Reference is made to your request of August 15,2006 (File No. 200601617-FBV). Under the
provisions of Section 10 of the Rivers and Harbors Act of March 3,1899 (33 U.S.C. 403), you are
hereby authorized to remove and replace an existing dock with a single finger comprised of a
new 121 x 561 float with 5-16" diameter concrete piles. No changes would be made to the
existing gangway, pier platform, or pier. The project would be located bayward of 2124 E,
Balboa Blvd. in Newport Bay in Newport Beach, Orange County, Califorr-da, as shown on the
enclosed drawings,
The owner or authorized responsible official must sign and date all copies of this Letter of
Permission (LOP) indicating that he/she agrees to the work as described and will comply with all
conditions. One of the signed copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed). In addition, please use the two attached
postcards to notify this office as to the dates of commencement (within 10 days prior to theatart of
construction) and completion of the activity (within 10 days following the end of construction).
Furthermore, you are hereby advised that the Corps of Engineers has established all
Administrative Appeal Process which is fully described in 33 CFR Part 331. The complete appeal
process is diagrammed in the enclosed Appendix B.

malina, that are required to be conducted under fcderal or state permits and authorizations

Pier Permit Conditions

With reference to the plans currently under consideration to reconfigure or modify the dock
system, the following conditions will now be in effect on the above referenced pier.
1. The pier permittee is aware of the Harbor Permit Policies and Chapter 17 of the City of
Newport Beach Municipal Code. The pier permittee understands that the above referenced
pier is under the purview of these Policies and Codes.
2. Any future work on the above mentioned pier requires permits with the City of Newport
Beach and any other applicable agencies. Painting, replacement of rub rails and work
considered to be cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the current, proposed dock system under
consideration. Any future modifications or alterations to the dock system may require new
conditions which may override or change these conditions. These conditions supersede all
past conditions associated with this property.
4. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. Patio
furniture, plants etc ... are not permitted.
5. Your side property lines extend in the water along their same bearing. Vessels shall not
encroach upon the neighbor's property on either side.
7. Vessels may not extend beyond the end of the float by more than the width of their beam.
8.The dock float will be permitted to extend to, but not cross the U.S. Pierhead Line.
9. The maximum width of a vessel permitted to side tie to the easternmost side of the float is 6'
feet.

STANDARD CONDITIONS:
1. Notice of Receipt and Acknowledgment. The permit is not valid and development shall not
commence until -a copy of thelpermit, signed by the permittee or authorized agent,
acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to
the Commission office. I
2. Expiration. If development has not commenced, the permit will expire two years from the date
this permit is reported to the Commission. Development shall be pursued in a diligent manner
and completed in a reasonable period of time. Application for extension of the permit must be
made prior to the expiration date.
3. 1 . nterpr . etation. Any questions of intent or interpretation of any term or condition will be resolved
by the Executive Director or the Commission.
4. Assignment. Th e permit may be assigned to any qualified person, provided assignee files with
the Commission an affidavit accepting all terms and conditions of the permit.
5. Terms and Conditions Run with the Land. These terms and conditions shall be perpetual, and
it is the intention of the Commission and the permittee to bind all future owners and possessors
of the subject property to the terms and conditions.
SPECIAL CONDITIONS: See pages four to seven.
EXECUTIVE DIRECTOR'S DETERMINATION (continued):
The Executive Director hereby determines that the proposed development is a category of
development, which, pursuant to PRC Section 30624, qualifies for approval by the Executive Director
through the issuance of an Administrative Permit. Subject to Standard and Special Conditions as
attached, said development is in conformity with the provisions of Chapter 3 of the Coastal Act of 1976
and will not have any significant impacts on the environment within the meaning of the California
Environmental Quality Act, If located between the nearest public road and the sea, this development is
in conformity with the public access and public recreation policies of Chapter 3.
FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION:
A. Proffiect Location and Descripti on
The subject site is located at 3124 East Balboa Boulevard in the City of Newport Beach (Exhibits #1 -2).
Single-family residences characterize the subject site and the surrounding area. The proposed project
involves the following: removal of an existing "U" shaped dock system and installing a new dock system
consisting of: 6' x 75' fingers, a 6' x 19' backwalk, 5-16" diameter concrete piles, re -using an existing 3'
x 24'gangway, a 5' x 36' approach with 2-14" "T" piles, and a 10' x 14' pier platform with 4-12" diameter
concrete piles (Exhibit #3). The dock will be constructed of Douglas fir. The proposed dock will be
within the U.S. Pierhead Line and is consistent with post Commission actions in the area.
Coastal public access to the beach is available near the site at the end of Balboa Boulevard/Channel
Road (Exhibit #1).

