The above dock was inspected by The Harbor Resources Division of the City of
Newport Beach at the property mentioned above.
We cannot transfer the pier permit until the following deficiencies have been corrected
and the property has been re -inspected:
1. It needs a new testable Backflow Prevention Device installed (please see diagram).
The Newport Beach City Municipal Code 17.60.030 states:
CA. Prior to the transfer of an annual pier permit, all harbor structures shall be
inspected for compliance with the City's minimum plumbing, electrical and
structural requirements, and the conditions of the existing permit. All structural
deficiencies must be corrected prior to the transfer of the permit. A fee will be
charged for this inspection, established by Resolution of the City Council.
Please call 949-644-3044 to request a reinspection. Once the property has passed
reinspection and we have the signed application, the pier will be transferred.

Dear Mr. Melum:
Reference is made to your letter dated June 3, 1997 in which you submitted on behalf
of Mr. Allen who resides at 1601 E. Bay Avenue, a notification for the maintenance dredging
of 100 cubic yards of sand and silt material by hydraulic suction and disposal of the dredged
material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Allen's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

GROIN RETURN WALL "H STREET" STREET EMD
Background:
The Marine Department issued a Maintenance Permit to Mr.
William H. Allen and Trautwein Brothers Marine Construction
on 12/28/83. The Maintenance Permit was to replace an existing
wood retaining wall (bulkhead and return wall groin). It was the
intention of both the contractor and the Marine Department that
the groin wall would be placed on the property line. It now
appears, without the benefit of an engineering survey, that the
groin wall is, at the landward end of H Street, encroaching a few
inches into the City street end.
Discussion:
The groin wall that was replaced with the issuance of the Harbor
Maintenance Permit was build immediately adjacent to the pier
leading to the float on .the westerly edge of Lot 1. (See attached
drawing). The new wall; which with a wood cap,:is of heavier
codstrucbion than the old wall, was built in substantially the
same location as the old wall. Because of the.wood cap and the
newer method of constructing these wooden return groin walls with
heavier timbers and tiebacks, the.wall was built as close to the
pier as.practical. However, approximately twenty or thirty feet
of the length of the wall appears to be about 6 to 7 inches into
the street end beach.
The purpose of the wood retaining wall and return groin wall is
to protect filled upland property in front of a residence built on
Lots 1 and 2 with 60 feet of bay frontage. The wooden return groin
wall in question helps protect the sandy street end beach at "H"
Street, as well as the private property in front of Lots 1 and 2.
There is an older groin wall on the west side of "H" Street. Both
these groin walls compartmentalize the street end beach at "H"
Street and protect it from natural beach erosion.
Based on a complaint, the Marine Director, during the second week of
March, inspected the property and scheduled the matter to be reviewed
by the Tideland Affairs Committee on March 14, 1984 in the field. The
Tideland Affairs Committee recognized the fact that the pier leading
from Lot 1 to the float is built -on the property line under a permit
that was issued prior to the adoption .of the Harbor Permit Policies.
Piers today are required to be set back 5 feet from the property line,
so that this type of situation cannot occur. The Tideland Affairs
Committee discussed the fact that the wall as. now built does not
increase the useable property of Lots 1 and 2 and that if the permittee
were now required to relocate the wall it would necessitate removal
of:the existing pier, and reinstallation of the groin wall at a cost
of approximately.$3000.to the permittee and with no substantial benefit
to the City.
The Tideland Affairs Committee recommended that the Staff take the
following action:

If desired, direct Staff to amend Harbor Permit 109-1601 to show the
encroaching portion of the wood return wail and condition the permit
so that when this new groin wall deteriorates and is rebuilt, that it
be relocated on the property line. Require that the pier leading to
the float be positioned with a five foot setback in accordance with
the Harbor Permit Policies, if.and when the pier structure is replaced
in the future.

Mav I bring to your attention an encroachment on the
city beach at the foot of "H" street. This encroachment
consists of a bulkhead under construction for the owner
of the nroperty at 1601 E. Bay Ave. The encroachment is
at a maximum of 92 " where it starts at the end of the city
sidewalk and lessens as it extends bayward and approaches
the mean tide line.
This encroachment was brought to the attention of
David Harshbarger and Tony Melum of Tidelands Atninistration
and Ron Whitley of the Parks Dept. All agreed that the
encroachment does exist. There was also a wood platform
of about 61X8' placed on. the beach by the owners contractor
for the convience of the owners guests walking down to the
boat slins in front of the property. Upon reporting both of these
encroachments to the Tidelands Administration last week,
Tidelands followed up and had the platform removed but the
encroaching bulkhead is still there. This matter was also
reported to Council members Ruthelyn Plummer and Phil Maurer
both of whom agreed that the encroachment exists. However
Councilmember Plummer wondered what damage the encroachment
was doing to the city. Any encroachment does damage to the
city. Is the city any different than a private party. Try
encroaching on your neighbors 35' lot here in Newport with
a 9z" wall and see what happens. Does the city, give away
its property because it has lots Of it. if the bulkhead in
auestion could not be placed where it should have been
for construction reasons, why wagnt it placed 921' on the
private property side of the line Z
The city employees and the members of the council are
expected to and must protect the city and its property
from all types of hazards, therefore I am asking you to
take all measures necessary to have this encroachment
removed.
