THE LAW REQUIRE
Administrative Citation
Newport Beach Municipal Code Section 1.05.020 provides for the issuance of administrative citations for Municipal Code
Violations. There are three levels of citations that can be issued progressively for a violation. -The fines, as indicated on the front of
the citation, are $100.00 for the First Citation, $200.00 for the Second Citation and $500.00 for the Third and subsequent Citations for
violations of the same ordinance within one year. These fines are cumulative and citations may be issued each day the violation
exists. A warning, if issued, does not incur a fine and therefore, is not appealable.
Rights of Appeal
You have the right to appeal this administrative citation within fifteen (15) days from the corfection date together with an
advanced deposit of the fine along with a Request for Hearing form. Art appeal must be in writing to the address on the front of this
citation and to the attention of "Administrative Hearing Officer." A properly filed appeal will result in an administrative hearing.
Failure of any person to properly file a written appeal within fifteen (15) business days shall constitute a waiver of his or her
right to an administrative hearing and adjudication of the administrative citation or any portion thereof and the total amount of the
fine.

The amount of the fine is indicated on the front of this administrative citation. Prior to receiving an invoice from the
Revenue Division, you may pay by mail or in person at 3300 Newport Blvd., Revenue Division, -Newport Beach City Hall. Payment
should be made by personal check, cashier's check, or money order, payable to the City of Newport Beach. Please write the citation
or account number on your check or money order
If the citation is not paid or appealed within the statutory time, you will receive an invoice from the City's Revenue Division.
Please follow the instructions on the invoice to ensure proper processing of your payment Payment of the fine shall not
excuse the failure to correct the violation nor shall it bar further enforcement action by
the City of Newport Beach.
Consequences of Failure to Pay the Fine
The failure of any person to pay the fine assessed by the administrative citation within the time specified on the citation or on
the invoice from the Revenue, Division may result in a claim with the Small Claims Court or any legal remedy available to collect
such money. The City has the authority to collect all costs associated with the filing of such actions. Failure to pay fine requirements
may be found in Newport Beach Municipal Code Section 1-05.100.

There are numerous enforcement options that can be used to encourage the correction of violations. These options include,
but are not limited to: civil penalties, abatement, criminal prosecution, civil litigation, recording the violation with the County
Recorder and forfeiture of certain State tax benefits for substandard residential rental property. These options can empower the City
to collect fines up to $100,000.00, to demolish structures or make necessary repairs at the owner's expense, and to incarcerate
violators. Any of these options or others may be used if the administrative citations do not achieve compliance -

Dear Mrs. Dibari:
This is a short note to summarize the details of our meeting at your
residence at 710 South Bay Front on Friday, November 20,1998.
The City Surveyor established the Northwest corner of your property
and marked the boundary for you. The line clearly indicated the vessel
side -tied to your dock is over the prolongation of side property line as
it runs bayward.
You did agree to arrange to have the vessel relocated to correct the
encroachment within 30 days from the date of our meeting. I agreed
not to issu e any citations during that interval.
Thank you for your cooperation in this matter, and please call me if
there is a need for additional information in regards to this matter.

complaints from residents along South Bay Front regarding a violation
of Section 21.A. of the Harbor Permit Policies. Specifically, the

