RECOMMENDATION: 1. Advise staff and provide comment on the proposed dock and pier configuration. FUNDING REQUIREMENTS: There are no funding requirements. DISCUSSION: The applicant proposes to reconfigure the existing dock and pier structure at 1322-1324 E. Balboa Blvd (Attachment A- Vicinity Map). The existing pier is approximately 800 square feet: 95' x 4' pier approach; 10' x 20' pier platform; 20' x 3' gangway; and 24' x 10' floating platform. In 1997, staff issued a Harbor Permit for pile replacement with the permit condition that two (2) 32-foot maximum length vessels may legally berth. For two vessels to berth at the subject pier they must be side -tied. The eastern edge of the float has a zero setback to the property line, which borders the F Street street=end. NBMC 17.35.020(B)(1) states that all piers for residential properties be set back a minimum of five feet from the prolongation of the property line. The reconfiguration proposes a structure of approximately 791 square feet: a minimized pier approach of 80' x 4'; pier platform of 165 square feet; 24' x 3' gangway; and 36' x 6.5' floating dock offset from the property line by at least one (1) foot (Attachment B- Proposed Configuration). This configuration aims to bring the float landward to provide the west side berth with a slightly larger area so that the vessel does not encroach beyond the side property line. The proposal increases the setback to at least one foot at the F Street property line reducing the street -end encroachment as well. Proposed Dock & Pier Configuration, 1322-1324 East Balboa Blvd October 13, 2014 Page 2 The current configuration is a case in which the property lines converge to a point so that when properly berthed both permitted vessels encroach over the property lines on either side. Newport Beach Municipal Code ("NBMC") 17.25.020(C)(1) states that boats berthed at private or public piers shall not extend beyond the projection of the property lines of the property to which the pier is connected. The proposed structure nearly eliminates the encroachment over the west property line. Since at least the 1980's the property owners at 1322 and 1324 have shared joint responsibility for the pier permit. NBMC 17.35.020(A)(10) grants residential pier permits for shared piers at the prolongation of common lot lines, such as 1322 and 1324 E. Balboa Blvd. Staff has conducted field surveys of the street end and moorings. At least since 1988 the property owners and mooring permittees have worked together in this formation. In other areas of the harbor, such as Balboa Island, it is common for vessels to berth and moor closely. Records indicate that the current structure has existed in this configuration since at least the 1960's. Staff supports the application for the reconfiguration, with the added conditions that limit the beam width of the both 32' vessels: At the 1324 E. Balboa and F Street property line the maximum allowable beam width is limited to 15 feet; and that on the side of 1322/1320 E. Balboa Blvd the maximum allowable beam width is limited to ten feet. ENVIRONMENTAL REVIEW: Staff recommends the Harbor Commission find this project exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15301, Class 1, (Existing Facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: This agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the Harbor Commission considers this item). Balboa Blvd. Ms. Levin, We reside at 1320 E. Balboa Boulevard and are the neighbors of 1322 (Miller) and 1324 (LeBeau). Miller and LeBeau maintain a shared pier and float adjacent to our dock at 1320 E. Balboa. We are aware that Mr. LeBeau has spent considerable time, together with his neighbor Mr. Miller and their consultant Pete Swift of Swift Slips to reconfigure the float and pier. The focus of the collective efforts has been to ease access to both our docks by increasing the distance between our perspective floats, We support the attached plan as it sheds 2.5 feet off the north side of the dock and moves the patio back towards the beach some 10 feet allowing for a longer, albeit substantially narrower float. The end results creates more distance between our docks and the longer float will allow for the boats to dock closer to the beach, in the area that provides for the greatest distance between our perspective docks. After reviewing the file there is an exception with this property allowing for the encroachment of a vessel onto that street end. In a Harbor Permit dated December 22, 1997 Wes Armand conditioned the permit to allow the berthing of two 32 foot maximum length vessels at this subject pier. At this time staff has determined that upon reconstruction or reconfiguration of the pier the 1997 permit will be invalidated and new or revised conditions may be placed upon the pier. i t7 W 7 b a ayy LLLL LL y W r2 n o E a yyryry Wi S a 1'7 22. 7y--5m 01 - Lo GI la; - -T' i r a- c, . i, . - CITY OF 1 ! ;.-. Fuchs Real Estate 700 East Balboa Blvd. Balboa., Calif. 92661 Dear Paul: Enclosed is the map I have of our property at 1324 E. Balboa Blvd. I .found this in the old files in the house when we purchased it in 1.968 from Mrs. Wi.11ock. fhe new pier and dock had been constructed about five ,years prior to that time I be.lieve.(R.eplacing the old one). The former owners ha.d a boat tied to our side for many ,years, as dial we. Ours was about 26' 'long. As you know, we own the dock jointly with the '+i.l.sons. From the.. early days they have used their side for their boat, and the owners of our house (there have been two prior to us since it was built in 1915) have used our sid.e. There has never been a problem. By coincidence, last Saturday our son and his wife were visiting us here fro -it Newport Beach Heights where they .Live. They invited over their good friends (who were vacationing in Santa Barbara for the weekend) to our home for refreshbents and conversr?t.ion. By sheer coincidence, it turned out to be Mr. & Mrs. "Pony Mel.um.* lie is the Tidelands Administrator of the City of Newport Beach, which Depar- ment is responsible for easernents,'beaches, piers and docks, etc. on the Bay. I. aoo..ed him the ericlu:;eu map, and he said as long as t4:e boat ;:as not disabled, and not lunger than the dock, there should be no problem. If the hettangill.'s boat is 28' or less, ana is properly re;:aired, Melum should be contacted for further information and verification that it will be O.K. (And probably to so infor(ri'•the harbor Patrol). Mrs. Pettengil.l said she thought "It is ❑,p to Mr. Langone to do this as he arranged everything for the lease." She said they're leaving; tomorrow on a. trip, and the boat is moored temporarily in an expensive place that's "costing us a. .lot of money". Please let me know if you have any questions or suggestions, Paul. Many thanks for taking care of this, if possible. Stored in plastic containers and immediately delivered to the la SAMPLE PREPARATION Entire sample transferred into 1 liter glass containers, deionized water added, and mixed to desalt and disperse the sediment. The sediment is allowed to completely settle and the clear water is removed by siphoning. The sample is placed in a drying oven at 50°C and occasionally stirred until the entire sample is completely dry. The dry sample is transferred to a desiccator for cooling. The sample is disaggregated and a Riffle sediment splitter is used to evenly split the sample to reduce the quantity of material to be analyzed to an allowable retention weight for the sieves, SAMPLE ANALYSIS The dry split fraction is processed through a # 10 U.S. standard sieve to remove the gravel/shell fraction of the sample. The material retained on the sieve is weighed and value recorded. The material passing through the # 10 sieve is wet sieved through a #230 sieve to remove the silt/clay fraction. The material retained on the sieve is transferred back into the glass container and placed back into the drying oven at 500C. The remaining sample is allowed to completely dry and the material is weighed and recorded to yield the sand fraction. The silt/clay fraction is calculated by, subtracting the gravel/shell and sand fractions from the total analysis weight.
