The City of Newport Beach Fire and Marine Department has received
a request to transfer pier permit 110-12000-1 for the above
mentioned property. The facility was inspected on October 3,
1997.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. This requirement is in accordance with Title 17 of the
California Administrative Code.
2 The electrical outlets on the dock must be GF1 or twist lock
receptacles for use in a water environment.
q/1 The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requirements, and the conditions of the existing
permit. All deficiencies must be corrected prior to
transfer of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE

SUBJECT: NOTICE TO PROCEED (File No. 98-00614-YJC)
Dear Mr. Melum:
Reference is made to your letter dated July 13, 1998 in which you submitted on behalf
of Mr. Roses who resides at 1200 E. Balboa Blvd., a notification for the maintenance dredging
of 100 cubic yards of sand and silt material by hydraulic suction and disposal of the dredged
material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Rose's contractor does not exceed the maximum dredging design depth
of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

Recommendation
If desired, 1) deny the request or 2) approve the request subject to the
condition that any vessel moored at this facility shall not extend bayward
of the float more than five (5) feet.

Dr. Deeb and Mr. Christiansen proposes to add 10 feet to their existing
40 foot long jointly owned float to provide adequate mooring for a 65'
vessel. Numerous bayfront property owners in the immediate zone believe
the approval of the 10 foot extension and the mooring of Dr. Deeb's boat
bayward of his property would have a negative impact on navigation and
woul d i mpai r vi ews i n thi s secti on of the bay.
Discussion
This application is before the Council for review and action at the request
of the neighboring property owners and by recommendation of the Joint Harbor
Committee.
Under existing Harbor Permit Policies (Section 23), a pier and float in this
area is allowed to extend to the U. S. Pierhead Line. In this zone, between
C Street and E Street, the U. S. Pierhead Line is approximately 40 feet
further bayward than the majority of the floats. Additionally, the Harbor
Permit Policies (Section 21) allow a vessel to extend beyond the float a
distance equal to the beam of a vessel moored at the float.
The neighbors have expressed a concern about a possible hazard to navigation
because of the offshore moorings bayward of this location being close to
shore (approximately 120 feet bayward of the U. S. Pierhead Line). The
neighbors also feel that approval of the float extension could set a precedent
for property owners to extend their floats out to the maximum allowed by the
Harbor Permit Policies.

On May 19, 1977, the Marine Department processed an "Approval of Concept" form
for the Regional Coastal Commission, in conformity with the Harbor Permit
Policies. As a result of the neighbors expressing concern to the City staff,
the "Approval of Concept" was withdrawn until such time as a resolution to
the problem is reached.
On July 27, 1977, the Joint Harbor Committee reviewed the application and
recommended denial of the request. Subsequently, Dr. Deeb requested that
the application not be submitted to the Council for action until such time
as he had reviewed his position. Dr. Deeb has requested that his application
be presented to Council at this time.
Prior to the Joint Harbor Committee meeting the Orange County Sheriff -Harbor
Patrol Bureau reviewed the application and indicated they would not oppose
a 10 foot float extension if the permit was conditioned so as to prohibit
any vessel extending more then five (5) feet beyond the dock. Dr. Deeb's
vessel has been moored at this existing float in the past in conformance
with Section 20 of the Policies and has not been considered a hazard to
navigation by the Harbor Patrol.
Staff has prepared 35mm slides for projection showing the zone and vessel
berthed at Dr. Deeb's float. Attached are letters from Dr. Deeb and his
neighbors stating their respective views.
Notices of tonight's meeting have been sent to the applicants and surrounding
property owners.

I will be unable to attend your meeting on November 14,
1977, when the above application will be considered. However,
as a person residing a few doors away from Dr. Deeb and
N. Christiansen, I wish to protest your giving a permit to
extend a float at their property located at 1200 E. Balboa
Boulevard.
The size of the boat they propose to keep at this float
in my opinion poses a navigational hazard in getting in and
out of this slip and it also extends out into the waterway
past the line of the boats that are moored along the other
docks in this area. It also blocks the view of the Bay for
the other residents of the adjacent block, as well as the
1200 block where it is moored.

