I am writing in response to your letter of July 24, 1986 regarding the
responsibility for maintenance of a seawall located on a County beach which
adjoins your property on the southwest and lies southeast of the County's
Harbor Patrol Readquarters. By your letter you transmitted a letter from Ms.
Barbara Wong of The Irvine Company in which she states that pursuant to an
agreement of September 9, 1950 that 11 . . . . an obligation is imposed upon the
County to maintain the beach area in return for the Company's granting an
access easement."
Notwithstanding Ms. Wong's assertion, we have reviewed the aforementioned
agreement and found that the seawall and its repair are not related to the
agreement, This agreement pertains to the granting of a public easement for
access to the County beach and the maintenance of such access and beach for
public benefit. Based on a visual inspection of the site, it is believede the
purpose of the wall (including the portion on County Tideland property) as
installed by The Irvine Company is for the purpose of protection of private
property. The seawall is not needed for the County beach, and provides no
public benefit. It is not legally permissible for the County to expend public
funds for the protection of private property except in times of declared
emergency.
A search of County records reveals no authorization for the construction of
the wall, apparently onto public property. we will be notifying The Irvine
Company, as owner and developers of Tract 2094, that it must provide us with
evidence of that authorization or apply to this agency for the necessary
permit. The authorization or permit will resolve wall maintenance
responsibility.

Thank you for your letter of August 27, 1986 with a copy of the letter
sent to Mr. Alvaro Bea on the same date.
We agree that the wall in question is on County property, however we
do not know who built the wall and have no evidence that it was
The Irvine Company.
Additionally, there is no benefit to The Irvine Company from the
wall and we have no interest in whether it remains on your property.
if it is the CountyTs intention to keep the wall, then it is our
position that maintenance of the wall is either the responsibility
of the County of orange, or, as you suggest, the upland property
owners.

Attached for your information is copy of letter to Mr. Alvaro Bea concerning
the seawall located on County tideland property adjacent to Tract 2094, Lot 9.
As stated in the letter, we can find no evidence that any permit has been
issued for what apparently is a seawall encroachment onto public property.
Since the wall was constructed to protect the adjacent tract, owned and leased
by The Irvine Company, please provide us with evidence that the encroachment
was authorized or apply for the necessary permit.

I am writing in response to your letter of July 24, 1986 regarding the
responsibility for maintenance of a seawall located on a County beach which
adjoins your property on the southwest and lies southeast of the County's
Harbor Patrol Headquarters. By your letter you transmitted a letter from Ms.
Barbara Wong of The Irvine Company in which she states that pursuant to an
agreement of September 9, 1950 that " . . . . an obligation is imposed upon the
County to maintain the beach area in return f . or the Company's granting an
access easement."
Notwithstanding Ms. Wong's assertion, we have reviewed the aforementioned
agreement and found that the seawall and its repair are not related to the
agreement. This agreement pertains to the granting of a public easement for
access to the County beach and the maintenance of such access and beach for
public benefit. Based on a visual inspection of the site, it is believed, the
purpose of the wall (i ' Including the portion on County Tideland property) as
installed by The Irvine Company is for the purpose of protection of private
property. The seawall is not needed for the County beach, and provides no
public benefit. it is not legally permissibl.e for the County to expend public
funds for the protection of private property.except in times of declared
emergency.
A search of County records reveals no authorization for the construction of
the wall, apparently onto public property. We will be notifying The Irvine
Company, as owner and developers of Tract 2094, that it must provide us with
evidence of that authorization or apply to this agency for the necessary
permit. The authorization or permit will resolve wall maintenance
responsibility.

ferenced property.
This is our second written communication with Your agency,
prior to which we made several telephone calls regarding the -
above matter; none of which have brought any reaction or answer
from your agency. We have been ignored!
As the photographs clearly show vou have a condition lead-
ing to imminent failure of your bulk-h-ead (and or sea wall) ;
should partial or complete failure occur damages to life & limb
as well as to property would be such that your Agency would be-
come a Media Event!
The deterioration of your protective facility became very
obvious during the so-called "El Nino" storms of lqSl - 19332.
During that period all 7 or 8 piers in the vicinity were either
totally destroyed or severly damaged. These private irD
rovements
were re -built by our neighbors at theirs and our expense, no claLn
being made to any governmental agency. The Countv of Orange has
not seen fit to follow the example, of the private sector -
As you may be able to tell from the photographs, and certain-ly
will be able to ascertain from a physical inspection, You have a
structural mess on your hands.
The required, by code, cover of concrete on Your re-
inforcing steel is obviously non existant. It would be
presumptive of me to speculate on the effect of continued
exposure of mild steel to the corrosive effects Of salt water
intrusion, Your structural engineer would be able to tell us
what should be taking Place, not only on the visually exposed
re -bar, but also on the as yet not observable interior re-
inforcing.
You should be aware that the public. beach adjacent to,
this property is used very heavily by young couples with very
young children. During periods Of low tides, we have Observed
these "tots" playing under the overhanging "chunks" of deter-
iorating concrete, a co -incidental collapse, and You are i

This Past week -end we had a rupture of our I" water line
from the house to the end of our pier, the rupture Occured n
the sidewalk behind the interlocking Z -Pilling; directly ino
front of our residence. While, without further investigation,
I would not say it was caused by differential sett lemeylt of the
fill behind the Pilling, should such be dl�termined to be the
cause, you have even more serious problems.

