The pier permittee is aware of the Harbor Permit Policies and Chapter 17 of the City of Newport Beach Municipal Code. The pier permittee understands that the above referenced pier is under the purview of these Policies and Codes. 2. Any future work on the above mentioned pier requires permits with the City of Newport Beach and any other applicable agencies. Although the proposed design fully corriplies with the City requirements for dock construction, staff felt that public outreach was necessary due to the unique configuration of the Carnation Cove area. Council Policy H-1 requires that residents within 300' of the proposed structure be notified. Attached are Exhibits 1, 2 & 3 which note the location of the pier in relation to the other piers in the surrounding area. All drawings are to scale. Please note that vessels will be allowed to extend beyond the end of the U-shaped float by their beam width per Council Policy H-1. Also, vessels will not be permitted to extend beyond the extension of the property lines as depicted on the drawings. PLEDGE OF ALLEGIANCE ROLL CALL: Commissioners John Corrough, Ralph Rodheim, Marshall Duffield, Don Lawrenz and Karen Rhyne were in attendance. Staff: Lorrie Arcese, Chris Miller, Tom Rossmiller, and Asst. City Manager Dave Kiff. Commissioners Tim Collins and Seymour Beek were absent. MINUTES: The minutes from last month were approved. ACTION ITEM ITEM #1 Subject: New Pier at 2223 Bayside Drive - Manzo Summary: Ms. Manzo proposes to construct a new dock system (pier, gangway and float) at 2223 Bayside Drive where a pier has never existed before. Due to the unusual configuration of the Carnation Cove area and because the pier is a new addition to the community, staff is seeking public input as well as the Harbor Commission's advice for approval. Discussion: The neighbors have been noticed and we received only one response which was positive. Commissioner Lawrenz raised a concern about the fee line. In this area the property lines extend into the harbor itself. Public Comments: Action: Commissioner Lawrenz made the motion to approve the permit for construction of a new dock system at 2223 Bayside Drive. The motion was seconded and passed with all ayes. ITEM #2 Subject: Lower Newport Bay Dredging — Implementation and Financing Issues. Summary: Should the Harbor Commission recommend City Council approval of a contract with Weston Solutions to assist in providing a solution to the amphipod toxicity and mercury contamination problems that prevent maintenance dredging of Lower Newport Bay? Harbor Resources is required to sign for the presence of eelgrass on the Approval in Concept. This document is then forwarded to the various agencies who will negotiate the eelgrass mitigation measures to adopt. Public Outreach: On December 7, 2006, a public outreach letter and proposed layout was sent to all waterfront residences (both owners and occupants — 27 total) within 300' of the project. The recipients were encouraged to provide feedback and to voice any potential concerns at the January Harbor Commission meeting. (See attached outreach letter.) At the time of publication, we received one letter of support and no oppositions. ALTERNATIVE: Advise Harbor Resources to deny the proposed project. ENVIRONMENTAL REVIEW: The Harbor Commission's approval of this item does not require environmental review and is categorically exempt per the California Environmental Quality Act (CEQA) 15303, Class 3.E (New Construction or Conversion of Small Structures), PUBLIC NOTICE: This agenda item has been noticed according to the the public meetings at which the Harbor Commission at City Hall and on the City website. Due to the unusual configuration of the Carnation Cove area and because the pier is a new addition to the community, staff is seeking public input as well as the Harbor Commission's advice for approval. RECOMMENDED ACTION: The Harbor Commission may approve construction of a now dock system at 2223 Bayside Drive. BACKGROUND: The applicant proposes to construct a 187' x 4' pier with a 10' x 14' pier platform supported by (22) 10" pipe piles, a new gangway and a 40' U-shaped float. The proposed pier conforms to the City's Standard Drawings in all aspects including dimensions and required setbacks. The outside edge of the northern side of the U-shaped float is 7' setback from the property line and the outside edge of the southern side of the float is setback 14' from the property line. Vessels side tied to either of these outside edges will be restricted by these setbacks. The property lines project bayward on their same bearing from the bulkhead and they are exactly parallel to one another. The center of the U-shaped float is 40' long and 16' wide. (See attached proposal.) Vessels will be permitted to extend beyond the end of the fingers by the width of their beam as allowed per Council Policy H-1. The depth under the slip is unknown but is presumed to be relatively shallow at low tide. There have been no applications submitted for dredging. Carnation Cove is an unusual location in the bay in that most of the lots are positioned on a large sweeping curve in the cove. As a result, most property lines extend out to a single point in the bay, therefore creating some crowding issues at times. However, at this particular address, the property lines extend parallel to each other and do not appear to conflict with the other docks in the area.
