The City Surveyor established the Northwest corner of your property and marked the boundary for you. The line clearly indicated the vessel side -tied to your dock is over the prolongation of side property line as it runs bayward. You did agree to arrange to have the vessel relocated to correct the encroachment within 30 days from the date of our meeting. I agreed not to issu e any citations during that interval. Bay Front will be moved by July 1st. This was originally just a temporary situation since I am currently having extensive dock repairs done. You indicated in your letter that a field inspection -revealed that this vessel is "berthed in a position that is extending across the property line and in that position is in violation of Section 21.A.11 This -situation is very distressing to me. I am very puzzeled as to how you determined where the property line is.; The "TNT" property markers in front of my house'were removed by the city when they replaced the Bay Front sidewalks about 6 years ago. If you go to the rear of my property you will see that the "TNT" property line marker there is at least 611-71, beyond the block wall that separates our properties. So, if I were to have a surveyor project the property line out to my dock -this matter might be put to rest once and for all. I think it is up to the city to replace the "TNT" property marke.� they removed so that this might be done. Otherwise, there will always be ambiguity over this issue. I feel that a "field inspection" cannot possibly determine whether or not I am in violation of Section 21.A. -You have no accurate point of reference. Besides, the dock was originally constructed to accomodate a much larger (52') boat on the side tie in question. Since the property site includes 2 lots, the dock was placed in such a way as to not interfere with property line issues. Interestingly enough, a "field insPeCtion" of the "TNT" marker at the rear of the property reveals a apparent encroachment of E!y property by the neighbors at 706 South Bay Front. They have attached structures to my wall. I have never complained about this. r Please advise me as to the next step to be taken. I would really like to know what my property rights are since this has become such an issue. She has taken action on previous occasions to remedy the situation. However, an anomaly has recently presented itself. She is uncertain as to where her exact property line would be measured from for purposes of having private boats moored at her residential dock. Your records should also indicate thatthe Bay Frontwalkway in front of Ms. Di Bari's home that extends the length of the bay was repaved, in approximately 1993 or 1994. Prior to that time, each of the residences along the bay front had a "lead and tack" marker for their property lines. Evidently, as a result of the resurfacing of the sidewalk in front of the homes that front the beach portion of the bay, these "lead and tack" markers were removed by the construction company hired by the City of Newport Beach. Consequently, Mrs. Di Bari, along with many of her neighbors on Bay Front Street are without the exact identifications that would permit them to draw an imaginary line forward from their property into the Bay to indicate that the moorings at their residential docks are in proper position. We are requesting that you bring this matter to the attention of the City of Newport Beach at their next council meeting and allow notice and opportunity for Mrs. Di Bari to present this problem to the city council. Mrs. Di Bari is hopeful that the restoration of the "lead and tack" markers will permit the landowners such as herself to moor in compliance with Section 21 -A of the Harbor Permit Policies which the City of Newport Beach is seeking to enforce. Bay Front Dear Mr. and Mrs. Di Bari: The City of Newport Beach has received a complaint regarding the use of your residential dock bayward of the above address. Specifically, the complaint is that the dock is being used in violation of Section 21-A of the Harbor Permit Policies which states: 21-A Moorings "Boats moored at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected." On September 15, 1994, the Harbor Inspector for the City of Newport Beach Marine Department inspected the facility and observed that the vessel moored on the side tie at your dock is, in fact, encroaching across -the bayward extension of the common property line between your property at 710 S. Bay Front and the property to your west. As a result, the vessel must be moved to be brought into conformance with the above quoted Harbor Permit Policy. In addition, vessels moored at this side tie should not be moored in such a fashion as to limit the ingress and egress of the adjacent shore moorings, specifically shore mooring S-78. The mooring floats should be perpendicular to the seawall and the post that attaches the mooring line to the seawall. In this particular case, mooring S-78 seems to be off at an angle to accommodate the large vessel that has been side tied at your dock. Once the offending vessel has been relocated, it will be necessary for the moorings to be straightened out, and they should all be parallel with the seawall. I have just received a copy of the minutes of the meeting and notice that the motion as recorded on page 3 under "Other Business" is in error. I realize that there was considerable discussion of the matter which could easily have invited mistakes- in recording what was agreed upon. My notes of the meeting indicate that the following conditions were imposed, and none other., namely: 1. Mr. and Mrs.'