2. The grading plan, if any.
3. The general uses and intensity of use proposed for each part of the area covered

A copy of any variance, exception, conditional use permit or other issued permit is
attached together with all conditions of approval and all approved plans including
approved tentative tract maps. On the basis of this finding, these plans are approved in
concept and said approval has been written upon said plans, signed and dated.
Should Newport Beach adopt an ordinance deleting, amending or adding to the
Municipal Code or other regulations in any manner that would affect the use of the
property or the design of a project located thereon, this Approval In Concept shall
become null and void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970' and state and local
guidelines adopted thereunder, this development:
Has been determined to be ministerial or categorically exempt.
ci Has received a final Exemption Declaration or final Negative Declaration (copy
attached).
o Has received a Final Environmental Impact Report (copy attached).
All discretionary approvals legally required of Newport Beach prior to issuance of a
harbor permit and a building permit have been given and are final. The development is
not subject to rejection in principal by Newport Beach unless a substantial change is
proposed.
This concept approval in no way excuses the applicant from complying with all
applicable policies, ordinances, codes and regulations of Newport Beach. See attached
Special Conditions.

issued by the U.S. Army Corps of Engineers and the Coastal Commission. The form has been

modification through publication of revisions to the eelgrass survey policy. It is incumbent upon

I am confirming that Shannon & I did go to the project site at 2301 Bayside Drive. This was at low tide and we were
able to see the entire survey area. There is NO eelgrass in the project footprint. Lisa is also correct with the height
requirement per out City of Newport Beach Standards- Seawalls shall have a top elevation of not less than 9.0 IVILLW.

Stephen,
I just visited the site at low tide with Shannon Levin and Lisa Walters from the City of Newport Beach Harbor
Resources --- they were able to see the ENTIRE survey area and will confirm to you directly that there is no eel
grass growing in that area.
As for the height --- the current failing wall is + 6 MLLW and there is a garden wall a bit behind it, poured on top
of the patio area that is +9.25 MLLW. The MINIMUM height requirement for the seawall, per City of
Newport Beach code is + 9 MLLW so the height difterental is a Building Code requirement --the 9.25 MLLW
will bring it into compliance and make it match with existing structures around it.
Right now the water comes over the. wall at at extreme high tide and is contributing to the failure and
erosion. The house and structures actually site much higher --hence also the need for a taller wall.

You can send a verification of the absence of eelgrass from the City of
Newport Beach to me via email or FAX. We will submit this information to
NMFS and they will also need to verify the absence of eelgrass adjacent to
the project site. For structures built along the coast, shading can affect
eelgrass growth for some distance away from the structure. NMFS will be
interested in the height difference between the original and proposed
seawall.

We received your application for a seawall replacement at 2301
Bayside Drive and Tom Nelson is listed as the eelgrass and Caulerpa surveyor.
The National Marine Fisheries Service (NMFS) has indicated they will not
accept eelgrass surveys from Tom Nelson until further notice. A new survey
may not be necessary if the seawall replacement is in-kind (same footprint
and height as the original seawall). A quick review of your proposed project
indicates the height of the seawall will increase. Please describe the
proposed increase in seawall height and indicate whether the footprint of the
seawall will extend further seaward (and if so, describe how much further
seaward).
We will send this information to NMFS and they will determine whether
a new survey is necessary and/or acceptable. The normal eelgrass survey
period ends October 3 1; however, due to these recent developments, NMFS may
accept eelgrass surveys until November 1.3, 2009 with prior approval. If a
new eelgrass survey is necessary and cannot be conducted prior to November
13, 2009, you may need to wait until March 1, 2010 to conduct the necessary
eelgrass surveys.
Important:
1) If a new celgrass survey is required, you will need to contact
the California Coastal Commission and ensure they will accept eelgrass
surveys conducted between November I and November 13, 2009.
2) NMFS will also begin enforcing eelgrass and Caulerpa mapping
standards described in the Southern California Eelgrass Mitigation Policy.
Please ensure surveyors are aware of this policy and provide the appropriate
inforination.
3) If there are any other pending projects involving eelgrass
surveys or if you have submitted any other pending projects to us, please let
me know.

