krugman Powers Permit Zone Boundary on the other side ("Krugman Water Space") B. Powers shall have the permanent, exclusive, right to use the water space between the Krugman Powers Permit Zone Boundary on the one side and the northerly boundary of the Powers Permit Zone on the other side ("Powers Water Space"). C. Martin shall have the permanent, exclusive, right to use the water space between the center line of the reconstructed Martin Krugman Dock, and the bayward prolongation thereof to a point seventy (70) feet bayward from the bulkhead, on the one side and the southerly boundary of the Martin Permit Zone on the other side ("Martin Water Space"). The rights of Powers to use the Powers Water Space, the rights of Krugman to use the Krugman Water Space, and the rights of Martin to use the Martin Water Space shall be deemed permanent, shall run with the land of the respective parties, and shall not be changed except by the mutual written agreement of Powers, Krugman and Martin, or their respective successors-m- interest, as appropriate. The reconstructed location of the Martin Kingman Dock shall be the permanent location of the Martin Krugman Dock unless and until changed by the mutual written agreement of Krugman Cl and Martin, or their respective successors -in -interest, as appropriate. Powers on the one hand, and Martin and Krugman on the other hand, reserve the right to rebuild and/or relocate their respective docks, but such relocation shall not alter the location of the Kingman -Powers Permit Zone Boundary, nor shall such reconstruction and/or relocation alter the rights of the respective parties to use the Powers Water Space, Krugman Water Space, or Martin Water Space as provided in this Agreement. 3.04 The reconstruction of both docks shall commence within thirty (30) days of obtaining the necessary permits and be completed as soon as possible thereafter, and in no event later than one hundred twenty (120) days following execution of this Agreement by all parties. 3.05 Martin shall be responsible for the cost of rebuilding the float portion of the Martin Krugman Dock, and Krugman shall be responsible for the cost of moving the bayward pile of the Martin Krugman Dock so that it is centered at the bayward end thereof. Martin and Krugman shall jointly share the cost of the permit fees. Upon execution of this Agreement by all parties, Chicago Title shall pay the sum of $15,500.00 to Powers. Powers shall be responsible for the costs of the permit.fees and the cost of reconstructing the Powers Dock. Immediately following execution of this Agreement by all parties, and in no event later than February 16, 1996, Krugman shall dismiss, with prejudice, the Lawsuit (Krugman v. Chicago Title, Orange County Superior Court Case No. 733575) and shall also record a notice of withdrawal of lis pendens with respect to the Lawsuit. 3.06 Martin, Krugman, and Powers, as appropriate, shall supervise the reconstruction of .their respective docks. Chicago Title shall not participate in the supervision of the reconstruction of the docks. 3.07 Martin, Krugman, and Powers, shall each, as appropriate, contract with a qualified contractor for the reconstruction of their respective docks in accordance with the terms W and conditions of this Agreement and Exhibit "A". 3.08 With the exception of the rights, duties, obligations, conditions and liabilities of the parties under and pursuant to this Agreement, each of the parties, on behalf of themselves, and their respective heirs, successors and assigns, hereby releases each of the other parties, and their respective heirs, successors and assigns, from any and all claims, debts, liabilities, demands, rights, obligations, costs, expenses, actions and causes of action, of whatsoever kind or nature, whether known or unknown, based on, arising out of, or in connection with anything whatsoever done, omitted, or suffered to be done at any time prior to the date of this Agreement, which are based on, arise out of, or connected with the respective docks, dock permits and water rights of the parties which are the subject matter of this Agreement. Each of the parties further acknowledges that this release provides for the release of unknown claims, and each of the parties hereby waive any and all rights which they, or any of them, might have under the provisions of §1542 of the Civil Code of the State of California which reads as follows: "A general release does not extend to claims which the creditor does not know or suspect to exist in. his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." This release is intended to and does include the release of any and all duties or obligations which Chicago Title may have to Powers pursuant to a separate Indemnity Agreement dated July 8, 1994 between Chicago Title and Powers. 3.09 This Agreement contains a settlement and compromise of disputed claims and actions, and shall never be treated as an admission of liability or fault by any party for any purpose. 3.10 The effective date of this Agreement shall be the date when the last of the parties to this Agreement signs it. 3.11 Martin, Kingman and Powers by mutual agreement, together, may substitute another dock reconstruction plan in place of the plans referred to in Paragraph 3.03 and attached hereto as Exhibit "A", providing that (1) the parties are able to obtain approval of the substituted plan by the City of Newport Beach Marine Department, and any other appropriate agencies, and the cost of reconstructing the dock(s) is paid by parties as they shall then mutually agree. 