Dear Ms. Hartling:
This is in response to your request for a letter outlining
the events of the past few days regarding your pier and float
location in relation to the float adjoining you belonging to
the BYC.
A field inspection by staff members of the Marine Department
revealed that the pier and float belonging to California
Recreation, sublet to the BYC is indeed 5 feet closer to your
float than it was prior •to the replacement of the docks in
1985.
This supported your position that it interferes with your
ability to access your docks side tie.
The Marine Department contacted Mr. Ed. Powers of California
Recreation and informed him of our findings. Mr. Powers in
return requested the Yacht Club to relocate the Whaler side
tied to the neighboring float. Mr. Powers stated that as an
act of courtesy to Ms. Hartling he has complied to our
departments request.
The BYC informed Mr. Powers on February 15, 1990, that they
would relocate the boat.
If this department can be of any further assistance in this
matter, please call at 644-3044.

Ed Powers
Discussed the Hartling situation with him and he agreed to
request the Yacht Club to move the vessel side tied near the
Hartling's pier.
He requested that a note be put in the file to the effect
that this is a courtesy gesture on the part of Cal Rea, and
is not to be construed as a judgement against the right of a
vessel to be moored at that side tie.
February 15, 1990
Ed Powers called to inform this department that the Yacht
Club has agreed to move the whaler and that a week to ten
days will be needed to find a spot to relocate it.
Hartling notified.

Saja Jane called requesting that this department send her a
letter outlining the events of the past few days in regards
to the pier and boat situation for her file. She wants to
ensure that this decision is binding and protects any new
occupants of her resident.
Discussed it with Tony, a letter will be sent and attached to
this memo.

Dear Ms" Hartling:
This is in response to your letter dated January 25, 1990"
The above mentioned letter complained of the hirdship caused
by the mooring of a vessel on BYC property adjacent to your
pier"
Specifically the complaint is that the ve,sel moored there is
blocking access to the side of your dock" Furthermore, your
letter states that the mooring in question was never used in
previous years as such; and that the reconfiguration of the
docks which occurred in 1985 placed the new docks 5 feet
closer to your property"
Regarding thy historical use of this mooring, aerial
photographs taken of the area in 1978/ 1981, and in 19R5
all have a vessel tied up on that mooring. These same
photographs have the docks in the same location as they were
prior to the replacement. Plans submit to the city and
inspected by the city Building Department have the docks in
the same location"
Mr, Ed Powers, manager for California Recreation, informed
me that in 1985, at a luncheon attended by Mr. Hartling, the
commodore of the BYC, and himself. an anreement was reache!
by all parties that asmall vessel could be moored at the
side in question"
Therefore it is this department's position that your
complainL has not sufficient merit to require California
Recreation to have the Whaler #Cf1169Jd removed"

Dear Sir:
Pursuant to a visit from a person from your department to my
residence at 1657 Bayside Drive, Corona del Mar and a request for
documentation, I submit this letter. I have been a member of
this community for 43 years and a resident at 1657 Bayside Drive
for 15 years. My children and I have enjoyed living on this
'Ibeautifal bay and have valued.our property. Every yaar-moresl-an

more boats are .jammed into this harbor. Several years ago we
endured when the BYC docks in front of our home were moved 5 feet
closer to our maritime property line. we expressed our concern
that too many docks were being added and that the harbor was
being over populated. However, assurances were given that our
dock and water space would not change. That was true up until 14
months ago when a homesteading boat owner, who mysteriously
showed up one day and installed cleats on the end of a BYC dock,
blocking access to the side of my dock. This dock was meant as a
drop off point of passengers. It has no electricity, no water or
dock box and never had cleats.
Roger McKinnon, a member of the BYC for 40 years, who had a slip
in the approximate area, can attest to the fact that this was
never a boat mooring and there was never a boat tie up there
until 14 months ago. I confronted the skipper, the owner of
Whaler #CF1169JD (Quickie) who incidentally has a larger yacht
about 50" which is moored 3 fingers north of the boat in
question. He claims the dockmaster gave him permission to use
the dock. When I asked the dockmaster about it, he said he
didn't give him permission. I then spoke with the Harbor
Department, California Recreation, and now am asking your
department for help!
This man and his boat are violating my access, my property and my
privacy. I can't believe this was ever allowed, and under who's
authority were my rights usurped? Surely there must be
protection for a homeowner like me against this "squaters rights"
type of tactics.
I respectfully request help from your office to remove this boat
and regain open access to my dock.