After the granting of the conceptual approval,which was later
withdrawn because of complaints from the next door neighbors to
the east of us (copies of complaints on file with City Council,
City of Newport Beach.) Their first complaint, that the boat would
extend 18fL. beyond the end of the new addition to the doc'k.has
already been answered, by our suggestion that a condition be recorded
with the City of Newport Beach, that no boat may extend beyond 8ft.
past the end of the new addition, -thus the boat would be in the same
position as the boat is now.
Secondly, their claim about a narrow channel etc.. The Marine
Department does nc-t agree and it is not in accordance with the.
Department's recommendation. (See previous paraqraph.page 1,
"Mr.Glen E.WP!Iden"� Th4s channel is 160ft. wide from the moorir;g
to the existing end of the dock, this represf�nts almost two to three
times the averaqe channel. as seen in the Marinas which have slips

In summary, the granting of the 10ft. extension for the dock will,
in no way'alter the existing condition whereby the boat in cupstion

of Newport Beach, that no boat may extend beyond Rft. past the new
10ft. dock addition.

This letter is written to you on behalf of Dr. Edward Deeb
regarding a matter of serious concern to swimmers and
adjoining property owners to property owned at 1204 East
Balboa Boulevard by Mr. and Mrs. Edwin H. Corbin and Mr.
and Mrs. John S. Neguss. A condition on said property has
developed relating to the wall partition or groin extending
into the water. Said groin is owned and is required to be
maintained by the above land owners. The condition is
extremely unstable in that the groin has lost its foundation
and depends upon its support upon a candelabra effect. On
the west side of the groin the condition is similar with the
additional feature that there is an extreme downward angula-
tion submerging part of the groin at high tide.
It is believed that this condition at anytime could cause
injury to swimmers, children and boats in the area; that it
constitutes a hidden menace and is extremely unstable.
Request is hereby made that an inspection take place and that
said groin, if found to impose a danger and impediment, be
repaired immediately in accord with legal requirements such
as permits, city building supervision, etc. Your prompt
action to this matter would be greatly appreciated. Repair
and continued maintenance of this groin will avoid what could
be serious injury to the yoy.,g children in the area.

Discussion
This application is being brought to the Joint Harbor Committee for review and
recommendation to the City Council because the proposed revision may be out of

Dear Mr. Welden:
Thank you for your correspondence of July 27, 1977. As I
have mentioned to you on the phone, I have been retained
by Dr. Edward Deeb in order to assist him in the above -
referenced matter.
In response to your July 27, 1977 memorandum to the Chair-
man and the Members of the Joint Harbor Control Committee, you
have suggested four alternate courses of action and have
indicated that the Harbor Control Bureaq has no opposition
to Alternate No. 3, that is to allow the permit with a limita-
tion of the -extension of any vessel to three feet beyond the
end of the proposed extended float with a navigational light
to be installed on said float.
In your memorandum you make refirence to a deed restriction
limiting the vessel length to 26 feet. However, in discussions
I have had with members of the community, the Marine Department,
the Harbor Department and others, this point does not seem to he
well taken by the opposing neighbor. First of all, as you know,
a restrictive covenant in a deed can be legally abandoned by
custom, usage and waiver by the dominant tenaments, that is by
those -who are benefited by the restriction and who have agreed
to it. There appears to be no doubt in anyone's mind that the
26 -foot limitation has been abandoned by a majority of the
neighbors originally bound by such restriction and by their
Yuccessors. Either such neighbors own a vessel in excess of
such restriction, and in some cases 2 to 2Q times the limitation
or have, since 1957, acquiesced in their neighbor's ownership.
There appears to be nothing new about Dr, Deeb's vessel size in
that area. However, I do not believe this is the issue since
the question.of the validity of a restrictive covenant is better
suited for a law court. Dr. Deeb's neighbor has apparently

refused to take this course of action since he knows that
lie could not prevail in a court of 'law, and is trying to
prevail in this more informal hearing. By way of example,
if the proposed dock was already in existence and a vessel
in excess of 26 feet, owned by Dr. Deeb, was moored at -its
side in conformity with the Harbor Regulations and Permit
Policies, the complaining neighbor could not come before this
Bo.ard in order to enforce a restrictive covenant. That would
be a Ovil matter and a question that Dr. Deeb would have the
right to be heard before a jury arises. At such a trial
questions of abandonment, usage, aesthetics and other matters
relating to -the rights of individual neighbors could be pre-
sented. It is, therefore, of some interest to me why reference
was made at all in your memornadum to the existence of a 190
deed restriction. That clearly is not the issue here nor could
it be.
With regards to navigational safety, as you pointed out in
your memorandum, the Harbor, Control Bureau has indicated -that
a 13 -foot extension or protrusion beyond the present dock does
not prescnt any hazard to navigation. This is somewhat shorter
than the 18 -foot beam on Dr. Deeb's present vessel, However-,
I do not think that Dr. Deeb should oppose y*our recommendation
and the Harbor Control Bureau's indication that Alternate No. 3
in YOUr memorandum is in conformity with safe navigational
standards. Nonetheless, I must point out that I do not believe
the -issue before the Joint Harbor Committee, at this time,
should be the vessel or the, usage or said dock,since Dr. Deeb
L ains other moorings and his vessel will be tied up for
ma i n ( '
s ign-i ficant periods of time el sewhere, and also, the vessel may
be exchanged for other like vessels or sold. Even whp.n the
vessel would be moored at the dock, it is not inconsistent with
the surrounding vessels or structures and numerous vessels of
equal or like.size moored or docked in the vicinity. The fact
that a neighbor may prefer a motor craft to a saling vessel
is a matter of personal judgment and should not affect the
rights or privileges of Dr. Deeb as a boat and home owner.
Finally, it appears that your initial Approval of Concept was
well taken. Apparently you reviewed the safety and navigational
features and felt that they were acceptable to your department.
It appears then that the only objection a neighbor might have
is pursuant to the restrictive covenant, which we have shown is
not at issue before this Board.