ISSUE:
Mr. Tim Byrne who lives at 2233 Bayside Dr, wishes install a Poly Lift boat system at his
new dock that is currently under construction. Harbor Resources has denied this
request due to the design that is inherent to all Poly Lift boat lifts which include a deck
that wraps around most of the vessel. Mr. Leonard Ozar of Poly Lift Systems is
appealing Harbor Resources decision.
ALTERNATIVES:
If desired, the Harbor Commission may:
Support Harbor Resources decision and deny this type of boat lift with the wrap
around deck to be used at this location and;
a) Advise Harbor Resources to evaluate future submittals on a case by case
basis considering the Poly Lift Systems to be an extension of the dock
and;
b) Evaluate conformance with applicable standards and policy related to
docks.
Reverse Harbor Resources decision and allow this type of boat lift with the wrap
around deck to be used at this location.
BACKGROUND:
Mr. Byrne is currently rebuilding his shared dock on Bayside Dr. and he intends on using
the Poly Lift boat system to raise and lower his vessel. Mr. Czar, President of Poly Lift
Systems of Southern California, approached Harbor Resources to confirm that his
product would conform to City standards for lifts. The City does not have any
specifications regarding air actuated lifts. Several of the harbor residents use the
HydroHoist style lifts which are similar in functionality yet they typically do not use the
wide decking as proposed with the Poly Lift product line.

Proposed Poly Lift Configuration
Mr. Ozer maintains that the decking is an integral part of the design of the Poly Lift
system and that it is needed from a structural point of view.
Harbor Resources believes the decking on the Poly Lift system creates an extension of
the existing dock system at a residential or commercial dock. In other words, the
decking adds usable walkway surface square footage to a dock when this additional
square footage might not have been approved if it were to be built as part of the
permanent dock system. If taken to the extreme, this extra walkway surface may
present other problems elsewhere in the Harbor. As an example, the current Policy
states that all docks on Balboa Island are not permitted to increase the overall square
footage when undergoing a reconstruction change. If the Poly Lift system with the
walkway surface was approved in the harbor, a potential resident on Balboa Island could
reconstruct their pier per the guidelines then purchase a lift with a walkway surface,
therefore increasing the overall square footage of their usable walkway / decking
surface.
The overriding question is whether to treat this Poly Lift system with the decking as an
extension of the dock or as an appurtenance of the vessel. If it is considered an
extension of the dock, then it must conform to the City's current construction standards,
particularly in width and stability, It would also have to abide by the 5 foot setback rule
to the property line. On the other hand, if it were considered an appurtenance of the
vessel, the system would be allowed to extend up to the property line. Historically,

Harbor Resources has considered the typical HydroHoist style boat lift (without decking)
to be an appurtenance of the vessel and it may extend up to the property line.
After consideration, Harbor Resources feels the Poly Lift system with the wrap around
decking to be an extension of the existing float. Therefore, permission has been denied
to allow this type of lift to be installed.
ENVIRONMENTAL REVIEW:
The Harbor Commission's approval of this Agenda Item does not require environmental
review.

This agenda item has been noticed according to the Ralph M Brown Act (72 hours in

With reference to the plans currently under consideration to reconfigure or modify the dock
system, the following conditions will now be in effect on the above referenced pier.
1. The pier permittee is aware of the Harbor Permit Policies and Chapter 17 of the City of
Newport Beach Municipal Code. The pier permittee understands that the above referenced
pier is under the purview of these Policies and Codes.

To try and resolve an unpermitted structure problem we issued several administrative citations to Brian Ray to no

existing dock/float encroacl-truent as shown in survey, pursuant to your letter to him dated

To clarify my understanding of the encroachment and what is to be removed, I have
attached a copy of Mr. Ray's survey prepared by RdM Surveying, dated February 2,
2000, which shows the encroachment into the set back as well as over our common
property li tie.
Even though more than two months has passed from the date of your letter, I trust that the
correction can be accomplished with 15 days, as roquired. Will you please hiform me as
to when the removal is expceted to be completed.

Based on the survey you provided to us, a portion of your float now
encroaches across the bayward extension of the property line between
2233 and 2231 Bayside Drive. This has been a problem of long standing
and I know there have been a number of issues that needed to be
resolved. 'It is my understanding that every�hing has been resolved at
this time. As a result, the encroachment must be removed within the
next 15 days.
In addition you asked whether your dock could be rotated to the
Southeast. It could but this would present a problem for the property
along that side. It does appear based upon the permit policies,
however, you could propose that revision. At a minimum, now the
existing encroachment must be removed. A proposal to rotate your
float could be considered in the future.

