September 9, 1995, at which time it was determined that it conforms
to City standards.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0109-1515-1 for the property located at
1515 East Day Avenue, Newport Beach, CA. The facility was
inspected on August 24, 1995.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and wE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no lo�iger
an approved backflow prevention device. This requirement is in
accordance with Title 17 of the California Administrative Code.
2. The electrical receptacles must be either GfI or twist lock for
use in a water environment.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for corrpliance with the City, s minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior totransfer of the
permit."

Dear Mr. Petermann:
The City of Newport Beach has received complaints regarding the
pier and float bayward from 1515 E. Bay Ave.
Specifically, the complaints are that a vessel is berthed in
violation of Section 21.A. of the City Harbor Permit Policies,
which states:
21.A. "boats moored at private or public docks shall not
extend beyond the projection of the property lines of the
property to which the dock facility is connected... 11.
A field inspection revealed that a vessel is berthed in a position
that has it extending across the property line at 1519 E. Bay
Avenue and is in violation of the above stated code.
Please arrange to have the boat relocated to conform with the
Harbor Permit Policies.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit #0109-1515 for the property located at
1515 East Bay, Newport Beach, CA. The facility was inspected on
6/19/89.
We cannot transfer the pier permit until the following
deficiency(ies) has/have been corrected and WE HAVE BEEN NOTIFIED
OF THE CORRECTION:
1. A City approved anti -syphon device is required at the water
connection to the pier and float. A drawing and description of
the device approved by the City is enclosed.
The anti -syphon device that is in place is in the wrong
location. As you will see from the enclosure, the anti syphon
device must be landward of the bulkhead or high tide line.
The City Harbor Permit Policies state:

Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED. When we have been notified, the structure will
again be inspected and when the requirements have been met the
pier permit will be transferred.

and Eastbluff Drive on November I allegedly resulting
from the malfunction of the signal light.
Claim of.David Zaugg, submitted by P.E. Brown & Company,
insurance adjusters for United Services Auto Associa-
tion, for damages in connection with an automobile
accident between David Zaugg and David Ogle at the
intersection of Jamboree Road and Eastbluff Drive on
November I allegedly resulting from the malfunction of
the signal light.
7. The public improvements constructed in conjunction with
Tract No. 6620 were accepted; and the City Clerk was
authorized to release the Faithful Performance Bond and
to release the Labor and Materials Bond in six months
provided no claims have been filed. (A report from
the Public Works Director was presented.)
8. Harbor Permit #109-1515 of Gordon Crary for maintenancc
dredging at 1515 East Balboa Boulevard was approved,
subject to the conditions of approval under the Blankel
Maintenance Dredging Permit issued by the U.S. Army
Corps of Engineers. (A report from the Marine Depart-
ment was presented.)
19. The following Budget Amendments were approved:
BA -28, $5,600 transfer from Off -Street Parking
Fund to reimburse Field Maintenance Division for
renovation of Hoag Hospital Coast Highway Parking

of certain public works on rivers and harbors, and for otber purposes."
you are hereby authorized by the Secretary of tl-.e Armv to install a wooden
bulkhead in Newport 13av, fronting Lot Nos. 8, 9 and 10, Block No. 24,
Eastside Addition to ralboa Tract, Newport Beach. Orarpe County, California,
as shown on the attached drawin�.
This authorization does not give any pronerty rights, either ir real
estate or material, or anv exclusive nrivileges- and does not authorize

The proposed location of the wall is bayward of the bay side of
Vacated Bay Avenue. Therefore, this permit required City Council
approval.
On February 7,!103, the Marine Safety Department staff issued a
harbor permit to construct a wood retaining wall on the bayward
line of Vacated Bay Avenue as allowed by Section 16 paragraph A
of the City Harbor Permit Policies.
As shown on th6 attached drawing a wood bulkhead exists east of
the subject lo(jation.at about the same location Mr. Crary wishes
to install a wood retaining wall. Westerly of the subject property
the berm of the sand profile is also about the same distance bay -
ward of Vacated Bay Avenue.
The Marine Safety Department staff has inspected the site and agree
with the applicant that construction of a wood retaining wall on
the bayward line of Vacated Bay Avenue would serve no.purpose at
this particular location.
