As for the height --- the current failing wall is + 6 MLLW and there is a garden wall a bit behind it, poured on top of the patio area that is +9.25 MLLW. The MINIMUM height requirement for the seawall, per City of Newport Beach code is + 9 MLLW so the height difterental is a Building Code requirement --the 9.25 MLLW will bring it into compliance and make it match with existing structures around it. Right now the water comes over the. wall at at extreme high tide and is contributing to the failure and erosion. The house and structures actually site much higher --hence also the need for a taller wall. Reverse Harbor Resources decision and allow this type of boat lift with the wrap around deck to be used at this location. BACKGROUND: Mr. Byrne is currently rebuilding his shared dock on Bayside Dr. and he intends on using the Poly Lift boat system to raise and lower his vessel. Mr. Czar, President of Poly Lift Systems of Southern California, approached Harbor Resources to confirm that his product would conform to City standards for lifts. The City does not have any specifications regarding air actuated lifts. Several of the harbor residents use the HydroHoist style lifts which are similar in functionality yet they typically do not use the wide decking as proposed with the Poly Lift product line. Poly Lift Systems Appeal September 14, 2005 Page 2 Proposed Poly Lift Configuration Mr. Ozer maintains that the decking is an integral part of the design of the Poly Lift system and that it is needed from a structural point of view. Harbor Resources believes the decking on the Poly Lift system creates an extension of the existing dock system at a residential or commercial dock. In other words, the decking adds usable walkway surface square footage to a dock when this additional square footage might not have been approved if it were to be built as part of the permanent dock system. If taken to the extreme, this extra walkway surface may present other problems elsewhere in the Harbor. As an example, the current Policy states that all docks on Balboa Island are not permitted to increase the overall square footage when undergoing a reconstruction change. If the Poly Lift system with the walkway surface was approved in the harbor, a potential resident on Balboa Island could reconstruct their pier per the guidelines then purchase a lift with a walkway surface, therefore increasing the overall square footage of their usable walkway / decking surface. The overriding question is whether to treat this Poly Lift system with the decking as an extension of the dock or as an appurtenance of the vessel. If it is considered an extension of the dock, then it must conform to the City's current construction standards, particularly in width and stability, It would also have to abide by the 5 foot setback rule to the property line. On the other hand, if it were considered an appurtenance of the vessel, the system would be allowed to extend up to the property line. Historically, Poly Lift Systems Appeal September 14, 2005 Page 3 Harbor Resources has considered the typical HydroHoist style boat lift (without decking) to be an appurtenance of the vessel and it may extend up to the property line. After consideration, Harbor Resources feels the Poly Lift system with the wrap around decking to be an extension of the existing float. It is our opinion, based on the fact that you have a very small usable permit area, that it would be unfair to not allow you full use of the water including the set back area, Your second request was to allow you to berth a boat at your dock that would encroach across the bdyward extension of the side property line shared with the property at 2227. TI -ds would be in violation of Section 21 of the City Council Policies dealing with moorings or boats, which states, "Boats moored at private docks shall not extend beyond the projection of the property lines of the property of which the dock facility is connected in accordance with 20-C." I realize that this creates a hardsl-dp for you and it could be argued that the exception process mentioned above should apply. There is, however, a distinction to be made relative to your first request versus your second. Sincerely, 2�7 / In Tony Melurn Deputy Cl -def Marine Environmental Division Attaclunent to Harbor Permit Application Brian and Crystal Ray July 1, 1999 2233 Bayside Drive This is an application for an "as builf' replacement dock located bayward of the residence of Brian and Crystal Ray at 2233 Bayside Drive, Newport Beach. The prior dock was badly damaged in the strong storms during the winter of 1997-98. The existing dock was built after the Fire and Marine Department of the City of Newport Beach approved a Harbor Permit Application, dated 2/10/98. The new dock is the same length and substantially the same configuration as the dock that was destroyed. A noted exception is the new dock, also L-shaped, has a relatively minor, four -foot extension of its base to accommodate the dry-docking of the Applicants' two personal watercraft. After the construction of the new dock was completed, the City Staff received a complaint from Craig Combs, who owns the neighboring house and dock at 2301 Bayside Drive. Mr. Combs thought a portion of the four -foot extension, while within the projection of the Applicants' property lines, encroached into the generally required five-foot set back. The City Staff determined it did, and a citation was issued "for work to dock not according to Harbor Permit Policies." The citation required the removal of the encroaching section. The Applicants appealed the citation. The Applicants believe the City's exception to the five-foot setback, contained in Section 20C, applies to this situation because of the non -perpendicular lot lines and the curving bulkhead along Carnation Cove. Therefore, the Applicants believe