RECOMMENDATION: Discuss, receive, and file the attached report. DISCUSSION: A joint session of the Newport Beach City Council and Harbor Commission has been requested to improve communication between the Council and an advisory body representing the diverse uses of Newport Harbor and its waterfront. Harbor Commissioners and Harbor Resources staff will present a PowerPoint presentation intended to update the Council and provide a basis for dialogue between the two groups. Open discussion of the recent accomplishments, future goals, tasks and priorities is recommended. In November, 2003 the Harbor Resources Division staff prepared a "State of the Harbor" report to the Harbor Commission describing the important issues in the Newport Bay; the Harbor Commission's prioritized task list; the accomplishments in the first year of the Commission and new staff; and achievable goals for the future for both the Harbor Commission and the Harbor Resources staff. Thus it was decided to utilize an abbreviated version of the State of the Harbor report to meet with the various groups to open meaningful discussion of the issues to further refine operation, protection and enhancement of present and future beneficial uses of the harbor resources. Advise the City Council in all matters pertaining to the use, control, operation, promotion and regulation of all vessels and watercraft within the Newport Harbor. B. Approve, conditionally approve, or disapprove applications on harbor permits. C. Harbor Resources Division What is the Purpose of a HAMP? -To provide a comprehensive area -wide aquatic resource plan that achieves a balance between aquatic resource protection and reasonable economic development and minimizes individual and cumulative effects of proposed projects. -With the HAMP approach, future projects can be authorized with programmatic level permits, if they meet specific criteria designed to avoid and minimize impacts to aquatic resources. -Under the proposed de minimus ruling losses of eelgrass of less than 10 square meters due to dredging or dock repair or construction would not require mitigation. Harbor Resources Division Accomplishment— Started consultant / staff study to revise harbor wide dock design criteria and standard drawings Future Task — Acquire Harbor Commission and City Council approval for time implementation with anticipated fire code compliance reconfiguration projects Priority - High • Standard's are necessary for consistent construction practices and modern design in the harbor. • Most of the standards and materials usage were established in the 1940's, revised in the early 70's with a few revisions in 1994. • Cash & Associates has been selected to revise and update these standards and practices. • Priority will be given to revision of commercial dock standards for timely implementation with the fire code compliance program. -All dock designs and standards, including public docks and private residential docks will be covered. Harbor Resources Division t Pt dN Future Project • Mooring Layoti t#alignment & Mooring :; Managembrtf K ` • a: Priority - High • There are about 9,900 vessels in the harbor 1,235 or about 12.5% of them are on moorings. The Army Corps has delineated certain areas of the harbor for mooring use. Over the past three decades there has been an excursion of moorings outside the designated areas. The Corps Is working on a plan to continue dredging the federal channels and the moorings need to be moved to within the delineated areas before dredging can proceed. Moorings located outside the designated areas also can inhibit safe navigation. We have proposed a budget Item that would establish a new mooring layout for better efficiency and compliance with federal rules. Harbor Patrol and City staff agree that current mooring management rules should be reviewed concurrent with layout realignment. Possible realignment of U.S. Pierhead Line and mooring area limits will be considered due to fire code and design standards Implementation. E • • C • Accomplishment - Finial Installation �tLryyN Harbor Resources Division -Finials are a historic 'landmark" element in Newport Harbor denoting the location of public piers for both land and water access and use — finials had fallen Into disrepair and /or stolen. -Finials provide excellent delineation of use as a public dock and reflective tape works well for nighttime location. -Comments from Community have been all positive regarding finial installation. -Repairs of decking, gangways and signage have also added to the improved functionality of the public docks.