Dear Mr. Armand:
In response to your letter of June 10, 1998, the boat side -tied
to my private dock bayward of 710 S. Bay Front will be moved by
July 1st. This was originally just a temporary situation since
I am currently having extensive dock repairs done.
You indicated in your letter that a field inspection -revealed
that this vessel is "berthed in a position that is extending
across the property line and in that position is in violation
of Section 21.A.11 This -situation is very distressing to me.
I am very puzzeled as to how you determined where the property
line is.; The "TNT" property markers in front of my house'were
removed by the city when they replaced the Bay Front sidewalks
about 6 years ago. If you go to the rear of my property you
will see that the "TNT" property line marker there is at least
611-71, beyond the block wall that separates our properties. So,
if I were to have a surveyor project the property line out to
my dock -this matter might be put to rest once and for all.
I think it is up to the city to replace the "TNT" property
marke.� they removed so that this might be done. Otherwise,
there will always be ambiguity over this issue. I feel that a
"field inspection" cannot possibly determine whether or not I
am in violation of Section 21.A. -You have no accurate point of
reference. Besides, the dock was originally constructed to
accomodate a much larger (52') boat on the side tie in question.
Since the property site includes 2 lots, the dock was placed in
such a way as to not interfere with property line issues.
Interestingly enough, a "field insPeCtion" of the "TNT" marker
at the rear of the property reveals a apparent encroachment of
E!y property by the neighbors at 706 South Bay Front. They have
attached structures to my wall. I have never complained about
this. r
Please advise me as to the next step to be taken. I would
really like to know what my property rights are since this has
become such an issue.

Dear Mrs. Dibari:
The City of Newport Beach Fire and Marine Department has received
complaints from residents along South Bay Front regarding a violation
of Section 21.A. of the Harbor Permit Policies. Specifically, the
complaint is that the vessel side -tied to the pier bayward of 710 South
Bay Front, and too large and is encroaching into the adjoining pier
permit area belonging to 706 South Bay Front.
A field inspection revealed that the above mentioned vessel is berthed
in a position that is extending across the property line, and in that
position is in violation of Section 21.A.
Boats moored at private or public docks shall not extend beyond
the projection of the property line of the property to which the
Dock facility is connected..."
Please arrange to relocate the vessel within 10 working days from the
date on this letter. Failure to do so will result in an Administrative
Citation being issued.

depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

Discussi,on:
This application is before the City Councfl as requi'red by Section
5.C.1. of the Harbor Permit Policfes, which states:
5.C.1. "Prior approval of the My Council wi1l.be required before
issuing a permit for shore -connected structures wh.en (1) the abutting
upland property is a dedi'cated public rfght-of-wAy except along the
Grand Canal on Balboa Island."
Regarding,piers on Balboa Island; -the Harbor Permit Policies, Section 22
further states':
22. "No new, con-commerci - al pters on Balboa. Islaind shal-l.be recommended
unless it is in the publi-.c interest or unless- it is at such- a location that
it is not,useable for swimming or bathi'ng.. Piers presently
in use may be repaired but;recommeddations for any addittons-or',:remodeling
shall be:.restricted to such changes that do not lessen�the us -e of ei'ther
the immediate water or land areas."
The revision proposed by the applicant is basically a rebui'lding and down-
sizing of the existing structure. No substantital changes . are proposed and
the revision will not lessen use of either the immedi.ate-water or land area.

Dear Mr. Melum:
As your records at City Hall may reflect, our client, Donna Di Bari, has received previous
notices that her residential dock in front of her home has been in violation of Section 21 -A of the
Harbor Permit Policies. She has taken action on previous occasions to remedy the situation.
However, an anomaly has recently presented itself. She is uncertain as to where her exact
property line would be measured from for purposes of having private boats moored at her
residential dock.
Your records should also indicate thatthe Bay Frontwalkway in front of Ms. Di Bari's home
that extends the length of the bay was repaved, in approximately 1993 or 1994. Prior to that time,
each of the residences along the bay front had a "lead and tack" marker for their property lines.
Evidently, as a result of the resurfacing of the sidewalk in front of the homes that front the beach
portion of the bay, these "lead and tack" markers were removed by the construction company
hired by the City of Newport Beach. Consequently, Mrs. Di Bari, along with many of her
neighbors on Bay Front Street are without the exact identifications that would permit them to draw
an imaginary line forward from their property into the Bay to indicate that the moorings at their
residential docks are in proper position.
We are requesting that you bring this matter to the attention of the City of Newport Beach
at their next council meeting and allow notice and opportunity for Mrs. Di Bari to present this
problem to the city council. Mrs. Di Bari is hopeful that the restoration of the "lead and tack"
markers will permit the landowners such as herself to moor in compliance with Section 21 -A of
the Harbor Permit Policies which the City of Newport Beach is seeking to enforce.