Dear Mr. Ray:
The Fire and Marine Department is denying your application to allow
your float to exist in its current as -built condition. Based on a survey
provi ' ded to us on January 3, 2000, the dock not only encroaches within
the set back but also extends across the bayward extension of the -
corm -non property line between your property and the property at-2-227—
Bayside Drive. z:e--51
We could allow the dock extension to exist within the five foot set back
right up to the common property line but cannot allow an
encroachment across the bayward extension of the common property
line between the two properties. The basis of us allowing you to extend
into the set back is provided for us in the Harbor Pern-dt Policies under
the section titled Exceptions which states, "Exceptions may be
approved to any of the requirements and regulations set forth. If there
are special circumstances or conditions affecting the harbor front
installation that would impose undue hardship on the applicant."
It is our opinion, based on the fact that you have a very small usable
permit area, that it would be unfair to not allow you full use of the
water including the set back area,
Your second request was to allow you to berth a boat at your dock that
would encroach across the bdyward extension of the side property line
shared with the property at 2227. TI -ds would be in violation of Section
21 of the City Council Policies dealing with moorings or boats, which
states, "Boats moored at private docks shall not extend beyond the
projection of the property lines of the property of which the dock
facility is connected in accordance with 20-C."
I realize that this creates a hardsl-dp for you and it could be argued that
the exception process mentioned above should apply. There is,
however, a distinction to be made relative to your first request versus
your second. Encroachment into the set back, in our opinion, would
have little or no impact on your neighbor., In contrast, allowing you
use of the water area outside your current permi't zone would impact
your neighbor. Both of these permits are very old and the permit zones
have been defined for years and although there is some evidence to the
contrary, they have been used consistent with the designated permit
zones. To change that now without agreement of all parties effected
would be inappropriate and is the basis for our denial on tl-ds issue,
On another issue, you asked if it would be possible for you to solve the
encroachment across the bay.ward extension of the common property
line by reorienting the float and positioning it parallel with your
property lines. That could be done, again the usable area for your float
would be the bayward extension of both your propeAy lines.
Please be advised if you wish to appeal the decision of the Fire and
Marine Department you have 14 days from notice of our decision to file
an appeal with the City Manager's Office.

