With reference to the plans currently under consideration at the above referenced address to
reconfigure or modify the dock system or bulkhead, the following conditions will now be in
effect:
1 . The project proponent is aware of the Harbor Permit Policies (Council Policy H-1) and Title
17 of the City of Newport Beach Municipal Code. The project proponent understands that the
above referenced structure(s) is under the purview of these Policies and Codes.
2. Any future work on the above mentioned structure(s) requires permits with the City of
Newport Beach and any other applicable agencies. Painting and work considered to be
cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the proposed dock system and/or
bulkhead under consideration. Any future modifications or alterations to the dock system
and/or bulkhead may require new conditions which may override or change these conditions.
These conditions supersede all past conditions associated with this property.
4. In accordance with Municipal Code 10.08.030 A. the project proponent shall obtain the
proper permits for equipment and materials storage. "Except as otherwise provided in this
section, no person shall use any public street, sidewalk, alley or parkway or other public
property for the purpose of storing or displaying any equipment, materials or merchandise, or
any other commercial purpose. B. Public streets, sidewalks, alleys, or parkways may be used
for the purpose of selling, storing, or displaying any equipment, material, merchandise or for
other commercial purposes in the following cases: ... For the temporary storage of construction
equipment or material provided a permit is issued pursuant to Chapter 12.62 of this Code and
the storage is consistent with provisions of the California Building Code."
5. The project shall be implemented in conformance with the Local Coastal Program - Coastal
Land Use Plan.

Weekdays and Saturdays. No person shall, while engaged in construction, remodeling, digging,
grading, demolition, painting, plastering or any other related building activity, operate any tool,

person of normal sensitivity who works or resides in the vicinity, on any weekday except
between the hours of seven a.m. and six -thirty p.m., nor on any Saturday except between the
hours of eight a.m. and six p.m. B. Sundays and Holidays. No person shall, while engaged in
construction, remodeling, digging, grading, demolition, painting, plastering or any other related
building activity, operate any tool, equipment or machine in a manner which produces loud
noise that disturbs, or could disturb, a person of normal sensitivity who works or resides in the
vicinity, , o n any Sunday or any federal holiday."

reconfigure or modify the dock system or bulkhead, the following conditions will now be in
effect:
I - The project proponent is aware of the Harbor Permit Policies (Council Policy H-1) and Title
17 of the City of Newport Beach Municipal Code. The project proponent understands that tile
above referenced structure(s) is under the purvi6w of these Policies and Codes.
2. Any future work on the above mentioned structure(s) requires permits"with the City of,
Newport Beach and any other applicable agencies. Painting and work considered to be.
cosmetic in nature does not require a permit.
3- The conditions set forth in this document pertain to the proposed dock system and/or
bulkhead under consideration. Any future modifications or alterations to the dock system
and/or bulkhead may require new conditions which may override or change these conditions -
These conditions supersede all past conditions associated with this property.
4- In accordance with Municipal Code 10.08.030 A- the project proponent shall obtain the

-proper pert -nits for equipment and materials storage. "Except as'otherwise provided in this
section, 6o person. shall use any public street, sidewalk, alley or parkway or other public
property for the purpose of storing or displaying any equipment, materials or merchandise, or
any other commercial purpose. B. Public streets, sidewalks, alleys, or parkway$ may be used
for the purpose of selling, storing, or displaying any equipment, material, merchandise or for
other commercial purposes in the follow-
ing cases. ...For the temporary storage of construction
equipment or mate.rial provided a permit is issued pu ' rsuant to Chapter 12.62 of this Code and

THIS AGREEMENT is made and entered into this day of
1996, by and between Levon Gugasian (hereinafter
110�NERII), and the City of Newport Beach, California, a municipal
corporation organized and existing under and by virtue of its Charter
and the Constitution and the laws of the State of California,
(hereinafter "CITY") , "'OWNER' I is the owner of property located at
630 Lido Park Drive, Newport Beach, California and legally described
as Lot 11, 12, 14, 15, 16, and 17, Tract 815; as shown on a map
recorded in Book 26, Pages 43 and 44, inclusively of Miscellaneous
Maps in the office of the County Recorder of Orange County,
California;
W I T N E S S E T H:
WHEREAS, OWNER desires to construct/maintain certain non-standard
improvements (hereinafter "PERMITTED IMPROVEMENTS") within the Lido
Park Drive right-of-way (hereinafter "RIGHT-07-WAY11) that is located
adjacent to 630 Lido Park Drive, Newport Beach, California;
WHEREAS, said PERMITTED IMPROVEMENTS may interfere in the future
with CITY'S ability to construct, operate, maintain, and replace CITY
and other public facilities and improvements within RIGHT-OF-WAY; and
WHEREAS; the parties hereto desire to execute an agreement
providing for fulfillment of the conditions required by CITY to permit
OWNER to reconstruct and maintain said PERMITTED IMPROVEMENTS;
NOW, THEREFORE, in consideration of the mutual promises, the
parties hereto agree as follows:

