Commission staff have reviewed the information submitted and determined that the above
referenced dredging events conform with Consistency Certification CC -078-99 and that no
further federal consistency review is necessary from the Commission for' the dredging
components of the projects. In addition, the proposed beach disposal has been reviewed and
found by the Executive Director to be consistent with Special- Conditions 1, 2, and 3 of
Coastal Development Permit 5-99-282. No further review is necessary from the Commission
for the beach disposal components of the project.
Please be advised that only the project described in the materials submitted for the sites listed
above have been found to conform with Consistency Certification CC -078-99 and/or conform
with the terms and conditions of Coastal Development Permit 5-99-282. Any change in the
project may cause it to lose its status as consistent with CC -078-99 and/or CDP 5-99-282.
This certification is based on information provided by the recipient of this letter. If, at a later
date, this information is found to be incorrect or incomplete, this letter will become invalid,
and any development occurring at that time must cease until a new determination regarding

Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit application for the development
described below, the Executive Director of the Coastal Commission hereby waives the requirement
for a Coastal Development Permit pursuant to Section 13238.1, Title 14. California Code of
Regulations. If, at a later date, this information is found to be incorrect or the plans revised, this
decision will become invalid: and, any development occurring must cease until a coastal
development permit is obtained or any discrepancy is resolved in writing.
WAIVER #: 5-00-304 APPLICANT: Sandra Rados for Sally Stanton
LOCATION: 1302 E. Balboa Blvd., Newport Beach, Orange County
PROPOSED DEVELOPMENT: Rebuild existing 4'x 30' ramp, 8'x 13' pier and 3' x 22'gangway
in-kind; replace existing "U" -shaped floating dock with 5' x 35' floating dock with 8' x 4' lobe; and
remove three existing. 14" piles and replace with two new 14" guide piles. The dock will remain within
the U.S. Pierhead Line.
RATIONALE: The proposed development consists of the replacement and reconfiguration of an
existing dock within the U.S. Pierhead Line. The subject site is located on the harbor side of the
Balboa Peninsula. Coastal access is available directly inland of the dock via a public walkway.
Direct access to the harbor is also available at the end of E Street, approximately 30'west of the
subject site. The proposed dock reconstruction is similar in function to other residential docks in the
immediate vicinity. An inspection performed by the City determined that no eelgrass exists in the
vicinity of the proposed project. Therefore, no eelgrass will be affected by the proposed project.
Also, the Regional Water Quality Control Board has determined that the proposed project will not
adversely impact water quality if standard construction methods and materials are used. The
proposed development will not result in adverse impacts to coastal access, coastal resources, public
recreation or coastal views. The proposed development would not prejudice the City's ability to
prepare a Certified Local Coastal Program and is consistent with the land use designation in the
City's certified Land Use Plan, past Commission actions in the area and Chapter 3 policies of the
Coastal Act.
This waiver will not become effective until reported to the Commission at their September 12-15,
2000 meeting and the site of the proposed development has been appropriately noticed, pursuant to
13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at
the site until the waiver has been validated and no less than seven days prior to the Commission
hearing. If four (4) Commissioners object to this waiver of permit requirements, a coastal
development permit will be required.

Reference is made to your letter dated June 22, 1998 in which you submitted, regarding
the property seaward of 1302-1324 E. Balboa Blvd., Newport Beach, a notification for the
maintenance dredging of 400 cubic yards of sand and silt material by hydraulic suction and
disposal of the dredged material on the adjacent beach (see attached drawing).
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that your contractor, Mark Sites, does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

If desired, approve the maintenance dredging application.
Discussion
The application requires City Council approval under the conditions
of approval placed on the City of Newport Beach general permit for
maintenance dredging issued by the U. S. Army Corps of Engineers, on
February 12, 1974, and subsequently amended on May 10, 1977 to allow
beach restoration. The location and applicant for the proposed dredging
and beach restoration is:
110-1302 W. Layton Stanton 1302 East Balboa Blvd.
The staff has reviewed the project and has determined that the work
will be done within the parameters of the Corps of Engineers permi,t.
The dredging contractor will place a filter screen around the discharge
site to control turbidity. There is no known eel grass in the vicinity
of the project,
All dredged material will be placed on an adjacent beach. This will
aid in the restoration of the beach bayward of a private residence.