Attaclunent to Harbor Permit Application Brian and Crystal Ray
July 1, 1999 2233 Bayside Drive
This is an application for an "as builf' replacement dock located bayward of the residence of
Brian and Crystal Ray at 2233 Bayside Drive, Newport Beach. The prior dock was badly
damaged in the strong storms during the winter of 1997-98. The existing dock was built after the
Fire and Marine Department of the City of Newport Beach approved a Harbor Permit
Application, dated 2/10/98. The new dock is the same length and substantially the same
configuration as the dock that was destroyed. A noted exception is the new dock, also L-shaped,
has a relatively minor, four -foot extension of its base to accommodate the dry-docking of the
Applicants' two personal watercraft.
After the construction of the new dock was completed, the City Staff received a complaint from
Craig Combs, who owns the neighboring house and dock at 2301 Bayside Drive. Mr. Combs
thought a portion of the four -foot extension, while within the projection of the Applicants'
property lines, encroached into the generally required five-foot set back. The City Staff
determined it did, and a citation was issued "for work to dock not according to Harbor Permit
Policies." The citation required the removal of the encroaching section. The Applicants
appealed the citation.
The Applicants believe the City's exception to the five-foot setback, contained in Section 20C,
applies to this situation because of the non -perpendicular lot lines and the curving bulkhead
along Carnation Cove. Therefore, the Applicants believe they should not be required to maintain
a five-foot setback for their dock. As shown on the City's aerial photos, many of the docks of
other homeowners in Carnation Cove do not comply with the five-foot setback, because they
also fall under this applicable exception. It would be a practical hardship or impossibility for all
of the homeowners in this part of the bay to both maintain a strict five foot setback and still
enjoy the use of their docks.
At the hearing on the appeal, it was held that the five foot set back may not apply to the docks
bayward of the homes along Carnation Cove, as suggested by the Applicants. However, the
hearing officer upheld the citation on another ground. During the appeal hearing the City Staff
pointed out that the Applicants' contractor, Swift Slips, checked the wrong box on the
application. He checked "maintenance" instead of "revision." Maintenance is only appropriate
where there is no change in configuration. With the four -foot addition, even though the dock
was substantially the same L -shape and the square footage was increased by only a small
fi-action, arguably it was a minor change in configuration. The hearing officer denied the appeal
for that reason. It appears the mistake on the application was either an inadvertent error or a
misunderstanding of the difference between "revision" and "maintenance" (which terms are not
defined in the Harbor Permit Policy.)
As stated above, the entire pier and dock, including the additional four feet, is within the
projection of the Applicants' property lines. It is in compliance with the Encroachment Permit
obtained by the Applicants from the County of Orange. The Encroachment Permit, which is
renewed annually, allows the Applicants to have a pier on public tidelands as long as it is within
the projection of the property lines. However, the County's permit is silent with regard to any
setbacks. The County defers to the 'City to set policy in this regard.
The Applicants request that the City of Newport Beach approve, as a part of this Harbor Permit
Application, the following (or substantially similar language):
"The five-foot setback that is generally required in the Harbor Permit Policy, Section 20,
should not be strictly applied to the subject property because (1) the property lines at
2233 Bayside Drive are not approximately perpendicular to the bulkhead line and (2) a
curve exists in the bulkhead line along Carnation Cove. Because of these unusual
physical conditions, special consideration will allow the Applicants to build and maintain
a pier and dock as long as it is within the projections of the property lines, but not
necessarily within a five-foot setback. It appears the exception in the Harbor Permit
Policy at Paragraph 20C applies to this situation. Tlierefore, existing pier and dock are
allowed."
More importantly, the Applicants need to be able to use the dock. It appears Section 2 1 A of the
Harbor Permit Policy allows a boat to extend beyond the projection of the property lines where
the physical conditions of Paragraph 20C apply, as they do here. Without this additional
condition (or similar language), the Applicants would be unable to use their dock:
"Furthermore, the Applicants have the right to moor a boat with a length consistent with
Harbor Permit Policy Paragraph 21 B and with a beam of up to 15 feet. 'Me boat may be
moored on the northwest side of their dock, even if the boat extends beyond the
projection of the property line between the subject and the neighboring lots."
The Applicants' dock is designed and built to accommodate the berthing of two boats, one up to
34 feet in length and one up to 45 feet in length, and there is ample room for a boat on the
northwest side of the dock without adversely impacting the neighbor's reasonable use of his
dock. Historically, since 1963, boats of varying sizes owned by the previous homeowners of
2233 Bayside Drive have side tied to this dock or its predecessor, even though the boats have had
to straddle the projection of the lot line. This has been done in the past by informal, verbal
agreements between friendly property owners. Many of the other property owners in Carnation
Cove, and other similar areas in the bay, have boats that extend over their property lines.
Finally, the Applicants also request that the City Manager reconsider Citation No. MC 99008 and
dismiss it, even though the appeal was denied. If the citation cannot be dismissed, in the
alternative, the Applicants request that the fine be waived and the required correction (remove
the encroaching section of dock) be deleted. If the setback does not apply here, then there is no
encroachment.

A. County hereby grants to permittee the right to use and occupy a portion of those lands,
commonly referred to as "Tidelands", conveyed to County of Orange on May 25, 1919, by
Act of Legislature of the State of Califohia.
This permit is issued subject to applicable Ordinances of the County of Orange. Validation
of permitted use may be subject to approval of the Coastal Commission, U.S. Army Corps
of Engineers, City of Newport Beach and other regulatory entities.
B. This permit may be revoked by County and permittee agrees, upon, notification from the
Director of Public Facilities & Resources, or his designated representative, to remove,
relocate, reconstruct or modify subject pier, including floating dock and ramp, at no
expense to County.
If litigation is required by County to enforce the terms of this permit because of breach or
default by permittee, County shall be entitled to recover from permittee administrative and
legal costs.
C. Permittee agrees to maintain the permitted facilities in good and substantial repair and
condition. All improvements shall remain the property of permittee during the terms of
this permit. County shall have no obligation to permittee for the condition of the
improvements. Permittee shall make all necessary repairs or improvements, including, but
not limited to the maintenance of piers, moorings, buoys, walk -ways, plumbing and
electrical installations (including lighting). Permittee further agrees to keep the area free
and clear of rubbish, debris and litter at all times.
D. By acceptance of this permit, it is understood and agreed that the term of this pennit is for
a maximuni period of twelve months and expires on December 31 of the year issued.
Permit fee is non-refundable, non-proratable and determined by the Board of Super -visors.
Fee is due and payable on January I of each applicable year.
Failure to pay applicable fees by date due, following notification by County will void
permitted use.
E, Perinittee acknowledges that County Tidelands utilized under this permit are for the
recreational use of the fee owners or long-term lease holders of the adjacent uplands and if
the facilities are rented, leased or used in any manner for applicant's financial gain, permit
will be automatically forfeited.
This permit is not subject to transfer, assignment, alienation, pledging or hypothecation;
any change in ownership requires a new permit.