3.12 Upon approval of this Agreement by the City of Newport Beach Marine Department, and/or issuance of the maintenance permits in accordance with Section 3.03 of this Agreement, the parties shall cause a copy of this Agreement to be recorded in the official records of Orange County, California. 3.13 Substantive terms of this Agreement were negotiated by the parties with the assistance of the Orange County Superior Court at a settlement conference held in the Lawsuit January 26, 1996, approved by the Court and made a part of the Court record. In the event of a conflict between the Court record and the terms of this Agreement, the terms of this Agreement shall apply. ARTICLE IV General Terms and Conditions 4.01. Counterparts. This Agreement may be executed in any number of counterparts and each such counterpart shall be deemed an original instrument. Counterparts, which show execution of this Agreement by a party, transmitted by fax, telecopier, or other electronic transmission, shall be deemed an original instrument for purposes of establishing execution and delivery of this Agreement by the parties whose signatures appear thereon. 4.02 Cooperation. Each of the parties hereto agree to execute any and all additional documents deemed reasonably necessary to give full effect to the intent of this Agreement. W 4.03 Successors and Assigns. Subject to any provisions or restrictions hereof limiting the right of assignment, this Agreement shall inure to the benefit of and be binding upon the parties hereto and their respective successors, assigns, heirs, executors and administrators. 4.04 Intemretation. This Agreement shall be interpreted under and pursuant to the Laws of the State of California. 4.05 Entire Agreement. This Agreement contains the entire agreement of the parties hereto with respect to the subject matters covered hereby, and no other oral agreement, statement or promise made by any parry hereto or by any employee or agent of any parry hereto, which is not contained herein, shall be binding or valid. This Agreement may only be modified or amended by a writing executed by the parties affected by such modification or amendment. 4.06 No Continuing_ Waiver. No waiver of any breach of any of the terms, conditions and covenants of this Agreement shall be construed as a waiver of any succeeding breach of the same or other terms, covenants and conditions hereof. 4.07 Notices. Any notices required or permitted to be given hereunder shall be in writing and may be given by personal delivery or by certified mail, return receipt requested, to the address specified for each parry in this Agreement. If any such notice is given by personal delivery, said notice shall be deemed given upon receipt. If any such notice is given by certified mail, return receipt requested, said notice shall be deemed given on the third day following the date of mailing, as indicated on the return receipt, regardless of whether the return receipt shows actual delivery, provided, however, that if the return receipt of any mailed notice indicates non- delivery,the party serving said notice shall forthwith mail another, exact duplicate copy of said notice, to the recipient by regular mail, postage prepaid. Any parry may, by written notice to another party, specify a different address for notice purposes. 4.08 Remedies Cumulative. Except as provided in Paragraph 4.14, no remedy or election hereunder shall be deemed exclusive but shall, whenever possible, be cumulative with all other remedies provided by agreement, at law, or in equity. 4.09 Invalidity in Part. In the event any provision of this Agreement shall be held to be illegal, unenforceable or inoperative as a matter of law, the remaining provisions shall remain in full force and effect unless such construction shall substantially frustrate the purpose and intent of this Agreement. 4,10 Covenants and Conditions. Each provision of this Agreement performable by a parry shall be deemed both a covenant and a condition. 4.11 Time of the Essence. Time is of the essence as to each and every term, covenant and condition of this Agreement in which time is a factor. 4.12 Survival. All covenants, conditions, warranties and representations made by any party in this Agreement shall survive the execution hereof. 4.13 Attorneys Fees. In the event of a dispute relating to this Agreement, the prevailing party shall be entitled to recover reasonable attorneys fees and court and arbitration costs from the losing parry. This right to attorneys fees includes, without limitation, attorneys fees which may be incurred in any Bankruptcy proceeding, whether for relief from stay, for adequate protection, determination of nondischargeability, objection to discharge, or otherwise. 4.14 Arbitration. Any dispute or claim in law or equity arising out of this Agreement or any resulting transaction shall be decided by neutral binding arbitration by the Judicial Arbitration and Mediation Services (JAMS) in accordance with JAMS' then applicable rules and regulations for such arbitration proceedings. Provided, however, upon the agreement of all parties, a private arbitrator other than JAMS may be selected in place of JAMS. In the event of any such arbitration, the parties shall have full rights to discovery in accordance with W, California Code of Civil Procedure §1283.05, which provisions are deemed incorporated herein by reference. This arbitration provision shall not apply to any matter which is within the jurisdiction of a probate court. I will provide some answers and explanations to your questions, but will focus on the central issue surrounding your dock, your neighbor's dock and Newport Slip Rentals. I do not know the legal responsibility or representation that Newport Slip Rentals has with the sub -lessee. The City's primary concern is with the upland property owner who is the pier permittee. It is with this person that the City enforces all rules and regulations. 