�Lowden shajl diligently pursue to sell their boat and shall not use the boat except as incidental to a sale. 2. Thereafter they shall not be permitted to moor in the slip a boat in excess of 32' in length. 3. Any boat, including the present boat, is to be moored with its bow towards, the shore. 4. Upon the sale of the real property by Mr. and Mrs. Lowden at any future time, the Committee will review the matter upon application to transfer the permit and impose whatever conditions it sees fit. I would very much appreciate your correcting the minutes of the meeting and thereafter I would appreciate receiving two copies of the motion as corrected so that my clients will be advised. Newport Blvd. Newport Beach, Calif. Dear Sirs: August 22, 1962 In as much as our slip float in its -present form,size and location has been in existence, according to permit # A-52 issued to Henry E. Kendall, since 1939, and we have been advised it was not built according to specifications outlined in the permit, we wish to make application to have this structurelas it now stands, legalized. Since a permit was required to construct this slip float, and according to sections 4 and 5 of the permib, notice had to be given upon completion and an inspection required, it must be assumed this was done and approval was given. This slip float was accepted by us in good faith when we purchased this property in 1957 and certainly no changes have been made by us. For 13 years prior to our purchase this property was owned by Henry Kendall., Belmont Sanchez and Dr, Robert Beauchamp. None of these owners were required to make any changes in this structure and now aftet 23 years, and through no fault of our own, we are requested to make changes, We feel this is unjust and would cause us undue and unfair hardship. We oun a 41 foot cruiser, which we have had up for sale and has been listed with boat brokers foe some weeks and have several interested prospective buyers at this time. We hope the boat will soon be sold. Should we be required to make these changes at this time, we would not be permitted to keep uur boat here, since the slip would have to be only 27 feet long and the boat could extend only 11 feet (width of beaml beyond the end of the slip. Therefore our boat would be -3 feet too long. Before buying this boat we asked and received permission from the harbor department to tie up,in our slip. nothine was said at that time about our slip b6ing -2 - improper. When our boat is sold, there will be no boat here with the exception of an 8 -foot Sabot type sail boat and a ten foot outboard motor boat,, and possibly occasional visiting boats. We were requested to tie up our boat with the bow toward shore. This we have done. The propellers will not be in operation except upon arrival or departure. The pier, as it is'now, was here when we purchased the property and we assumed, since it had been built for quite some years, it had been built according to specifications of the permit issued to whomsoever built it. Our neighbor, Mr. Palmer, told us he had suggested t# you that our boat is causing the erosion of our beach., but it is our opinion that this is not true. rv-,-*, We have owned G -r boat for three years, but only recently has the beach begun to erode and we have used our boat very seldom the past. year. Mr. Lowden has developed a, heart condi- tion and was advised to give up fishing so uur boat is for sale. It has been out only a few times during the past year, once for fishing and the other times for having work done on the boat. As to the way we dock our boat- it would be impossible to board her if It were headed in rather thl-n backed. It has always been docked in this manner and for more than two years there was no erosion of the beach When you write " the size and location of your existing float should be corrected". To relocate the pier, I must say, would be a little difficult and most exDensive. However, we do own another piece of property at 520 S. Bay Front. Perhaps we could move it there. Or perhaps it could be moved in front of the Palmer property. They would like that, I'm sure. And when you say we must correct the size. do you want us to make it larger or smaller. When you threaten to revoke our permit, Mrs. Pullman Lowden 710 South Bay Front Balboa Island, California does this mean the pier wpuld have to be dismantled and done away with or that we would have to tie up our boat elsewhere ? If we can find an available slip, I suppose we could remove our boat completely and I am sure you would find the erosion would continue. However part of the value of our property is the pier and would seem a little silly to have to pay rent for a place to tie up our boat. As soon as our boat is sold, there will be no boat tied up there, with the exception of occasional visitor's boats. Perhaps the Palmers would not object to this as occasionally tie up their own boat there, My Certainly, if it is something we are doing to cause the erosion, it is our desire to correct it, as we do not like the damage to the beach either. However rather than assume, the Palmers are correct in puttiAgrrthe blame on our boat, why not investigate the possibility that something else could be causing itq We plan to be out of town a few days.