G. Any improvement is limited to a single pier and float or slip bayward of each parcel or lot.
Construction of any other improvements on the County Tidelands, including bulkheads,
walks, decks and retaining walls is prohibited under the scope of this pem-iit.
H. Permittee shall provide the County with verification of combined single limit insurance in
the amount of Five Hundred Thousand Dollars ($500,000) for publicliability and property
damage, from an insurance company satisfactory to County, in which the County of
Orange and the State of California shall be named as additional insured with permittee.
The insurance verification certificate must contain a clause requiring the insurance
company to give the County thirty (30) days �� notice prior to any change in
insurance coverage. Property coverages must contain a standard subrogation clause.
This permit shall not be effective until evidence of such insurance is on file with this office
and is approved by the Office of the County Counsel. The insurance certificate shall refer
to this permit application number and be mailed to County of Orange, County Property
Permits, P.O. Box 4048, Santa Ana, CA, 92702-4048.

The County of Orange Public Facilities and Resources Department has
responded to Mr. Higbie's request to review the City of Newport Beach Harbor
Permit Policy as it affects your harbor permit area bayward from your property
at 2223 Bayside Drive (see attached).
The County has elected not to intercede in this issue and defers to the City to
administer the boundaries and establish policy regarding construction of
private improvements.
The City of Newport Beach Fire and Marine Department requires that portion
of your dock that is within the five (5) foot set back to be removed by February
12, 1999. Failure to comply with this request will result in a second citation.
The level of citation is now pending and you may be cited each day the
violation exists beyond the February 12, 1999, completion date.

Gentlemen:
This is in response to the letter sent to the Board of Supervisors on

In the first paragraph of the above mentioned letter, Mr. Higbie stated

Gentlemen:
A problem has arisen in Carnation Cove in the City of Newport Beach-
-nothing serious but only the Board can solve it. A number of piers
permitted by the City of Newport Beach extend into tidelands which
are within the jurisdiction of the County of Orange. The various
pier owners have permits for the piers but the permits do not define
the water space available to the individual pier user. There is the
potential for a misunderstanding and an actual dispute has arisen
between two of the owners each claiming the right to use the same
water space.
A complaint was made to the Director of the Marine Department City
of Newport Beach for a resolution. The director was unwilling to
settle the dispute because of the County rights over the particular
tidelands involved. A map is enclosed which will show the area.
How does the county wish the parties to proceed for a ruling on this
issue? If the county will set a hearing on the right to exclusive
use of its tidelands for the mooring of a vessel at a permitted
pier, the matter can be resolved with reference to that policy. The
Board M4ght also refer the matter to the City of Newport Beach for
resolution according to its established policies which prevail in
the balance of the harbor.
If the Board wishes any further information it will be provided.

Dear Tony,
In your letter to Mr. Ray of June 26" you advised him that an inspection by your staff in
mid June revealed that his pier and float had been illegally modified. You informed Mr.
Ray and his contractor Swift Slip that they are in violation of the City of Newport Beach
Harbor Permit Policy, Section 20-C.
On July 21" a Notice of Violation was issued with a correction date set by August 3 d . To
date, no corrections have been made. Has an Administrative Citation been issued? More
importantly when will (his illegal encroachment be corrected?
Will you please apprise me of the resolution of this matter as soon as possible?

Dear Mr. Combs:
In response to your recent inquiry regarding the status of the
encroachment at 2233 Bayside Drive, this office issued a Notice of
Violation on July 21, 1998, to the property owner with a correction date
of August 3,1998.
If the violation exist on August 3, an Administrative Citation will be
issued. If the violation is not corrected within a specified time, a second,
or third citation will be issued if necessary. The citations have
monetaxy penalties up to $500.
If you have further questions regarding this matter, please call 644-
3043.

