Dear Mr. Armand:
This is in reply to your application (File No. 199915672-dlc) dated April 20, 1999, for a
Department of the Army Permit to conduct maintenance dredging in Newport Bay in Newport
Beach, Orange County, California.
Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 18.
As long as you comply with the general permit conditions of RGP No. 18 an individual
permit is not required. This letter of verification is valid until August 29, 1999, when RGP No.
18 will expire. A general permit does not grant any property rights exclusive privileges. Also, it
does not authorize any injury to the property or rights of others or authorize interference with
any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain
other Federal, State, or local authorizations required by law.

application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code..,,,
If, at a later date, this information,is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy

PROPOSED DEVELOPMENT: Revision of a boat dock. Revisions consist of a now
31x22' gangway, installation of 2 new 14" guidepiles, move 2 existing 12"

shaped float of the same square footage comprised of a 41x271 finger and a
51x27' finger connected by a 41x241 headwalk. The existing pier would remain.
RATIONALE: The proposed project would not extend channelward of the existing
dock nor the City project line. The proposed project would not interfere with
harbor navigation. The proposed project would not result in significant
adverse impacts to coastal access, coastal resources, nor public recreation
opportunities, and would be consistent with the City's certified land use
plan, past commission actions in the area, and the Chapter 3 policies of the
Coastal Act. 1!
This waiver will not become effective until reported to the Commission at their
February 3. 1998 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

which you notified the Corps of Engineers that Mr. Gary Wilder
intends to maintenance dredge approximately 120 cubic yards of
material by hydraulic suction from 1702 South Say Front and
dispose of the material on an adjacent beach, in the City of
Newport Beach, Orange County, California.
Based on the furnished information, we have determined that
your proposed activity complies with the terms and conditions of
Permit No. 89 -211 -GS provided Mr. Wilder does not exceed the
maximum dredging design depth of -5 feet MLLW with a maximum
allowable overdepth of -1 foot MLLW.

with Section 10-D of the Harbor Permit Policies it cannot be
transferred until it meets City requirements.,
10.D."At the time of transfer, all harbor structures shall be
inspecte ' d for compliance with the City's minimum plumbing,
electrical and structural requirements,, and the conditions of
the existing permit. All structural deficiencies.must be
corrected prior to transfer of the permit."
A'permit for'plumbing or electrical work must be obtained from the
Building Department of the City.

The application requires City Council approval under the conditions of approval
placed on the City of Newport Beach general permit for maintenance dredging
issued by the U. S. Army Corps of Engineers, on February 12, 1974, and subsequently
amended -on May 10, 1977 to allow beach restoration.
The location and applicant for the proposed dredging and beach restoration are.:

The staff has reviewed the projects and has determined that the work will be
done within the parameters of the Corps of Engineers permit. The dredging
contractor will place a filter screen around the discharge site to control
turbidity. There is no known eel grass in the vicinity of the projects.
The projects will aide in the restoration of a beach bayward of private
residences.