1. It is mutL--Lly agreed that PERMITTED PROVENENTS shall be
defined as a non-standard water service and appurtenances for a fire
sprinkler system located in the seawall (bulkhead) in the Lido Park
Drive right -of -away as shown on EXHIBIT "All attached hereto and as
approved by the City Engineer.
2. CITY will permit OWNER to construct, reconstruct, install,
maintain, use, operate, repair and replace said PERMITTED IMPROVEMENTS
and appurtenances incidental thereto, within a portion of RIGH -T -OF -
WAY, all in substantial conformance with plans and specifications on
file in the CITY. CITY will further allow OWNER to take all
reasonable measures necessary or convenient in accomplishing the
aforesaid activities. In addition, the OWNER is responsible for said
PERMITTED IMPROVEMENTS and appurtenances -from IC -he non-standard water
service connection (outside of the seawall) to the building.
3. Rights granted under this Agreement may be terminated by CITY
at any time by giving 60 days' notice, specifying in said notice the
date of termination. CITY shall incur no liability whatsoever in the
event of the termination of this Agreement, or subsequent removal of
improvements by CITY.
4. OWNER and CITY further agree as follows:
a. OWNER may construct and install PERMITTED IMPROVEMENTS
and appurtenances incidental thereto, in substantial conformance with
plans and specifications therefor on file in the CITY's Public Works
Department, and as described on Exhibit "All hereto attached.
b. OWNER shall maintain the PERMITTED IMPROVEMENTS in
accordance with general prevailing standards of maintenance, and pay
all costs and expenses incurred in doing so. However, nothing herein
shall be construed to require OWNER to maintain, replace or repair any
CITY -owned pipeline, conduit or cable located in or under said
PERMITTED IMPROVEMENTS, except as otherwise provided herein.
C. If City or other public facilities or improvements are
damaged by the installation or presence of PERMITTED IMPROVEMENTS,
OWNER shall be responsible for the cost of repairs.

d. That should CITY be required to enter onto said RIGHT-
OF-WAY to exercise its primary rights associated with said RIGHT-OF-
WAY, including but not limited to, the maintenance, removal, repair,
renewal, replacement or enlargement of existing or future public
facilities or improvements, CITY may remove portions of the PERMITTED
IMPROVEMENTS, as required, and in such event:
M CITY shall notify OWNER of its intention to
accomplish such work, if any emergency situation does not exist.
(ii) OWNER shall be responsible for arranging for any
renewal or restoration of the PERMITTED IMPROVEMENTS affected by such
work by CITY;
(iii) CITY agrees to bear only the cost of any removal
of the PERMITTED IMPROVEMENTS affected by such work by CITY;
(iv) OWNER agrees to pay all costs -for renewal or
restoration of the PERMITTED IMPROVEMENTS.
5. In the event either party breaches any material provision of
this Agreement, the other party at its option may, in addition to the
other legal remedies available to it, terminate this Agreement, and,
in the event the breaching party is OWNER, CITY may enter upon the
RIGHT-OF-WAY and remove all or part of the improvements installed by
OWNER. Termination because of breach shall be upon a minimum of ten
(10) days' notice, with the notice specifying the date of termination.
In the event of litigation commenced with respect to any term of
condition of this Agreement, the prevailing party shall be entitled to
reasonable attorneys fees and costs incurred.
6. OWNER shall indemnify and hold harmless CITY, its City
Council, boards and commissions, officers and employees from and
against any and all loss, damage, liability, claims, suits, costs and
expenses whatsoever, including reasonable attorneys' fees (when
outside attorneys are so utilized), regardless of the merit or outcome
of any such claim or suit arising from or in any manner connected with

the design, constrUL-ion, maintenance, or conti Ae existence of the
PERMITTED IMPROVEMENTS.
7. OWNER agree that this Agreement shall remain in full force
and effect from execution thereof; shall run with the land; shall be
binding upon the heirs, successors, and assigns of OWNERS' interest in
the land whether fee or otherwise, and shall be recorded in the Office
of the County Recorder of Orange County, California.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed on the day and year first -above written.

