SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information.provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER #5-89-555 APPLICANT: Wes Kohtz
LOCATION: 1508 South Bayfront, Newport Beach
PROPOSED DEVELOPMENT: Demolish floating 220 square foot dock and construct 168
square foot dock. The existing pier does not exceed the U.S. Pierhead Line.
RATIONALE: The proposed project is consistent with the Coastal Act, the City's
Land Use Plan and past.Commission actions and has no potential for significant
adverse impacts on coastal resources or public access.
This waiver will not become effective until reported to the Commission at their
July 11-14, 1989 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

OF 1508 SOUTH BAY FRONT
Recommendation:
If desired, approve the application subject to the following
conditions:
1. Approval of the California Coastal Commission
2. Approval of the Army Corps of Engineers
3. Approval of plans and specifications by the City
Public Works Department.
Discussion:
This application is before the City Council as required by Section
22 of the Harbor Permit Policies, which states:
22. " Balboa Island. No new, non-commercial piers on Balboa
Island shall be recommended unless -it is in the public interest or
unless it is at such a location that it is not useable for
swimming or bathing.
Piers presently in use may be repaired but
recommendations for any additions or remodelling shall be
restricted to such changes that do not lessen the use of either
the immediate water or land areas."
The applicant proposes a change in the float configuration from a
rectangular float to a narrow, single finger float. There will be
a net decrease in the amount of water area covered by the
structure with the proposed revision. The change would not lessen
the use of the water or land areas. The proposed revision would
therefore conform to the above quoted policy.

Dear Si r:
The City of Newport Beach has received an application to transfer
pier permit # 225-1508 fbr the property located at 1508 So. Bay Frotr
Newport Beach, California.
The structure was inspected on 3/22/85 at which time it was determined
that the following deficiencies exist: (pier is being transferred; below
is for information only).
1. Flotation at back of float should be repaired, as dry rot is
beginning on the back fascia.
2. The ramp anchor is bent.
3. Pilings will need to be replaced in about 5 years
4. Dry rot and loose boards on float
5. Ramp off track
In accordance with Section 10-D of the City Harbor Permit Policies:
"All structural deficiencies must be corrected......", it will be
necessary for these to be corrected. A permit for any electrical or
plumbing work must be obtained from the Building Department.of the City.
All other work requires a Harbor Permit.
Please advise this department when the above deficiencies have been corrected.
Another inspection will be made, and if the deficiency is solved; it will
then be possible to transfer the pier to the new owner.

Dear Dr. Kohtz:
The City of Newport Beach has received a complaint regarding the dock
bayward from your property at 1508 South Bay Front, Newport Beach.
Specifically, the complaint is that a vessel berthed at your dock is across the
East property line and encroaches into the area used by on -shore mooring
S-141. Two field inspections have verified that a vessel at your dock does
extend across the property line and affects the permittee's use of mooring S-
141.
This is a violation of the City Harbor Permit Policy 21.A. " boats moored at
private or public docks shall not extend beyond the projection of the property
lines of the property to which the dock facility is connected."
Please arrange to have the boat relocated to conform to the above stated policy
within two (2) weeks from the date on this letter.
Your cooperation in this matter will be greatly appreciated. If you have any
questions in regard to this matter, please call 949-644-3043.