The dock project will be used for boating related purposes to serve a single-family residential
development. The site has been surveyed by the City of Newport Beach Harbor Resources,Division for
eelgrass and eelgrass was discovered within 15 feet of the project area. However, the project does not
anticipate adverseimpacts to eelgrass associated with the proposed project since the dock and piles
will be located away from.the existing eelgrass,beds on site (Exhibit #4). . An eelgrass survey t I ook
place on April 3, 2006 by the City of Newport Beach Harbor Resources Division and an additional
eelgrass survey was conducted on May 5, 2006 by Coastal Resource Management. Eelgrass surveys
completed during the active growth phase of eelgrass (typically March through October) are valid for
60 -days with the exception of surveys completed in August -October. A survey completed in August -
October shall be valid until the resumption of active growth (i.e., March 1). The project is agenclized for
the November 2006 Coastal Commission Hearing and by this time the eelgrass surveys would not
continue to be valid since 60 -days have passed since the survey was completed. Thus, an up-to-date
eelgrass survey must be conducted prior to commencement of the proposed project. In addition, a pre -
construction Caulerva taxifolia survey was completed on May 6, 2006 by Coastal Resource
Management, Caulerpa taxifolia surveys are valid for 90 days. The project is agenclized for the
November 2006 Coastal Commission Hearing and by this time the Caulerpa taxifolia survey would not
continue to be valid since 90 -days have passed since the survey was completed. Thus, an up-to-date
Caulerpa taxifolia, survey must be conducted prior to commencement of the project. Therefore, the
Commission imposes Special Conditions No. 2 and No. 3, which identifies the procedures necessary to
be completed prior to beginning any construction. Also, if any Caulerpa taxifolia is found on the project
site, Special Conditions No. 3 also identifies the procedures necessary to be completed prior to
beginning any construction.
The proposed project has received an approval in concept from the City of Newport Beach Harbor
Resources Division. The Regional Water Quality Control Board (RWQCB) has determined that the
proposed project will not adversely impact water quality if standard construction methods and materials
are use d. The applicant has applied for a permit from the U.S. Army Corps of Engineers.
Section"30600(c) of the Coastal Act provides for the issuance of coastal development permits . directly
by the Commission in regions where the local government having jurisdiction does not have a certified
Local Coastal Program. The City of Newport Beach only has a certified Land Use Plan and has not
exercised the options provided in 30600(b) or 30600.5 to issue its own permits. Therefore, the Coastal
Commission is the permit issuing entity and the standard of review is Chapter 3 of the Coastal Act. The
certified Land Use Plan may be used for guidance.
B. Marine Resources
The proposed recreational boat dock development and its associated structures are an allowable and
encouraged marine related use. The project design includes the minimum sized pilings and the
minimum number of pilings necessary for structural stability. There are no feasible less
environmentally damaging alternatives available. As conditioned, the project will not significantly
adversely impact eelgrass beds and will not contribute to the dispersal of the invasive aquatic algae,
Caulelpa taxitolia, Further, as proposed and conditioned, the project, which is to be used solely for
recreational boating purposes, conforms to Sections 30224 and 30233 of the Coastal Act.
C. Water Quali
The proposed work will be occurring on, within, or adjacent to coastal waters. The storage or
placement of construction material, debris, or waste in a location where it could be discharged into
coastal waters would result in an adverse effect on the marine environment. To reduce the potential for
construction reJated impacts on water quality, the Commission imposes special conditions requiring,
but not limited to, the appropriate storage and handling of construction equipment and materials to

