Please review our concept for re -attachment of the seawall earth anchors to the new basement
structure of the planned house. The California Coastal Commission requires the City of Newport
Beach Approval -In -Concept prior to accepting the Coastal submittal. We are working on this
project for Brion Jeannette Architecture. They have already submitted the application for permit
to Coastal, but was rejected based on not having a CIP specifically addressing the seawall plan.
There is no intent at this time for the applicant to request any change to the existing overhanging
deck. We are assuming that this deck will be left in-place during the re -attachment of the tie
rods to the existing concrete cap.

A copy of any variance, exception, conditional use permit or other issued permit is

concept and said approval has been written upon said plans, signed and dated.
Should Newport Beach adopt an ordinance deleting, amending or adding to the Zoning
Ordinance or other regulations in any manner that would affect the use of the property or
the design of a project located thereon, this approval in concept shall become null and
void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970, and state and local
guidelines adopted hereunder, this development:
O/Has been determined to be ministerial or categorically exempt.
o Has received a final Exemption Declaration or final Negative Declaration (copy
attached).
o Has received a Final Environmental Impact Report (copy attached).
All discretionary approvals legally required of Newport Beach prior to issuance of a
building permit have been given and are final. The development is not subject to
rejection in principal by Newport Beach unless a substantial change is proposed.
This concept approval in no way excuses the applicant from complying with all
applicable policies, ordinances, codes and regulations of Newport Beach. See attached
conditions to the pier permit.

The dock was inspected by the Harbor Resources Division of the City of Newport
Beach at the property mentioned above. We cannot transfer the pier permit until
the following deficiencies have been corrected and the property has been re-
inspected:
It needs a GFI (ground fault interrupter) on the electrical line to the dock.
It needs a new testable Backflow Prevention Device installed (please see diagram).
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures shall be inspected for
compliance with the City's minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the permit."
Please call 644-3034 to request a reinspection. Once the property has passed
reinspection and the application is signed by all parties (including Joint
Permittees), the dock will be transferred.

In connection with our earlier telephone conversation of today, I wanted to
communicate to you an error in my previous correspondence. After careful
measurements of the space between the my dock float and my neighbors', I
wanted to advise you that the width between the two docks at their closest point
on the upland front is 30 feet; the distance between the two at their closest point
on the bay front side is 25 feet [not 22 feet as I originally described]. Their dock
float sits in the water 11 feet further into the harbor than my dock float does and
they are at a slight angle to each other. My float is 48 feet long and if extend my
dock line into the harbor an additional 11 feet, the hypothetical distance between
them would be 23 feet. All of this makes sense if you consider the 40 foot
corridor that the City maintains into the harbor [i.e. Carnation Street — which I
have permission to use for my dock float].
My current plans are to purchase a new boat in the spring which is in the range
of 48-50 feet LOA with a berth of 16.5 feet. I can not imagine docking a larger
boat here given the nature of the currents in Carnation Cove [particularly during
storm seasons]. It is important though to understand and protect the rights which
inure to this property. I would like to reach a reasonable conclusion to this
situation. I appreciate all of your help in this situation, and I will await your input
later next week.

A recent field inspection has revealed that there is a vessel (Duffy) berthed at the western
most side of your dock that is extending beyond the projection of the property line into the
City street end. This is in violation of the Newport Beach Harbor Permit Policies:
Moorings, A, which states:
"Boats moored at private or public docks shall not extend beyond the projection of
the p I roperty lines of the property to which the dock facility is connected in
accordance with section 20-C."
This letter is to advise you that unless you relocate your vessel within 15 days of the date
of this notice, an Administrative Citation may be issued and penalties will begin to accrue
($100, $200, $500 increments). Your cooperation will be greatly appreciated in this matter.
Please see the attached picture of the infraction along with a drawing that depicts the
property lines. If you have any questions regarding the enforcement of the Harbor Permit

