Dear Dr. Beauchamp:
After our telephone conversation on November 8, 1977, 1 researched
the 'darine Department records back to 1927. As far as our records
are concerned, a permit has never been issued covering the current
size and shape of the pier and -float at 2000 E. Bay.
I have called your office several times and left messages hoping to
forward this information to you, but have been unable to reach you.
Technically a new permit for the structure as built is required to
be on file with the Marine Department. However, since the work has
been done for sometime, a drawing indicating -the location and
dimensions of the current pier and float would suffice.
This drawing should be in the same Format as if it was being sub-
mitted for a new permit.
If you have any questions, please call me at -the Marine Department,
640-2156.

The Marine Department is currently conducting inspections of all
structures on the waters of Newport Harbor for conformance with
City Council Harbor Permit Policies.
During the course of this inspection, it was noted that the structure
at the above listed address did not conform to the Harbor Permit on
file. A copy of the drawing for that permit is attached for your
reference.
Pursuant to Harbor Permit Policies and the Newport Beach Municipal
Code, a drawing accurately reflecting the dimensions and location
of the structure at the permit site must be on file with the Marine
Department.
Would you please contact Tony Melum at the Marine Department, 640-2156
between the hours of 8-10 a.m. and 4-5 p.m. at your earliest conven-
ience so we can assist you in correcting this problem.

SUBJECT: HARBOR PERMIT APPLICATION #109-2000 - An APPLICATION
BY ROBERT BEAUCHAMP TO CONSTRUCT A CONCRETE BULKHEAD
ON THE U. S. BULKHEAD LINE BAYWARD OF HIS RESIDENCE
.AT 2000 EAST BAY AVENUE.
Recommendation
If desired, approve:the harbor permit application to construct a
bulkhead, as shown on the attached application drawing, subject to
the approval of the U. S. Army Corps of Engineers.
Discussion
On June 18, 1973,the City Council amended Section 16. A. of the Har-
bor Permit Policies to read as follows:
"All bulkheads in residential districts shall be installed on the
established bulkhead line or at a location behind -the bulkhead line
that would preserve the design profile of the harbor. Any retaining
or ornamental wall installed landward of the bulkhead line shall be
considered a bulkhead if it also serves to contain.the waters of the
harbor and shall be processed in the same manner as if it were on the
bulkhead line.
The Marine Safety Department may issue permits for -bulkheads, between
U. S. Bulkhead Station Numbers 112-109 not to exceed the landward side
of the 'Vacated East Bay Avenue'. Concrete bulkheads and wooden retain-
ing wall structures proposed to be constructed bayward of the bayward
most line of vacated East,,Bay Avenue shall be subject to City Council
approval."
The subject application falls within the limits of the amended section
of the Harbor Permit Policies. Council approval is required because
the applicant wishes to construct the bulkhead on the U. S. Bulkhead Line.
Staff recommends approval of this permit for the following reasons:
1. The subject location is the first lot east of the eastern end
of "Vacated East Bay Avenue" and is a logical location to allow
bulkhead construction to return to the U. S. Bulkhead Line.
2. Standard concrete bulkheads have been built on the U. S. Bulkhead
Line two lots to the east of the subject property and extend from

there to the entrance channel.
3. A sand beach will remain bayward of the proposed bulkhead with an
elevation of ± 4 MLLW.
4. The construction of the bulkhead will allow the applicant to retain
a yard area of approximately 351 in depth. This is consistent with
adjoining properties to both the east and west.
Application to the South Coast Regional Zone Conservation Commission will
be made, subject to the City's disposition of the request.

Ken -
Dr. Beauchamp would like to construct a wooden bulkhead
close to the bulkhead line to control erosion.
Currently there are no bulkheads in the immediate area.
Erosion is currently being controlled by wooden groins.
I would appreciate the following background information:
1. What has been the past history in.this area in
reference to bulkhead construction.
2. What other alternatives could we suggest.
It appears to me that if we were to allow this construction
we would possibly aggrevate the problem to adjoining pro-
perty.
1. The two alternatives that I can see -are lengthen,the
existing wood6n.groins slightly and place fill material.
2. Approve the proposed new woodwall if moved back about
10' - 15' and lower the design profile to a maximum height
of+3 or 41 MLLW.
I need any comments or thoughts you might have.