minimize the potential of pollutants to enter coastal waters. To reduce the potential for
post -construction impacts to water quality the Commission requires the continued use and
maintenance of post construction BMPs. As conditioned, the Commission finds that the development
conforms to Sections 30230 and 3023.1 of the: Coastal Act.
D. Local Coastal Program
The LUP for the City of Newport Beach was effectively certified on May 19, 1982. At the October 2005
Coastal Commission Hearing, the certified LUP was updated. As conditioned, the proposed
development is consistent with Chapter 3 of the Coastal Act and with the certified Land Use Plan for
the area. Approval of the project, as conditioned, will not prejudice the ability of the local government to
prepare a Local Coastal Program that is in conformity with the provisions of Chapter 3.
E. California Environmental Quality Act (CEQA)
As conditioned, there are no feasible alternatives or additional feasible mitigation measures available
that would substantially lessen any significant adverse effect that the activity may have on the
environment. Therefore, the Commission finds that the proposed project, as conditioned to mitigate the
identified impacts, is the least environmentally damaging feasible alternative and can be found
consistent with the requirements of the Coastal Act to conform to CEQA.
SPECIAL CONDITIONS:
Water Quallt
A. Construction Responsibilities and Debris Removal
(1) No construction materials, equipment, debris, or waste will be placed or stored
where it may be subject to wave, wind, or rain erosion and dispersion.
(2) Any and all construction material will be removed from the site within 10 days of
completion of construction.
(3) Machinery or construction materials not essential for project improvements will not
be allowed at any time in the intertidal zone.
(4) If turbid conditions are generated during construction -a slit curtain will be utilized to
control turbidity.
(5) Floating booms will be used to contain debris discharged into coastal waters and
any debris discharged will be removed as soon as possible but no later than the
end of each day.
(6) Non�buoyant debris discharged into coastal waters will be recovered by divers as
soon as possible after loss.
B. Best Management Practices Program
By acceptance of this, permit thea . pplicant agrees that the long-temnwater-borne
berthing of . boat(s) in the appr oved dock and/or boat slip will be managed in a manner
tha . t protects w ater q uality pursuant to the implementation of the following BMPs.

b. In -the -water hull scraping or any process that occurs under -water that results in
the removal of paint from boat hulls shall be prohibited. Only detergents and
cleaning components that are designated by the manufacturer as phosphate -
free and biodegradable shall be used, and the amounts used minimized,
c. The applicant shall minimize the use of detergents and,boat cleaning and
maintenance products containing ammonia, sodium hypochlorite, chlorinated
solvents, petroleum distillates or lye.
(2) Solid and Liquid Waste Management Measures:
a. All trash, recyclables, and hazardous wastes or potential water contaminants,
including old gasoline or gasoline with water, absorbent materials, oily rags,
lead acid batteries, anti -freeze, waste diesel, kerosene and mineral spirits will
be disposed of in a proper manner and will not at any time be disposed of in the
water or gutter.
(3) Petroleum Control.Management Measures:
a. Boaters will practice preventive engine maintenance and will use oil absorbents
in the bilge and under the engine to prevent oil and fuel discharges. Oil
absorbent materials shall be examined at least once a year and replaced as
necessary. Used oil absorbents are hazardous waste in California. Used oil
absorbents must therefore be disposed in accordance with hazardous waste
disposal regulations. The boaters will regularly ins p*eGt and maintain engines,
seals, gaskets, lines and hoses in order to prevent oil and fuel spills. The use of
soaps that can be discharged by bilge pumps is prohibited.
b. If the bilge needs more extensive cleaning (e.g., due to spills of engine fuels,
lubricants or other liquid materials), the boaters will use a bilge pump -out facility
or steam cleaning services that recover and prolp�arly dispose or recycle all
contaminated liquids.
c. Bilge cleaners which contain detergents or emulsifiers will not be used for bilge
cleaning since they may be discharged to surface waters by the bilge pumps.
2. Eelgrass Survey(s)
A. Pre Construction Eelgrass Survey. A valid pre -construction eelgrass (Zostera
marina) survey shall be completed during the period of active growth of eelgrass
(typically March through October). The pre -construction survey shall be completed
prior to the beginning of construction and shall be valid until the next period of active
growth...The survey shall be prepared in full compliance with the "Southern California
Eelgrass Mitigation Policy" Revision � (except as modified by this special condition)
adopted. by the National Marine Fisheries Service and shall be prepared in consultation

