S. Pierhead Line at the above address. Attached is a copy of that Approval In Concept and two stamped drawings for submittal to the Coastal Commission. Prior to us issuing our final permit, it will be necessary for you to submit approval from the California Coastal Commission and the Army Corps of Engineers of your permit revision, and as an additional requirement, we would request that until such time as other docks in your neighborhood extend their floats to the U. S. Pierhead Line that you light the end of your dock with a navigational light approved by the Marine Department and the Orange County Sheriff's Harbor Patrol. Recommendation: If desired, approve the Harbor Permit application by Koussay Okko to extend his dock to the U. S. Pierhead Line as authorized by Council Policy H-1, Section 23-C, and direct staff to allow future applications between U. S. Bulkhead Station 110 to 112 to extend to the U. S. Pierhead Line. At the City Council meeting of February 13, 1995, the above application was before the City Council for approval to allow the existing dock to be extended to the U. S. Pierhead Line as currently provided by the City Council Harbor Permit Policies, Section 23-C. Following discussion by the City Council, staff and members of the public, the City Attorney recommended that this item be continued to allow staff to take another look at this particular application in light of existing Council Policy. As a result, the matter was directed to the Harbor and Beaches Committee to review Council Policy H-1 as it relates to this application and report back on March 13, 1995. Discussion: On February 27, 1995, the Harbor and Beaches Committee met and the Marine Department staff provided the Committee with background on the development of the Harbor Permit Policies, particularly as they related to the establisment of the U. S. Pierhead Line as the bayward most point to which docks could be extended. In the location in question, between C Street and E Street on East Balboa Boulevard, the Harbor Permit Policies allow docks to extend to the U. S. Pierhead Line. However, by private agreement, the residents in this two block area had held back from the U. S. Pierhead Line voluntarily, and a line was established for the docks in this two block area, back behind the U. S. Pierhead Line. That agreement expired in 1980 and was not renewed. As a result, property owners have approached the Marine Department with requests to now extend their docks out to the U. S. Pierhead Line, and most recently, the above application has been presented to the City / Council for a request to make that extension. Currently, in this two block area, there are twenty-six (26) harbor permits, and all have held back from the U. S. Pierhead Line. Prior to this application going to the Council, all permittees within this area were notified of the application and the requests to allow extensions to the U. S. Pierhead Line. Out of all the permittees notified, eleven indicated that they were in favor of the extension of docks to the U. S. Pierhead Line, two responses indicated that they were opposed, and 13 did not respond. Although the Marine Department had some concerns about extensions creating the potential for navigational problems in this location, the channel will remain as large as channels in adjacent locations, so the navigational issue is not a major concern. Also, allowing this two block area to extend to the U. S. Pierhead Line is consistent with Council Policies in other locations within the harbor. As a result of the above, the Committee is recommending that the City Council approve the application to extend the dock to the U. S. Pierhead Line, and that, in the future, any applications within this two block area be allowed to extend to the U. S. Pierhead Line as authorized by City Council Policy. Burnham SUBJ: Permit Application No. 110-1124 This memo will confirm my discussion with Jim at the conclusion of the 2-13-95 Council meeting. I told Jim that we did not have good authority to deny this application based upon the current provisions of the Harbor Permit Policy or Chapter 17.24. The City is not in a position to make decisions on piers based upon desires of adjoining property owners or private contracts. Denial may be appropriate given the extension of the vessel beyond adjoining piers but we would have a tough time justifying the denial in court. The best solution would seem to be a modification to the Harbor Permit Policies for the area in question that would confirm the right to "pier out" to the pier head line but prohibiting any additional bayward protrusion of large vessels. I would like your thoughts on the advantages and disadvantages of our current policy that allows boats to extend beyond on the pier head line to the extent of the width of the bow. As you mentioned, this would bring the dock out perhaps 16 feet, This in our judgement, since we have a small boat and rely on this area which we use a great deal would create a dangerous situation. Often in the summer, there are so many lame boats out and of course this increases every year. if it weren t for these waters near short docks we can be in danger. In fact we have been hit by a careless boatr_-tan in a large boat,who wasn't or did not care to iook out for the smaller boats and they didn't even stopl It is not that we are against large boats per say but feel they should be inoored in a more proper place. We enjoy taking out such boats bl t they are moored in the bay or at shipyards. We have been on the bay going on 35 years and strongly feel everything should be done to preserve the charming character Newport Bay has rather than