(2) Any labor in excess of 40 hours per week per man will be billed at time and a half.

(5) All agreements are contingent upon strikes, accidents, or delays beyond our control.
(6) Any additional Labor will be charged at $55/hour in addition to the above total.

The City of Newport Beach Marine Department has received a request
from you to inspect the pier and dock for the property located at
the above mentioned address. The property was inspected by a
representative of the Fire and Marine Department.
we cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
The electrical outlets on the dock must be GFI or twist lock
receptacles for use in a water environment.
The Newport Beach City Council Harbor Permit Policies state:
10 D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."

and Marine Department.
2. In my position as a Deputy Chief, my duties include the
issuance of dock and pier permits in the City of Newport Beach.
3. 1 make this declaration based on my personal knowledge
and, if asked, would and could competently testify thereto.
4. The City of Newport Beach (the ""City") administers the
Harbor Permit for pier adjacent to 906 S. Bayfront, Newport Beach, California
(the ""Pier").
5. The land on which the pier is built is State of California
Tideland, given to the City of Newport Beach in trust. The City issued a permit
pursuant to its powers under the Municipal Code for the Pier. The permit
describes the pier.
6. The Pier is located on State tidelands.
7. Pursuant to Section 17.24.030 of the Municipal Code and the
Harbor Permit Policy, "'No person who as an abutting upland owner or lessee of
real property was granted a permit for a pier, float or similar structure shall
retain any right of use in such pier, float or similar structure after having
divested himself of the ownership or leasehold interest in such real property"
8. The permittee must pay a $75.00 annual fee for the right to
occupy State property.

Dear Mr. Kemp:
The City of Newport Beach has, upon your request, re -inspected
the above mentioned property and found that it meets City
Standards.
The permit may be transferred to a new property owner once this
office has received notice that a sale is in escrow and the two
parties sign the transfer card. Also, since this is a joint pier
the joint permittee must sign on the card. once we have received
the transfer card and the additional $150 required for the
transfer, the permit will be transferred to the new owner.

JOINT OWNERSHIP PIERS
A, Permits may be granted for Joint ownership p-Jers
at the prolongation of comxqon lot lines subject
to the followling conditions*
1. No perm. its will be granted to persons other
than the owners or long-term lessee of the
abutting upland propertiese
2. The -permit application must be signed by the fee
owners or long-term lessee of all abutting upland
property having access to the facility4
3. The permit shall provide that all parties shall
have equal rights under the permit and shal-I be
help jointly responsible�for compliance with
all rulesf regulationsf and conditions set forth:,

Bw The policy for set -backs applies to joint ownership