they should not be required to maintain a five-foot setback for their dock. As shown on the City's aerial photos, many of the docks of other homeowners in Carnation Cove do not comply with the five-foot setback, because they also fall under this applicable exception. It would be a practical hardship or impossibility for all of the homeowners in this part of the bay to both maintain a strict five foot setback and still enjoy the use of their docks. At the hearing on the appeal, it was held that the five foot set back may not apply to the docks bayward of the homes along Carnation Cove, as suggested by the Applicants. However, the hearing officer upheld the citation on another ground. During the appeal hearing the City Staff pointed out that the Applicants' contractor, Swift Slips, checked the wrong box on the application. He checked "maintenance" instead of "revision." Maintenance is only appropriate where there is no change in configuration. With the four -foot addition, even though the dock was substantially the same L -shape and the square footage was increased by only a small fi-action, arguably it was a minor change in configuration. The hearing officer denied the appeal for that reason. It appears the mistake on the application was either an inadvertent error or a misunderstanding of the difference between "revision" and "maintenance" (which terms are not defined in the Harbor Permit Policy.) As stated above, the entire pier and dock, including the additional four feet, is within the projection of the Applicants' property lines. It is in compliance with the Encroachment Permit obtained by the Applicants from the County of Orange. The Encroachment Permit, which is renewed annually, allows the Applicants to have a pier on public tidelands as long as it is within the projection of the property lines. However, the County's permit is silent with regard to any setbacks. The County defers to the 'City to set policy in this regard. The Applicants request that the City of Newport Beach approve, as a part of this Harbor Permit Application, the following (or substantially similar language): "The five-foot setback that is generally required in the Harbor Permit Policy, Section 20, should not be strictly applied to the subject property because (1) the property lines at 2233 Bayside Drive are not approximately perpendicular to the bulkhead line and (2) a curve exists in the bulkhead line along Carnation Cove. Because of these unusual physical conditions, special consideration will allow the Applicants to build and maintain a pier and dock as long as it is within the projections of the property lines, but not necessarily within a five-foot setback. It appears the exception in the Harbor Permit Policy at Paragraph 20C applies to this situation. Tlierefore, existing pier and dock are allowed." More importantly, the Applicants need to be able to use the dock. It appears Section 2 1 A of the Harbor Permit Policy allows a boat to extend beyond the projection of the property lines where the physical conditions of Paragraph 20C apply, as they do here. Without this additional condition (or similar language), the Applicants would be unable to use their dock: "Furthermore, the Applicants have the right to moor a boat with a length consistent with Harbor Permit Policy Paragraph 21 B and with a beam of up to 15 feet. 'Me boat may be moored on the northwest side of their dock, even if the boat extends beyond the projection of the property line between the subject and the neighboring lots." The Applicants' dock is designed and built to accommodate the berthing of two boats, one up to 34 feet in length and one up to 45 feet in length, and there is ample room for a boat on the northwest side of the dock without adversely impacting the neighbor's reasonable use of his dock. Historically, since 1963, boats of varying sizes owned by the previous homeowners of 2233 Bayside Drive have side tied to this dock or its predecessor, even though the boats have had to straddle the projection of the lot line. This has been done in the past by informal, verbal agreements between friendly property owners. Many of the other property owners in Carnation Cove, and other similar areas in the bay, have boats that extend over their property lines. Finally, the Applicants also request that the City Manager reconsider Citation No. MC 99008 and dismiss it, even though the appeal was denied. If the citation cannot be dismissed, in the alternative, the Applicants request that the fine be waived and the required correction (remove the encroaching section of dock) be deleted. C. Permittee agrees to maintain the permitted facilities in good and substantial repair and condition. All improvements shall remain the property of permittee during the terms of this permit. County shall have no obligation to permittee for the condition of the improvements. Permittee shall make all necessary repairs or improvements, including, but not limited to the maintenance of piers, moorings, buoys, walk -ways, plumbing and electrical installations (including lighting). Permittee further agrees to keep the area free and clear of rubbish, debris and litter at all times. D. By acceptance of this permit, it is understood and agreed that the term of this pennit is for a maximuni period of twelve months and expires on December 31 of the year issued. E, Perinittee acknowledges that County Tidelands utilized under this permit are for the recreational use of the fee owners or long-term lease holders of the adjacent uplands and if the facilities are rented, leased or used in any manner for applicant's financial gain, permit will be automatically forfeited. Permittee shall provide the County with verification of combined single limit insurance in the amount of Five Hundred Thousand Dollars ($500,000) for publicliability and property damage, from an insurance