(5 Ayes, 1 Excused) Item 2: A request for a Use Permit for the Balboa Theater (PA2004 -032) at 707 East Balboa Boulevard was approved and is subject to appeal or call up by the City Council. (5 Ayes, 1 Excused) This Use Permit provides for the Balboa Theater to be restored and reconstructed at a height of 55 feet as allowed by the exception to the height limit allowed by the Zoning Code for Landmark Buildings. The item was approved without comment by the Planning Commission. Item 3. A Condominium Conversion and Tentative Tract Map for the Espinoza building (PA2004 -137) at 329 Marguerite Avenue was continued to October 7, 2004. (5 Ayes, 1 Excused) This project, at the corner of Marguerite Avenue and Bayside Drive in Corona del Mar, would result in the conversion of an existing 7 unit apartment project to condominiums, allowing for individual ownership of each unit. The Planning Commission was concerned about what effect the conversion would have on the potential to eventually redevelop the property which has several non conformities, parking in particular. The Commission requested additional information from staff and continued the item to October 7. 2004. Item 4: Appeal of the determination of (PA2004 -008) at 505 J Street appellant. (5 Ayes, 1 Excused) Pla nni n g:sha red -pla nn i ng comm ission- pcagenda rpt compliance for the Gates residence was continued at the request of the Planning Commission Agenda September 28, 2004 Page 2 0 Item 5: St. Mark Presbyterian Church (PA2003 -085) at 2200 San Joaquin Hills Road, General Plan Amendment No. 2003 -002, Planned Community Test Amendment No. 2003 -001, Use Permit No. 23003 -015, Traffic Study No. 2004 -004, Parcel Map No. 2004 -036 and certification of the Environmental Impact Report was recommended for approval and is automatically forwarded to the City Council. (5 Ayes, 1 Excused) The proposal, if approved, will allow the construction of a new church, fellowship hall, and preschool to be constructed at the northwesterly corner of MacArthur Boulevard and San Joaquin Hills Road. The project includes the preservation of an existing canyon (arroyo) on site, as well as the transfer of land to the Big Canyon Country Club. Discussion of the Commission centered on parking for the preschool, the access to the project from both MacArthur Boulevard and San Joaquin Hills Road, the configuration of the acceleration and deceleration lanes, and the height of the sanctuary building. The Commission imposed conditions to insure adequate parking for the preschool, extended the length of the deceleration lane on Macarthur Boulevard for the secondary access to the property, and limited the height of the sanctuary to 51 feet in height. The item is expected to be scheduled for hearing at City Council on October 12, 2004. • Item 6: St. Andrews Presbyterian Church Expansion (PA2002 -265) at 600 St. Andrews Road, General Plan Amendment, Zone Change and Use Permit was continued to October 21, 2004 at the request of the applicant.. REQUEST FOR CONTINUANCES: CONSENT CALENDAR Notice to the Public All matter(s) listed under CONSENT CALENDAR (Item 1) is considered by the Commission to be routine and will all be enacted by one motion in the form listed below. The Planning Commission Members have received detailed staff reports on each of the items recommending an action. There will be no separate discussion of these items prior to the time the Commission votes on the motion unless members of the Commission, staff or the public request specific items to be discussed and /or removed from the Consent Calendar for separate action. Members of the public who wish to discuss a Consent Calendar item should come forward to the lectern upon invitation by the Chairman, state their name and Consent Calendar Item number. ITEM NO. 1. SUBJECT: Minutes of the regular meeting of September 9, 2004. ACTION: Approve as written and order filed. HEARING ITEMS: ITEM NO. 2. SUBJECT Balboa Performing Arts Theater (PA2004 -032) SUMMARY: Request for approval of a Use Permit for the Balboa Performing Arts Theater, a designated Landmark Building and permitted use, to allow an increase in building height up to a maximum of 55 feet pursuant to Section 20.65.070 of the Municipal Code. ACTION: Staff recommends that the Planning Commission approve Use Permit No. 2004 -003 to allow the Balboa Theater to increase in height up to a maximum of 55 feet, subject to the findings and conditions of approval within the draft resolution. ALL TESTIMONY GIVEN BEFORE THE PLANNING COMMISSION IS TAPE RECORDED. SPEAKERS MUST LIMIT REMARKS TO THREE MINUTES ON ALL ITEMS. (Red Ilght signifies when three minutes are up; yellow light signifies that the speaker has one minute left for summation.) ITEM NO. 3. SUBJECT: Espinoza Condo Conversion and Tract Map (PA2004 -137) 329 Marguerite Avenue SUMMARY: The Condominium Conversion and Tentative Tract Map relate to the conversion of an existing 7 unit apartment building to condominiums for the purpose of individual sale. The Coastal Residential Development Permit Application relates to compliance with affordable housing regulations applicable within the Coastal Zone. ACTION: Staff recommends that the Planning Commission approve Condominium Conversion No. 2004 -014, Newport Tract Map No. 2004 -002 & Coastal Residential Development Permit No. 2004 -001, subject to the findings and conditions of approval within the draft resolution. ITEM NO. 4. SUBJECT: Gates Residence Appeal PA2004 -208 505 J. Street SUMMARY: Appeal of the determination of compliance with the provisions of Chapter 20.65 of the Newport Beach Municipal Code (Building Height) by the Planning Director related to the approval of a plan revision for a project at 505 J Street. The appeal contests the correctness of that determination. ACTION: Continue to October 21. 2004. ITEM NO. 5. SUBJECT St. Mark Presbyterian Church (PA2003 -085) SUMMARY: Proposed General Plan Amendment to change the land use designation from Recreational and Environmental Open Space (REOS) to Government, Educational and Institutional Facilities (GEIF); amend the Big Canyon Planned Community Text to include the project site within it's boundaries, designate the site "Institutional and Nature Preserve" and adopt Planned Community District development regulations; Use Permit to allow the construction of a new church complex with the main sanctuary building to exceed the base 32 foot height limit; Traffic Study pursuant to the Traffic Phasing Ordinance; Tentative Parcel Map to subdivide an existing 10.81 acre parcel into three parcels. The total proposed square footage for all structures is approximately 34,000 square feet. ACTION: Staff recommends that the Planning Commission recommend approval of the General Plan Amendment No. 2003 -002, Planned Community Text Amendment No. 2003 -001, Use Permit No. 2003 -015, Traffic Study No. 2004 -004, Parcel Map No. 2004 -036 and certification the Environmental Impact Report to the City Council. ITEM NO. 6. SUBJECT: St. Andrews Presbyterian Church Expansion (PA2002 -265) 600 St. Andrews Road SUMMARY: Request for a General Plan Amendment, Zone Change and Use Permit for the replacement and construction of additional buildings and a below grade parking garage. The General Plan Amendment involves an increase the maximum allowable building area with no change to the existing land use designation. The Zone Change would change the zoning district from R -2 & R -1 to GEIF to be consistent with the existing General Plan, Land Use Element designation. The Use Permit involves the alteration of existing buildings, replacement of the existing fellowship hall and classroom building and the construction of a new multi - purpose gymnasium and youth center. The Use Permit also considers setting the maximum allowable building height of 40 feet for the two proposed buildings. ACTION: Continue the public hearing to October 21, 2004.
