The proposed work would take place bayside of East Balboa Boulevard in Newport Bay within the city of Newport Beach, Orange County, California (Figure 1). This letter supersedes the previous letter dated February 14, 2014. Based on the information you have provided, I have determined that your proposed activity complies with the terms and conditions of Regional General Permit (RGP) No. 54-Maintenance Dredging and Beach Nourishment. ,As long as you comply with the terms and conditions of RGP No. 54, an individual permit is not required. Specifically, you are authorized to conduct the following regulated activities: 1. .Dredge up to approximately 723 cubic yards of sediment from approximately 0.096 acre of non -wetland waters of the United States using a six-inch hydraulic suction dredge (Figure 2). 2. Discharge up to approximately 723 cubic yards of the dredged sediment onto the adjacent beach below the High Tide Line, temporarily impacting approximately 0131 acre of non - wetland waters of the United States (Figure 2). Furthermore, you must comply with the following non -discretionary Special Conditions: 1. This letter of verification is valid through December 20, 2015. 2. A new pre -construction Caulerpa (Caulerpa taxifolia) survey shall be conducted in accordance with the Caulerpa Control Protocol (http://www.westcoast fisheries noaa goy/ ublications/habitat/calilerpa_taxifolia/caulerpa- contr of protocol 4 ndf) and submitted to the Corps Regulatory Division before project -related activities commence. Furthermore, a pre -project eelgrass survey shall be conducted in accordance with the Southern California Eelgrass Mitigation Policy (SCEMP) (httP://wwwwestcoast fisheries noaa gov/publicafons/habitat/ aliforriia eclorass mitigation/eel pohevll final.ndf) and submitted to the Corps Regulatory Division before project -.related activities commence. No work shall be conducted until a Notice to .Proceed is issued by the Corps Regulatory Division. 3. Within 45 calendar days of completion of authorized work in waters of the United States, the Pennittee shall submit to the Corps Regulatory Division. a post -project implementation memorandum including the following information: A. Date(s) work within waters of the United States was initiated and completed; B. Summary of compliance status with each special condition of this permit (including any noncompliance that previously occurred or is ctarently occurring and corrective actions taken or proposed to achieve compliance); and C. One copy of "as built" drawings for the entire project. Electronic submittal (Adobe PDF format) is preferred. All sheets must be signed, dated, and to -scale. If submitting paper copies, sheets must be no larger than 11 x 17 inches. 4. Pursuant to 36 C.F.R. section 800.13, in the event of any discoveries during construction of either human remains, archeological deposits, or any other type of historic property; the Permittee shall notify the Corps' Archeology Staff within 24 hours (Steve Dibble at 213-452- 3849 or John Killeen at 2(3-452-3861). The Permittee shall immediately suspend all work in any area(s) where potential cultural resources are discovered. The Permittee shall not resume construction in the area surrounding the potential cultural resources until the Corps Regulatory Division re -authorizes project construction, per 36 C.F.R. section 800.13. Tides higher than +6.0' MLLW are required for beach restoration work, and I simply ran out of days with sufficient tides before I could start this project (March and April do not have high enough tides during worldng hours). Favorable tides will return in June. As the agent, I erroneously showed the addresses as 1302-1316 E. Bay Ave. The correct addresses are 1302-1316 E. BALBOA Blvd. The error was due to a long vacated street shown on old drawings. I apologize for the error and for the extra time it will take you to correct my mistake. Stored in plastic containers and immediately delivered to the lab. SAMPLE PREPARATION Entire sample transferred into 1 liter glass containers, delonlzed water added, and mixed to desalt and disperse the sediment. The sediment is allowed to completely settle and the clear water is removed by siphoning. The sample is placed in a drying oven at 500C and occasionally stirred until the entire sample is completely dry. The dry sample is transferred to a desiccator for cooling. The sample is disaggregated and a Riffle sediment splitter is used to evenly split the sample to reduce the quantity of material to be analyzed to an allowable retention weight for the sieves. SAMPLE ANALYSIS The dry split fraction is processed through a # 10 U.S. standard sieve to remove the gravellshell fraction of the sample. The material retained on the sieve is weighed and value recorded. The material passing through the # 10 sieve is wet sieved through a #230 sieve to remove the silt/clay fraction. The material retained on the sieve is transferred back into the glass container and placed back into the drying oven at 50°C. The remaining sample is allowed to completely dry and the material is weighed and recorded to yield the sand fraction. The silt/clay fraction is calculated by subtracting the gravellshell and sand fractions from the total analysis weight. Unfortunately, I have finally made a mistake, and I am told that you are the one most likely to be able to help me with the problem I have created. The Commission recently reviewed and approved an application to dredge private docks at 1302-1316 E. Bay Ave. (Philip S. Doane, applicant). It has now been brought to my attention that E. Bay Ave. terminates at the 1400 block and is officially "vacated" in the 1300 block. Therefore, the correct address on the application and the surveys should have been shown as 1302-1316 E. Balboa Blvd, rather than 1302-1316 E. Bay Ave. The lots and docks shown on the application are one and the same; I simply got the changing street name wrong. Andrew Wendt, of the U. S. Army Corps of Engineers, has stated that he will correct their Notice to Proceed, with a condition that the Coastal Commission's approval be corrected as well. I am very hopeful that the correction is not a difficult one for your office to make. I apologize for the error and the extra work it creates for everyone concerned, and I will make every effort to be sure it does not happen in the future. Discussion This application requires City Council approval under the conditions of approval of the City of Newport Beach "blanket" permit for main- tenance dredging issued on February 12, 1974, by the U. S. Army Corps of Engineers. The locations and applicants for the proposed maintenance dredging are: 138-1 E. L. Overholt, #1 Harbor Island 139-11 Elsa Schaeffer, #1.1 Harbor Island 110-1306 C. Hermann, 1306 E. Balboa Blvd. The staff has reviewed the proposed dredging and has determined that the work to be done is within the parameters of the Corps of Engineers permit. There is no.anticipated adverse affect on proximity beaches or contigous bulkheads.
