A. CALL TO ORDER—The meeting was called to order at 3:30 p.m.

C. PUBLIC HEARING ITEMS
ITEM NO. 1 Janes Residence Modification (PA2014-139)

Jason Van Patten, Planning Technician, stated that the request was for a twenty-two (22) percent addition to
the single-unit dwelling with nonconforming parking. He stated that the Modification Permit was necessary for
additions larger than ten (10) percent on properties with nonconforming parking. Mr. Van Patten provided an
overview of improvements proposed and stated that staff believed findings for approval could be made. He
indicated that the property would maintain three (3) parking spaces on site that are adequate in size to
accommodate vehicles and that the property was compliant with regard to parking prior to the 2010 Zoning
Code update. He noted that staff had recommended a condition requiring storage cabinets on the south side
of the garage be removed to provide clearance to the driver side of a vehicle.
Applicant Scott Brownell, on behalf of the property owner, stated that he had reviewed the draft resolution
and the required conditions. Mr. Brownell stated that he would prefer that the storage not be removed
because it would simply end up in another location within the garage. He stated that the size of the garage
has worked comfortably for quite some time.
The Zoning Administrator suggested that the condition of approval be revised so that any obstructions within
the 19-foot clear garage width, as shown on the plans, be removed.
Mr. Brownell acknowledged that he agreed with the change.
The Zoning Administrator opened the public hearing.
A member of the public, Mr. Jim Mosher, spoke and asked if the condition of approval prohibiting vehicles
from projecting into the public right-of-way included both the street and the sidewalk.
The Zoning Administrator responded by stating that he was correct.
Property owner Donna Janes, spoke and stated her desire to maintain the storage in the garage.
The Zoning Administrator stated that the condition of approval would reflect that the 19-foot clear garage
width remain unobstructed, allowing any storage beyond to remain.
There were no other public comments.

The Zoning Administrator then moved to approve the project with the amendment to Condition no. 3 to
indicate that the 19-foot garage width requirement remain unobstructed.
Action: Approved
ITEM NO.2 Shaoulian Lot Merger(PA2014-218)
328, 332 and 340 Old Newport Boulevard CD2
Jaime Murillo, Senior Planner, provided a brief project description stating that the proposed request would
merge four (4) legal lots into a single 25,725-square-foot development parcel. The request is associated with
prior 2010 development approvals authorizing redevelopment of the site for a medical office building. These
approvals included a general plan amendment, modification permit, use permit and traffic study. Specifically,
the general plan amendment authorizes development of the site to a development intensity of 1.0 FAR,
provided the four(4) lots are merged into one (1) parcel to provide for unified site design. The property owner
is now seeking building permits to construct the medical office building, requiring this subject merger.
Dr. Shaoulian, Property Owner, stated that he had reviewed the draft resolution and the required conditions.
The Zoning Administrator opened the public hearing.
A member of the public, Mr. Jim Mosher, provided the following comments and questions: 1) identified a
grammatical error within the draft resolution; 2) questioned why Fuscoe Engineering was identified as the
applicant in the staff report; 3) requested clarification on the number of lots to be merged; and 4) requested
status of the development approvals and construction plans.
The Zoning Administrator acknowledged the grammatical error and clarified that the applicant listed is the
entity who filed the application and listed on the application itself. Senior Planner Murillo clarified the existing
underlying legal lot configuration, stating that once merged, the property would consist of one (1) single
parcel with no underlying lot lines. He also confirmed that the development approvals associated with the
medical office project are valid and have been issued extensions by the City until March 2015.
A second member of the public, Mr. Tom Baker, spoke and questioned whether or not the process of a lot
merger or parcel map resulted in different tax implications with the County Assessor. John Olivier, a
representative of the applicant, clarified that both the lot merger and parcel map are recorded at the County
and would be viewed similarly with regard to property tax assessments.
Seeing that no one else from the public wished to comment, the Zoning Administrator closed the public
hearing and moved to approve the lot merger request.
Action: Approved
