Based on the information you have provided, the Corps of Engineers has determined that your proposed activity complies with the terms and conditions of Regional General Permit (RGP) No. 54- Maintenance Dredging, Beach Nourishment, and Dock Maintenance. As long as you comply with the general permit conditions of RGP No. 54, an individual permit is not required. Specifically, you are authorized to: 1. Dredge 180 cubic yards of sediment over a 0.024-acre area using 6" hydraulic suction; and 2. Dispose dredged material on adjacent beach over a 0.035-acre area (85 linear feet). A general permit does not grant any property rights or exclusive privileges. This letter of verification is valid until October 4, 2011. Also, it does not authorize any injury to the property or rights of others or authorize interference with any existing or -2- proposed Federal project. The sediment is allowed to completely settle and the clear water is removed by siphoning. The sample is placed in a drying oven at 50°C and occasionally stirred until the entire sample is completely dry. The dry sample is traw sferred to a desiccator for cooling. The sample is disaggregated and a Riffle sedime it splitter is used to evenly split the sample to reduce the quantity of material to bE analyzed to an allowable retention weight for the sieves. SAMPLE ANALYSIS The drysplit action is processed through a # 10 U.S. standard sieve to remove the gravel/shell f action of the sample. The material retained on the sieve is weighed and value record . The material passing through the # 10 sieve is wet sieved through a #230 sieve tc remove the sili/clay fraction. The material retained on the sieve is transferred bi ick into the glass container and placed back into the drying oven at 50°C. The remainin sample Is allowed to completely dry and the material is weighed and recorded to y aid the sand fraction. The siWelay fraction is calculated by subtracting the gravel/sh II and sand fractions from the total analysis weight. The Wilsons own the house situated at 1322 East Balboa Boulevard and are strongly opposed to the construction of a pier which would extend sixteen feet beyond the U.S. Pierhead line. Our foremost concern is that such a departure from the Pierhead line would create a substantial navigational hazard and would undoubtedly result in serious damages and injuries during the future years. In addition, the extension of a neighboring pier for such an additional distance would substantially impair and interfere with my clients' use of their pier and create a significant hazard. While we have no objections to Mr. Ortega repairing or replacing his existing pier, that construction should not be undertaken in a way which results in a material detriment to the harbor and to the adjoining neighborhood. The applicant must comply with Section 15 of the Harbor Permit Policies. Discussion: This application is before the City Council as required by Section 5.B, of the Harbor Permit Policies, which state: 5.B. "Prior approval of the City Council will be required before the Marine Department may issue any permit that does not conform to standard drawings and the adopted Harbor Permit Policies". Piers in this general area of the harbor are allowed to extend 16 feet channelward of the U.S. Pierhead line. In this particular location, however, the docks have historically held back. From the corner of F street west, the floats are basically on a line approximately 16 feet back from the U.S. Pierhead line. To allow the current applicant to extend the float bayward as far as is proposed could pose a hazard to navigation, by creating a break in the bayward line of existing floats. Additionally, the float size proposed by the applicant could effectively double the size of the boats berthed there. This could then necessitate more dredging in the area, to the detriment of the sandy, sloping beaches along this block. The proposed large float and the large vessels it could subsequently accomodate might also affect the use of the existing dock at 1322/1324 East Balboa Blvd. As the attached drawing suggests, this is a request for a joint pier to be shared by the property owners at 1318 and 1320 East Balboa. For this reason the proposed float is located on the common property line. Balboa Blvd. Balboa, California 92661 Space above this line for recorder's use COMMON RESIDENTIAL PIER AGREEMENT THIS AGREEMENT IS MADE this day of August, 1985, by and between JOHN ORTEGA II and VONNA WILKINS ORTEGA, husband and wife, hereinafter referred to as "Ortega," and ELIZABETH MC GLOHN, hereinafter referred to as "Mc Glohn," who agree as follows: WHEREAS, Ortega is the owner of certain real property located at 1318 East Balboa Blvd., Balboa, California, more particularly described in Exhibit "A," which is attached hereto and made a part hereof by reference; and WHEREAS, Mc Glohn is the owner of certain real property located at 1320 East Balboa Blvd., Balboa, California, which is more particularly described in Exhibit "B," which is attached hereto and made a part hereof by reference; and WI:EREAS, the properties of Ortega and Mc Glohn are adjoin- ing properties, having common boundry lines; and WHEREAS, the parties hereto desire and intend to demolish an existing pier which is bayward of the Ortega property and construct a new and larger residential pier to be located on the dividing line between the premises of the parties, it being contemplated that said pier shall be divided equally, one half of said pier extending bayward on the Ortega property and the other half of said pier extending bayward of the Mc Glohn property; and WHEREAS, it is the desire of the parties to set forth their respective rights, duties, and obligations with respect to the construction, enjoyment, use, maintenance and other aspects of said residential pier, NOW, THEREFORE., for good and valuable consideration re- ceipt of which is. hereby acknowledged, and the mutual covenants and agreements herein contained, the parties hereto do hereby agree for themselves, their respective heirs, and assigns as follows: 1. The parties hereto are hereby permitted to erect the common residential pier as herein described pursuant to the conditions of this Agreement. 2. For the purpose of erecting, using, enjoying, main- taining or repairing said residential pier as may be herein provided, each party is licensed by the other to enter upon the other parties premises to the extent necessary to exercise to rights provided in this Agreement. 