Bay Front Balboa Island, CA 92660 Re: Construction Work on City Property Dear Mr. Glassell A routine inspection of the public facilities bayward of 1204 South Bay Front indicated that there has been a coring through the bulkhead and under the sidewalk in front of your property. It appears that the work has been to facilitate the installation of PVC pipe through the cored hole to accommodate water and electricity out to the dock. These improvements are under City property and as such require an encroachment permit from the City's Public Works Department. To facilitate this permit, please contact Gill Wong in the Public Works Department at 644-3311. In addition to the encroachment permit any plumbing or electrical fed through the conduit out to the dock requires a City Building Permit as provided by the City's Harbor Permit Policies. SUBJECT: CITY'S BERTHING POLICY VESSEL ENCROACHMENT Recommehdati on If desired, 1) re-affi rm the City staff's interpertation of Harbor Permit Policies regarding vessel berthing and encroachments and direct the staff to advise Mr. Glassell to re -locate the vessel. Situation The Marine Department staff, during a routine harbor inspection, observed a 50' Columbia.Sailboat berthed at a private pier in front of 1204 South Bayfront, I Balboa,Island. The vessel was moored contrary to Section 21 paragraph A of the City Council's Harbor Permit Policies. This section reads: "Boats moored -at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected in accordance with Section 20-C." Section 20-C states: "C. The projection of the property line bayward of the same bearing from the bulkhead shall generally be used in determining the allowable set backs for piers and floats. Because there are certain physical conditions which preclude the strict application of this policy without prejudice to adjoining properties, Council approval will be required in areas where precise projections of the property line have not been determined and the following condi- tions exist: 1. Where property lines are not approximately perpendicular to the bulkhead line. 2. Where curves or angles exist in the bulkhead line. 3. Where bridges, topography, street -ends or publicly owned facilities adjoin the property." PAGE TWO APPLICANT: GLASSELL The lot at 1204 South Bayfront is 30' in width. The 50' Columbia Sailboat moored parallel to the shoreline attached to a rectangular float extends approximately 10' beyond the projection of the property lines on either side of the property. When the City staff observes an encroachment of this type or it is brought to our attention by the Orange County Sheriff's Department -Harbor Patrol Bureau, we routinely advise the harbor permit holder of the City's policy regarding vessel berthing and request that the vessel be re -located in accordance with the City's policy. On August 23, the Marine Department staff advised Mr. Andrew Glassell, by letter of the problem and asked him to correct the situation. On September 13, Mr. Glassell met with the Marine Director to review the City's request. As a result of the September 13 meeting, Mr. Glassell has requested that an exception to the subject Harbor Permit Policy be granted. Mr. Glassell has contacted the property owner at 1206 S. Bayfront who has a shore mooring which is partially blocked by the Columbia Sailboat. The Scanlons and Mr. Roger Vandergrift who have adja- cent shore moorings have given Mr.. Glassell letters indicating they have no objection to the method in which the sailboat is berthed at 1204 S. Bayfront. Discussion The Joint Harbor Committee reviewed this situation on September 28, 1977, and were unable to reach an agreement, whereby a recommendation could be forwarded to Council. In summary, the Joint Harbor Committee was split between granting a short term exception and granting a longer exception until such time as formal complaints were received. It was also brought out during the Joint Harbor Committee discussion, that the applicant has access to an off -shore mooring. The City's Mooring File Register shows that Andrew Glassell, P. 0. Box 372, Balboa Island, maintains mooring A- 143 and that a 50' sailboat CF 9619FD is registered to that mooring. Currently, there is a 40' ketch "Cetecea", documented vessel, occupying mooring A-143. The Marine Director, prior to the Joint Harbor Committee meeting, advised Mr. Glassell that the staff does not have the discretionary authority to grant an exception of this type. The reason the Joint Harbor Committee and the City Council have not allowed mooring variances in the past are: 1. The tendency to establish a precedent which becomes extremely difficult to reverse. 2. Balboa Island has a balance between beach use and boat berthing capacity. 3. Discretionary enforcement of City Ordinances and/or Harbor Permit Polqcies cause confusion for both the City staff as well as Orange County Sheriff's Department Harbor Patrol Officers. I had the notice attached upon my return and the hearing was held before I received it. I own the property at 1202 South Bay Front. I ha ve half owner- ship with Mr. and Mrs. Paul Ryckoff on the pier that is right next to Mr. Glassell's pier. The arrangement we have with Mr. and Mrs. Ryckoff is that he uses one side of the pier and I use the other side (closest to Mr. Glassell's pier). At the present, I do not have a boat on my pier --- however I just recently purchased a boat and plan to use my side from time to time. Mr. and Mrs. Glassell are good neighbors, but we must recognize a problem --- there is a shore mooring between our piers --- there is n ' a Way the owner of the shore mooring will be able to get his sail boat in and out if the varience is granted and I have a boat on my pier. The only way is for one of us to move each time. I am not going to be too thrilled about that and I doubt if the owner of the shore mooring is going to be to happy either. I understand a Mr. Lyle Finley owns that shore mooring. I think the last thing anyone wants to do in this world is start an argument with a neighbor --- expecially people as nice as the Glassells, but we must recognize a problem that is real and does exist. To ignore it will only make problems worse. As long as I do not use my pier, there will not be a problem --- but when we do use it --- there is definately not enough room considering the shore mooring.