Reference is made to your letter of June 26, 1998, to Mr. Ray, in which your field
inspection revealed that Mr. Ray's pier and float has been modified resulting in an
encroachment into our adjoining property and construction of a non -permitted pier and
float.
It has been over one month since your letter notifying Mr. Ray of the violation and
request to correct it within ten days by removing the added float extension.
Will you please inform me, at your earliest convenience, of the status, timing and your
enforcement action to correct the violation.

The City of Newport Beach Marine Department has received a request
to transfer pier permit 0105-2233-1 for the property located at
2233 bayside Drive, Corona Del Mar, CA. The facility was inspected
on July 18, 1995.
we cannot transfer the pier permituntil the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is nojoi�ger
an approved backflow prevention device. This requirement is in
accordance with Title 17 of the California Administrative Code.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City Is minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."

If desired, amend the Harbor Permit Policies Section 16.A. to
include the following paragraph:
"U.S. Bulkhead Station 104 for the addresses at 2209, 2223, 2227,
2231 and 2233 Bayside Drive: Recommendations for bulkheads bayward
of the above properties shall require a special permit approved by
the City Council. Staff recommendation for a bulkhead at these
properties shall not exceed a point bayward of the average high
tide line established at a point 40 feet landward of the face of
the.bulkhead at the property at 2137 Bayside Drive, and then on a
straight line from that point to the bayward most point of the
bulkhead at the property at 2301 Bayside Drive." (see attached
exhibit)
Background:
On March 12, 1990, an application was made by Lynn Burnett to build
a new bulkhead bayward of 2209 Bayside Drive. The proposed
location of that bulkhead was at the same location as the bulkhead
at 2137 Bayside Drive, approximately 40 feet bayward of the high
tide line of the sandy sloping beach.

on December 8, 1989 a survey crew from the City of Newport Beach
Public Works Deprtment will be on the beaches bayward of your
property. The purpose of the survey is to establish the existing
beach profile, in an effort to make an recommendation to the City
Council for approved locations for bulkheads for the properties
that have yet to bulkhead.
After we have established the existing beach profile we will
contact each property owner to solicit input relative to the
possible location of a bulkhead and then staff will make a
recommendation to the City Council for a policy establishing a
bulkhead location for the properties that are not bulkheaded.

1. COUNTY grants to PERMITTEE the right to use and occupy a portion of
5 those lands, commonly referred to as Tidelafids, conveyed to COUNTY
May 25, 1919, by act of the Legislature of the State of California.
6 Said Tidelands are more specifically identified by Exhibit "A,"
attached hereto and by reference made a part hereof, and are
7 hereinafter referred to as the "Demised Premises."
8 2. The Pemised Premises shall be used for the sole purpose of a private
recreational pier by the owner of the single-family residential
9 property adjoining the Demised Premises (PERMITTEE).
10 3. The term of this Agreement shall be January 1, 1976 through
December 31, 1985 and may be extended from year to year on the same
11 terms and:conditions as herein contained. Such extension shall be
effective�upon the payment by PERMITTEE and acceptance by COUNTY of
12 the rental specified in Clause 4 below.
13 4. PERMITTEE agrees to pay to COUNTY as rental for use of the Demised
Premises, during the full term of this Agreement, the sum of
14 One Hundred Dollars ($100.00) per annum. The first year's rental
W, shall be due and payable,upon execution of this Agreement. For
15 each successive year, rental shall be due and payable in advance

Santa Ana, California 92702. The place of payment may be changed
18 at any time by COUNTY upon ten (10) days' written notice to
PERMITTEE.
19 5. If money payable to COUNTY as A condition of this Agreement is not
20 paid within ten (10) days after due date, a late charge of one
percent (1%) of the payment due and unpaid plus.$25.00 shall be
21 added to the payment and the total sum shall become immediate ly
due and payable to Lessor. An additional charge of one percent
22 (1%) of said payment, excluding late charges, shall be added for
23 each additional month that said payment remains unpaid.
6. This Agreement and any rights herein conveyed are subject to the

General Conditions attached hereto and by reference incorporated
herein. By execution of this Agreement, PERMITTEE agrees to comply
25 with and be bound by said conditions and all other terms hereof.

