Currently, the existing seawall Is leaking and undermining the foundation of the house. SPECIAL CONDITIONS: 1. Mitigation Shall be Carried Out as Proposed a. The intertidal sandflats mitigation plan described in the document titled Big Canyon Tidal Channel Mitigation Project, Upper Newport Bay, California, prepared by Coastal Resources Management, .and dated August 24, 1999 shall be carried out as proposed. Eelgrass. Surveys a. Pre -construction Eelgrass Survey As proposed, the pre -construction eelgrass survey shall be conducted not more than one hundred twenty (120) days prior to commencement of construction of the bulkhead. The survey shall be prepared in full compliance with the most recent version of the "Southern California Eelgrass Mitigation Policy" adopted by the National Marine Fisheries Service and shall be prepared in consultation with the California Department of Fish and Game. The applicant shall submit the eelgrass survey for the review and written approval of the Executive Director within five (5) working days of completion of the eelgrass survey and in any event no later than ten (10) working days prior to commencement of construction. b. Post -construction Survey Within one month after the conclusion of the bulkhead construction, the applicant shall survey the project site to determine if any eelgrass was adversely impacted. The survey shall be prepared in full compliance with the most recent version of the "Southern California Eelgrass Mitigation Policy" adopted by the National Marine Fisheries Service and shall be prepared in consultation with the California Department of Fish and Game. The applicant shall submit the post -construction eelgrass survey for the review and approval of the Executive Director within thirty (30) days after completion of the survey. 3. Construction Materials Disturbance to sand and intertidal areas shall be minimized. No local sand, cobbles, or shoreline rocks, not presently used in existing on -site development, shall be used for backfill orconstruction material. All construction materials shall be stored landward of the bulkhead, in improved areas only, and shall be removed at the conclusion of construction. 4. We have not heard from you relative to those conditions and we are assuming from your silence that you are agreeing to the conditions written in our letter of January'26. Therefore, unless we hear from you, we will assume that you will do the following: 1. Allow us to attach our swim lines to your dock whenever it is felt necessary by the Marine Department. 2. That you will incur the expense of removing the piling and if it should be necessary for another piling to be purchased in. the future and re -installed, that this would be done at your expense, and 3. You would supply the mounting hardware approved by the Marine Department for use in attaching our swim lines. I am aware that Fred did communicate with the carrier concerning representation but his letter fails to reference the Policies which require indemnification. We'are, by copy of this letter, asking Tony Melum to advise permittee to make any corrections necessary with respect to the electrical installations at the pier so as to eliminate the possibility of future injury. Balboa Boulevard RECOMMENDATION: That the application be denied. DISCUSSION: The prior approval of the City Council is required because the application does not conform to the standard harbor drawings. The standard drawings show slip floats constructed perpendicular to the bulkhead line. The recommendation for denial is based on: (1) The fact that floats parallel to the bulkhead line tend to interfere with the rights of neighboring property. In this case, the neighboring property to the south is the "N" Street public swimming beach. The lifeguards dis- courage swimmers from swimming beyond the.rope, but there is no law against it. It is against the law to swim across the entrance channel. (2) There is sufficient room to install the float in accordance with the Standard Drawings. The applicant feels that he should be granted the permit for the following reasons: (1) His present float is parallel to the bulkhead line. (2) If his float was in the conventional location, he would inter- fere with marine traffic in the entrance channel when entering or leaving his slip. as his float.