company satisfactory to County, in which the County of Orange and the State of California shall be named as additional insured with permittee. The insurance verification certificate must contain a clause requiring the insurance company to give the County thirty (30) days �� notice prior to any change in insurance coverage. Property coverages must contain a standard subrogation clause. A complaint was made to the Director of the Marine Department City of Newport Beach for a resolution. The director was unwilling to settle the dispute because of the County rights over the particular tidelands involved. A map is enclosed which will show the area. How does the county wish the parties to proceed for a ruling on this issue? If the county will set a hearing on the right to exclusive use of its tidelands for the mooring of a vessel at a permitted pier, the matter can be resolved with reference to that policy. The Board M4ght also refer the matter to the City of Newport Beach for resolution according to its established policies which prevail in the balance of the harbor. Staff recommendation for a bulkhead at these properties shall not exceed a point bayward of the average high tide line established at a point 40 feet landward of the face of the.bulkhead at the property at 2137 Bayside Drive, and then on a straight line from that point to the bayward most point of the bulkhead at the property at 2301 Bayside Drive." The Pemised Premises shall be used for the sole purpose of a private recreational pier by the owner of the single-family residential 9 property adjoining the Demised Premises (PERMITTEE). 10 3. PERMITTEE shall indemnify and save harmless COUNTY, its officers, agents, and employees, from and against any and all claims, demands, loss or liability of any kind or nature which COUNTY, its officers, agents, and employees may sustain or incur or which may be imposed upon them or any of them for injury to or death of persons, or damage to property as a result of, arising out of, or in any manner .connected with this Agreement or with occupancy and use of County Tidelands by PM%IITTEE', its officers, agents, employees, subtenants, licensees, patrons, or visitors. 2.. PERMITTEE agrees and certifies by signing this Agreement that he shall maintain comprehensive public liability insurance in full force throughout the term of this Agreement Said policy shall have limits of not less than $100,000 and $300,060 for injuries to person or persons, and not less than $100,000 for property damage. 3. Should PERMITTEE default in the performance of any covenant, condi- tion, or agreement contained in this'AgreOment, and such default is not corrected within a reasonable time after written notice of default from COUNTY, COUNTY may terminate this Agreement. All rights of.PERMITTEE and those who claim under PERMITTEE, stemming from this Agreement, shall end at the time of such termination. In the event of such termination, PERMITTEE forfeits and waives any and all claim or right to PEMITTEE's recreational pier and COUNTY may, at its discretion, remove, demolish or sell pier. PERMITTEE agrees to reimburse COUNTY the reasonable costs of such removal, sale or demolition. If litigation is required by COU14TY to enforce the terms of this , Agreement because of breach or default by PERMITTEE, COUNTY shall be entitled to recover from PERMITTEE attorney's fees, as fixed by the Court, including all costs of the services of the office of County Counsel. 4. This Agreement and the rights and privileges granted PERMITTEE in and to the Demised Premises are subject to all covenants, condi- tions, restrictions, and exceptions of record or apparent, includ- ing those which are set out in the Tideland Grant by the State of California to the County of Orange (Chapter 575, Statutes of 1929, State of California), and.those set out in Uniform Building Code, National Electrical Code, Uniform Plumbing Code, all as amended and adopted by the County of Orange, and all fire protection ordinances and rules and regulations of the Orange County Fire Protection Department, and County of Orange Ordinances, Title 2, Division 2, Article 10, Sections 2-2-148, 149, 150, 151, 152, as well as other applicable ordinances of the County of Orange and codes and speci- fications of County, State, and Federal Agencies. 5. Neither this Agreement norany of the r ights herein granted shall be assigned without the prior written approval of COUNTY. PERMITTEE shall keep and maintain the Demised Premises and any improvements thereon in good and substantial repair and conditions. COUNTY shall have no obligation to PEMIITTEE for the condition of the improvements or for the condition of the Demised Premises. PEMMITTEE shall make all. necessary repairs or improvements, including, but not limited to, the maintenance of piers, moorings, buoys, walkvays, plumbing and electrical installations (including lighting). PEIUIITTEE further agrees to keep the Demised Premises free and clear of rubbish, debris, and litter at all times. 8. In the event all or part of the boat -berthing facility covered by this Agreement is constructed after January I of the current year, the applicable annual rental charge for the newly constructed portion shall be prorated from the first day of the first month following completion of 'construction to year's end. For the purposes of this Agreement, completion of construction shall mean the date the facility was sub- stantially in place and capable of berthing a vessel. 0 'F ----e shall be given a credit for all rentals paid by current Lessee to the COUNTY pursuant to Resolution No, 71-1399,.Iess amounts chargeable as rental from January 1, 1972 or the date Lessee took title to the adjacent uplands, whichever is later, through December 31, 1975, at an annual rental of $100 prorated on a 30 -day month - 360 day year basis. 10.