A revision is possible at the above property essentially along the lines you
propose, subject to the following conditions:
1. That the dock extend no further bayward than adjacent floats.
2. That the dock be designated and signed as follows, "Public guest dock, limit
4 hours".
3. That you submit an application drawing depicting the revised dimensions of
the float and also identifying the U.S. Pierhead line, U.S. Bulkhead line and
their dimensions from the existing seawall. Also, in the drawing it would be
necessary to indicate the locations of the existing float, southerly of the
proposed -revised float and their dimensions.
It will be necessary to procure permits from the City of Newport Beach, the
California Coastal Commission and the U.S. Army Corp of Engineers. If these
conditions are agreeable to you please contact my office and we will assist you in
this process.

Bayward of 630 Lido Park Drive
Attached is a copy of a previously submitted application showing the location of
the bulkhead and pier head lines. As you can see by this exhibit, the proposed
revision will extend bayward of the pier head line, essentially in violation of the
Section 2D of the Harbor Permit Policies, which states;
"'The "Pierhead Lines," as established, shall define the limit for pier and
float -type structures."
In 1972 when the existing pier was approved it initially had an L shaped float
bayward of the pier and also bayward of the US pier head line. The float was
subsequently deleted from the application and it is suggested in the file,
although not specifically mentioned, that the reason was to bring the structure
within the US pier head line. The existing docks to the left of the pier extend
beyond the US pier head line, however, the file doesn't indicate exactly when
they were built, but it appears they were built prior to 1964 before the Harbor
Permit Policies were adopted. It has been our position in the past that structures
that were existing prior to the Harbor Permit Policies could be repaired and
maintained, but if they were rebuilt or revised they would have to conform to
the current Harbor Permit Policies.
I have also attached a letter in the file from the then Tidelands Administrator to
the then City Manager indicating that after discussions with the City Attorney, it
was felt to allow a guest dock in this area would essentially encroach on the
Rhine wharf bulkhead beyond the pier head line and should require some kind
of public return.
In addition, one of the proposed uses of the Rhine wharf was to allow loading
and unloading, repairs and berthing of commercial fleet fishing boats. Since it is
the only public location within the city to do those type of operations, the
commercial fishing fleet and their supporters have been very opposed to any
encroachments into that area.
In reviewing the Municipal Code, the only pertinent sections aie Section
17.20.010 and 17.28.010, which basically deal with the use of that particular
bulkhead and their time limits and don't give a lot of guidance.
I have included, for your information, a copy of the Council agenda item that
originally outlined the design of the wharf.

We would suggest that the following conditions be added to the permit if it is
constructed as proposed in the applicants drawing of 9/18/96.
1. That the float extend from the pier no further bayward than 28 feet, wl-dch is
the furthermost extension of the existing piers and floats in this location.
2. That the dock be designated and signed a public dock and the use of the
northerly side between the float and the RhineWharf shall be limited to a 4
hour berthing maximum. Vessels using this side shall be in the actual process
of loading, unloading or engaged in temporary repairs. The Harbor Master
may authorize an extension of the 4 hour period where special circumstances
dictate an extension. The southerly side shall also be designated a public
dock and shall be available for public berthing and no vessels will be allowed
to remain on the southerly side overnight.
3. The applicant shall resubmit the application drawing depicting the revised
dimensions of the float and also identifying the U.S. Pierhead Line and U.S.
Bulkhead Line and their dimensions from the existing seawall. Applicant
should also indicate on the drawing the locations of the -existing floats
southerly of the proposed float and their dimensions.

The attached response reflects our staffs input on the purposed
dock modification at 632 Lido Park Drive.
In summary, our concern is with a dangerous narrowing of the
channel which currently serves businesses on the Rhine Channel.
Extension of the docks naturally corresponds to not only greater
boat length but also greater extensions beyond the docks due to
current policy. My suggestion would be that, if the docks are
extended as proposed, no vessel be permitted to extend beyond the
end of the docks. This restriction would logically exclude
dinghies, davits, swim steps, sprits, etc. from extending beyond
the end of the docks. Such a permit could be beneficial in
providing a set policy which would eliminate the "gray areas" for
enforcement purposes.