turning it into a freeway for large vessels.. KOUSSAY OKKO TO REVISE THE RESIDENTIAL FLOAT BAYWARD OF 1124 EAST BALBOA BLVD Recommendation: If desired: 1) Deny the application, or; 2) Approve the application and allow all docks between C Street and E Street, East Balboa Blvd., to be built out to the U. S. Pierhead Line. Discussion: This application is before the City Council at the request of the applicant as a result of a denial of his permit application by the Marine Department to extend his dock to the U. S. Pierhead Line. Section 23 of the Harbor Permit Policies allows the extension of floats to the U. S. Pierhead Line in this location as quoted below: Section 23.C. "U. S. Bulkhead Sta. 110 to 112. Piers will be permitted to extend out to the U. S. Pierhead Line." In this two block area between C Street and E Street, all of the property owners have held their docks back from the U. S. Pierhead Line, and essentially, are the same distance bayward from the bulkhead line. This has occurred as a result of a mutual agreement by the effected property owners to limit the size of boats bayward of the properties. A copy of that agreement, which the Marine Department has on file, indicates that the restrictions expired as of January 1, 1980. As a result of the above mentioned agreement, an unofficial pierhead line has been established over the years, contrary to the Harbor Permit Policies, and all of the docks in the area have adhered to that unofficial pierhead line. The applicant now proposes to extend his dock approximately 16 feet bayward of the adjacent floats, out to the U. S. Pierhead Line. The Marine Department is concerned that allowing an extension to the U. S. Pierhead Line, in this area, has the potential for creating navigational problems for the following reasons: 1. Because there is now an established line of floats, allowing the applicant to extend beyond this established line creates a situation where one float extends bayward further then the neighboring properties, thereby, creating a potential for obstruction in an otherwise uniform channel. 2. Increasing the bayward extension of the floats allows the berthing of larger vessels, which could protrude into the channel an additional 15 to 18 feet. 3. Nine of the applicant's neighbors have indicated a desire to also extend their floats out to the U. S. Pierhead Line. However, there are 23 permits within this location and if they do not all desire to extend to the U. S. Pierhead Line, it creates an uneven channel in a channel which is now relatively uniform. Should the City Council approve the application, it is recommended that the following conditions be added to the approval: 1) Approval of the Coastal Commission. 2) Approval of the Army Corps of Engineers. 3) Approval of the plans and specifications by the City's Public Works Department. The powerful congressional hierarchy with ju- risdiction over offshore oil and gas exploration and development has transferred, virtual] overnight, frorn individuals who are strong aw vacates of environmental protection to their counterparts who are close allies of the petrole- um industry. The implications of this transfer of power for coastal protection efforts are ex- tremely alarmin, and highlight the absolute necessity of building and strengthening truly bipartisan coalitions to protect our coastal re- sources. Securing continuation of legislative protection for the coast has always been com- pletelyy dependent upon maintaining the chair- mansIups of several key congressional coni mittees. Theprognosis now, for the most part, is not ggood. Former Rep. Bill Lowery (R -California) and present Rep. Ron Packard (R -California) have both championed the OCS Moratorium while serv- ing on the House Subcommittee on Interior Appropriations. Rep. Ron Packard now emer�- es as perhaps the most important single advocafe for the coast on this critical Sub - (continued over) -> CHRRTER TEL No.70`875-2947 committee. Mr. Packard needs to hear from a broad range of constituents who support keep- ing theresent OCS Moratorium in place for all areas ofpthe coast, not just for California. Behind the scenes, twopossible legislative sce- narios exist for continuing the OCSwloratorium for fiscal year 1996: 1n one scenario, the White House Budget will include the fiscal year 1996 OCS protections when it is released in January, and new Subcommittee on Interior Appropria- tions Chairman Ralph Regula is some ow con- vinced by our Republican allies around the country to keep the language in the Sub- committee markup. In a second }possible sce- nario, the White House Budget includes the fis- cal year 1996 OCS protections when it is released, Mr. Re ula's markup vehicle deletes it, and an amendment to reinstate the Morator- ium is introduced during the Subcommittee markup and is narrowly adopted by a vote of the Subcommittee. A thirdpossible scenario would call for an amendment to add the OCS Moratorium to be adopted in the full House Appropriations Committee. None of these scenarios will be easily ac- complished, but none are impossible. Afl rely on drastically stepped -y grassroots pressure to ensure that protecting the coast remains a high political priority for both pi.rties. If the OCS is- sue is allowed to die away in the arena of pub- lic opinion, the OCS Moratorium will not be re- newed next year. If the OCS Moratorium is not renewed for FY 1996, it will expire on October 1,1995 and it is highly unlikely that it will ever be reinstated. The management of the OCS Leasing Program will then be completely at the mercy of whatever President is in power at any given time. F.ven without congressional re- newal