Dear Mr. Bauer:.
The Newport Beach.Marine Department has received a complaint
regarding the use of the residential pier bayward of 1633 Bayside.
Specifically, the complaint is that vessels are be -Ing berthed
there in violation of Sections 4,K. and 21.A. of the Harbor Perm -it
Policies, which state:
4.K. "In those areas of the harbor where the piers and floats
are bayward of residential zoned areas and are reserved for the
occupants of the abutting upland propertl�, liveaboards shall not
be permitted."
21.A. "Boats moored at private or public docks shall not extend
beyond the projection Of the.property lines of the property to
which the dock facility is connected....".
To preclude further action by this department, the encroaching
vessel(s) must be relocated and the liveaboard conduct must be
stopped.

the ability of the local government to prepare a local coastal
program that is in conformity with the provisions of Chapter 3 of
the California Coastal Act of 1976.
2. If located between the nearest public -road and the sea or shore-
line of any body of water located within the coastal zone, the
d-evelopment is in conformity with the public access and public
recreation policies of Chapter 3 of the California Coastal Act of
1976.
3. There are no feasible alternatives, or feasible mitigation
measures, as provided in the California Environmental Quality"
Act, available for imposition by this Commission under the
power granted to it which would substantially lessen any signi-
ficant adverse impact that the development, as finally proposed
may have on the environment.