requires this department to approve all transfer of pier
permits.
section 17,24.030 " No person shall transfer a permit
pier, float or similar structure granted under the
Drovisions of this Chapter without prior written
approval of the City. No pe rson who as an abutting
upland owner
or lessee of real property was granted a permit for a
pier, float or similar structure shall retain any right
of use in such Dier, float or similar structure after
having divest --ed himself of the ownership or leasehold
interest in such real property. Upon such divesting,
the ownership interest in such pier, float or similar
structure shall remain with the person to whom the
permit was granted, but the right of use thereof shall
vest in the City until such time as a permit for such
pier, float or structure is granted to another person."
Please return the enclosed application to the Marine
Department. Remit $275.00, plus $70.00 for not applying
within 30 days of escrow closing for the transfer
application. Check should be payable to the City of Newport
Beach.
A pier inspection by the Marine Department is needed before

The City of Newport Beach Marine Department has received a request
to transfer pier permit 221-632 for the property located at 634 and
632 Lido Park Drive, Newport Beach, CA. The facility was inspected
on 1/21/91.
We cannot transfer the pier permit until the following
deficiency(ies) has/have been corrected and WE HAVE BEEN NOTIFIED
OF THE CORRECTION:
A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved - type of device and its installation is
enclosed.
All electrical ouitlets on the seawall and docks should be
relocated and replaced.
The City Harbor Permit Policies state:
10. D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requiremenmts, and
the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
A permit for plumbing or electrical work must be obtained from the
Building Department of the City. Telephone: 644-3265.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred. Included in requirements for transfer of the
pier permit is the $275 transfer fee and the signed transfer card.

The pier where the vessel Oceana is currently moored was constructed
under a valid Harbor Permit and the permit was issued to Sea Enter-
prises as you point out in your letter of March 23, 1978.
The problem exists because the existing pier, a commercial structure,
is allowed a zero set back -in relation.to the property line adjacent
to 28th Street. Sea Enterprises has taken advantage of this and the
pier finger nearest to 28th Street is either right on or within a
foot of the property line. Therefore, any vessel side -tied On that
finger could be in violation of the Harbor Permit Policies Section
21-A -which states:
"Boats moored at private or public docks shall not extend beyond
the projection of the property lines of the property to which
the dock facility is connected in accordance with Section 20-C."
Section 20-C states:
"The projection of the property line bayward of the same bearing
from the bulkhead shall generally be used in determining the
allowable set backs for piers and floats. Because there are
certain physical conditions which preclude the strict application
of this policy without prejudice to adjoining properties, Council
approval will be required in areas where precise projections of
the property line have not been determined and the following
conditions exist:
1. Where property lines are not approximately perpendicular to
the bulkhead.
2. Where curves or angles exist in the bulkhead line.
3. Where bridges, topography, street -ends or publicly owned
facilities adjoin the property."

There has been no Council action exempting the general interpreation of
this Harbor Permit Policy, so if you extend the property line at 28th
Street nearest Sea Enterprises pier, bayward from the bulkhead on the
same bearing it will bisect the Oceana.
This being the case, the vessel Oceana is moored in violation of the
Harbor Permit Policies and therefore is in an area not designated for
moori ng
As a consequence of this, it must be relocated as pointed out in Newport
Beach Municipal Code Section 17.22.010:
"LOCATION. No person having charge of any vessel shall moor or anchor
the same in Newport Harbor except within the areas and at the places
designated therefor. Any vessel which is moored or anchored at a
place not designated for such vessel shall, upon the demand of the
City Manager, be forthwith moved to the place or places designated
therefor. In the designation of mooring areas and anchorages,
consideration shall be given to the needs of commerce,, the utilization
of turning basins or channel unless the same shall be secured both
fore and aft except as provided in Section '17.22.150. Every vessel
moored or anchored in any part of a harbor outside of any turning
basin or channel shall be so moored or anchored as to prevent such
vessel from swinging or drifting into any turning basin or channel."
As regards -the use of a street -end, the Harbor Permit Policies, Section I -D
specifically prohibits private pier construction there and street -end
moorings are limited to vessels under 18 feet in length.
In light of the above, the vessel Oceana must be relocated within a
reasonable time. If you have further questions, please contact me at
the Marine Department.

Thank you for your letter of March 14, 1978 regarding the
"Oceana."
It might be interesting for you to know that I had been
mooring my vessel at that particular place for approxi-
mately four years. This is the first time that anyone
from the City of Newport Beach has ever advised me that
I was violating a part of the Newport Beach Municipal Code.
I should like to ascertain whether your position is correct.
Will you please provide me with a copy of the Municipal
Code Ordinance or law which you claim I am violating.
The language quoted in your letter does not provide me
with much help. Upon ascertainment of the correctness
of your position, 1 will, of course, make immediate plans
to move the vessel and all that I would request of you, is
a reasonable opportunity to find another place for a mooring,
because as you know, the situation is quite tight in the
Newport Beach area.
You might also be interested to know that I have been paying
rent each month to a private concern who claims to have the
right to lease that space to me, and I wonder if your letter
might not be directed to this concern which is known as
Sea Enterprises, 177-F Riverside Avenue, Newport Beach,
California.

