OWNER -BUILDER DECLARATION
I hereby affirm that I am exempt from the contractor's license law for the following reasons: (Sec.
7031 d.5, Business and Professions Code). Any City or County which requires a permit to construct, alter,
improve, demolish, or repair any structure, prior to its issuance, also requires the applicant for such permit —
to file a signed statement that he is licensed pursuant to the provision of the Contractors License Law
(Chapter 9, commencing with Section 7000) of Division 3 of the Business and Professions Code) or that
he is exempt therefrom and the basis for the alleged exemption. Any violation of Section 7031.5 by any
applicant for a permit subjects the applicant to a civil penalty for not more than five hundred dollars ($500).
I, as owner of the property, or my employees with wages as their sole compensation, will do the
work, and the structure is not intended or offered for sale (Sec. 7044, Business and Professions Code:

SUBJECT: NOTICE TO PROCEED (File No. 98-00687-YJC)
Dear Mr. Armand:
Reference is made to your letter dated September 1, 1998 in which you submitted on
behalf of Mr. Howard P. House who resides at 1803-1805 E. Bay Ave., a notification for the
maintenance dredging of 110 cubic yards of sand and silt material by hydraulic suction and
disposal of the dredged material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89-211-
GS provided that Mr. House's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

A final inspection was conducted at the above properties on
August 12, 1997, at which time it was verified that the
maintenance to the piers and revision of the floats were done
according to the plans approved by the City of Newport Beach
Public Works Department.