of the OCS Moratorium next year, it is unlikely that the Clinton Administration would actually approve new QCS leasing in any con- troversial coastal areas in the lower -48 states (outside of the Gulf of Mexico). The same kind of executive protection, however, cannot be as- sured for Alaskan waters. Hue areas of the Alaskan federal OCS have beenlargeted b&the Clinton Administration's Five -Year OCS Leas- ing Program. If future congressional Morator- ium protection is allowed to lapse, a future Re- publican president could lease offshore wherever and whenever he wished, even in spite of the Bush -announced deferrals. Keep in mind that the congressional CICS Moratorium was originally puE in place by a Democratic Congress to control the pro-develo went zeal of former Interior Secretary James Watt. Coastal Crisis in the Coming Decade: The next Interior Department pro-drillin zeal- ot, however, mi ht unfortunately coincide with the tenure of tc Republican control of both Nov.15 94 10:33 P.03 Next Year to Decide tine Fate of the Coast: The offshore drilling to pic remains a hot news item in California. Uovernor Pete Wilson made front pape headlines during his recent successful re-election campaign by signing a Democratically -sponsored statewide 3 -mile state waters offshore drilling ban into effect. Candidates of all political stripes used the is- sue in their cam aign ads, taking credit for "saving the coast. The real question now is whether or not we can continue to muster public pressure in order to renew the federal OCS Moratorium without our good friend Rep. Sidney Yates in the key Chairman's seat. The coming legislative session promises to be a determinative one on the OCS issue, per- haps the most decisive yet, and we have few allies in high places. A Broad Range of Republican Agenda Items of Grave Concena: With or without renewal of the OCS Morator- ium, a number of the emerging legislative pri- orities of the new Republican Majority party will have serious implications for the CICS is- sue. The "line -item veto", for example, would render environmental protections embedded within Appropriations legislation sub 'ect to selective elimination. There is little doutt that former President Reagan would have vetoed the OCS Moratorium if he could havegotten at it without cutting off all funding to the In- terior Department. The Republican leadership has also been talk- ie a good deal of late about offeringg the pe- tro industry a broad }package of financial and regulatory incentives to increase domestic oil and gas exploration. Any and all aspects of this package of incentives, if adopted, can be expected to change the fiscal dynamics of many OCS exploration decisions. -Waiting in the wings, and enjoying apparent sympathy even within the Clinton Administration, is an industry -backed proposal to permit the export of Alaskan North Slope oil, a measure certain to increase leidative pressure to drill within the Arctic Nalcanal Wildlife Refuge as well as in unexplored "frontier" OCS areas off of Alaska and the lower -48, Several other forms of "regulatory relaxation" have been an emergent theme of the so-called "wise -use" movement in the Senate, which will now be heavily -represented within the Republican Ma'ority. Look for significant roll- backs in. regulatoryprotection for the environ- ment in general anion the OCS in particular. An "OCS Revenue Sharing" approach is sure to resurface aimed at providing fiscal pun- ishments for local jurisdictions which oppose OCS development and fiscalFrincentives for I IV LLJCJ Vl \-Vil�l Cb:., utua it uclacu n.r� r iui uac by -then entrenched pro-developmer ..hairs of key Coinhuttees. A memo prepared by the City Manager Kevin Murphy was discussed in detail, and the following recommendations were made: That the City retain auditors to prepare an audit of the Tidelands and Submerged Lands Funds, and report back to the City Manager on that audit. Specifically, those areas dealing with administrative salaries and overhead, police protection and fire protection. Also, the committee recommended that the City go forward with a plan to prepare a comprehensive survey of City and County Tidelands within the City of Newport Beach. Finally, regarding moorings, it was Staff's opinion that the management of the moorings by the Orange County Sheriff's Harbor Department, under contract, was still a good deal for the City and no changes should be implemented at this time. B. Additional Tideland's Activities: Councilwoman Hart felt that there should be an inventory of the City docks, and we should prepare a five year maintenance replacement program for those docks and include this in our upcoming budgets. She felt that the same should also be done for dredging on public beaches. Councilwoman Hart felt that it would be important for the City to continue to search for appropriate sites for a public boarding area within the harbor, and it was suggested that the Staff revisit the site adjacent to the Rueben E. Lee/Charlie Browns, and also investigate whether funds would be available from the State Boating and Waterways. C. The next item for discussion was the offshore reef proposal by Rodolphe Streichenberger. The Tideland Affairs Committee concurred with the Staff recommendation that the applicant apply for a City Harbor Permit, and, in conjunction with that application, prepare an initial study, working with the Planning Department. D. Other matters related to Tidelands issues: There were no additional matters discussed. The meeting was adjourned and no new date for the Tideland Affairs Committee has been set. The preliminary drawings conform to the City's Standard