Dear Mr. Trane:
This is in reply to your application (File No. SPL-2008-00570-SLP) dated December
26, 2007, for a Department of the Army Permit to conduct maintenance. dredging, per
RGP 54 in Newport Bay within the City of Newport Beach, Orange County, California
(as shown on enclosed maps). This letter authorizes maintenance dredging bayward of
2018 East Bay Avenue.
Based on the information you have provided, the Corps of Engineers has
determined that your proposed activity complies with the terms and conditions of
Regional General Permit (RGP) No. 547 Maintenance Dredging, Beach Nourishment, and
Dock Maintenance.
As long as you comply with the general permit conditions of RGP No. 54, an
individual permit is not required.
Specifically, you are authorized to:
1. Dredge up to 200 cubic yards of sediment over a 0.031-acre area using a 6-inch
hydraulic dredge; and
2. Discharge dredged material on adjacent beach over a 0.029-acre area (as shown
on enclosed maps).

A general permit does not grant any property rights or exclusive privileges. This
letter of verification is valid until October 4, 2011.A1so, it does not authorize any injury
to the property or rights of others or authorize interference with any existing or
proposed Federal project. Furthermore, it does not obviate the need to obtain other
Federal, State, or local authorizations required by law.

Commission staff have reviewed the information submitted and determined that the above referenced dredging
events conform with Consistency Certifications CC-031-06 and the Special Conditions of Coastal Development
Permit 5-06-117. Please note that the eelgrass and Caulerpa taxifolia surveys completed are only valid for a
limited time period and that additional surveys must be completed and submitted to Commission staff for review if
the dredging and beach nourishment events listed above do not commence prior to expiration of the initial survey.
In addition, please note that this authorization shall expire on October 23, 2011 and that all authorized work must
be completed prior to that date.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC-031-06 and/or conform with the terms and conditions of
Coastal Development Permit 5-06-117. Any change in the projects may cause them to lose their status as
consistent with CC-031-06 and/or CDP 5-06-117. This certification is based on information provided by the
'recipient of this letter. If, at a later date, this information is found to be incorrect or incomplete, this letter will
become invalid, and any development occurring at that time must cease until a new determination regarding
conformance with CC-031-06 and(or CDP 5-06-117, is. obtained.

information on this application is accurate and complete. I also certify that I have read the California
Coastal Commission Permit 5-06-117 & Federal Consistency Certification CC-031-06, the Army Corps
of Engineers Regional General Permit No. 54 (File No. 200501233-DPS) and the California Regional
Water Quality Control Board General Certification for Regional General Permit No. 54 for maintenance
dredging in Newport Harbor and that I will comply with all of the conditions in those permits. I also
certify that by acceptance of this Permit, the applicant acknowledges and agrees that the site may be
subject to hazards from waves and erosion.
I will further hold the City of Newport Beach harmless from and indemnify the City against any claim for
damages arising out of the exercise of these pennits. In addition, I shall reimburse the City of Newport
Beach for all attorney's fees and other costs expended by them in defending any claim, lawsuit, or
judgment arising out of the activities of the applicant carried on under the authority of such Permit.
I understand that any work authorized must be completed by October 4, 2011 after which a new
authorization is required. I also understand that the applicant will submit a Post Dredging Completion
Report no later than 30 calendar days after completion of each dredging project. All work scheduled to
be completed before 7:00 AM or after 6:00 PM (Monday - Saturday) or on Sundays or holidays must be
approved by Harbor Resources.
Per the RGP Permit, all dredging applications will be processed by the various agencies through monthly
batch submittals sent to them by Harbor Resources. Therefore, all dredging at) lications must be
submitted to and received by Harbor Resources by the l"Monday of every month Applications
submitted prior to this deadline are encouraged and appreciated.

