Developments -Section 30624.7 of the Coastal Act
Based on your projectplans and information provided in y our permit application for the
development described below, the Executive Director of the Coastal Commission hereby
waives the requirement for a Coastal Development Permit pursuant to Section 13238.1,
Title 14, California Administrative Code. If, at a later date, this information is feund ��o be
incorrect or theplans revised, this decision will become invalid; and, any development
occurring must cease until a coastal development permit is obtained or any discrepancy is
resolved in writing.

LOCATION: 802 S. Bayfront, City of Newport Beach (Balboa Island), County of Orange
PROPOSED DEVELOPMENT: Remodel and addition to an existing dock. The proposed
project includes narrowing an existing float measuring 11 feet by 24 feet to 8 feet by 24
feet. This remodeled float will be connected to an existing float measuring 4 feet by 24
feet via a new headwalk measuring 10 feet by 4 feet, resulting in a 24 -foot long by 22 -foot

RATIONALE: The proposed development would not exceed the U.S. Project Line nor
interfere with navigation in the existing harbor. The proposed development will not
adversely impact coastal access, resources or public recreation opportunities, and is
consistent with the City's certified Land Use Plan, past Commission actions in the area and
Chapter Three policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their September
8-11 1998 meeting and the site of the proposed development has been appropriately
noticed, pursuant to 13054(b) of the Administrative Code. The enclosed Notice Card shall
remain posted at the site until the waiver has been validated and no less than seven days
prior to the Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

Dear Mr. Rich:
The Marine Department has received a complaint regarding the
residential pier and float bayward of the above address.
Specifically, the complaint is that the pier and float is
deteriorating and in violation of section 4.H. of the City
Harbor Permit Policies, which states:
4.H. 11 The Permitee shall keep the structure in good
repair at all times. Failure to repair, when written
notice has been given by the Marine Department, shall be
cause for the revocation of the permit."
A field inspection revealed that the pier is indeed in need
of repair. In addition there was material on the dock
suggesting that work was about to commence. Before any
maintenance work can be done to any structure over the waters
of Newport Harbor, the permitee must first obtain a written
"Harbor Permit" to do so from the City's Marine Department.
This requirement may be found in the City Harbor Permit
Policies, Section 3.A.
The repairs must not alter the shape or dimensions of the
existing pier and float, unless the'permitee applies to do so
with an application to revise the pier. Harbor Permit
Policies, Section 3.A.

The City of Newport Beach Marine Department has recived a request
to transfer mit # 225-802 for the property located at

We cannot transfer the pier permit until the following
deficiencies have been corrected and we have been notified:
1. A City -approved anti -syphon device is required at the water
connection to the pier and float.

The floats are in general disrepair, need to be improved.

The structure was inspecte&�.:. on 3/3/88 and in�accordance
with Section 10-D of the H arbor Permit Policies it cannot be
transferred until it meets City requirements.
10.D."At the time of transferi all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirementsy and the conditions of
the existing permit. All structural deficiencies.must be
corrected prior to transfer of the permit."
A permit for plumbing or electrical work must be obtained from the
Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED. When notified, the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred.

It has come to the attention of the Newport Beach Marine Department�
that you have recently rebuilt your pier bayward of 802 South Bay
Front. This type of work requires a Harbor Permit from the City,
as outlined in Section 3.A. and 5.H. of the Newport Beach Harbor
Permit Policies, which state:
3.A. "No person or agency shall build, maintain, extend or make
structural alterations on any building, pier, piling, bulkhead,,
sea wall , reef, breakwater, or other structure in, upon or over
the waters of Newport Harbor or'the Pacific Ocean or any other
water where the tide ebbs and flows within the City, or do any
filling, excavating or dredging in said waters or ocean, without
first obtaining a written permit to do so from the City."
5.H. "A written permit for maintenance is required from the Marine
Department for any structural or work where the cost for such work,
including labor and materials, would normally exceed $500.00.
Painting, replacement of rubrails and work considered cosmetic
in nature does not requi ' re a permit. Prior to issuance of a permit,
the applicant will show proof of Longshoremen's Worker's Comp- I
ensation Insurance as required by the Longshoremen's Act."
Failure to comply with the aboVe quoted Harbor,, -Permit Policies can
be grounds for revocation of your existing Harbor Permit and the
subsequent removal of the pier.

SUBJECT: HARBOR PERMIT 225-802
At our meeting in your office on 12/14/83 a question came up regarding
the reconstruction of the pier bayward of 802 South Bay Front, belonging
to Lou Akerman.
Specifically, the questions were what, in fact, had been done to the pier
and whether or not the permittee had secured the necessary permits.
On 12/14/83 1 inspected the pier in the field. The pier itself has
been totally rebuilt -to include new railings, new decking, and new
cross braces. The materials and sizes appear to meet the City standards.
The pilings supporting the pier have been sleeved with PVC pipe and it
appears as if concrete has been poured 'into the PVC.
The reconstructed pier does not exceed the original permit dimensions
(see attached drawing). The floats bayward of the pier are the
original ones and -no work has been done to them.
On 12/15/83 1 corresponded with Mr. Akerman (see attached letter) in-
dicating to him that a permit was required for this type of work and
that our records reflected that he had not gotten one. Once he contacts
the Marine Department, we will get the necessary permits and also in-
vestigate the specifics on the piling repairs.