GENERAL CONDITIONS
1. PERMITTEE shall indemnify and save harmless COUNTY, its officers,
agents, and employees, from and against any and all claims, demands,
loss or liability of any kind or nature which COUNTY, its officers,
agents, and employees may sustain or incur or which may be imposed
upon them or any of them for injury to or death of persons, or
damage to property as a result of, arising out of, or in any manner
.connected with this Agreement or with occupancy and use of County
Tidelands by PM%IITTEE', its officers, agents, employees, subtenants,
licensees, patrons, or visitors.
2.. PERMITTEE agrees and certifies by signing this Agreement that he
shall maintain comprehensive public liability insurance in full
force throughout the term of this Agreement Said policy shall have
limits of not less than $100,000 and $300,060 for injuries to person
or persons, and not less than $100,000 for property damage.
3. Should PERMITTEE default in the performance of any covenant, condi-
tion, or agreement contained in this'AgreOment, and such default is
not corrected within a reasonable time after written notice of
default from COUNTY, COUNTY may terminate this Agreement. All rights
of.PERMITTEE and those who claim under PERMITTEE, stemming from
this Agreement, shall end at the time of such termination. In the
event of such termination, PERMITTEE forfeits and waives any and all
claim or right to PEMITTEE's recreational pier and COUNTY may, at
its discretion, remove, demolish or sell pier. PERMITTEE agrees to
reimburse COUNTY the reasonable costs of such removal, sale or
demolition.
If litigation is required by COU14TY to enforce the terms of this ,
Agreement because of breach or default by PERMITTEE, COUNTY shall be
entitled to recover from PERMITTEE attorney's fees, as fixed by the
Court, including all costs of the services of the office of County
Counsel.
4. This Agreement and the rights and privileges granted PERMITTEE in
and to the Demised Premises are subject to all covenants, condi-
tions, restrictions, and exceptions of record or apparent, includ-
ing those which are set out in the Tideland Grant by the State of
California to the County of Orange (Chapter 575, Statutes of 1929,
State of California), and.those set out in Uniform Building Code,
National Electrical Code, Uniform Plumbing Code, all as amended and
adopted by the County of Orange, and all fire protection ordinances
and rules and regulations of the Orange County Fire Protection
Department, and County of Orange Ordinances, Title 2, Division 2,
Article 10, Sections 2-2-148, 149, 150, 151, 152, as well as other
applicable ordinances of the County of Orange and codes and speci-
fications of County, State, and Federal Agencies.
5. Neither this Agreement norany of the r ights herein granted shall
be assigned without the prior written approval of COUNTY. Such
approval shall be obtained prior to the closing of escrow on the
adjacent uplands, and shall be a condition of said escrow.

PERMITTEE agrees no improvements shall be erected, placed upon,
operated nor maintained on the Demised Premises, nor any business
conducted or carried on therein or therefrom in violation of the
terms of this Agreement, or of any regulation, order of law,
statute, bylaw, or ordinance of a governmental agency having

7. PERMITTEE shall keep and maintain the Demised Premises and any
improvements thereon in good and substantial repair and conditions. All
improvements within the Demised Promises shall remiin the property of
PEP"MITTEE during the term of this Agreement. COUNTY shall have no
obligation to PEMIITTEE for the condition of the improvements or for
the condition of the Demised Premises. PEMMITTEE shall make all.
necessary repairs or improvements, including, but not limited to, the
maintenance of piers, moorings, buoys, walkvays, plumbing and electrical
installations (including lighting). PEIUIITTEE further agrees to keep
the Demised Premises free and clear of rubbish, debris, and litter at
all times.
8. In the event all or part of the boat -berthing facility covered by
this Agreement is constructed after January I of the current year, the
applicable annual rental charge for the newly constructed portion shall
be prorated from the first day of the first month following completion
of 'construction to year's end. For the purposes of this Agreement,
completion of construction shall mean the date the facility was sub-
stantially in place and capable of berthing a vessel.
0 'F ----e shall be given a credit for all rentals paid by current
Lessee to the COUNTY pursuant to Resolution No, 71-1399,.Iess amounts
chargeable as rental from January 1, 1972 or the date Lessee took title
to the adjacent uplands, whichever is later, through December 31, 1975,
at an annual rental of $100 prorated on a 30 -day month - 360 day year
basis.
10. Lessee and his successors and assigns covenant that no action,shall
be brought against the COUNTY, -or its servants and employees, with
respect to any rental payment made or due hereunder or made for the
period of January 1, 1972 to December 21, 1975, provided credit is given
in accordance with Clause,9 hereof.

