BOX 4040 SAKIA, ANA, CA 92702-4048 I am writing in response to your letter of July 24, 1986 regarding the responsibility for maintenance of a seawall located on a County beach which adjoins your property on the southwest and lies southeast of the County's Harbor Patrol Readquarters. By your letter you transmitted a letter from Ms. Barbara Wong of The Irvine Company in which she states that pursuant to an agreement of September 9, 1950 that 11 . . . . an obligation is imposed upon the County to maintain the beach area in return for the Company's granting an access easement." Notwithstanding Ms. Wong's assertion, we have reviewed the aforementioned agreement and found that the seawall and its repair are not related to the agreement, This agreement pertains to the granting of a public easement for access to the County beach and the maintenance of such access and beach for public benefit. Based on a visual inspection of the site, it is believede the purpose of the wall (including the portion on County Tideland property) as installed by The Irvine Company is for the purpose of protection of private property. The seawall is not needed for the County beach, and provides no public benefit. It is not legally permissible for the County to expend public funds for the protection of private property except in times of declared emergency. A search of County records reveals no authorization for the construction of the wall, apparently onto public property. we will be notifying The Irvine Company, as owner and developers of Tract 2094, that it must provide us with evidence of that authorization or apply to this agency for the necessary permit. The authorization or permit will resolve wall maintenance responsibility. Bea: I am writing in response to your letter of July 24, 1986 regarding the responsibility for maintenance of a seawall located on a County beach which adjoins your property on the southwest and lies southeast of the County's Harbor Patrol Headquarters. By your letter you transmitted a letter from Ms. Barbara Wong of The Irvine Company in which she states that pursuant to an agreement of September 9, 1950 that " . . . . an obligation is imposed upon the County to maintain the beach area in return f . or the Company's granting an access easement." Notwithstanding Ms. Wong's assertion, we have reviewed the aforementioned agreement and found that the seawall and its repair are not related to the agreement. This agreement pertains to the granting of a public easement for access to the County beach and the maintenance of such access and beach for public benefit. Based on a visual inspection of the site, it is believed, the purpose of the wall (i ' Including the portion on County Tideland property) as installed by The Irvine Company is for the purpose of protection of private property. The seawall is not needed for the County beach, and provides no public benefit. it is not legally permissibl.e for the County to expend public funds for the protection of private property.except in times of declared emergency. A search of County records reveals no authorization for the construction of the wall, apparently onto public property. We will be notifying The Irvine Company, as owner and developers of Tract 2094, that it must provide us with evidence of that authorization or apply to this agency for the necessary permit. The authorization or permit will resolve wall maintenance responsibility. However, there is one basic control which goes back to old riparian law. Every riparian owner has the right to "wharf out" but, in doing so, he cannot construct his pier or wharf in such a way that it will interfere with the rights of adjacent riparian owners. Therefore, it is my opinion that Mr. Smith is not bound to conform to the.direction of either of the existing piers - in fact, he has to conflict with one or the other! If there is room between the two existing piers, I see no reason for the Harbor Commission to deny a permit regardless of its angle with the shoreline. Although there is no law or established rule, I believe that a court of law would uphold a pier location which is at right angles to the property line (Bulkhead line in this case) based on the laws of accretion. Accreted lands on a fairly straight shoreline are always appor- ,tioned at right angles to the shoreline. There have -been court cases caused by this same sit- uation. One in particular,,at Clear Lake in Lake County, involved a pier which was built at such an First American Title Insurance Company Mr. William T. The court ruled that the pier interfered with the rights of the adjacent riparian owner and ordered the pier re- moved and relocated. The State Lands Commission is very much aware of this type of problem.on granted tidelands. The City of Newport Beach is the Grantee of all of the tidelands within the city limits and, as grantee, is responsible for jurisdiction over the granted lands. Apparently, this jurisdiction is shared by a Joint Harbor Commis- sion in.Newport Bay.. I was Chief Engineer for the State Lands Commission for 16 years and I recall that the State Lands Division, years ago, proposed that the various Grantees of tide- lands adopt a Master Plan for Harbor Development which included a uniform plan for pier construction which would have eliminated a problem such as yours. How- ever, it is obvious that there is no such master plan in Newport Bay. In fact, the Harbor Commission seems to operate rather haphazardly and inconsistently as is evidenced by the conflicting directions of the two existing piers. in this particular case, I see no reason why Mr. Smith cannot build this joint ownership pier at right -angles to the bulkhead line. This would not interfere.with the owner of Lot 2 and the owner of Lot 11 shares the pier.. There is certainly no basis for the Joint Harbor Com- missions to refuse Mr. Smith a permit. I really do not understand their position. -it appears that they are unwilling to make a decision to solve a problem which they created in the first place. As I pointed out above ' if the pier between Lots 9 and 10 is causing serious problems because it is built on a prolongation of the property line,litigation (as a last resort) would most likely result in a court order to relocate the pier at right angles. (The above First Anwrican Title lasurance Corhpany Mr. William T. Hossfeld June 15, 1978 Page 3 opinion is based on court case precedents and the laws of accretion.) However, it would seem that Mr. Smith's ' problem can be solved amicably without drastic measures such as litigation... If I can be of further help, please do not hesitate to call Me!