#110-1200. 1 understand this application involves a request
for considerable lengthening of the existing pier and float
at 1202 E. Balboa Boulevard.
I feel that this would be undesirable in that it will bring
in a very large boat which not only obstructs the view of
the homeowners but also obstructs the access in our already
narrow channel between the floats and the boats tied up in
the bay. I understand this matter is to come up at the July 27
meeting. I will not be able to attend that meeting, however,
I wish this letter to express my opposition to the proposed
enlargement of the pier and float.

pending covering the 10 foot bayward extension
to the joint pier and float located 1200 and
1202 East Balboa Blvd., Balboa, Calif. We are
opposed to the granting of this permit for the
following reasons.
The boat to be moored at this float is
65 feet in length with a beam of lb feet.
Under existing regulations, the stern of the
boat could extend 26 feet further out into the
bay from the present line of floats. This
would represent the 10 foot float extension
plus the beam of the boat at lb feet. Such a

large sized boat is incompatible with this
area and restricts the view of Balboa bay
including the public view from D street.
Any encroachment such as mentioned above
into the already narrow channel will create a

to the Deeb property at 1202 East Balboa.
We wish to protest very strongly any extension of
the joint pier at 1200-1202 Bast Balboa. The float at
this pier presently extends approximately 41 further
into the bay than most of tTle neighboring floats which
is apparently due to the fact that the. present float
is li-O feet long whereas -the pier permit on file with
the City of Newport Beach specifies a f1oat :to be
�construced 35 feet in- length. In addition it is noted
-that the "Notice of Public Hearing" datedl/9/77'
indicaLes-the present float as being 25 feet in length
before -the 10 foot addition whereas t.he physical measure-
ment is 40 feet or a difference of 1-5 feet.
In our estimation, another 10 feet added to the
present 40 foot float will create a navigation hazard
due 'to the encroachment �into -the channel. It is our
understanding that the City of Newport Beach-peTmits a
boat -to extend beyond the pier float by the beam of the
boat which, in this case, would be approximately 15 feet
'beyond the proposed 10 foot extension.
Even:at present without the addition it is very
difficult for sailboats -to approac).-i and leave our pier
due to,the.extension of the next door boat beyond the
finger. float into the channel. The enclosed photograph
was taken. from the pier. at 1206 East Balboa showing the
pilings.at the end of -the pier for 1206 and 1204 on the
present pier line and the 15 foot extension of the boat
at 1202 East Balboa.

Recommendation
If desired, approve the Maintenance Dredging Harbor Permit
Application.
Discussion
This application requires City Council approval under the
conditions of approval of the City of Newport Beach "blanket"
permit for maintenance dredging issued on February 12, 1974,
by the U. S. Army -Corps of Engineers.
The location and applicant for the proposed maintenance dredging is:
110-1202 Edward Deeb, 1202 E. Balboa Blvd.
The staff has reviewed the proposed dredging and has determined
that the work to be done is within the parameters of the
Corps of Engineers permit. There is no anticipated adverse
affect on proximity beaches or contigous bulkheads.
Shellmaker, Inc., the dredging contractor, will mi. i i
nimize
turbidity as much as is possible and will barge the dredged
material to the Environmental Protection Agency's designated
disposal site, four miles at sea.

In reviewing your dredging application permit no. 110-1202 of 18 OCT 76,
1 request the inclusion of a special condition that the applicant notify
the U. S. Coast Guard Captain of the Port, Los AngeleslLong Beach at
least 24 hours prior to any dumping activity authorized under the U. S.
Army Corps of Engineers permit. The inclusion of this condition in the
permit will enable the Coast Guard to perform its ocean dumping surveillance
and enforcement functions under the Marine Protection, Research, and
Sanctuaries Act of 1972.

