CITY OF NEWPORT BEACH 'September 15, 1987 Frank Sennes Coldwell Banker Newport Beach, CA 92663 644-9060 675-3735 Dear Sir: 4, 0 The City of Newport Beach has received an application to transfer pier permit # 110-1126 for the property located at 1126 East Balboa Blvd. Newport Beach, California. The structure was inspected on 9/15/87 at which time it was determined that the following deficiencies exist: 1. A City -approved anti -syphon device is required at the water connection to the pier and float. 2. The extension cord running onto the dock must be replaced by electrical line in conduit, connected to a junction box. 3. 4. 5. Unfortunately, our moving from our home of the last seven years can only solve one of the problems of which the people at 1134 E. Balboa have complained. We can only limit the number of people who come onto the dock. The traffic on Balboa Blvd. and the quality of the water in Newport Bay will remain thesame as we have no influence over these complex situations. Since we are both SCUBA divers, as well as ocean voyagers, and have a great appreciation for the fragile beauty of marine life, we would not knowingly contribute to its destruction or demise. The parking and traffic situations on Balboa Blvd. will remedy themselves around the first of October as they do every year. As we have done our part to comply with the laws of this city and rectify the complaints against us, I hope that the residents of 1134 E. Balboa Blvd. will do their part by ceasing to watch Mr. Barneson, his family, and his friends with high-powered binoculars and allow those good people to conduct their affairs in private. Barneson 1126 East Balboa Boulevard Balboa, California 92661 Re: Violation of Harbor Permit Policies Section 1.A and 4.K Dear Mr. Barneson: The Marine Department of the City of Newport Beach has requested this office to take legal action against you for disregard of Harbor Policies and disregard of repeated requests to comply. Specifically, by letters dated May 10, 1984 and May 31, 1984, you were informed of complaints received by the Marine Department, concerning liveaboards using your residential float. In conversation with Tony Melum, Tidelands Administrator, you informed him that no one was living aboard the vessel. However, Mr. Melum spoke with Mr. Alfery who admitted that he actually was living aboard the vessel. That admission was also confirmed by the County Harbor Department. As a condition of your Harbor Permit, No. 110-1126, you agreed to comply with all of the Harbor Permit Policies. Harbor Permit Policy Sections 1.A and 4.K, prohibit liveaboards. In a final informal effort to clarify any misunderstanding and to resolve this matter, a meeting has been scheduled for August 17, 1984, at 9:30 a.m., in our offices. Failure to appear as scheduled, or to immediately make alternative arrangements, will result in this office taking appropriate legal action against you and your Permit. The complaint was that a vessel moored on the west side of the float encroached into the City street end, in violation of Section 21.A of the Harbor Permit Policies. On July 7, 1983 we wrote the property owner regarding this problem and wrote him again on August 5, 1983, June 7, 1984, and June 22., 1984 (see attached). During this period I had two conversations with the property owner's son who -is managing the property, and one conversation with the boat owner. They assured me that something would be done. It has, however, been over a year since our first contact and the problem is unchanged. For your information I have included a copy of the permit drawing. #2. 110-1126 In May'of 1984 the Marine Department received a complaint from adjacent residents regarding a liveaboard bayward of 1126 E. Balboa Blvd., in violation of Section 4.K. of the Harbor Permit Policies. I contacted the Harbor Department and they verified that a Paul Alfery was staying aboard the vessel "Lusty" bayward of the above property. We wrote the property owner on May 10 and May 31, 1984 (see attached). We. also spoke to the property owner in person. He indicated no one was living aboard. I also spoke to Mr. Alfery and he indicated he was staying aboard but would cease to do so.