2. Harbor Resources considers the channels in Dover Shores as private waterways. However, these channels still must abide by the Municipal Code (Section 17.04.200) as well as the Harbor Permit Policies. Upon further consideration of the Harbor Permit Policies, your wooden plank is permanently affixed to your pier, therefore making it a part of the structure. All structures in the Harbor are to be set back a minimum of 5 feet from the property line as stated in the Policies. "All piers and floats for residential properties shall be set back a minimum of five feet from the projection of the property line." The plank on your dock needs to conform to these regulations. However, Harbor Resources feels that it would be sufficient and acceptable to reduce the length of the plank to the size of your hydra hoist in order for you to step to the other side of the hoist. The Harbor Permit Policies nor the Municipal Code do not place any restrictions on the size of vessel that is allowed to dock at a residential or commercial property. Vessels are allowed to use all of the open water space out to the adjoining property line. In the case of your property and your z neighbor's, the City will honor the property line boundaries as settled in the 1996 legal agreement between the two properties. 3. Newport Slip Rentals has obtained a business license with the City. There are currently no rules that address private residential pier permittees from renting their dock space. I suspect that this issue will probably be discussed within the City in the future. 4. It appears that you have an earlier version of the Harbor Permit Policies from the passages that you have quoted. The most recent version may be accessed at the City's website, http://www.city.newoort-beach.ca.us/home.htm, City Council / Council Policy Manual / Harbor Permit Policy, H-1. The current Policies read as follows: "A. Shore connected piers and floats bayward of residential zoned areas shall be controlled by the Harbor Permittee. Vessels moored at residential piers shall not create a nuisance with regard to vehicle parking, vessel waste, liveaboards, or noise disturbances to adjoining residents. B. Are you aware that the replacement boat took on so much water that the automatic bilge pumps were unable to accommodate it and the Harbor Patrol was called in and spent several hours pumping the boat out to keep it afloat? This is the third time that boats renting space on this same dock in the last year have caused substantial pollution to our bay. The Harbor Patrol also came to this site on the two prior occasions and most certainly will have a record based on the substantial amount of diesel oil that was pumped overboard on both occasions. 3. Are you aware that there is now a third rental craft at the dock that is like the first vessel, a three deck view blocker? The beam of this new boat is 14 feet, allowing only 6 inches of leeway on either side. 4. From the bullet points in your letter, I can assume that you extracted these from Newport Slip Rentals' a -mails to me. Did Newport Slip Rentals also furnish you with my responsive e-mail? I have enclosed a copy for your records which will indicate how little value the fenders would add. 5. You have taken the position, as suggested by Newport Slip Rentals, that the tenant will walk the boat in rather than motor it in. Have you observed this in any fashion? I would suggest that the second boat attempted this on only one occasion in their several dockings. The Association has also informed me that the Harbor Patrol most recently told the Directors of the Association that they were unable to remove a small half -sunken rowboat because it was a private waterway. As a representative of the Harbor Resource Division, do you view this as a private water way? Your opinion of the accommodations by both Newport Slip Rentals and my neighbor is interesting, but your opinion appears to have been established by what you were told not what you observed or is actually happening. 7. What authority is your request based on that I remove or reduce any part of my hydro -hoist that is within my designated water rights? 8. As a representative of the City, have you verified that Newport Slip Rentals is properly licensed with the City of Newport Beach? 9. Drawing number two was submitted by the Roger's Family and approved in August of 1989, showing a revision to the dock at 1044, and drawing number three is the permit drawing for the joint dock bayward of 1036 Polaris and 404 Morning Star. As drawing number one purports to show, there was twelve feet from the permitted structure to the common permit line between 1044 and 1036 Polaris. Drawing number two indicates that this distance has been widened to fifteen feet, and drawing number three shows approximately fifteen feet from the edge of the dock to the permit line shared with 1044 Polaris. If these drawings were taken at face value, there should now be thirty parallel feet between the joint dock at 1036 Polaris and 404 Morning Star and the dock at 1044 Polaris. The representatives of the joint dock have indicated that this is not the case, and that they would like to, at a minimum, make the twcL docks parallel and establish some usable water space between the two docks that is fair and equitable to all parties. Specifically, the complaint is that a vesssel tied at 1044 is encroaching into the permit zone at 1036 Polaris. A review of the Harbor Permit for 1036 Polaris indicates that the property owner should have 15 feet from his dock to his side permit line. Any vessel encroaching within that 15 feet is in violation of Section 21.A. of the Harbor Permit Policies. 