Mrs. Di Bari would be more than happy to replace these markers, so long as the City of
Newport Beach affords her just compensation due to their removal of those markings during
reconstruction work.

On Friday, November 18, 1994, Gene Crouse, owner, vessel "Adiosill
went into the Orange County Sheriff's Department and requested
the Harbor Department look at the location of his vessel and
inform him if in their opinion, an encroachment exist at the
west side of your dock.
Officer Lundy investigated the situation on November 19, 1994,
and reported that the vessel is both over the property line and
too close to on -shore mooring S-78 (see attached).

Dear Mr. and Mrs. Di Bari:
The City of Newport Beach has received a complaint regarding the
use of your residential dock bayward of the above address.
Specifically, the complaint is that the dock is being used in
violation of Section 21-A of the Harbor Permit Policies which
states:
21-A Moorings "Boats moored at private or public docks shall
not extend beyond the projection of the property
lines of the property to which the dock facility
is connected."
On September 15, 1994, the Harbor Inspector for the City of Newport
Beach Marine Department inspected the facility and observed that
the vessel moored on the side tie at your dock is, in fact,
encroaching across -the bayward extension of the common property
line between your property at 710 S. Bay Front and the property to
your west. As a result, the vessel must be moved to be brought
into conformance with the above quoted Harbor Permit Policy.
In addition, vessels moored at this side tie should not be moored
in such a fashion as to limit the ingress and egress of the
adjacent shore moorings, specifically shore mooring S-78. The
mooring floats should be perpendicular to the seawall and the post
that attaches the mooring line to the seawall. In this particular
case, mooring S-78 seems to be off at an angle to accommodate the
large vessel that has been side tied at your dock.
Once the offending vessel has been relocated, it will be necessary
for the moorings to be straightened out, and they should all be
parallel with the seawall.

Recommendation
If desired, approve the Maintenance Dredging Harbor Permit
Applications.
Discussion
These applications require City Council approval under the conditions
of approval of the City of Newport Beach "blanket" permit for main-
tenance dredging issued on February 12 by the U. S. Army Corps of
Engineers.
The locations and applicants of the proposed maintenance dredging
applications are:
824 W. Bay Avenue Mr. Stan Williams
710 S. Bay Front Mr. Spence Clark
1124 W. Bay Avenue - Dr. John Reynolds
W. Coast Highway - Newport Arches Marina
720 W. Bay Avenue - Newport Harbor Yacht Club
The staff has reviewed the proposed dredging and have determined that
the work to be done is within the parameters of the Corps of Engineers
permit. Thereis no anticipated adverse affect on proximity beaches
or contiguo s bulkheads.

Gentlemen:

At the meeting of September 4, 1962, 1 appeared on behalf of Mr. and
Mrs. Lowden with reference to their application for permission to
maintain their float in its present form.
I have just received a copy of the minutes of the meeting and notice
that the motion as recorded on page 3 under "Other Business" is in
error. I realize that there was considerable discussion of the
matter which could easily have invited mistakes- in recording what
was agreed upon.
My notes of the meeting indicate that the following conditions were
imposed, and none other., namely:
1. Mr. and Mrs.'�Lowden shajl diligently pursue to sell
their boat and shall not use the boat except as incidental to a
sale.
2. Thereafter they shall not be permitted to moor in the
slip a boat in excess of 32' in length.
3. Any boat, including the present boat, is to be moored
with its bow towards, the shore.
4. Upon the sale of the real property by Mr. and Mrs.
Lowden at any future time, the Committee will review the matter upon
application to transfer the permit and impose whatever conditions
it sees fit.
I would very much appreciate your correcting the minutes of the meeting
and thereafter I would appreciate receiving two copies of the motion
as corrected so that my clients will be advised.

