SUBJECT: NOTICE TO PROCEED (NO. 95-00178-BH)
Dear Mr. Melum:
Reference is made to your letter dated February 7, 1995 in which you submitted on
behalf of Ms. Lillian Lumpkin at 1314 E. Balboa Boulevard, a notification for the maintenance
dredging of 225 cubic yards of sand and silt material by hydraulic suction and disposal of the
dredged material at an adjacent beach replenishment area.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89-211-
GS provided that Ms. Lumpkin's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot. Please note that the
drawing enclosed with the notice indicated that the proposed dredge depth is -6 feet MLLW.
Dredging to this depth is not authorized under the terms and conditions of Permit No. 89-
211-GS. As noted above, dredging to a design depth of -5 feet MLLW is authorized. The
maximum overdepth of -1 foot is to allow for situations that may be difficult to control on
the part of the City or the property owner's contractor. Dredging to a design depth of
greater than -5 feet MLLW would be a violation of the terms and conditions of Permit No.
89-211-GS.

SUBJECT: NOTICE TO PROCEED
Dear Mr. Melum:
Reference is made to your letter (No. 94-381-BH) dated
January 26, 1994 in which you submitted on behalf of Lilian
Lumpkin at 1310-1320 E. Balboa Boulevard a notification for the
maintenance dredging of 200 cubic yards of sand and silt material
by hydraulic suction and disposal of the dredged material by
pipeline transport to a beach reclamation area.
Based on the furnished information, we have determined that
the proposed maintenance dredging activity complies with the
terms and conditions of Permit No. 89-211-GS provided that Ms.
Lumpkin's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1
foot MLLW.

Development Description: Demolition of existing 5' x 20' dock and construction of a _
3' x 32' dock in conjunction with an existing single-family dwelling. Project has RWQCB,
State Lands and Corps of Engineer approvals. Project is between the first public road
and the sea Adequate access exists in the area.
I. The Executive Director of the South Coast Regional Commission hereby grants, subject. to
condition(s), a permit for the proposed development, on the grounds that the development
as conditioned will be in conformity with the provisions of Chapter 3 of the California
Coastal Act of 1976, will not prejudice the ability of the local government having juris-
diction over the area to prepare a Local Coastal Plan conforming to the provisions of
Chapter 3 of the Coastal Act, and will not have any significant adverse impacts on the
environment within the meaning of the California Environmental Quality Act.

13170 of the Coastal Commission Rules and Regulations.
IV. This permit shall not become effective until:
A. Completion of the Regional Commission review of the permit pursuant to the notice

B. A copy of this permit has been returned to the ,.egional Commission, upon which copy
all permitees or agent(s) authorized in the permit application have acknowledged
that they have received a copy of the permit and have accepted its contents.
V. Any development performed on this permit prior to the review by the Regional Commission
is at the applicant's risk and is subject to stoppage upon completion of the review
pending the Regional Commission's approval and/or completion of any appeal of the
Regional Commission's decision.
VI. Work authorized by this permit must commence within two years from the date of approval.
Any extension of time of said commencement date must be applied for prior to expiration
of the permit.

Recommendation.
If desired, approve the application subject to the conditions listed in the staff
report of September 8, 1980 (attached).
Discussion: -
On September 8, 1980, the Marina Department received a telephone call from a
Mrs. Bradford indicating she was the property owner at 1316 E. Bay, the property
that is adjacent to the applicant's property.
Mrs. Bradford stated she had some reservations about the applicant's planned
revision and would like to go on record by a letter to the Marine Department
stating the specifics.
The applicant was contacted and agreed to have the application continued so that
this matter could be resolved.

able to contact her. Staff has again reviewed the project in the field and sees

Discussion:
The prior approval of the City Council is required on this application be-
cause the float, as revised, will not conform to the standard harbor draw-
ings.
The applicant wishes to revise the existing structure which currently -con-
sists of a rectangular float 10' x 20'. This float will be reduced to a
5' x 20' rectangular float and a 3' x 32' hold -off float will be installed
five (5) feet from the most westerly.property line.
This new configuration will allow the applicant a more secure berthing
space for their vessel than the current 10' x 20' float provides.

Before Mrs. Sophia Rickenbaugh starts
the remodelling of her existing float, I request that
an existing survey be looked up. I am very sure that
one was made when remodelling was done at 1316 East
Balboa Blvd. in the late 1960's. It e,ould iLther have
been made by my contractor, Mr. Warnec.,e, or by Mrs,
Rickenbaugh or Mr. Lumpkin at 131E Balboa. As I re-
member, the existing float of the Rickenbaugh's was a
few feet over on my property, As it is constantly
hitting into my float, I should like to recommend that
the existing pilings be moved at this time of remodelling
at 1318, as I am very sure if any problems in the
future occur because of the float changes, the cost to
them would be an additional sum of money, and I thin~;
roblem should be dealt with at this time.

Reference is made to your request of 22 June 1976 (76-131). Upon the
recommendation of the Chief of Engineers and under the provisions of
Section 10 of the River and Harbor Act of March 3, 1899 (33 U.S.C. 403),
you are hereby authorized by the Secretary of the Army to modify an
existing dock at 1314 East Balboa Boulevard, Lot 8, Tract Eastside
Addition, in Newport Bay, Pacific Ocean, City of Newport Beach, Orange
County, California, as shown on the attached drawing and subject to the
attached conditions (a) through (v).
Notice of the commencement of the activity must reach this office at
least five (5) days before the activity actually starts. Please use the
inclosed forms.

Recotmnendation:
If desired, approve the application subject to:
1. Approval of the U.S. Army Corps of Engineers.
2. Approval of the South Coast Regional Zone Coastal Commission.
Discussion:
The prior approval of the City Council is required on this application be-
cause the float, as revised, will not conform to the standard harbor draw-
ings.
The applicant wishes to revise the existing structure which currently con-
sists of a rectangular float 10' x 20'. This float will be reduced to a
5' x 20' rectangular float and a 3' x 32' hold -off float will be installed
five (5) feet from themost westerly property line,.
This new configuration will allow the applicant a more secure berthing
space for their vessel than the current 10' x 20' float provides.