Regarding your memorandum of October 30, 1975, requesting
comment with reference to the width of the public walkway
bordering the restaurant, it is the Marine Director's
observation that a 6 foot walkway is adequate. By reducing
the walkway from ten feet to six feet, potentially the
city would have less to maintain or be liable for in the
future.
I know when we discussed public walkways with reference to
the Coves Condominium Project, it was the feelings of Dennis
and ex -councilman Kymla that somewhere down the road the
city would be responsible for maintenance of these easements.

Again, as a product of a complaint, I was called to the
location of your harbor permit to observe a significant
amount of floating debris. This occurred on Monday,
August 11, at 1:00 p.m. In November of last year you
were notified of this problem, and since then, there has
been little improvement.
Although the debris drifts into your locale from other
areas, nevertheless when it lodges within the zone under
your registered permit, it is the 'Law that you remove it.
If your employees canno'c_ be given the necessary time to
periodically clean the surface waters of your permit area,
you can call the Chamber of Commerce and be advised of
who is now contracting with harbor permittees for cleanup
of their tidelands lease areas. our offices can also
supply this information.
Under almost any circumstances, you, the permittee should
be able to see floating rubbish within your own permit zone
before we see it. Further, upon sighting it, obviously you
should remove it before it is called to our attention by
someone else. Therefore, again we are requesting that you
take the initiative instead of being taken by government.
our course of initiative lies in enforcing the City Codes,
and Council Policies, relative to maintaining the status
quo of harbor permits. Because of this, I much prefer asking
for your help.

PARK AND MISCELLANEOUS STREET IMPROVEMENTS ON LIDO PARK DRIVE

RECOMMENDATION:
Adopt a resolution authorizing the Mayor and City Clerk to
execute an engineering services agreement with Raub, Bein,
Frost and Associates for the design of the subject improvements.
DISCUSSION:
The current budget includes a building excise tax fund project
which provides for the construction of the Rhine Wharf Park on Lido Park Drive
easterly of Lafayette Avenue. The work includes a new wood boardwalk over-
hanging the bulkhead at The Rhine, and associated street improvements. The
design incorporates provision for a fishing boat service area; including a
loadifig ramp, water and electrical services, and mooring cleats.
Raub, Bein, Frost and Associates has sub itted a proposal for pro-
viding engineering services required to design the project. The major services
to be provided are:
1. Prepare detailed plans and specifications for the proposed
improvements.
2. Prepare quantity and cost estimates.
3. Perform supplemental field topographic surveys as needed and
design water and electrical services to the fishing fleet
loading area.
The firm of Raub, Bein, Frost and Associates is well qualified and
has satisfactorily performed similar work in the past for the City. They have
previously performed engineering services on Lido Park Drive for property owners
in the area.
Compensation is based on standard hourly r*ates with a specified max-
imum fee of $11,800.
Funds for the project have been provided in the current budget,
Account No. 27-7797-054. The total estimated cost is $101,00o.

Completion of the detailed plans and specifications is required
before the City can apply for the required permits. Permits from the follow-
ing agencies will be required:
1. California Regional Water Quality Control Board.
2. South Coast Region Coastal Zone Commission.
3. U. S. Corps of Engineers.
The project will also have to be reviewed by the Joint Harbors Committee,
the Parks, Beaches and Recreation Commission and possibly the Orange County Harbor,
Beaches and Parks District.
After design has been completed it is estimated that it will take 6 to
9 months to obtain the permits.