This form is required to be submitted for any surveys conducted for the eelgrass, Zostera
marina, that are required to be conducted under federal or state permits and authorizations
issued by the U.S. Army Corps of Engineers and the Coastal Commission. The form has been

This form is required to be submitted for any surveys conducted for the invasive exotic alga
Caulerpa taxifolia that are required to be conducted under federal or state permits and
authorizations issued by the U.S. Army Corps of Engineers or Regional Water Quality Control
Boards (Regions 8 & 9). The form has been designed to assist in controlling the costs of
reporting while ensuring that the required information necessary to identify and control any
potential impacts of the authorized actions on the spread of Caulerpa. Surveys required to be
conducted for this species are subject to modification through publication of revisions to the
Caulerpa survey policy. It is incumbent upon the authorized permittee to ensure that survey

referenced dredging event conforms with Consistency Certification CC-078-99 and that no
further federal consistency review is necessary from the Commission for the dredging
component of the project. In addition, the proposed beach disposal has been reviewed and
found by the Executive Director to be consistent with Special Conditions 1, 2, and 3 of
Coastal Development Permit 5-99-282. No further review is necessary from the Commission
for the beach disposal components of the project.
Please be advised that only the project described in the materials submitted for the sites listed
above have been found to conform with Consistency Certification CC-078-99 and/or conform
with the terms and conditions of Coastal Development Permit 5-99-282. Any change in the
project may cause it to lose its status as consistent with CC-078-99 and/or CDP 5-99-282.
This certification is based on information provided by the recipient of this letter. If, at a later
date, this information is found to be incorrect or incomplete, this letter will become invalid,
and any development occurring at that time must cease until a new determination regarding

Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 54. Your original submittal of March 26, 2001, included two dredging applications
for dredging located.at.2692 Bayshore Drive and 1911/1913 E. Bay Ave. These locations have
not yet been approved by the. California Coastal Commission and will be addressed in a`
subsequent letter from our office.

As long as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July 24, 2005, when RGP No. 54
will expire. A general permit does not grant any property rights exclusive privileges. Also, it
does not authorize any injury to the property or rights of others or authorize interference with
any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain
other Federal, State, or local authorizations required by law.

intends to maintenance dredge approximately 150 cubic yards of

Newport Beach, Orange County, California.
Based on the furnished information, we have determined that
your proposed activity complies with the terms and conditions of
Permit No. 89-211-GS provided Mr. Trane does not exceed the
maximum dredging design depth of -5 feet MLLW with a maximum
allowable overdepth of -1 foot MLLW.

On a routine inspection of piers on January 16, I noted that you
had removed the westerly float and ramp of two floats authorized
you under Harbor Permit A-791 (now changed to number 110-1124).
I also observed that the remaining easterly platform was insecure
upon its floats and that there is daziger of the floats working
loose and drifting away.
I would appreciate; very much your checking your float and caking
action to secure the floats.

Please refer to your letter of April 8, 1969 in reference to a
flotation block that was in danger of breaking loose from the
float that is bayward of my property at 1124 E. Balboa Boulevard.
I have examined the float as best as I can from the shore and I
am unable to observe any of the floats that appear to be coming
out from underneath the main float. This condition did exist
on the other side of the slip for the float which has since been
removed; where some of the flotation blocks were coming out from
underneath the badly deteriorated float. Is it possible that
there has been confusion between the two floats? If not, I would
very much appreciate it if you would identify for me the flotation
block that you feel is in danger of breaking loose and then I can
give explicit instructions to one of the contractors in the harbor
area and have it repaired. At the moment I am at a loss to tell them
what to do, but I certainly do not wish to have parts of my float
drifting around the harbor.

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, .this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any d6 elopment occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER #5-97-325 APPLICANT:_ Fr nk Trane
LOCATION: 2018 E. Bay Front, Newport Beach, County of Orange
PROPOSED DEVELOPMENT: Add a 9 foot by 12 foot section to a floating dock with
one 14 inch pile, replace a 3 foot by 24 foot gangway, and veneer the existing
seawall with 3 inch by 10 inch tongue and groove plastic planks.
RATIONALE: The proposed development consists of improvements to an existing
dock, gangway and seawall. The proposed development will have no adverse
impacts on coastal access and recreation or on coastal resources identified in
Chapter 3 of the Coastal Act and is consistent with prior Commission actions -
in the vicinity.
This waiver will not become effective until reported to the Commission at their
December 9-12. 1997, meeting and the site of the proposed development has been
appropriately noticed, pursuant to 13054(b) of the Administrative Code. The
enclosed Notice Card shall remain posted at the site until the waiver has been
validated and no less than seven days prior to the Commission hearing. If
four (4) Commissioners object to this waiver of permit requirements, a coastal
development permit will be.,required.