On motion of Supervisor Caspers, duly seconded and carried,
the following Resolution was adopted:
WHEREAS, this Board is in receipt of an opinion of the County
Counsel of Orange County that the California Constitution requires that
this County impose a fee equivalent to fair market value for the use of
public tidelands for private purposes; and
WHEREAS, this Board, on Septeri�ber 7, 1971, declared its intent
to impose fees for the use of County tidelands in Newport Harbor; and
WHEREAS,. in the opinion of this Board such fees should now be
imposed ;
NOW, THEREFORE, BE IT RESOLVED as follows:
I.. Effective January 1, 1972, the following fees are hereby
.imposed for the use of County tidelands in Newport Harbor:
A. An annual rate of $5.50 per lineal foot of
boat slip or length of vessel docked, whichever is
greater, for private residen tial piers.
B. .$6.00 per lineal foot per annum of mooring
based on the length of vessel the mooring is capable
of anchoring in lieu of the present fee.
C. A charge of $4.00 per night for use of guest
slips o�-med or operated by the Orange County Harbor
District or the County of Orange.
2. The Director of Harborsj Beaches and Parks is authorized
to execute permits imposing these charges on behalf of the County of
Orange for use of County tidelands under this Resolution for periods
not in excess of one year.

On August 5. 1975, the Board of Supervisors enacted Resolution
No. 75-1096 which approves of a proposed settlement submitted
by Counsel for the affected litto-ral lando-aners who have private
recreational piers on County Tideland Waters in the Bay of
Newport Harbor. This approval by the Loard of Supervisors is
subject to Court approval which is expected in the latter part
of December.
In view of the requirement that the rental fees must be submitted
to the County prior to December 31, 1975�:` the attached'! --ase and
billing are now being sent to allow you sufficient time to comply
with the deadline.

to complete. Please retain the P-P,!D copy of the agreement and

Discussion
These applications require City Council approval under the conditions
Of approval of the City of Newport Beach "blanket" permit for main-
tenance dredging issued on February 12 by the U. S. Army Corps of
Engineers.
The locations and applicants of the proposed maintenance dredging
applications are:
2319 Bayside Dr. - Mr. Liston
2301 Bayside Dr. - Mr. I. Burg
71 Linda Isle - Mr. B. Pascoe
800 Via Lido Nord - Mr. C. Westering

The staff has reviewed the proposed dredging and have determined that
the work to be done is within the parameters of the Corps of.Engineers
permit. There is no anticipated adverse affect on proximity beaches
or contiguous bulkheads.

CONDITIONS
The Applicant Warrants and Agrees That:
I . The attached exhibit furnished by the applicant shows accurately the location, extent, and character of the work
for which this permit is granted.
2. The County tidelands utilized under this permit are for the recreational use of the fee owners or long-term lease
holders of the adjacent uplands, and if the facilities are rented, leased, or used in any manner for the applicant's
financial gain, the permit will be outomaticolly forfeited.
3. This permit is not subject to transfer, assignment, alienation, pledging or hypothecation; any change in owner-
ship requires a now permit.
4. The County of Orange retains authority to cancel the permit without cause upon 30 days written notice to the
Permittee's current mailing address kept on file with the Orange County Harbors, Beaches and Parks District,
1901 Boyside Drive, Newport Beach, California 92662.
5. In the event the Permittee is requested to remove any facilities, the removal will be mode and the site restored
to its prior unimproved condition at no expense to the County or the District. If the facilities are not removed as
requested, the Permittee acknowledges the financial responsibility and agrees to reimburse the County or the
District for any expense incurred in the removal of the facilities.
6. All facilities covered by this permit shall be maintained in good repair and failure to comply will be cause for
cancellation of the permit.
7. The permit shall be automatically forfeited in the event the facilities are unused by the applicant for a period of
one year.
8. The County has adopted a policy for the renting of tidelands to the adjacent property owners. The area covered
by this permit wi I] be subject to the fee.so established by Resolution 71-1399.
9. The County of Orange and the Orange County Harbors, Beaches and Parks District shall be hold harmless from
any and all liabilities arising out of use of these tidelands.
10. This permit does not eliminate the need for other permits for construction and use of facilities, as may be re-
quired by other governmentcl agencies.
11. The improvement is limited to a single pier and float or slip bayward of each parcel or lot.