Mr. Gordon Crary, 1515 and 1519 E. Balboa Boulevard, to construct a bulkhead
along the bayward side of the vacated Bay Avenue.
4. On 23 May 1974, this office issued a permit (73-63) to Dr. Robert Beauchamp,
at 2000 E. Bay Avenue, to construct a bulkhead 44 ft. bayward of the bayward
side of Bay Avenue.
5. At this time, high tide waters extend to within a few feet of the rear
of Mr. Elder's home. At times of a combination of high tide and Santa Ana
�tfndsout of the east, waves generated on Newport Bay will sweep into the

Engineers requires rebuttal to objection.
8. March 29, 1974 Public Works survey crew surveyed site to
determine Mean High High Water line.
9. March 29, 1974 Corps of Engineers called Marine Department
staff regarding: (1) Need for letter
rebutting River Basin Studies objection and
(2) corrections to drawing submitted.
10. April 1, 1974 Marine Department staff met with King Benham
of Corps of Engineers and Pat Wright of River
Basin Studies on site to discuss River Basin
Studies.
11. April 3, 1974 River Basin Studies (Pat Wright) called
Marine Department and stated they will allow
bulkhead to be constructed on line of MHHW
(+5.3). This would allow construction of
bulkhead 101 bayward of house.
12. June 18, 1974 Corps of Engineers called regarding need for
South Coast Regional Zone Conservation Com-
mission approval of revision.
13. June 19, 1974 Letter from South Coast Regional Zone Conser-
vation Commission sent to Corps of Engineers
re #12 above.
14. August 7, 1974 Corps of Engineers sent permit and report
from L. A. office to regional office in
San Francisco for review.
15. Sept. 18, 1974 Corps of Engineers called and stated that
permit application, survey of 3-29-74 and
corrected permit drawings along with L. A.
office revised report has been returned to
San Francisco for second office.
16. Oct. 13, 1974 Mr. Elder required to obtain survey of site
by licensed surveyor because River Basin
Studies disputed original drawing. This survey
indicated MIIWL to be 151 to 2b' from house.
17. Jan. 7, 1975 Mr. Elder called Corps of Engineers and was
told his file had been sent back to San
Francisco again.
18. Jan. 29, 1975 TedYee of COE called. Div. office of COE
in San Francisco wants:
1. Aerial photo of entire bay showing
develop.
2. Aerial photo of immediate area around
Elder showing bulkheads.
3. Estimate of area bulkheaded.
19. Feb. 27, 1975 John McVay of COE called regarding photo

ACTIVITY: Remove the existing wood groin and replace it with a concrete
bulkhead; construct and install anchor pilings and a new woodwall; relocate
the existing.pier and ramp; revise the existing slip to extend 10 feet bay -
ward of the U.S. Bulkhead Line in front of Lots I and 2, Block 19, Eastside
Addition Tract, Balboa, Orange County, California, as shown on the drawing
accompanying this notice.
PURPOSE AND USE: To provide a larger docking facility.
FEDERAL, STATE AND LOCAL AUTHORIZATIONS: Approved by the California Coastal
Zone Conservation Commission - South Coast Region, Permit No. P-8-13-73-1695,
and the City of Newport Beach. The California Regional Water Quality Control
Board - Santa Ana Region, has indicated that they have no objection to the
proposed activity provided that there shall be no dewatering associated with
the bulkhead construction and that the wa ' ters of Newport Bay shall be main-
tained free of all construction debris.
ENVIRONMENTAL IMPACT: Based on information received, it is not anticipated
that the activity will require the preparation of an Environmental Impact
Statement by this office.
PUBLIC HEARING: Any person who has an interest which may be adversely
affected by the issuance of a permit may request a public hearing. The
request must be submitted in, writing to the District Engineer within
thirty (30) days of the date of this notice and must clearly set forth
the interest which may be affected and the manner in which the interest may
be affected by the activity. Activities under Section 103 of the Marine
Protection, Research and Sanctuaries Act (PL 92-532) and Section 404 of the
Federal Water Pollution Control Act (PL 92-500) will be considered in con-
junction with this notification.
CRITERIA: Your written comments or objections should include the number
of this notice and must reach this office within thirty (30) calendar days.
The decision whether to issue a permit will be based on an evaluation of
the probable impact of the activity on the public interest. That decision
will reflect the national concern for both protection and utilization of

