This was appropriate for a joint dock. However, after the bills were sent this dock permit was converted to a single permit, was no longer a joint dock, and the bill was revised to $55. They are willing to pay the additional amount to make the payment $55; however, based on the way the tideland property is held, they need a new bill showing balance due of $55 minus the $27.50 already paid. The Newport Beach Municipal Code states: 17.22.050. "Penalty for Failure to Pay Fees. Any owner or permit holder who fails to pay any fee required by this Chapter within thirty (3) days after same is due shall be subject to a penalty in the amount of 25 percent (25%) of said fee on the first day of each month after the due date thereof; provided, however, that the amount of such penalty to be added shall in no event exceed one hundred percent (100%) of the amount of the fee due. Failure to pay the fee plus any accrued penalty within one hundred and fifty days (150) after the fee was originally due shall constitute grounds for revocation of the permit by the City Council (Ord.1801s1 (part), 1979; Ord 1667sl, 1976; Ord 1387 sl (part) 1971)." A check of your Harbor Permit shows that your permit is held jointly with 1210 East Balboa Blvd. According to the Harbor Permit Policies, 15-B states: 15.B. Harbor Permit.110-1208 for the property bayward of 1210 East Balboa Blvd. Dear Mr. Walters: The City of Newport Beach has received a complaint regarding the use of your residential dock at, the above address. Specifically, the complaint is that a vessel CF 8420HM is being berthed at your dock in violation of Section 21.A. of the Harbor Permit Policies, which states: 21.A. "Boats moored at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected...".