21.A "Boats moored at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected...." Field inspections in the past have indicated that a vessel berthed at 1044 Polaris is, in fact , encroaching into that 15 foot zone. However, there appears to be a "good faith" dispute between the property owners relative to the size of the permit zones for each property and the location of the floats relative to those permit zones. There is some ambiguity in the original documents submitted by the developer, which documents established the original permit zones for each property. The permit drawings submitted by the first permittees for each property are also open to interpretation. A survey done by the property owner at 1044 Polaris has not resolved the question but it has, in our view, highlighted the two above discrepancies and ambiguities. It is impossible for the City at this time to resolve the encroachment issue. There seems to be two possible avenues to a resolution to the 3300 Newport Boulevard, Newport Beach problem. First an agreement could be reached between the permittees at 1036 and 1044 as to the water areas available to each. When this agreement has been made, new drawings could be prepared establishing the locations of the docks and the water area available to each property owner. Barring unforseen problems, this agreement would be acceptable to the City. The second alternative may be legal action between the parties. it is our opinion that it will be necessary for the harbor permittees listed above to resolve this dispute. Their resolution of the problem between themselves or a resolution arrived at through legal action would be accepted by the City of Newport Beach. Unfortunately this does not answer your questions. Our understanding of the dimensions of our permit zone is that the area has the following dimensions: 47.08' at the sea wall, narrowing to 34' at the opposite end, with a distance between of 701. It is also our understanding that the joint pier and float were permitted to be located in the center of the joint space with a minimum distance of 15 feet from each seaward outside corner of the float to the respective edges of the permit zone. I think if you will review our permit you will concur that these are the dimensions shown on the permit. I understand that there is apparently some disagreement as to the end dimension of our joint permitted space on the previous plan. We don't think this is a relevant issue. However, and so that there is no misunderstanding, it is our opinion that the previous plan shows an end dimension on the seaward side of our joint permitted space of slightly less than 38 feet. We believe that to be the only logical interpretation of the previous plan. I understand that the actual permit shows a dimension for the seaward end of the permit zone at 34 feet which would be approximately four feet less than as shown on the previous plan. It is also our opinion that the location of our pier and float, as originally built, and as presently existing, is in substan- tial compliance with the permit issued for this space. It is our desire that the permits for all properties remain as origi- nally issued. Page Two It was my understanding, from your correspondence in October of 1989, that these matters had been resolved. When I learned that Dr. Krugman's attorney had written a letter requesting that the city investigate the continuing encroach- ment of Mr. and Mrs. Rogers' boat into Dr. Krugman's side of our permitted space, I felt it necessary to advise you as to our position on the matter. While it is my opinion that Mr. and Mrs. Rogers' boat does, in fact, encroach approximately 2&1/2 feet into Dr. Krugman's side of the joint permitted space, it was not my intent to initiate a complaint nor ask that the boat be moved. That would be a matter for Dr. Krugman and his attorney. Our concern is that nothing occur in the resolution of the problem between Dr. Krugman and Mr. and Mrs. Rogers that would adversely affect our rights with regard to the joint permit. As you suggested, I contacted Mrs. Rogers to determine whether she would have any interest in having an expert analyze the available space to determine if a more efficient layout could be achieved which would resolve the current dispute. Mrs. Rogers advised me that she had no interest in pursuing such a possible resolution unless Dr. Krugman, ourselves and the city agreed that her boat, in its present location, does not en- croach upon our joint permitted area. We obviously cannot agree to such a condition as I do not believe that to be the case. We think your suggestion of reanalyzing everyone's space to determine if a more efficient use might be available has a great deal of merit. I have spoken with Sam Kniff and he has agreed to come up with some preliminary suggestions. I am doing this on my own to see if a possible compromise solution might be available. I shall let you know what results, if any, are achieved. In the meantime, please keep me fully advised as to any action which may be taking place on these matters. Dr. Krugman is