Dear Mr. Melum:
Reference is made to your letter dated May 17, 1996 in which you submitted on behalf
of Ms. Judith Binder at 1903 East Bay Front, a notification for the maintenance dredging of
120 cubic yards of sand and silt material by hydraulic suction and disposal of the dredged
material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Ms. Binder's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

This is in reply to your application (File No. 200100978 -SMS) dated May 3,2001, for a
Department of the Army Penrit to dredge for maintenance just bayward of 1903 East Bay
Avenue, 840 Via Lido Nord, 829 Harbor Island, and 101 Via Lido Soud, in Newport Bay in the
City of Newport Beach, Orange County, COornia, as described below.

your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 54.
As Iona as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July 24,2005 when RGP No. 54
will expire. A general perndt does not grant any property rights exclusive privileges. Also, it
does not authorize any injury to the property or rights of others or authorize irfte3:f�,cnce -,vifll
any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain
other Federal, State, or local authorizations required by law.

Commission staff have received information submitted as evidence of compliance with Coastal
Development Permit 5-99-282 and/or as evidence of conformance with Consistency Certification
CC -078-99 for the following sites in the City of Newport Beach:
Commission staff have reviewed the information submitted and determined that the above
referenced dredging event conforms with Consistency Certification CC -078-99 and that no further
federal consistency review is necessary from the Commission for the dredging component of the
project. In addition, the proposed beach disposal has been reviewed and found by the Executive
Director to be consistent with Special Conditions 1, 2, and 3 of Coastal Development Permit 5-99-
282. No further review is necessary from the Commission for the beach disposal components of
the project.
Please be advised that only the project described in the materials submitted for the sites listed
above have been found to conform with Consistency Certification CC -078-99 and/or conform with
the terms and conditions of Coastal Development Permit 5-99-282. Any change in the project may
cause it to lose its status as consistent with CC -078-99 and/or CDP 5-99-282. This certification is
based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring

The staff of the State Lands Commission has received your letter, dated
May 20, 1985, and copies of the permit drawing relative to the proposed re-
modeling of your client's existing docking facilities in Newport Bay.
The tide and submerged lands over which the proposed project will extend
are sovereign lands of the State of California that the Legislature granted
in trust to the City of Newport Beach. Therefore, you need not apply to the
State Lands Commission for project authorization. You should, however, apply
to all other agencies having approval authority.
This action does not constitute, nor shall it be construed as a waiver

Dear Sir:
A check of the City's Harbor Permit.files has revealed that the
permit for the Dier and float at 19031 East Bay Avenue, Newport
Beach is registered to D. Smith.
A tra nsfer application must be completed and a transfeer'fee
paid each time the permit has changed ownership.
Chapter 17.24.036 of the Municipal Code addresses the transfer of
a permit and reads as follows:
"No person shal! transfer a permit for a pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City".
Failure to pay the transfer fees can be grounds for revocation of
the Harbor Permit in accordance with Chapter 17.24.090 of the
Municipal Code.
Your cooperation in bringing this permit up to date will avoid
any action by the City.

This letter is in response to your complaint regarding the sailboat
moored next door to you at 190 . 3 Fast Biay, w�ich was allegedly en-
croaching onto your permit zone.
Upon inspection, the boat in question wasIound to have a beam of
13'6". On the Permit drawing, the, dock was shown to have A side
set back of 14 feet. I recluested the owner of the boat to have his
contractor confirm the "as built"'setback. This rinasurement was
retported back to us as 15.12%
�The City is, therefore, satisfied that the said sailboat'is mcored
.wii�hin its legal permit zone, and no encroachment'exists at this
time.