PARK AND MISCELLANEOUS STREET IMPROVEMENTS ON LIDO PARK DRIVE

RECOMMENDATION:
Adopt a resolution authorizing the Mayor and City Clerk to
execute an engineering services agreement with Raub, Bein,
Frost and Associates for the design of the subject improvements.
DISCUSSION:
. The current budget includes a building excise tax fund project
which provides for the construction of the Rhine Wharf Park on Lido Park Drive
easterly of Lafayette Avenue. The work includes a new wood boardwalk over-
hanging the bulkhead at The Rhine, and associated street improvements. The
design incorporates provision for a fishing boat service area; including a
loading ramp, water and electrical services, and mooring cleats.
Raub, Bein, Frost and Associates has submitted a proposal for pro-
viding engineering services required to design the project. The major services
to be provided are:
1. Prepare detailed plans and specifications for the proposed
improvements
2. Prepare quantity and cost estimates.
3. Perform supplemental field topographic surveys as needed and
design water and electrical services to the fishing fleet
loading area.
The firm of Raub, Bein, Frost and Associates is well qualified and
has satisfactorily performed similar work in the past for the City. They have
previously performed engineering services on Lido Park Drive for property owners
in the area. '
Compensation is based on standard hourly 'rates with a specified max-
imum fee of $11,800.
Funds for the project have been provided in the current budget,
Account No. 27-7797-054. The total estimated cost is $101,000.

Completion of the detailed plans and specifications is required
before,the City can apply for the required permits. Permits from the follow-
ing agencies will be required:
1. California Regional Water Quality Control Board.
2. South Coast Region C oastal Zone Commission.
3. U. S. Corps of Engineers.
The project will also have to be reviewed by the Joint Harbors Committee,
the Parks, Beaches and Recreation Commission and possibly the Orange County Harbor,
Beaches and Parks District.
After design has been completed it is estimated that it will take 6 to
9 months to obtain the permits.

SUBJECT: PROPOSED DEBRIS TRAP (SEA SHANTY),
I've reviewed.the drawings for the proposed debris trap
submitted by Mr. Tozer (Sea Shanty) with regards to Use
Permit #1638 condition #5.
The debris trap concept, as you know, is a new approach
to the floating debris problem. The principal behind the
proposed debris trap seems sound, but it is impossible to
say just what success this will have. I've discussed the
drawings with a local marine contractor and it was his
feelings the proposed trap will probably work; however,
it is a little more elaborate than possibly necessary.
I'm sure Mr. Tozer would be amenable to modifying the
trap if experience shows it doesn't work. Because of the
lack of precedents in this line I would recommend approval
with the note that if the system doesn't work, we might
request modifications.

DISCUSSION: 1. The City Council approved harbor permit
application #221-632 December 18, 1972 for a
pile supported pier and "L" shaped float bayward
of Lot #12. This permit included a public walkway
around the guest waiting room.
2. The applicant has requested that the City
Council consider a revision to the harbor permit
approved December 18, 1972 which would allow the
extension of the walkway in front of Lot 9, 10
and 11.
3. The proposed walkway extension would be 14' land-
ward of the U. S. Bulkhead Line and is consistent
with the general redevelopment plans for this section
of the Rhine, which have been reviewed by the Joint
Harbor Committee, Planning Commission and City Staff.

Phil Tozer, one of owners of the pro perty, appeared
before the Planning Commission and stated that they
concurred with the staff recommendations and ex-
panded on their plans which they felt would enhance
the area and with the inception of their trash trap
aid in clearing the bay of debris. :Mr. Tozer added
that they felt the 10 ft. walkway was excessive but
would. abide by that decision.
City Engineer Nolan stated that the plans for the
10 ft. walk were tentative at this time.
Community Development Director Hogan added that a
proposed meeting was planned with Mr. Tozer and
other property owners in that area to discuss
methods for beautifying the area. In response to
,the
Plann-ing Commission, Mr. Hogan stated that the
walkway would start at 30th Street, go across end
of channel to connect with Delaney's, and hopefully
extend from there.

recommended amending Condition No. 3 to 10 ft. or
such lesser width that is agreed upon.

proximately 170 persons and would require approximately,57off-
street parking spaces. There presently are sixty on-site parking
spaces in addition to fifty-three metered public parking stalls
adjacent to the Sea Shanty Restaurant which in the:past were
utiTized by Davey's Locker. Charlie's Chili Restaurant would
require approximately five additional parking stalls, exclusive
of. outdoor seating areas.
The applicant also is proposing to redesign the facade of the
restaurant and adjoining building along the Rhine to 11 create an
impression of the type of structure one would find on Mon t erey's
Cannery Row." The redecorating:of the building facades will be
accomplished by adding false fronts and roofs to the existing
buildings. The attached rendering indicates the "architectural
feeling" proposed, including an old roof sign and painted wall
sign identifying the restaurant. A "fish market" sign is also
included, retaining the old historical'feeling of the entire facade.
It should be noted that the. attached rendering does not s�how the
proposed public walk around the proposed waiting room since the walk
was added after the rendering was drawn.
Staff feels that the proposed expansion appears to be in keeping
w1th the current, redevelopmentof the Rhine area, and the'new,facades
will enh
anc6 the Cannery Village atmosphere. The public walkway
beyond the bulkhead line also.is reasonable since: the Planning Com-
mission approved a six foot wide`�ublic walkway beyond the bulkhead
line for the Cannery Restaurant, across the Rhine from the subject
property (Use Permit No. 1521, approved on April 29,, 1971).

