BOX 532711 LOS ANGELES, CALIFORNIA 90053-2325 June 2, 2009 REPLY TO ATTENTION OF Office of the Chief Regulatory Division Tom Ahern C/o Lisa Walters City of Newport Beach, Harbor Resources Division 829 Harbor Island Drive Newport Beach, California 92660 Dear Mr. Ahern: This is in reply to your application (File No. SPL-2009-00417-MAS) dated May 19, 2009 for a Department of the Army Permit to discharge fill onto waters of the U.S., in association with the dredging of docks in Lower Newport Bay. The proposed work would take place at 1306 and 1310 E. Balboa Boulevard in Lower Newport Bay in the City of Newport Beach, Orange County, California (as shown on diagram). Based on the information you have provided, the Corps of Engineers has determined that your proposed activity complies with the terms and conditions of Regional General Permit (RGP) No. 54-Maintenance Dredging, Beach Nourishment, and Dock Maintenance. As long as you comply with the general permit conditions of RGP No. 54- Maintenance Dredging, Beach Nourishment, and Dock Maintenance, an individual permit is not required. Specifically, you are authorized to: 1. Dredge 310 cubic yards of material from 0.057 acres of Lower Newport Bay using a 6" hydraulic suction dredge 2. Place material along 140 linear feet of beach at 1306 and 1310 E. Balboa Boulevard -2- A general permit does not grant any property rights or exclusive privileges. Also, it does not authorize any injury to the property or rights of others or authorize interference with any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other Federal, State, or local authorizations required by law. Attached to this verification that your project is authorized by RGP 54 is an approved jurisdictional determination (JD). If you are not in agreement with that approved JD, you can make an administrative appeal under 33 CFR 331. Thank you for participating in our regulatory program. If you have any questions, please contact Melanie Stalder at 213.452.3294 or via e-mail at Melanie.A.Stalder@usace.army.mil. Please be advised that you can now comment on your experience with Regulatory Division by accessing the Corps web -based customer survey form at: http://pert.nwp.usace.army.mil/survey.html. C. SIGNIFICANT NEXUS DETERMINATION A significant nexus analysis will assess the flow characteristics and functions of the tributary itself and the functions performed by any wetlands adjacent to the tributary to determine If they significantly affect the chemical, physical, and biological integrity of a TNW. For each of the following situations, a significant nexus exists if the tributary, in combination with all of Its adjacent wetlands, has more than a speculative or insubstantial effect on the chemical, physical and/or biological integrity of a TNW. Considerations when evaluating significant nexus include, but are not limited to the volume, duration, and frequency of the flow of water in the tributary and its proximity to a TNW, and the functions performed by the tributary and all its adjacent wetlands. It is not appropriate to determine significant nexus based solely on any specific threshold of distance (e.g. between a tributary and its adjacent wetland or between a tributary and the TNW). Similarly, the fact an adjacent wetland Iles within or outside of a floodplain is not solely determinative of significant nexus. Significant Nexus: Not Applicable D. Where there is a break In the OHWM that is unrelated to the waterbody's flow regime (e.g., flow over a rock outcrop of through a culvert), the agencies will look for Indicators of flow above and below the break. - 71bid. 8-See Footnote 93. 9 -To complete the analysis rater to the key in Section III.D.6 of the Instructional Guidebook. 1e-Prior to asserting or declining CWA jurisdiction based solely on this category, Corps Districts will elevate the action to Corps and EPA HQ for review consistent with the process described in the Corps/EPA Memorandum Regarding CWA Act Jurisdiction Following Rapanos. https://orm:nsace.anny.rail/orin2/Pp=l06:34:465521773057104::NO:: 6/2/2009 ........ ........ ... y OF NEWPORT' HERCH CITY OF' NENPORT REAUJ *.IPORit T QD /-IR "'Z% 'A hAy J- iN RP wrml. Stored in plastic containers and immediately delivered to the lab. SAMPLE PREPARATION Entire sample transferred into 1 liter glass containers, deionized water added, and mixed to desalt and disperse the sediment. The sediment is allowed to completely settle and the clear water is removed by siphoning. The sample is placed in a drying oven at 50°C and occasionally stirred until the entire sample is completely dry. The dry sample is transferred to a desiccator for cooling. The sample is disaggregated and a Riffle sediment splitter is used to evenly split the sample to reduce the quantity of material to be analyzed to an allowable retention weight for the sieves. SAMPLE ANALYSIS The dry split fraction is processed through a # 10 U.S. standard sieve to remove the gravel/shell fraction of the sample. The material retained on the sieve is weighed and value recorded. The material passing through the # 10 sieve is wet sieved through a #230 sieve to remove the silt/clay fraction. The material retained on the sieve is transferred back into the glass container and placed back Into the drying oven at 50°C. The remaining sample is allowed to completely dry and the material is weighed and recorded to yield the sand fraction. The silt/clay fraction is calculated by subtracting the gravel/shell and sand fractions from the total analysis weight. Operator: Mark Sites — ExPuiauce_1982_to-Present-on-above-equipment — -----..—_ ------- Other: No barges or tugs are used. Typically, sand is pumped through a plastic pipeline to a nearby beach disposal / restoration site: Debris Management Plan 130 , 41316 , Ac lhac The sand to be removed fiom this site is quite clean, with little debris present. This observation comes from past dredging projects at this site. The dredge itself will not pass anything larger than a 4" sphere. Smaller objects, such as shells and cobble, may be pumped to the beach with the sand where they would be difficult to remove before becoming buried. However, shells are a common component of all bay beaches. .Most trash, such as plastics, bottles, and old boat covers, becomes lodged in the intake nozzle and creates a clog. The pumping operation is temporarily stopped while the nozzle is lifted and the debris removed and placed to the side for later disposal. Some smaller trash can pass through the pipeline and be deposited along with the sand on the beach. Being lighter than the sand, most of it tends to wash to the sides of the deposited sand along with the tail -water. After the dredging operation is complete, the beach is generally raked in order to level out high and low areas, and to remove any trash that might be on the beach. In addition, any lighter trash that has washed to the sides of the deposited fill is picked up as the tide drops and properly disposed of Eelgrass Survey Reporting Form (Version 1.0, .Tune 20, 2003) This form is required to be submitted for any surveys conducted for the eelgrass, Zostera marina, that are required to be conducted under federal or state permits and authorizations issued by the U.S. Army Corps of Engineers and the Coastal Commission.
