The dock will remain within the U.S. Pierhead Line. RATIONALE: The proposed development consists of the replacement and reconfiguration of an existing dock within the U.S. Pierhead Line. The subject site is located on the harbor side of the Balboa Peninsula. Coastal access is available directly inland of the dock via a public walkway. Direct access to the harbor is also available at the end of E Street, approximately 30'west of the subject site. The proposed dock reconstruction is similar in function to other residential docks in the immediate vicinity. An inspection performed by the City determined that no eelgrass exists in the vicinity of the proposed project. Therefore, no eelgrass will be affected by the proposed project. Also, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used. The proposed development will not result in adverse impacts to coastal access, coastal resources, public recreation or coastal views. The proposed development would not prejudice the City's ability to prepare a Certified Local Coastal Program and is consistent with the land use designation in the City's certified Land Use Plan, past Commission actions in the area and Chapter 3 policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their September 12-15, 2000 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at the site until the waiver has been validated and no less than seven days prior to the Commission hearing.
