SUBJECT: California Board of Corrections Grant Award
"Every 15 Minutes — Substance Abuse Program "
RECOMMENDATION:
1. Approve acceptance of a $19,228 grant from the State of California, Board of
Corrections (BOC A301).
2. Approve a budget amendment increasing expenditure appropriations by $19,228 in
the Police Substance Abuse Program Account 1850 -9019. (The remaining $2,136
of required City matching funds will be funded from the Police Department's
Narcotics Asset Forfeiture Fund in Account 1210 - 9300.)
DISCUSSION:
The Police Department has successfully provided substance abuse program (SAP)
classes to first time juvenile offenders for more than a decade. Youthful offenders
facing potential criminal penalties for alcohol or drug charges have been referred to
SAP as an alternative to sending them to the juvenile courts. In conjunction with the
SAP classes, the Police Department has added the juvenile safety education program,
"Every 15 Minutes," which is focused towards high school aged children.
The Program's name was derived from the fact that in the early 1990's, every 15
minutes someone in the United States died in an alcohol - related traffic collision. Due to
the implementation of new laws, along with grass roots programs (like MADD, SADD,
"Friday Night Live," and "Every 15 Minutes"), and improved emergency medical services
at crash scenes, the death rate is now every 30 minutes —a figure that continues to be
unacceptable. The "Every 15 Minutes" training event is a two -day program focusing on
high school juniors and seniors, which challenges them to think about drinking, driving,
. personal safety, the responsibility of making mature decisions, and the impact their
decisions have on family, friends, and many others.

Last year, the Program was successfully presented at Newport Harbor High School. It
was funded by a similar grant from the Governor's Office of Criminal Justice Planning
(OCJP). Because of the State's financial difficulties, OCJP was closed, and their grant
management responsibilities dealing with this specific area of focus were transferred to
the California Board of Corrections (BOC). This year, the Newport Beach Police
Department plans to continue the Program, "Every 15 Minutes," at Corona Del Mar High
School. If funding continues in the future, we plan to alternate this annual presentation
between the Newport Harbor and Corona Del Mar campuses. The Program is intended
to establish and maintain an accountability -based program designed to protect students,
school personnel, and the general public from alcohol and drug- related incidents,
crimes, and traffic collisions involving youthful offenders.
The grant funds cover the costs of producing the two -day training event, along with
some funds for eauiament to improve our presentations in the schools. There are no
personnel costs included in the allocation.
Background:

The City of Newport Beach received a grant award for the "Every 15 Minutes - Substance
Abuse Program" Project in the amount of $19,228 from the State of California, Board of
Corrections (BOC). That funding was deposited into the Every 15 Minutes- Substance .
Abuse Program Revenue Account.
Environmental Review:
None required.
Funding Availability:
This is a grant- funded program.
CONCLUSION:
Approve the recommendations as outlined in the report, thereby allowing the
Department to continue to offer this worthwhile program to Newport Beach Public High
Schools.

II. Drug -Free Workplace Act of 1990 -(Grantee Handbook Section 2152)
The State of California requires that every person or organization awarded a grant or
contract shall certify it will provide a drug free workplace.
III. California Environmental Quality Act (CEQA) - (Grantee Handbook Section 2153)
The State of California requires all BOC funded projects to obtain written certification that
the project is not impacting the environment negatively.
IV. Lobbying —(Grantee Handbook Section 2154)
BOC grant funds, grant property, or grant funded positions shall not be used for any
lobbying activities, including, but not limited to, being paid by or on behalf of the
undersigned, to any person for influencing or attempting to influence an officer or employee
of any agency, a Member of Congress, an officer or employee of Congress, or an employee
of a Member of Congress in connection with the making of any federal grant, the entering
into of any cooperative agreement, and the extension, continuation, renewal, amendment, or
modification of any federal grant or cooperative agreement.
V. Debarment and Suspension — (Grantee Handbook Section 2155)
(This applies to federally funded grants only)
BOC funded projects must certify that it and its principals are not presently debarred,
suspended, proposed for debarment, declared ineligible, sentenced to a denial of federal
benefits by a state or federal court, or voluntarily excluded from covered transactions by any
federal department of agency.
VI. Proof of Authority from City Council /Governing Board
The above -named organization (applicant) accepts responsibility for and will comply with the
requirement to obtain written authorization from the city council /governing board in support
of this program. The Applicant agrees to provide all matching funds required for said project
(including any amendment thereof) under the Program and the funding terms and conditions
of BOC, and that any cash match will be appropriated as required. It is agreed that any
liability arising out of the performance of this Grant Award Agreement, including civil court
actions for damages, shall be the responsibility of the grant recipient and the authorizing
agency. The State of California and BOC disclaim responsibility of any such liability.
Furthermore, it is also agreed that grant funds received from BOC shall not be used to
supplant expenditures controlled by the city council /governing board.
The Applicant is required to obtain written authorization from the city council /governing
board that the official executing this agreement is, in fact, authorized to do so. The
Applicant is also required to maintain said written authorization on file and readily available
upon demand.

All appropriate documentation must be maintained on file by the project and available for
SOC or public scrutiny upon request. Failure to comply with these requirements may
result in suspension of payments under the grant or termination of the grant or both and
the grantee may be ineligible for award of any future grants if the BOC determines that any
of the following has occurred: (1) the grantee has made false certification, or (2) violates
the certification by failing to carry out the requirements as noted above.