Drawings, and on that basis could be approved on a staff level. However, the float is shown as extending to the U.S. Pierhead Line. In this particular location, between C Street and E Street, all the docks are held back approximately 16 feet behind the Pierhead Line. In the past the docks in this location have all been held back because of the difference in the distance between the Bulkhead and the Pierhead Lines, and the difference in the size of the underwater lots bayward of vacated Bay Avenue. It would be the position of the staff that this particular dock could be built as preliminary drawings show, however it could not go further bayward than those docks on its immediate east and/or west. DEEB AND MR. CHRISTIANSEN TO ADD A 10 FOOT EXTENSION TO AN EXISTING FLOAT AT 1200 EAST BALBOA BLVD. Recommendation If desired, 1) deny the request or 2) approve the request subject to the condition that any vessel moored at this facility shall not extend bayward of the float more than five (5) feet. Situation Dr. Deeb and Mr. Christiansen proposes to add 10 feet to their existing 40 foot long jointly owned float to provide adequate mooring for a 65' vessel. Numerous bayfront property owners in the immediate zone believe the approval of the 10 foot extension and the mooring of Dr. Deeb's boat bayward of his property would have a negative impact on navigation and would impair views in thissection of the bay. Discussion This application is before the Council for review and action at the request of the neighboring property owners and by recommendation of the Joint Harbor Committee. Under existing Harbor Permit Policies (Section 23), a pier and float in this area is allowed to extend to the U. S. Pierhead Line. In this zone, between C Street and E Street, the U. S. Pierhead Line is approximately 40 feet further bayward than the majority of the floats. Additionally, the Harbor Permit Policies (Section 21) allow a vessel to extend beyond the float a distance equal to the beam of a vessel moored at the float. The neighbors have expressed a concern about a possible hazard to navigation because of the offshore moorings bayward of this location being close to shore (approximately 120 feet bayward of the U. S. Pierhead Line). The neighbors also feel that approval of the float extension could set a precedent for property owners to extend their -floats out to the maximum allowed by the Harbor Permit Policies. � rr. APPLICANT: DEEB AND CHRISTIANSEN PAGE TWO On May 19, 1977, the Marine Department processed an "Approval of Concept" form for the Regional Coastal Commission, in conformity with the Harbor Permit Policies. As a result of the neighbors expressing concern to the City staff, the "Approval of Concept" was.withdrawn until such time as a resolution to the problem is reached. On July 27, 1977, the Joint Harbor Committee reviewed the application and recommended denial of the request. Subsequently, Dr. Deeb requested that the application not be submitted to the Council for action until such time as he had reviewed his position. Dr. Deeb has requested that his application be presented to Council at this time. Prior to the Joint Harbor Committee meeting the Orange County Sheriff4arbor Patrol Bureau reviewed the application and indicated they would not oppose a 10 foot float extension if the permit was conditioned so as to prohibit any vessel extending more then five (5) feet beyond the dock. Dr. Deeb's vessel has been moored at this existing float in the past in conformance with Section 20 of the Policies and has not been considered a hazard to navigation by the Harbor Patrol. Our property has been. in our family since 1916, We object: strongly to Dr. Deebs' application to extend his float farther out into the southerly channel of Balboa Bay which he and we face. Obviously, his sole purpose is to facilitate the mooring of a boat: which is much too large for his property. If it weren't, there would be no need for,his application. Un- usually high -sided, the Boat Is about 63 feet long and 16 feel wide. When moored at the existing facility, the boat already extends considerably beyond all the floats and boats on the bay front in the general area as well as beyond the waterfront lots and U. S. Bulkhead line. Because of the already existing hazard to navigation, Dr. Deebs deems it prudent to keep lights on the stern at night or to keep the boat moored at Long Beach. Extending the boat: still farther out at Balboa would materially increase the public hazard and make it even more difficult for neighbors to use theix (lochs. Please bear in mind that the lots, including the waterfront lots for several blocks in this part of Balboa Bay,. are only thirty feet in width. .From the standpoint of view and elbow room, the bay is everything -- a green belt of a sort. In fact, in the late fifties, all of the waterfront property owners in four ur five blocks entered into an agreement designed to protect the view by limiting plantings, fences, sizes of boats, and the like. Dr. Deebs! boat, when moored in front of. his house, constitutes a serious obstruction to the view of several property owners and otherwise violates the agreement mentioned. In fact, we are reluctantly considering bringing a lawsuit to clear up certain questions. Since his boat rides over our waterfront lot part of the time, there is a title question. On at least two occasions our float has been hit in the docking of his boat. Then there are questions about the property owners' agreement. In conclusion, we repeat, the simple fact of the rnafter is that the boat in question, or any boat that size, is far too rnuch boat to be moored where indicated.
