This letter of verification is valid until July 24, 2005, when RGP No. 54 will expire. A general permit does not grant any property rights exclusive privileges. RATIONALE: The subject site is a bayfront lot located between the first public road and the sea. The proposed development consists of the reconstruction and reconfiguration of an existing. dock within the Project Line. As allowed by the City of Newport Beach Harbor Permit Policy (Section V. 1, Bayward Location of Piers and Floats), dock projects within the subject area may extend up to 16' beyond the U.S. Pierhead Line to avoid the need for excessive dredging. The proposed dock is similar in function to other residential docks in the immediate vicinity. Vertical public access to the bayfront is available at the end of Jade Avenue, immediately east of the proposed development. Lateral public access along the bayfront is available along an existing public walkway, which occurs seaward of the proposed development and fronts the harbor bulkhead along the perimeter of Balboa Island. An inspection performed by the City determined that no eelgrass exists in the vicinity of proposed project. Therefore, no eelgrass will be affected by the proposed project. The proposed development will not result in adverse impacts to coastal access, coastal resources, public recreation or coastal views. The proposed development would not prejudice the City's ability to prepare a Certified Local Coastal Program and is consistent with the land use designation in the City's Certified Land Use Plan, past Commission actions in the area and Chapter 3 policies of the Coastal Act. This waiver will not become effective. until reported to the Commission at their March 14-17, 2000 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of Regulations. I understand that there is a request to modify the slip. Mr. Gene Lu, owner of the slip, has discussed with me his propossed modification. He has promissed that after removing the upbay finger of his slip, that his boat will not extend upbay past the 12 ft. 3 inches being removed. He has stated that he will agree to this in writing. I have no objections to the slip modification as long as any boat docked there does not extend past the current slip width. Any widening of the use would present an obstacle to my getting in and out from my shore mooring. He also suggested that the Council adjourn this meeting to Thursday, July 2 to receive a report on how the 'staff would recommend the City deal with this budget after the State has taken their official action. If the State has not adopted their budget by July 2, then there would be no need to meet. In view of the above comments, Council Member Hedges recommended that the City not expend any monies for any Arts and Cultural grants until such time as the City knows what the State is going to do to this City's budget. Dorrit Fitzgerald,.2753 Vista Umbrosa, addressed the Council regarding funding for the Arts and what might possibly be cut from the current budget. She stated she is the Curator of Exhibitions for the Irvine Fine Arts Center and has held this position since 1983. She stated that many years ago she participated in the Newport Beach Arts Festival, and won award, and it was this award that gave her the courage to proceed in the arts field. She emphasized the importance of Art in the community_ and urged the Council to continue funding the City's art program.' "In those areas of the harbor where the piers and floats are bayward of residential zoned areas and are reserved for the occupants of the abutting upland property, liveaboards shall not be permitted. Subsequent to that letter I received a call from Brady Brown, indicating that there was.no one living aboard the vessel berthed at your permitted pier, and that people came only periodically to spend a couple of days aboard the vessel. Recently the City of Newport Beach has again received complaints of adjoining residents, indicating that people are in fact living aboard the boat. Complaining parties have documented liveaboard status of those people for a three month period. We must again ask that, if people are in fact living aboard the boat, they must vacate the boat to bring it into compliance with the above quoted Harbor Permit Policy. If we continue to receive complaints of liveaboards on this vessel it will be necessary to turn this matter over to the City Attorney's office for enforcement. (2) The proposed remodelling will lessen the use of the immediate water area. The prior approval of the U.S. Corps of Engineers is required because the proposed work extends beyond the U.S, Pierhead Line. The Harbor Permit Policies allow piers to _extend 16 feet bayward of theUo_S._ Pi erhead__Li ne in -this The Harbor Permit Policies state that whenever an application to install a new non-commercial pier on Balboa Island is to be taken under consideration by the City Council, all occupants within 300 feet of the proposed work shall be notified in writing. Because this application is for a revision to an existing installation and not for a new one; the Public Works Department has interpreted the policy to mean that notification would not be necessary. If the Council wishes to have the surrounding occupants notified, this application should be held over until the notifications can be mailed. The adopted Harbor Permit Policies provide that in this area dredging around floats shall not exceed a depth of 4 feet at Mean Lower Low Water along a line 85 feet channel - ward of and parallel with the U.S. Bulkhead Line. The application drawing submitted in 1966 shows an existing depth of 4.5 feet at Mean Lower Low Water at a point 84 feet bayward of the U.S. Bulkhead Line, slightly deeper than allowed; so no further dredging should be -permitted. The float is designed to cantilever 16 inches shoreward in order to allow a 32 inch wide backwalk without the need for further dredging. Recommendation for denial of the application is based on the following para- graph in Section 22 of the Harbor Permit Policies: "Piers presently in use may be repaired but recommendations for any additions or remodelling shall be restricted to such changes that do not lessen the use of either the immediate water or land areas."