GS provided that Mr. Hogan's contractor, Shellmaker Inc., does not exceed the maximum
dredging design depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot
MLLW.

to transfer pier permit #0108-2124-1 for the property located at
2124 East Balboa Blvd., Newport Beach, CA. !'The facility was
inspected on 4/6/89.
we cannot transfer the pier permit until the folowing
deficiency(ies) has/have been corrected and WE HAVE BEEN NOTIFIED
OF THE CORRECTION:
1. A City approved anti -syphon device is required at the water
connection to the pier and float. A drawing and description of
the device approved by the City is enclosed.
The City Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requiremenmtsr and the conditions of the existing
permit. All structural deficiencies must be corrected
prior to transfer of the permit."
A permit for plumbing or electrical work must be obtained from the
Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED. When we have been notified, the structure will
again be inspected and when the requirements have been met the
pier permit will be transferred.

dated June 18, 1982 and copies of the permit drawing relative to the
construction of your client's slip float in Newport Bay.
This is to advise that the tide and submerged lands over which
the proposed project will extend are sovereign lands of the State
of California that the Legislature granted in trust to the City of'
Newport Beach. Therefore, you need not apply to the State Lands Commission
for project authorization. You should, kowever, apply to the City
of Newport Beach for any necessary permits or approvals. You should
also apply to all other agencies having approval authority.
This action does not constitute, nor shall it be construed as,
a waiver of any right, title, or interest by the State of California

The Executive Director hereby issues a permit for the proposed develop-
ment on the grounds that the deve-T-o—pment will be in conformi.ty with the
provisions of Chapter 3 of the California Coastal Act of 1976, will not
prejudice the ability of the local government having jurisdiction over
the area to prepare a Local Coastal Program conforming to the provisions
of Chapter 3 of the Coastal Act, is located between the Sea and the
first public road nearest the shoreline and is in conformance with the
public access and public recreation policies of Chapter 3 of the Coastal
Act, and will not have any significant adverse impacts on the environment
within the meaning of the California Environmental Quality Act.

B. Public Access/Certified Land Use Plan Consistency. Public.
vertical access to the sandy beach areas Fn- Balboa Peninsula is
by way of the street ends around -the periphery. These points
provide vertical access at intervals of approximately 225 feet
along the entire length of the peninsula. The Executive Director
determines that consistent with Section 30212, there is adequate
vertical access on the peninsula and near the project site.
Lateral access exists for the entire seaward shoreline of the
peninsula since the vertical access street ends terminate at the
public owned sandy beach. A public walkway has been constructed
adjacent to the sandy beach and there are no private boat docks
along this seaward shoreline.
The proposed project is located on the bay side of the peninsula
where lateral access is seriously impeded along the public sandy
beaches seaward of the bulkhead by the development of private
boat docks adjacent to the bulkhead, the ramps for which are
physical barriers to lateral access. Additionally, there are
several instances where patios and walls have been previously
constructed which encroach beyond the bulkheads onto the public
sandy beach. It should be noted that the sandy beach below the
low bulkhead on the bay side is extremely narrow and has limited
capacity and usability. Nevertheless, if the public were not
impeded by numerous physical obstacles such as ramps to boat
docks, the limited sandy beach area would be usable. The City of
Newport Beach Certified Land Use Plan contains the following lateral
access policy (Page 9, Policy 5):
Lateral Access for easement dedications shall be required for
'hew development fronting on the bay and ocean except:
repair and maintenance activities or replacement of destroyed
by natural disaster." Additionally, improvements to any struc-
ture or demolition and reconstruction of any single-family
dwelling resulting in an increase of floor area, heights, or
bulk of more than 10% shall require such access easement dedications.
The Executive Director therefore, determines that lateral access
easement dedication is not required nor is it feasible for the
proposed project; and further that the proposed project is
consistent with the access policies of Chapter 3 of the Coastal
Act and the Certified Land Use Plan.