(a) That this instrument.does not convey any property rights either in real
estate or material, or any exclusive privileges; and that it does not authorize
any injury to private property or invasion of private rights, or any infringe-
ment of Federal, State or local laws or regulations, nor does it obviate the

or work authorized.
(b) That the structure or work authorized herein shall be in accordance with
the plans and drawings attached hereto and construction shall be subject to the
supervilsion,and'approval of the District Engineer, Corps of Engineers, in charge
of the District in which the work is to"be performed.
(c) That the District Engineer may at any time make such inspections as he
may deem necessary to assure that the construction or work is performed in
accordance with the conditions of this permit and all eirpenses thereof shall be
borne by the permittee.
(d) That the permittee shall comply promptly with any lawful regulations,
conditions, or instructions affecting the structure or work authorized herein
if and,when issued by the Environmental Protection Agency and/or the State
water pollution control agency having jurisdiction to abate or prevent water
pollution, including thermal or radiation pollution. Such regulations,
conditions or instructions in effect or hereafter prescribed by the Environ-
mental Protection Agency and/or the State agency are hereby made a condition
of this permit.
(e) That'the permittee will maintain thework authorized herein in good
condition in accordance with the approved plans.
(f)'That this permit may, prior to the completion of the structure or work
authorized herein, be suspended by authority of the Secretary of the Army if
it is determined that suspension is in the public interest.*
(g) That this permit may at any time be modified by authority of the
Secretary of the Army if it is determined that, under existing circumstances,
modification is in the public interest.* The permittee, upon receipt of a
notice of modification, shall comply therewith as directed by the Secretary
of the Army or his authorized r epresentative.
(h) That this permit may be revoked by authority of the Secretary of the
Army if the permittee fails to comply with any 01 4-S provisions or if the
Secretary determines that, under the existing circumstances, such action is
required in the public interest.*
(i) That any modification, suspension or revocation of ' this permit shall
not be the basis for a claim for damages against the United States.
(j) That the United States shall in no way be liable for any damage to any,
structure or work authorized herein which may be caused by or result from future
operations undertaken by the Government in the public interest,.
(k) That no attempt shall be made by the permittee to forbid the full and
free use by the public of all navigable waters at.or adjacent to the structure
or work authorized by this permit.
(1) That if the display of lights and signals on any structure or work
authorized herein is not otherwise provided for by law, such lights and signals
as may be prescribed by the United States Coast Guard shall be installed and
maintained by and at the expense of the permittee.
(m) That the permittee shall notify the District Engineer at what time the
construction or work will be commenced, as far in advance of the time of
commencement as the District Engineer may specify, and of its completion.
(n) That if the structure or work herein authorized is not completed on
or before the 31st day of December 1976, this permit, if not:previously
revoked or specifically extended, shall cease and be null and void.
(o) That the legal requirements of all Federal agencies be met.
(p) That this permit does not authorize or approve the construction of
particular structures, the authorization or approval of which may require
action by the Congress or other agencies of the Federal Government.

Gentlemen:
Sea Enterprises, a local partnership, is presently engaged in improv-
ing its property at 632 Lido Park Drive. We are re -designing and re-
decorating Delaney's Sea Shanty Restaurant to create an impression of
the type of structure one would find on Monterey's Cannery Row. We
believe this architectural style will most closely coincide with and
enhance the gez ' �,�-al impression being created in this area with the
construction oi . �he Cannery Village Restaurant across the channel and
other adjacent shops.
Design and decoration is being done by Arthur Valdes & Co., whom we
believe to be the best available in this particular style.
Most of the effects will be achieved by adding false facades to the
existing building and veneering the exterior walls with authentic old
redwood siding which we have obtained from an ancient barn in Northern
California.
However, we firmly believe that if we are to achieve the desired e'
fect, we must have part of the building on pilings over the bay.
There is no legal problem here as the structure would be within our
legal bulkhead lines. The new addition would also serve as a waiting
room for this very popular restaurant and provide an attractive and
much needed adjunct with guest docking.
We have adequate on-site parking; there are 53 spaces of adjacent
metered parking, and we recently re -located Daveyls Locker to further
relieve any parking pressure on this property.
Since the addition requ . ired a Use Permit we respectfully request that
you grant our application and help expedite the re -development of the
Cannery Village area in this very desirable direction.