3. The residential pier shall be located bayward of the parties' respective residential properties and the midline of said residential pier shall be an extension of the boundry line between each of the respective property owned by the parties hereto. Said residential pier is more fully described in the drawing which is attached hereto, marked Exhibit "C," and made a part hereof by reference. 4. The new residential pier, whether original, recon- structed, or restored, or any extension or addition to the same, shall be in a good, substantial, and workman like manner in strict conformity with the laws, ordinances and regulations of the City of Newport Beach and the State of California regulating the construction of such piers and in conformity with what is considered to be "good construction,'" within the industry which builds such residential piers. 5. The cost and expense of the demolition of the exist- ing pier and the construction of the new pier shall be borne by the parties as follows: (a) The cost of the extraction, removal and demolition of the existing pier located in front of the Ortega premises which has been estimated to cost $6,200.00 shall be paid by Ortega paying two-thirds of the cost thereof and Mc Glohn paying one- third of the cost thereof. (b) The cost of the construction of the new residential pier contemplated by this Agreement shall be borne equally by the parties, each party paying. one-half thereof. It is under- stood that the estimate for the construction of said residen- tial pier, as of the date of this Agreement, is in the amount of $28,872.00, excluding permits, running of utilities, etc. -2- 6. The parties hereto shall have the right to use and enjoy the whole of the residential pier, regardless of where the median line thereof exists, however, Ortega shall be only allowed to tie a vessel or utilize the westerly side of the residential pier. Furthermore, Mc Glohn shall only be allowed to tie a vessel or utilize the side on the easterly side of said residential pier. Either party shall be allowed to store supplies and objects on the pier only on. the side on which they have the right to tie a vessel. 7. Either party may tie their own vessel to their respective side of the pier or it is contemplated that either party may, if the event arises, rent their side of the pier to a tenant or licensee. 8. Neither party, nor their tenants or licensees who may be utilizing either side of the residential pier shall inter- fere with the quiet enjoyment of the other side of the pier or of the residential uses landward of the residential pier. To this extent, any tenant or licensee which is utilizing either side of the pier shall not be permitted to live aboard a vessel. Furthermore, tenants or licensees of either parties shall be duly notified of the rights of quiet enjoyment granted under this agreement. In the event a licensee or tenant continues to disturb the quiet enjoyment of either of the parties to this Agreement or their tenants or licensees to either the residen- tial pier or the residential premises, then and in that event, the complaining party (either Ortega or Mc Glohn) may give notice to the other party and demand arbitration concerning the continued use of the residential pier by the individual com- plained of. It is contemplated by this Agreement that because of the nature of the Agreement that the parties hereto shall cooperate with each other to the fullest extent possible in order to minimize conflicts. 9. The cost of electrical and water service to the residential pier shall be borne by the parties on a equal basis. However, in the event a vessel is not utilizing one of the parties' side of the residential pier and such non-use is for thirty (30) consecutive days or more, then and in that event, the party who is not utilizing their respective side of the pier shall not have any liability for utilities used on the residen- tial pier. 10. The parties hereto each agree to maintain liability insurance for the use of the residential pier in question. It is contemplated that such liability insurance shall be in conjunction with the homeowner's liability policy on the prem- ises of the respective party. The limits of the liability for each party shall, at this time, be in the amount of not less than One Million Dollars and each party shall, on their respective policy of liability insurance, name the other party as an -3- additional insured. The parties shall, every five (5) years from the date of this Agreement, review the amounts of liability insurance provided pursuant to this Agreement. At such time, they shall adjust the liability insurance, if necessary. In the event there is a controversy concerning the liability insurance coverage, the parties hereto shall submit the matter to arbi- tration as hereinafter provided. 11. Each party agrees to hold and maintain the other party free and harmless from any injuries, damages, claims or suites resulting from any acts of negligence or other acts on the residential pier committed by such party agreeing to hold and defend the other party harmless. 12. While live aboards are not contemplated under the terms of this Agreement, occasional weekend visits to vessels or a live aboard by a skipper shall not be considered as violative of this Agreement so long as such actions do not disturb the quiet enjoyment of the other parties rights under this Agreement or of the quiet enjoyment of the premises which are landward of the residential pier. 13. If it shall become necessary to repair or rebuild the residential pier or any portion thereof as constructed, the cost of such repairing or rebuilding, including annual main- tenance such as painting, shall be at the expense of both parties in equal shares. In the event of any emergencies requiring immediate attention, eitherpartymay authorize such repairs. However, for any expenses over $500.00, the consent of both parties will be required to undertake such repairs or maintenance. In the event a disagreement arises as to repairs which are in excess of $500.00, the parties hereto agree to submit the matter to arbitration as hereinafter set forth. 14. In the event the residential pier is wholly or partially destroyed by fire or other cause, the parties hereto, their successosrs, heirs, or assigns shall be obligated to reconstruct the same and each of the parties shall bear the expenses therefore. 15. This Agreement shall be perpetual and the terms of this Agreement shall be incorporated into a restrictive coven- ant running with the land; provided, however, nothing herein contained shall be construed as a conveyance by either party of his respective rights in the fee of the land upon which the residential pier shall be attached. This Agreement shall be recorded by the parties hereto. 