Dear Mr. Miller,
Thank you for meeting with me last Friday and for all of your assistance. I have
reviewed the historical documentation that you provided to me during our visit,
and I wanted to draw your attention to what I believe was an incorrect conclusion
regarding the beam limitations as set forth in my permit.
It appears that prior to 1983, the property that I now own, along with my
neighbors obtained a permit to establish a dock float that was dramatically
different from the existing structure. The new float incorporated a new design
and was permitted by approval of the Newport Beach City Council and Mayor's
Office on Junel 3, 1983.
The old structure seems to have been one long side -tie dock float that must have
extended far into the harbor. It was destroyed by a storm in 1983 and rebuilt in
accordance with a new permit, into a completely different design. The letter
dated August 5, 1983 from Mr. Toney Melum and attached Staff report dated
June 13, 1983 describe these changes.
The new structure incorporates a double slip float with two side ties, which by
definition must encroach upon County property. As part of this permit, two
conditions existed:
1. The applicant secure a construction permit from the Army Corps of
Engineers, and
2. Securing a permit from the County
Two other rights were granted under the permit [according to the Staff Report]:
1. The five-foot setback from the easterly most portion of the float was
waived. and

26, 2002 the building department was notified the project is completed and final
inspection called for.
I am sure you have been aware that the problems on what was a simple project were
not caused by Shellmaker Inc. Pacific Bell refused to locate and mark 4 telephone
cables that run through the jobsite- This coupled with several changes of ownership on
two of the properties added to the problem.
In any event, the project is now completed.

Dear Sir,
I am in receipt of a copy of your letter of February 8, 2002 and need to apprise you of
some problems with this project which follow�
I - Over a year ago we obtained a building permit for this project and purchased the
required pilings.
2. As required by law, we notified Dig -Alert to mark any utilities running through the
site- There are 4 telephone cables which cross the bay to Balboa Peninsula which
run right through the work area.
3. Pacific Bell, although required by law, refused to mark the cables but finally agreed
to pay half of the cost of marking the cables with a maximum limit.
4. Before this agreement was accepted, the building permit expired.
5. For the following reasons, I question that we can start the repair work in 30 days.
a. A new permit has not been issued yet.
b. Our barge is currently hauled out for and overhaul.
c. No resolution has been reached on who pays for marking the cables.
I assure you that we are making every effort to get this project completed but a little
more time may be needed.

Dear Sirs:
The City of Newport Beach Harbor Resources Office has received a request to transfer
the above noted pier permit for 2323 Bayside Drive. The structure was inspected by the
Harbor Resources Staff and we cannot transfer the pier permit until the following
deficiencies has been corrected and we have been notified of the corrections:
The water service to the east side of the dock is for the side tied assigned to 2323 and it
does not have a Backflow Prevention Device. One must be installed at the facility. The
purpose of this device is to protect the domestic water system from being contaminated
by seawater. A drawing of an approved device and a drawing showing a typical
installation are attached.
The electrical receptacle on the pier/dock has one outlet not with the appropriate GFI
outlet required on all receptacles in a water environment.
The inspection also found that the pilings are in need of repair and the work has not been
done. Please refer to the attached letter, which explains the need to repair these pilings
before this permit can be transferred from the seller to the buyer.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

Dear sirs:
The City of Newport Beach Harbor Resources Division received a request to transfer
Joint Harbor Permit RP1052319-1 f6r 2319 Bayside Drive. This request generated an
inspection of the structure. The inspection found the pilings in a state of disrepair. This
structure may become dangerous for people to go out on it or possibly might not be able
to safely berth vessels.
The City Council Harbor Permit Policies requires the property owner(s) to keep the
structures in good repair at all times. The City Municipal Code requires the permittee(s)
to immediately repair the pier once notice has been given. Since this is a Joint Pier all
four of the permittees are responsible for the necessary repairs. These repairs require a
permit from the City Building Department. Failure to repair, when written notice has
been given, shall be cause for issuance of an administrative citation or cause for
revocation of the pier permit.
This is notice that repairs of the structures must commence within 30 working days from
the date on this letter.

Dear Sirs'
The City of Newport Beach Harbor Resources Office has received a request to transfer
the above noted pier permit for 2323 Bayside Drive. The structure was inspected by the
Harbor Resources Staff and we cannot transfer the pier permit until the following
deficiencies has been corrected and we have been notified of the corrections:
The water service to the east side of the dock is for the side tied assigned to 2323 and it
does not have a Backflow Prevention Device. One must be installed at the facility. The
purpose of this device is to protect the domestic water system from being contaminated
by seawater. A drawing of an approved device and a drawing showing a typical
installation are attached.
The electrical receptacle on the pier/dock has one outlet not with the appropriate GFI
outlet required on all receptacles in a water environment.
The inspection also found that the pilings are in need of repair and the work has not been
done. Please refer to the attached letter, which explains the need to repair these pilings
before this permit can be transferred from the seller to the buyer.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.