si".reet parking spaces. There presently are sixty on-s'ite' parking
spaces in addition to fifty-three metered pu!;TT'c'_'p_a_rking stalls
adjacent to the Sea Shanty Restaurant which in the past were
u-i-Ilized by Davey's Locker. Charlie's Chili Restaurant would
require approximately five additional parking stalls, exclusive
of outdoor seating areas.
The applicant also is proposing to redesign the facade of the
res-111-aurant and adjoining building along the Rhine to "create an
impression of the type of structure one would find on Mont-erey's
Cannery Row." The redecorating of the building facades wil] be
accomplished by adding false fronts and roofs to the existing
buildings. The attached rendering'indicates the "architectural
feeling" proposed, including an old roof sign and painted wall
sign identifying the restaurant. A "fish market"' sign is also

included, retaining the old historical feeling of the entire facade.
It'-. should be noted that the attached rendering does not show the
proposed public walk around the proposed waiting room since the walk
was added after the rendering was drawn.
Staff feels that the proposed expansion appears to be in keeping
w 4 th the current redevelopment of the Rhine area, and the new facades
will enhance the Cannery Village atmosphere. The public walkway
beyond the bulkhead line also is reasonable since the Planning Com -
miss on approved a six foot wide public walkway beyond the bulkhead
line for the Cannery Restaurant, across the Rhine from the subject
property (Use Permit No. 1521, approved on April 29, 1971).
Staff recommends approval of Use Permit Application No. 1638, subject
to the following conditions:
1. That development be according to the approved plot plan
and elevations except for minor modifications approved
by the Department of Community Development.
2. A harbor permit approved by the City Council and the U.S.
Army Corps of Engineers shall be required for the new
construction in the Rhine and proposals for any revisions
to existing pier, ramp or boat slips.
3. The public walkway around the proposed guest waiting ro I om
shall have a minimum width of ten feet.
4. Consideration shall be given to deb'ris accumulation
between pilings.
5. Plans, including proposals for the control of debris
and protection of the adjoining channel during con-
struction, shall be submitted to and approved by the
Director.of Community Development prior to the issuance
of building permits.

This application requests the expansion of the existing Delaney's
Sea Shanty Restaurant. In accordance with Section 20.30.040,
restaurants shall be permitted in the M-1,District subject to the
securing of a use permit. (The,,Planning Commission'approved an
expansion of the existing restaurant on July 18, 1968-,- 'Use Permit
No . 13 9 0.
Subject Property and Surrounding Land Use
The site contains the existing restaurant, Charlie's Chili Restaurant,
and vacant space that was formerly occup I ied by Davey's Locker, a
sportfishing landing facility. To the north is the Rhine; to the
east, across Lido Park Dri.ve, are the Cabanas Marinas apartments
and a vacant site where a condominium project is under construction;
to the south, across 28th Street, is a large trailer park; and to
the west is the Rhine.

The applicant proposes to construct a 191��' x 26' (509 sq.ft.) waiting
room for dining guests and a new entrance to the existing restaurant.
The proposed waiting room will be built on pilings placed beyond
the existing bulkhead and will extend to the bulkhead line. A four
-foot wide public walk is propos.ed to extend from Lido Park Drive
ar'OUndl the proposed building addition -IL-.o the existing walk in front-.
of the Sea Shanty and Charl i e ' s Chil i restaurants so as to retai n
public pedestrians' access along ithe Rhine. (The City Engineer has
indicated -that this walk should be a minimum of ten -feet in width

promenade adjoining Lido Park Drive.)

In response to your request for a re-examination of the pier
and docks bayward of 632 Lido Park Drive I Newport Beach,
Tony Melun and I met today with Steve Hook (Building
Department). We formulated the minimum required corrections
to be done to the piers and docks electrical service in order
to meet safety standards.
This is in consideration for a transfer of the piery�rmit
only and not associated with any maintenance or revision
application.
Please arrange for a meeting between Mr. Hook and your
electrical contractor during the week of July 20-24, 1992.
At that time Mr. Hook will explain the scope of the work
requited to bring the docks to compliance and answer any
questions relative to the City's standards.
A maintenance permit from the Marine Department and a permit
to do electrical work from the Building Department
will be necessary.
The lateness in getting this work completed demands that a
scheduled is established and maintained between you and the
City. Please keep this office apprised of the situation as it
proceeds along towards completion.