An additional policy relating to lateral access appears on page
9(a) of the Certified Land Use Plan which states that Policy 5
(loc cit) does not apply to established, existing residential
subdivisions where on sandy beach exists.
The Executive Director further determines that sandy beaches do
exist seaward of the bulkhead along the channel side of Balboa
Peninsula and further the impeded lateral access in the area
should be addressed in the Implementation Phase of the Local
Coastal Program in order to develop a long range program of re-
establishing lateral public access along the sandy beach areas of
the bayside.

The application required City Council approval under the conditions

maintenance dredging issued by the U.S. Army Corps of Engineers, on

beach restoration. The locations and applications for the proposed
dredging and sand disposition are:

The dredged material will be placed on a beach bayward of private
residences which will aid in the beaches' restoration.
The staff has reviewed the projects and determined that the work will
be done within the parameters of the Corps of Engineers permit. The
dredging contractor will place a filter screen around the discharge
site to control turbidityi There is no known eel grass in the vicinty
of the projects.

as much as is possible and will barge the dredged material to the
Environmental Protection Agency's designated disposal site, four
miles at sea.

Commandant of the Eleventh Coast Guard District report-
ing the circumstances of your unfortunate experience on
the loth of May
We were searching our files,and records to see if. there
was any way we could assist you in this respect, when,
I regret to say, we found that the permit for your
facility is under the name of Mr. A. G. Roach. Apparently*
the permit to maintain the harbor facility bayward of your
residence was never transferred to your name.
While the permit should be transferred, in any event, I
think some consideration should be given to affecting
the transfer promptly in the,event there is some legal
question rising from your claim against the Coast Guard,
I have enclosed a copy of the City's Harbor Permit Policies,
and I would invite your attention to Paragraph IOA gover-
ning the transfer of harbor permits. I have also enclosed
applicatiou. forms.

This letter Is to report d-amage to my private
dock located 'at 2124 East Balboa Blvd., Balboa, Calif. ..Tqa(�
damage occurred. on May 10, 1969 at approximately 1010,2M and
was caused by the wake from the Coast Guard Cutter Point'
Divide".
The float at my dock consists of a wo6d deck
over a framework of 6 x 6 inch structural members all of
which is supported by nine pontoons which are.four feet by
eight feet by eighteen inches in heightg.and construcl�ed of
plywood and covered by fiber -glass. Each pontoon.fits into
a socket of wood fraMing under the deckq and is kept in place
by the weight of the deck and framework. This Is typical of
float construction in Balboa.
On May 10, 1969, The Cutter "Point Divide"
passed my dock at high speed pulling a.high wake behind.it...
When the wake passed under my dock, the dock.was tossed about
to the extent that one pontoon was ejected completely from its
"socket" under the dock framework and floated*free. ,Another
pontoon broke loose from its "socket" * b-ot..romaindd under the
decking. In both cases the wood framingforming the socket
was torn free and must be replacodjtogether wIth a �O foot long
2 x 12 facing piece which was splintered when*the one..pontoon
was ejected completely from under the.deck,,.'.
About a monthago I had to have, a pontoon
replaced in its "socket" and I wondered at: th6:,time how it
could have become dislocated. This timaq howeyerp' por-,�'
sonally witnessed what happened.

I have received a bid of 41:�)0.00 from the Anchor
Ni'arine Repair Co. to repair the damage. Part of their cost
is for a diver to replace the damaged "socket" framing under
the decking. I have authorized them 'to proceed with�the.l..
work.
I consider 'this damage to be the direct re I s I pons . i-
bility of the Coast Guard. I will have the work done and pay'
Lhe contractor, and then submit my bill to the Coast,G-uard.
The work will be done within the next week. If there is any
question about the amount of the con,�ract price., I suggest
that the Coast Guard send a representative to my home right;
away to inspect the damage before it is repaired.