Local cities participating in tile Coopera-
tive City/County Summer Day Camp Program con-
duct overnight campOLlts at county day use
regional parks. 011 s"Ch occasions overtime
staffing is necessary for reasons of security.
To offset tile overtime cost of this periodic
staffing increase, EMA recommends the estab-
lishment of a $100 fee for each city -conducted
overnight campOLIt at -1 day Ilse facility in
conjunction with a Summer Day Camp Program.
RECOMMENDED ACTION: Recommend to Board of
Supervisors overnight fee ror Summer Day Camp
Program.

These applications are being brought to the City Council for action as
required by the following sections of the Newport Beach Harbor Permit Policies -
"5B. Prior approval of the City Council will be required
before the Marine Department may issue any permit that does
not comform to the standard harbor drawings and the adopted
Harbor Permit Policies."
"20C. The projection of the property line bayward of the
same bearing from the bulkhead shall generally be used tn
determining the allowable set backs for piers and floats,
Because there are certain phystcal conditions which pre-
clude the strict application of this policy without
prejudice to adjoining properties, Council approval will
be required in areas where precise projections of the
property line have not been determined and the following
conditions exist:
1. Where property lines are not approximately perpendicular
to the bulkhead line.
2. Where curves or angles exist in the bulkhead line.
3. Where bridges, topography, street ends or publicly -owned
.facilities adjoin.the.property.1'

The permit applications affect the permit areas in front of 4 properties.
These are 2039, 2033, 2027, and 2021 Bayside Drive. In the initial
phases of the application process, it was noted that each address mentioned
above had a different size permit area. This was due to the angle of.the
bulkhead in relationship to the individual property lines which caused
varying widths of the permit area when these property lines were projected
bayward.
To facilitate the designing of both application structures, it was felt
that each permit area should be equalized as to width if possible, The
affected property owners made a suggested redistribution of the permit
area widths for which they ask City approval. They each have agreed to this
permit area redistribution in writing, onfile with the Marine Department.
The changes would be as follows:

permit area widths and allow them sufficient room for the structures they

attached) is utilizing an unusual float angle. The main purpose of this
angle is to position the floats to minimize the surge which comes down the

area and is therefore unaffected.

The map and permits make the problem quite clear but
I do not believe that it is serious or "unsolvable"'
To answer your question, there is no statuto'r'y law
which regulates the location or direction of piers
built into tidelands. However, there is one basic
control which goes back to old riparian law. Every
riparian owner has the right to "wharf out" but, in
doing so, he cannot construct his pier or wharf in
such a way that it will interfere with the rights of
adjacent riparian owners.
Therefore, it is my opinion that Mr. Smith is not bound
to conform to the.direction of either of the existing
piers - in fact, he has to conflict with one or the
other! If there is room between the two existing piers,
I see no reason for the Harbor Commission to deny a
permit regardless of its angle with the shoreline.
Although there is no law or established rule, I believe
that a court of law would uphold a pier location which
is at right angles to the property line (Bulkhead line
in this case) based on the laws of accretion. Accreted
lands on a fairly straight shoreline are always appor-
,tioned at right angles to the shoreline.
There have -been court cases caused by this same sit-
uation. One in particular,,at Clear Lake in Lake
County, involved a pier which was built at such an

angle with the shoreline that it extended across the
water in front of the adjacent property. The court
ruled that the pier interfered with the rights of
the adjacent riparian owner and ordered the pier re-
moved and relocated.
The State Lands Commission is very much aware of this
type of problem.on granted tidelands. The City of
Newport Beach is the Grantee of all of the tidelands
within the city limits and, as grantee, is responsible
for jurisdiction over the granted lands. Apparently,
this jurisdiction is shared by a Joint Harbor Commis-
sion in.Newport Bay..
I was Chief Engineer for the State Lands Commission for
16 years and I recall that the State Lands Division,
years ago, proposed that the various Grantees of tide-
lands adopt a Master Plan for Harbor Development which
included a uniform plan for pier construction which
would have eliminated a problem such as yours. How-
ever, it is obvious that there is no such master plan
in Newport Bay. In fact, the Harbor Commission seems
to operate rather haphazardly and inconsistently as is
evidenced by the conflicting directions of the two
existing piers.
in this particular case, I see no reason why Mr. Smith
cannot build this joint ownership pier at right -angles
to the bulkhead line. This would not interfere.with
the owner of Lot 2 and the owner of Lot 11 shares the
pier..
There is certainly no basis for the Joint Harbor Com-
missions to refuse Mr. Smith a permit. I really do
not understand their position. -it appears that they
are unwilling to make a decision to solve a problem
which they created in the first place.
As I pointed out above ' if the pier between Lots 9 and
10 is causing serious problems because it is built on
a prolongation of the property line,litigation (as
a last resort) would most likely result in a court
order to relocate the pier at right angles. (The above

opinion is based on court case precedents and the
laws of accretion.) However, it would seem that
Mr. Smith's ' problem can be solved amicably without
drastic measures such as litigation...

Mr. Jack D. Hensley has recently established an inter vivos trust
with this Bank as Trustee. Mr. Hensley has placed his residence
in Corona Del Mar and the Associated Leasehold Interest and Pier
Permit in the trust. Any asset of an inter vivos trust may be
withdrawn at any time by the Trustor since the trust is fully re-
vocable and amendable. No sale of the Permit is involved, only a
transfer from Mr. Hensley to the trust which he established.
It is our understanding that Mr. Hensley discussed this with
Captain Harsbarger last week. During the discussion, apparently
Captain Harsbarger indicated that for this type of transfer there
is the possibility that you would waive the $50 transfer fee.
