Sirs:
The City of Newport Beach Marine Division has received a request
to transfer pier permit for the above mentioned property. The
facility was inspected on May 30, 1997.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and wE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no longer
an approved backflow prevention device. This requirement is in
accordance with Title 17 of the California Administrative Code.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for conpliance with the City's
minimum plumbing, electrical and structural
requirements, and the conditions of the existing
permit. All structural deficiencies must be corrected
prior to transfer of the permit."

Sirs:
The City of Newport Beach Harbor Resources Office has received a request to transfer
the above noted pier permit for 2112 East Balboa Blvd. The facility was inspected on
October 18, 2000. We cannot transfer the pier permit until the following deficiency has
been corrected and we have been notified of the correction:
A Backflow Prevention Device must be installed at the facility. The purpose of this
device is to protect the domestic water system from being contaminated by sea water.
A drawing of an approved device and a drawing showing a typical installation is
attached. This device could not be located during this inspection.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

A check of the City's Harbor Permit files has revealed that the
permit for the pier and float at 2110 East Balboa Blvd., -Newport
Beach is registered to Merlin Norton.
A transfer application must be completed and a transfer fetj�
paid each time the permit has changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a permit and reads as follows�
"No person shall transfer a permit for a pier, float at -
similar structure granted under the provisions of this
chapter without prior written approyal of the CR/�
Failure to pay the transfer fees can he grounds for revocatium of

The staff of the State Lands Commission has received your letters of
Nov. 17, and Dec. 16, 1981 and copies of the permit drawing relative to the
reconstruction of your client's dock in Newport Bay.
This is to advise that any sovereign interests of the State of California
in the existing tide and submerged lands over which the project will extend have
been granted in trust by the Legislature to City of Newport Beach pursuant to
Chapter 74 Statutes of 1978. Therefore, you need not apply to the State Lands
Commission for project authorization. However, you should contact the City of
Newport Beach and all other applicable agencies having approval authority for
your project.
This action does not constitute, nor shall it be construed as, a waiver of
any right, title, or interest by the State of California in any lands under its
jurisdiction.
