Dear West Coast Escrow;
The above dock was inspected by The Harbor Resources Division of the City of
Newport Beach at the property mentioned above.
We cannot transfer the pier permit until the following deficiencies have been corrected
and the property has been re -inspected:
1. It needs a new testable Backflow Prevention Device installed (please see diagram).
The Newport Beach City Municipal Code 17.60.030 states:
CA. Prior to the transfer of an annual pier permit, all harbor structures shall be
inspected for compliance with the City's minimum plumbing, electrical and
structural requirements, and the conditions of the existing permit. All structural
deficiencies must be corrected prior to the transfer of the permit. A fee will be
charged for this inspection, established by Resolution of the City Council.
Please call 949-644-3044 to request a reinspection. Once the property has passed
reinspection and we have the signed application, the pier will be transferred.

future owners and possessors of the subject property to the terms and conditions.
SPECIAL CONDITIONS: See pages 4-7
EXECUTIVE DIRECTOR'S DETERMINATION (continued):
The Executive Director hereby determines that the proposed development is a category of
development which, pursuant to PRC Section 30624, qualifies for approval by the
Executive Director through the issuance of an Administrative Permit. Subject to Standard
and Special Conditions as attached, said development is in conformity with the provisions
of Chapter 3 of the Coastal Act of 1976 and will not have any significant impacts on the
environment within the meaning of the California Environmental Quality Act. If located
between the nearest public road and the sea, this development is in conformity with the
public access and public recreation policies of Chapter 3.
FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION:
A. Promect Description and Backaround
The applicant proposes modifications to an existing boat dock including: install a new 4' by
4' gangway lobe with one new 12" concrete pile to the existing pier platform; in6tall new 3'
by 24' gangway; and re -deck existing approach, pier platform and floating dock.
The subject site is located on the Balboa Peninsula in Newport Harbor, near the harbor
entrance. The harbor side of the Balboa Peninsula, like the majority of harbor front homes
5-03-097 Hoyle
Page 3
in Newport Harbor, includes private recreational boat docks associated with residential
development. The proposed dock revision is similar in function to other docks associated
with residential development in the immediate vicinity. The boat dock will be used solely
for boating recreation purposes. The site has been surveyed by the City of Newport Beach
Harbor Resources Division for eelgrass and no eelgrass was discovered within 15 feet of
the project area. In addition, Special Condition 4 requires a Caulerpa taxilfolia survey not
more than 90 days prior to commencement of construction. The surveys are valid for a
limited period of time (until the next growing season for eelgrass and 90 days for Caulerpa
taxiltblia). If construction does not occur within the respective time periods, subsequent
surveys will be required.
Public access in the project vicinity exists along the ocean fronting sandy beach and at
Jetty View Park, both approximately two blocks south of the subject site (Exhibit A). The
proposed project has received approval in concept from the City of Newport Beach Harbor
Resources Division (Harbor Permit No. 107-2278). The applicant has applied for approval
of the proposed project from the U.S. Army Corps of Engineers. The project has received
approval from the California Regional Water Quality Control Board (RWQCB). The
RWQCB has determined that the proposed project will not adversely impact water quality if
standard construction methods and materials are used.
B. 'Recreational Marine Resources
The proposed recreational boat dock development and its associated structures are an
allowable and encouraged marine related use. The project design includes the minimum
sized pilings and the minimum number of pilings necessary for structural stability. There
are no feasible less environmentally damaging alternatives available. As conditioned, the
project will not significantly adversely impact eelgrass, beds and will not contribute to t ' he
dispersal of the invasive aquatic algae, Caulerpa taxifolia. Further, as proposed and
conditioned, the project, which is to be used solely for recreational boating purposes,
conforms with Sections 30224 and 30233 of the Coastal Act.
C. Water Qual it
The proposed dock work will be occurring on or within coastal waters. The storage or placement
of construction material, debris, or waste in a location where it could be discharged into coastal
waters would result in an adverse effect on the marine environment. To reduce the potential for
construction related impacts on water quality, the Commission imposes special conditions
requiring, but not limited to, the appropriate storage and handling of construction equipment and
materials to minimize the potential of pollutants to enter coastal waters and for the use of on-going
best management practices following construction. As conditioned, the Commission finds that the
development conforms with Sections 30230 and 32031 of the Coastal Act.
D. Public Access
As conditioned, the proposed development will not have any new adverse impact on public access
to the coast or to nearby recreational facilities. Thus, as conditioned, the proposed development

conforms with Sections 30210 through 30214, Sections 30220 through 30224, and 30252 of the
Coastal Act.
E. Local Coastal Proaram
The LUP for the City of Newport Beach was effectively certified on May 19, 1982. The certified
LUP was updated on January 9, 1990. As conditioned, the proposed development is consistent
with Chapter 3 of the Coastal Act and with the certified Land Use Plan for the area. Approval of
the project, as conditioned, will not prejudice the ability of the local government to prepare a Local
Coastal Program that is in conformity with the provisions of Chapter 3 of the Coastal Act.
F. California Environmental Quality Act (CEQA)
As conditioned, there are no feasible alternatives or feasible mitigation measures available
which would substantially lessen any significant adverse effect which the activity may have
on the environment. Therefore, the Commission finds that the proposed project, as
conditioned to mitigate the identified impacts, is the least environmentally damaging
feasible alternative and can be found consistent with the requirements of the Coastal Act
to conform to CEQA.

Re: Pier Permit 10722781 for 2278 Channel Road , #CO -12855 -TC
Dear Sirs:
The City of Newport Beach Harbor Resources Office has received a request to transfer
the above noted pier permit for 2278 Channel Road. The facility was inspected on
December 4, 2001. We cannot transfer the pier permit until the following deficiency has
been corrected and we have been notified of the correction:
The electrical receptacle on the pier/dock must be Gfl or Twist Lock for use in a water
environment.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

permit for activities which are substantially similar in nature, that
cause only minimal adverse environmental impacts when performed separately
and have minimal adverse cumulative effect on the environment. Upon
issuance of a general permit, all activities meeting the established cri-
teria are approved and will not require the submission of individual
permit applications.
This general permit also authorizes the modification and replacement of
existing boat docks but not the installation of new boat docks where none
exist in Dover Shores and around the perimeter of Balboa Island. Under no
circumstances will the general permit allow boat dock construction requir-
ing bulkheading, dredging, or filling below the Mean Higher High Water
(MHHW) elevation or in wetlands. Construction of a boat dock will not be
allowed across any beach designated for community or public use, unless
the new dock will replace an existing dock and cause no additional encum-
brances on beach recreation.
Typical drawings, depicting the most common types of installations that
are covered by this general permit, are included in this notice along
with a map showing those Navigable Waters of the United States where the
general permit is applicable.
The general permit covers both existing and proposed facilities within
any of the private property boundaries shown on the attached drawings.
Individual boat docks that do not conform to the established general
criteria will require a separate permit. The general permit is not

bayward of the piethead line.