the permittee pursuant to the above -referenced Harbor Permit and your assistance is once again sought in connection with an ongoing encroachment into his permit zone. After speaking with you again yesterday afternoon, you confirmed my understanding that Dr. Krugman's dock is, in fact, properly located within his permit zone and that he is entitled to no less than 15 feet from the edge of his dock to the boundary of his permit ,zone adjacent to the permit zone assigned to 1044 Polaris Drive. Given these circumstances, Wes Armand of your office sent written notification on October 12, 1990 to the owners of 1044 Polaris Drive, Dave and Ann Rogers, advising them that their vessel extended into Dr. Krugman's 15 foot permit zone and request was made that the vessel be relocated. Despite Mr. Armand's October 12th request, the encroachment persists. It is my understanding that Jim Martin, the owner of 404 Morning Star, presented you with a proposal that, if implemented, would result in additional distance between Dr. Krugman's dock and the Rogers' dock. Further, although you indicated that you would recommend to the City of Newport Beach that it approve Mr. Martin's proposal, the Rogers rejected the proposal because it entailed moving their dock into the setback between the Rogers' property and the Rogers' neighbor, Mr. Dahl. It is my understanding that the Rogers are unwilling to move their dock into the setback (even with the City's blessing and even if Dr. Krugman and Mr. Martin share in the cost) because the Rogers would then be unable to moor a second vessel to their dock adjacent to Mr. Dahl's property. Based on the permit drawing submitted by the original applicant at 1036 Polaris, the distance from the dock to the permit line is fifteen feet. That is the permit line which separates your permit area from the permit area at 1036 Polaris. The original permit drawing submitted by your successor also indicates that it is scaled from that drawing and that there was 15 feet from the edge of the dock to the permit line dividing your permit zone from 1036 Polaris. It is, therefore, the opinion of Marine Department staff that there is 15 feet available for the property owner at 1036 Polaris. Any vessel tied at your dock that encroaches into this fifteen feet is an encroachment in violation as indicated in Section 21 of the Harbor Permit Policies. Because of this encroachment controversy you hired a licensed suveyor to determine the location of the docks relative to the bulkheads at 1036 and 1044 Polaris and to also attempt to establish where the permit zones were relative to the original permit line survey submitted by the developer and relative to the permit lines drawn on the submitted permit application. Essentialy what I think this survey indicated was that it located the docks relative to the bulkheads. The location of the permit lines seem to be a matter of some difference of opinion. As you know when the docks were originally installed by your predecessor and the predecessor at 1036 they were not surveyed as to their location. Because the permit lines come off at angles to the bulkhead make. it more difficult to establish their exact location. The position of the Marine Department is going to be the following• Since the application for the dock at 1036 was accepted and approved prior to the installation of your dock, we feel the 15 feet from the edge of the dock at 1036 to your permit line is the available water area for 1036. The balance of the water area from that line to the line seperating your property at 1048 is your permit zone and your dock is estblished in there. Whatever water area is available to you is a function of how much water area your dock takes up. However the impobtant point as far as the encroachment goes is the property owner at 1036 from the edge of his dock to the permit line. Any vessel tied at your dock that encroaches into tht 15 feet is in violation. Therefore, we are requesting that the vessel currently berthed at your dock, if it -is encroaching into the 15 feet, be relocated. If you do not want to relocate we will turn the matter over to the City attorney's office and request that they take whatever legal procedures are neceessary and appropriate in this situation. Prior to commencing the work on our revised pier and float, we hired the services of Coast Survey Inc., to locate the exact location of our pier, float, and extension of the property lines. Working in conjunction with our contractor, Peter Swift, we reduced the size of our dock to increase the distance from the property line from 12 feet to 15 feet to remain in accordance with our pier permit. Please review our prior pier and float plan. You will note that our float is to be parallel to the property line between lot 154 (our lot) and lot 155. All calculations and revisions were carefully maintained for the new location of our dock in order to remain exactly parallel to the extension of the property line. "boats moored at private or public docks shall not extent beyond the projection of the property lines of the property to which the dock facility is connected..,". A field inspection revealed that a vessel' is.berthed in a Position that has it extending across .the property line at 404 Morning Star Lane. and is in violation of the above stated code. According to the plans housed at the Marine. Department, the permit area for 404 Morning Star Lane extends 15 feet out from the pier at that location. A field inspection found that the vessel moored at your pier extends within the 15 foot boundary.
