Box 4259 Balboa, CA 92661 A recent field inspection of your dock at 1805 E. Bay Ave. has revealed a vessel is extending beyond the projection of the property line and into the property at 1807 E. Bay Ave. This is in violation of Newport Beach Municipal Code Section 17.25.020(c): "Boats berthed at private or public piers shall not extend beyond the projection of the property lines of the property to which the pier is connected in accordance with Section 17.35.020. " This letter will advise you that the encroaching vessel must be relocated within thirty (30) days from the date of this notice, otherwise an Administrative Citation may be issued and penalties will begin to accrue ($100, $200, $500 daily increments). Your cooperation is greatly appreciated. Below is a picture of the encroaching vessel along with an aerial from 2012 showing the same vessel. Bay Ave. has since passed as of September 14, 2013. I am in receipt of your email dated September 10, 2013 in which you described the encroaching boat's owner reaching an agreement with 1807 E. Bay Ave. to allow the encroachment to continue. You mentioned that I would be receiving confirmation from 1807 E. Bay Ave. to that effect, and 1 am confirming that I have not yet heard from her. I encourage neighbors to work out solutions such as you described, but since a complaint has been filed, it is incumbent upon you to ensure I receive written confirmation from 1807 E. Bay Ave confirming that she no longer wishes the City to enforce the encroachment. Therefore, I am granting you one additional week to produce a signed, written statement from 1807 E. Bay Ave. documenting that she no longer wishes the City to enforce the encroachment. Department of the Army Pernut to conduct dredging activities and discharge dredged material into waters of the United States, in association with the 1805 and 1807 East Bay Avenue Dredging Project. The proposed work would take place in Newport Bay within the City of Newport Beach, Orange County, California. Based on the information you have provided, the Corps of Engineers has determined that your proposed activity complies with the terms and conditions of Regional General Permit (RGP) No. 54-Maintenance Dredging, Beach Nourishment, and Dock Maintenance. As long as you comply with the general permit conditions of RGP No. 54, an individual permit is not required. Specifically, you are authorized to conduct the following regulated activities: 1. Dredge up to 220 cubic yards of sediment within a 0.035 acre area, as shown on Figure 2 (see attached). 2. Discharge up to 220 cubic yards of dredged material onto the adjacent beach within a 0.048 acre area, as shown on Figure 2 (see attached). 3. Temporarily impact 0.083 acre of non -wetland waters of the United States. Furthermore, you most comply with the following non -discretionary Special Conditions: 1. As specified in your application, an existing eelgrass bed is located approximately 18 feet from the site where dredging activities are proposed. Per Special Conditions f(e)(iv,2-3) of RGP 54: "2. If eelgrass is present between 15-30 feet from the proposed dredge material disposal footprint (in any direction), then monitoring of the site for potential eelgrass impacts from disposal operations shall be required. Monitoring shall consist of pre- and post - project transeets placed perpendicular to the shoreline and spaced five feet apart which map the eelgrass bed. Enough transects will be used to extend the length of the project footprint. Along -2— each transect, the extent of eelgrass will be measured. Any decrease in eelgrass extent along any transect (pre -project vs. post -project) will constitute an impact. The pre -project transacts shall be conducted no sooner than 60 days prior to the start of dredging and the post -project transects shall be conducted no later than 30 days following the completion of dredging. 3. Should the monitoring required in special condition "iv.2"above identifij an impact to the mapped eelgrass bed, then mitigation consistent with the provisions of the Southern California Eelgrass Mitigation Policy shall apply. An eelgrass monitoring report will be submitted to the Corps, NMFS, and California Coastal Commission no later than 90 days following completion of dredging. if an impact was detected (as defined above), the report will include a summary of how the Southern California Eeggrass Mitigation Policy will be complied with. 2. Within 45 calendar days of completion of authorized work in waters of the United States, the Permittee shall subm t to the Corps Regulatory Division a post -project implementation memo indicathlg the date authorized impacts to waters of the United States ceased. 3. The permitted activity shall not interfere with the right of the public to free navigation on all navigable waters of the United States as defiled by 33 C.F.R. Part 329. 4. No earthwork is authorized by this Regional General Permit. 5. 'The Permittee shall discharge only clean construction materials suitable for use in the oceanic environment. The Permittee shall ensure no debris, soil, silt, sand, sawdust, rubbish, cement or concrete washings thereof, oil or petroleum products, from construction shall be allowed to enter into or placed where it may be washed by rainfall or runoff into waters of the United States. Upon completion of the project authorized herein, any and all excess material or debris shall be completely removed from the work area and disposed of in an. appropriate upland site. 6. The Pemrittee and its contractor(s) shall not remove, relocate, obstruct, willfully damage, make fast to, or interfere with any aids to navigation defined at 33 C.F.R. chapter I, subchapter C, part 66. The Permittee shall ensure its contractor notifies the Eleventh Coast Guard District in writing, with a copy to the Corps Regulatory Division, not less than 30 calendar days in advance of operating any equipment adjacent to any aids to navigation that requires relocation or removal. Should any federal aids to navigation be affected by this project, the Permittee shall submit a request, in writing, to the Corps Regulatory Division as well as the U.S. Coast Guard, Aids to Navigation office (contact information provided above). The Pernrittee and its contractor are prohibited from relocating or removing any aids to navigation until authorized to do so by the Corps Regulatory Division and the U.S. Coast Guard. C. Should the Permittee determine the work requires the temporary placement and use of private aids to navigation in navigable waters of the United States, the Permittee shall submit a request in writing to the Corps Regulatory Division as well as the U.S. Coast Guard, Aids to Navigation office (contact information provided above). The Permittee is prohibited from establishing private aids to -4— navigation in navigable waters of the United States until authorized to do so by the Corps Regulatory Division and the U.S. Coast Guard. D, The COTP may modify the deployment of marine construction equipment or mooring systems to safeguard navigation during project construction. The Permittee shall direct questions concerning lighting, equipment placement, and mooring to the appropriate COTP. The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the Corps of Engineers Regulatory Division, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall bemade against the United States on account of any such removal or alteration. A general permit does not grant any property rights or exclusive privileges. Also, it does not authorize any injury to the property or rights of others or authorize interference with any existing or proposed Federal project. SAMPLE PREPARATION Entire sample transferred into 1 liter glass containers, deionized water added, and mixed to desalt and disperse the sediment. The sediment is allowed to completely settle and the clear water is removed by siphoning. The sample is placed in a drying oven at 50°C and occasionally stirred until the entire sample is completely dry. The dry sample is transferred to a desiccator for cooling. The sample is disaggregated and a Riffle sediment splitter is used to evenly split the sample to reduce the quantity of material to be analyzed to an allowable retention weight for the sieves. SAMPLE ANALYSIS The dry split fraction is processed through a # 10 U.S. standard sieve to remove the gravel/shell fraction of the sample. The material retained on the sieve is weighed and value recorded. The material passing through the # 10 sieve is wet sieved through a #230 sieve to remove the silt/clay fraction. The material retained on the sieve is transferred back into the glass container and placed back into the drying oven at 50°C. The remaining sample is allowed to completely dry and the material is weighed and recorded to yield the sand fraction. The silt/clay fraction is calculated by subtracting the gravel/shell and sand fractions from the total analysis weight.