accrue from the activity must be balanced against its reasonably fore-

The purpose of this letter is to provide additional
information related to my application to build a
seawall on my property at 1200 E. Balboa Boulevard.
1. construction
As described in a quotation by Trautwein Brothers:
Wood wall constructed of creosoted tongue and
groove 3 x 12 x 12 ft. long with:8 x 8 ft. whaler,
2 x 12 ft. redwood cap painted and deadmen with
1-1/8" rods at approximately 12 ft. on center.
I considered concrete construction but determined
it to be undesirable because of the problem of
connecting it to the wood groin on the west side
of the property and a wood groin and seawall
backfulled with sand, on the east side of.the
property.
Deed for the Improvement
The present beach in front of the house is con-
stantly wet and unusable due to the low profile
of the sand line. It tends to collect unsightly
material and interrupts the otherwise even flow
of current in the channel. Lastly, due to the
fact that the sand line is low, there is a drop-
off adjacent to the sidewalk in front of the house
that is hazardous to my guests at night when
visibility is poor.

3. Precedence
Numerous properties in the 1100, 1200 and 1300
blocks have similar waterfront improvements.
Although practice varies, these improvements
generally involve seawalls constructed 40 ft.
bayward of the zero setback line, or about 10 ft.
bayward of the vacated easement. Some consider-
ation was given to an improvement 30 ft. bayward
of the zero setback, but that proved less
desirable because it would not mate conveniently
with the structural members in the two adjoining
groins. By constructing the seawall at a 40 ft.
distance, a stronger structure can be built and
repairs can be made to a deteriorated segment of
the city groin on the west side of the property.

The City Manager called Thursday, November 2. and asked that I
compile a report with background information concerning the
CoVplaint from MrZ. Gilliland about the Martin's overcrowding
and renting their slip structure at 1209 A. Balboa Boulevard,
Vreceived from Title Insurance and Trust Co& on September 22o
a letter, transfer card and check (Exhibit 1) requesting the
transfer of Harbor Permit 0110-1200, located at 1200 E, Balboa:
Boulevard, from Mandell's to the Martin's. This facility Was � .
inspected on September 18, on a request -from the escrow company
to verify that the slip would meet building code specifications,
for transfer,
Approximately September 25p Mrs. Gilliland called me and.asked
what type of restrictions the City had with Werence to renting
slips in a residential zone. I explainbdjo her that it was
discouraged in accordance.with the Council's Harbor Permit Policies
SAetion Ip A. which states "Shore connected piers and floats
blyward of residential zoned areas shall be reserved for the
occupants of the abutting upland prpperty", At the time of her
initial inquiriest she did not identify that she had a complaint
to make. in the course of our discussion, I further explained
to Mrs. Gilliland that the renting of slip or side -tip space
in, residential areas was a couunon occurrencei I also explained
that there were no restrictions to the number of vessels a
single slip or float structure could accommodate as long as the,
vessels moored to a facility did not encroach across the pro-
longation of the��common property line or extend more than the
width of the beambayward of the slip or floatp in general,

At this point in the conversation,, she indicated that she was
very unhappy with the adjoininq property owners who had just

The Harbor Department: report does not indicate a recommended

Since the initial conversations with Mrs* Gilliland, she had not
recontacted am. I have been under the assumption that the prw-

In summationp I definitely believe the City should enforce
encroachment situations. However, at this time it would be
virtually impossible to enforce residential harbor permit
holders to restrict their facilities for their own vessel use,
I do not -have any statistics to indicate how many people are
renting or loaning slip space but I would venture to say that
it would be somewhere about 30%, Vessel mooring spaces are
and have been for a number of years at a premium throughout
the haZbor which is reflected in the high cost of commercial
slip space approximately $3100/foot per month, It is not
uncommon to see residential space advertised in the local papers,

side of Lots I and 2 in Block L of Bay Front Section of
the Balboa Tract, owned by Daniel Mandell and Leone R.
Mandell.
The sellers are unable to locate their Harbor Permit. We
ask that you kindly forward us a duplicate Permit, or
sufficient information so we may prepare the transfer

Please find enclosed Section 4 (A-H)of tile City Council's
liArbor Permit Policies. These "General Provisional' are
for Your informationt and are the basic conditions under
which the Harbor Permit is being transferred to you.
Also, for your information Section l(a) of the Harbor Per-
mit Policieso states# "Shora connected piers and floats
bayward of residential zoned areas shall be reserved for
the occupant of the abutting upland property."
The pier and dock were inspected a few days ago, in conjunc-
tion with transferring the harbor permit to you,
The domestic water supply to the pier and slip needs an
anti -siphon valve installed in order to meet city standards.
In accordance with Section 10 D (Harbor Permit Policies) the
anti -siphon valve must be installed within 6 months from the
date of transfer. Would you please advise this department
when this requirement has been Mato Thank you for your
