Further, they have requested that we contact you on this first recorded offense. The placement of any fill material in the bay is an illegal act, punishable by federal action, unless prior approval is granted by the Army. The material must be analyzed for con- taminant content before being placed anywhere within the harbor. The analysis of samples is an expense to be born by the tidelands user, and the samples must meet certain stand- ards. The standards are reviewed by the Environmental Pro- tection Agency, the California Fish and Game, the Regional Water Quality Control Board, and the Department of Interior, River Basin Studies. Since this activity is now under very close surveillance by the Corps of Engineers, and other agencies, we strongly suggest that you contact this department before any further fill mater- ial is contemplated to be placed along the shoreline. The permit procedure must now be strictly adhered to; or, as the Army related to us, they will file with the Attorney General for prosecution. This letter is written in order to inform you of the situation in the event you were previously not aware of it. If you have any questions, please feel free to contact the U. S. Your comments were discussed with Mr. Dave Harshbarger of the Marine Safety Department, City of Newport Beach. He advised us that the correct set back of a boat dock from the property line is 5-feet rather than the 4-feet as stated in your letter. He also told us that there is no restriction on docking a boat within this 5--foot space providing, of course, that the beam of the boat is such that it does not extend over the property line. It appears that this reconstruction of Mr. Pittroff's dock will improve access between the beach and .the open bay area. We sincerely appreciate your interest and taking the time to write to us about it. if you still feel that there is an infringement of yours or someone else's property rights, we auggest that you contact Mr. Harshbarger. BALBOA BOULEVARD Recommendation If desired, approve the permit subject to (1) the approval of the U. S. Army Corps of Engineers and (2) the applicant guarantee the City that construction of the seawall will commence upon final approvals by the Corps of Engineers and the City. Discussion The subject harbor permit application requires City Council approval because the proposed seawall would be constructed 30' bayward of "Vacated East Bay Avenue". The Harbor Permit Policies (Section 16 Bulkheads) was amended by Council in June of 1973. The following paragraph, applicable to these pending permits states: "The Marine Safety Department may.issue permits for bulkheads, between U. S. Bulkhead Station Numbers 112-109 not to exceed the bayward side of the 'Vacated East Bay Avenue'. Concrete bulkheads and wooden retaining wall structures proposed to be constructed bayward of the bayward most line of Vacated East Bay Avenue shall be subject to City Council approval." On cFebrua-r_y 2,5, seven of the eight property owners bordering the Bay between F & G Streets on the Balboa Peninsula received Council approval to construct a wooden seawall 30' bayward of Vacated East Bay Avenue. The eighth was the ,applicant, Mr. Pittroef, who chose not to seek approval at that time. Mr. Pittroef now desires Council approval to permit construction of a wooden seawall bay - ward of his home that will connect to the previously approved seawalls. Page Two As shown on the attached sketch dated 1-25-13, the property owners to the immediate east and west of the subject location would have had to construct return walls should the applicant chose not to construct his portion of the total seawall. To assure the City as well as his neighbors that these return walls will, in fact, not be needed staff recommends that the applicant guarantee..in writing to the City that he will begin construction on his portion of the seawall upon receiving Corps of Engineers approval and issuance of a City Harbor Construction Permit. Last year I removed the house and con- structed a new home. I moved the old property back to meet with standard variances required by the City. At present the land adjacent to my property (1401 East Bay) has a pier located up against the property line. I believe the City requires a 5 foot set -back.