Dear Sirs:
August 22, 1962
In as much as our slip float in its -present
form,size and location has been in existence, according
to permit # A-52 issued to Henry E. Kendall, since 1939,
and we have been advised it was not built according to
specifications outlined in the permit, we wish to make
application to have this structurelas it now stands,
legalized.
Since a permit was required to construct this
slip float, and according to sections 4 and 5 of the
permib, notice had to be given upon completion and an
inspection required, it must be assumed this was done
and approval was given.
This slip float was accepted by us in good
faith when we purchased this property in 1957 and
certainly no changes have been made by us. For 13 years
prior to our purchase this property was owned by
Henry Kendall., Belmont Sanchez and Dr, Robert Beauchamp.
None of these owners were required to make any changes
in this structure and now aftet 23 years, and through
no fault of our own, we are requested to make changes,
We feel this is unjust and would cause us undue and
unfair hardship.
We oun a 41 foot cruiser, which we have had
up for sale and has been listed with boat brokers foe
some weeks and have several interested prospective
buyers at this time. We hope the boat will soon be sold.
Should we be required to make these changes at this time,
we would not be permitted to keep uur boat here, since
the slip would have to be only 27 feet long and the boat
could extend only 11 feet (width of beaml beyond the end
of the slip. Therefore our boat would be -3 feet too long.
Before buying this boat we asked and received
permission from the harbor department to tie up,in our
slip. nothine was said at that time about our slip b6ing
-2 -
improper.
When our boat is sold, there will be no boat here
with the exception of an 8 -foot Sabot type sail boat and
a ten foot outboard motor boat,, and possibly occasional
visiting boats.
We were requested to tie up our boat with the
bow toward shore. This we have done. The propellers will
not be in operation except upon arrival or departure.
We will appreciate any consideration you might
give us. in our request to legalize the present structure.

Your letter of August 10 just came and
if it would be convenient for you, will you plesae come
and discuss this matter with me and explain just what it I
is you wish us to do.
life purchased this home in the fall of
1957. The pier, as it is'now, was here when we purchased
the property and we assumed, since it had been built
for quite some years, it had been built according to
specifications of the permit issued to whomsoever built
it.
Our neighbor, Mr. Palmer, told us he had
suggested t# you that our boat is causing the erosion
of our beach., but it is our opinion that this is not true.

We have owned G -r boat for three years,
but only recently has the beach begun to erode and we
have used our boat very seldom the past. year.
Mr. Lowden has developed a, heart condi-
tion and was advised to give up fishing so uur boat is for
sale. It has been out only a few times during the past
year, once for fishing and the other times for having
work done on the boat.
As to the way we dock our boat- it would
be impossible to board her if It were headed in rather
thl-n backed. It has always been docked in this manner
and for more than two years there was no erosion of the
beach
When you write " the size and location of
your existing float should be corrected". To relocate the
pier, I must say, would be a little difficult and most
exDensive. However, we do own another piece of property
at 520 S. Bay Front. Perhaps we could move it there.
Or perhaps it could be moved in front of the Palmer
property. They would like that, I'm sure.
And when you say we must correct the size.
do you want us to make it larger or smaller.
When you threaten to revoke our permit,

does this mean the pier wpuld have to be dismantled and
done away with or that we would have to tie up our boat
elsewhere ? If we can find an available slip, I suppose
we could remove our boat completely and I am sure you
would find the erosion would continue.
However part of the value of our property is
the pier and would seem a little silly to have to pay
rent for a place to tie up our boat.
As soon as our boat is sold, there will be no
boat tied up there, with the exception of occasional
visitor's boats. Perhaps the Palmers would not object
to this as occasionally tie up their own boat there,

Certainly, if it is something we are doing
to cause the erosion, it is our desire to correct it,
as we do not like the damage to the beach either.
However rather than assume, the Palmers are correct
in puttiAgrrthe blame on our boat, why not investigate
the possibility that something else could be causing itq
We plan to be out of town a few days. Nhen
we return, I will phone you,possibly Wednesday, and
perhaps we can get together and I can get a better underf4l,-,
standing of.just what it is yau expect of us. And if
you will,bring a copy of the original permit or tell me
where I can see the permit.
