conditions, appear on subsequent pages.
NOTE: P.R.C. Section 30624 provides that this permit shall not become effective until it is
reported to the Commission at its next meeting. If one-third or more of the appointed
membership of the Commission so request, the application will be removed from the
administrative calendar and set for public hearing at a subsequent Commission meeting. Our
office will notify you if such removal occurs.

Reference is made to your request of April 5,2005 (File No. 200500864-SJH). Under the
provisions of Section 10 of the Rivers and Harbors Act of March 3,1899 (33 U.S.C. 403), you are
hereby authorized to discharge fill into 0.0026 -acre of open waters of the U.S. Discharge is
associated with modifications to the U-shaped floating dock bayward of 1304 E. Balboa Blvd., in
Newport Bay, in. the community of Newport Beach, Orange County, California, as shown on the
enclosed drawings.
The owner or authorized responsible official must sign and date all copies of this Letter of
Permission (LOP) indicating that he/she agrees to the work as described and will comply with all
conditions. One of the signed copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed). In addition, please use the two attached
postcards to notify this office as to the dates of commencement (within 10 days prior to the start of
construction) and completion of the activity (within 10 days following the end of construction).
Furthermore, you are. hereby advised that the Corps of Engineers has established an
Adrainistrative Appeal Process which is fully described in 33 CFR Part 331. The complete appeal
process is diagrarruned in the enclosed Appendix B,

If standard dock construction methods and materials are utilized, this project should not adversely
impact Water quality. A statement has been submitted that there will be no waste discharged from
the proposed project, Based on these assurances, clearance is provided.
However, should the Army Corps of Engineers determine that this project requires a Section 404
permit, it Will be necessary for the project proponent to obtain from this Board a Water Quality
Certification under Section 401 of the Clean Water Act.

RE: Your Float Located at 1304 E. Balboa Blvd
Dear L.G. Hahn
A recent field inspection of your dock has revealed your float to be in extremely poor condition.
The float is breaking apart into the bay and presents a hazard to swimmers and other vessels in the
area. The severe condition of your float is in violation of the Newport Beach Municipal Code, Title
17.24.090 which states that your pier permit may be revoked if it is detrimental to navigation, use of
the harbor or has fallen into a state of disrepair.
I am aware of an application, filed through Swift Slip to this office, that you intend to remove and
replace your entire pier structure. Harbor Resources has already issued your Approval In Concept
and Swift Slip has forwarded all paperwork to the appropriate agencies. However, the approval
process can be lengthy and I suspect you might have at least 2 months until construction may begin.
(Please verify with Swift Slip.) With this in mind, I am asking you to remove your float
immediately to eliminate any future personal or property damage. Please make arrangements with
your contractor, Swift Slip, to eliminate the hazard as soon as possible.

SUBJECT: HARBOR PERMIT APPLICATIONS 110-1304, 135-121, 144-23 and
258-305 FOR MAINTENANCE DREDGING
Recommendation
If desired, approve the Maintenance Dredging Harbor Permit Applications.
Discussion
This application.requires City Council approval under the.conditions of
approval of the City of Newport Beach "blanket." permit for maintenance
dredging issued on February 12, 1974, by the U. S. Army Corps of Engineers.
The locations and applicants for the proposed maintenance dredging are:
110-1304 Louis Hahn, 1304 E. Balboa Blvd.
135-121 William Hadley, 121 Harbor Island Drive
144-23 Richard Nabers, #23 Harbor Island
258-305 Peter Vail, 305 S. Bayfront
The staff has reviewed the proposed dredging and has determined that the
work to be done is within the parameters of the Corps of Engineers permit.
There is no anticipated adverse affect on proximity beaches or contigous
bulkheads.
Shellmaker, Inc., the dredging contractor, will minimize turbidity as much
as is possible and will barge the dredged material to the Environmental
Protection Agency's designated disposal site, four miles at sea.