16. This instrument contains the entire Agreement be- tween the parties relating to the rights herein granted and the obligations herein assumed. Any oral representations or mod- ifications concerning this instrument shall be of no force and effect excepting a subsequent modification in writing, signed -4- by the party to.be charged. 17. In the event of any controversy, claim, or dispute between the parties hereto, arising out of or relating to this Agreement or any breach thereof, the prevailing party shall be entitled to recover from the losing party reasonable expenses, attorney's fees and costs. 18. Any dispute hereunder shall be submitted to arbitra- tion under the rules of the American Arbitration Association. 19. This Agreement shall bind and inure to the benefit of the respective heirs, personal representatives, successors and assigns of the parties hereto. CALIFORNIA BOOSB REPLY TO 'ATTENTION OF: SPLCO-R TO WHOM IT MAY CONCERN: General Permit GP004 Newport Bay August 19, 1983 The District Engineer, Los Angeles District, Corps of Engineers announces the renewal of General Permit 004, covering the installation of privately - owned boat docks in Newport Bay, a Navigable Water of the United States, as required by Section 10 of the River and Harbor Act of 3 March 1899. This permit is issued in accordance with the provisions of 33 CFR 320, 322, 325-26, and, 328-29, titled, "Regulatory Program of the Corps of Engineers" which provides that the District Engineer may issue a general permit for activities which are substantially similar in nature, that cause only minimal adverse environmental impacts when performed separately and have minimal adverse cumulative effect on the environment. Upon issuance of a general permit, all .activities meeting the established criteria are approved and will not require the submission of individual permit applications. This renewed general permit also authorizes the modification and replacement of existing boat docks but not the installation of new boat docks where none exist in Dover Shores and around the perimeter of Balboa Island. Under no circumstances will the general permit allow boat dock construction requiring bulkheading, dredging, or filling below the Mean High Water (MHW) elevation or in wetlands. Construction of a boat dock will not be allowed across any beach designated for community or public use, unless the new dock will replace an existing dock and cause no additional encumbrances on beach recreation. Typical drawings, depicting the most common types of installations that are covered by this general permit, are included in this notice along with a map showing those Navigable Waters of the United States where the general permit is applicable. The general permit covers both existing and proposed facilities within any of the private property boundaries shown on the attached drawings. Individual boat docks that do not conform to the established general criteria will require an individual permit. The general permit is not applicable to commercial or public marinas. That all activities identified and authorized herein shall be consistent with the terms and conditions of this general permit; and that any activities not specifically identified and authorized herein shall constitute a violation of the terms and conditions of this general permit which may result in the institution of such legal proceedings as the United States Government may consider appropriate, whether or not this general permit has been previously modified, suspended, or revoked in whole or in part. b. That the permittee agrees to make every reasonable effort to prosecute the work authorized herein in a manner so as to minimize any adverse impact of the work on fish, wildlife, and natural environmental values. c. That the permittee agrees to prosecute the work authorized herein in a manner so as to minimize any degradation of water quality. d. That the permittee shall permit the District Engineer or his authorized representative(s) or designee(s) to make periodic inspections at any time deemed necessary in order to assure that the activity being performed under authority of this general permit is in accordance with the terms and conditions prescribed herein. e. That the permittee shall maintain the structure or work authorized herein in good condition and in accordance with the drawings attached hereto. f. That this general permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and that it does not authorize any injury to property or. invasion of rights of any infringement of Federal, State, and local laws or regulations, nor does it obviate the requirements to obtain State or local assent required by law for the activity authorized herein. g. That this general permit does not authorize the interference with any existing or proposed Federal Project and that the permittee shall not be entitled to compensation for damage or injury to the structures or work authorized herein which may be caused by or result from existing or future operations undertaken by the United States in the public interest. h. That this general permit may be summarily suspended, in whole or in part, upon a finding by the District Engineer that immediate suspension of the activity authorized herein would be in the general public interest. I. That this general permit may be either modified, suspended, or revoked, in whole or in part, if the Secretary of the Army or his authorized representative determines that there has been a violation of any of the terms or conditions of this permit or that such action would otherwise be in the public interest. Any such modification, suspension, or revocation shall become effective thirty (30) days after publication of written notice of such action which shall specify the facts or conduct warranting same. 3 w J. That any modification, suspension, or revocation of this general permit shall not be the basis for any claim for damages against the United States. k. That no attempt shall be made by the owner to -prevent the full and free use by the public of all ,navigable waters at or adjacent to the activity authorized by this general permit: 1. That if the display of lights and signals on any structures or work authorized herein is not otherwise provided for by law, such lights and signals as may be prescribed by the United States Coast Guard shall be installed and maintained by and at the expense of the permittee. m.
