A. Design of harbor structures that do not conform to the Standard Drawings
contained within "Design Criteria and Standard Drawings for Harbor
Construction," needs the approval of the Building Department prior to the
issuance of a harbor permit.
B. Harbor structures shall be designed in accordance with design criteria adopted
by the City of Newport Beach and contained within "Design Criteria and
Standard Drawings for Harbor Construction."
C. The decking of all piers and pier platforms shall not exceed an elevation of 9.0
M.L.L.W. nor be less than an elevation of 8.0 M.L.L.W.
JOINT OWNERSHIP PIERS
A. Permits may be granted for joint ownership piers at the prolongation of common
lot lines subject to the following conditions:

1. No permits will be granted to persons other than the owners or long-term
lessee of the abutting upland properties.
2. The permit application must be signed by the fee owners or long-term
lessee of all abutting upland property having access to the facility.
3. The permit shall provide that all parties shall have equal rights under the
permit and shall be held jointly responsible for compliance with all rules,
regulations, and conditions set forth in the permit.
B. The policy for setbacks applies to joint ownership piers with the exception that
the slips, floats and piers may extend over the common property line.
BULKHEADS
A. All bulkheads in residential districts shall be installed on the established
bulkhead line or at a location behind the bulkhead line that would preserve the
design profile of the harbor. - Any retaining or ornamental wall installed
landward of the bulkhead line shall be considered a bulkhead if it also serves to
contain the waters of the harbor and shall be processed in the same manner as if
it were on the bulkhead line.
The Harbor Resources Division may issue permits for bulkheads, between U.S *
Bulkhead Station Numbers 112-109 not to exceed the bayward side of the
"Vacated East Bay Avenue." U.S. Bulkhead Station 104 for the addresses at 2209,
2223/ 2227, 2231 and 2233 Bayside Drive: Staff recommendation for a bulkhead at
these properties shall not exceed a point bayward of the average high tide line
established at a point 40 feet landward of the face of the bulkhead at the property
at 2137 Bayside- Drive, and then on a straight line from that point to the bayward
most point of the bulkhead at the property at 2301 Bayside Drive.
B. Bulkheads shall be at the existing height established for the area and shall be
connected to adjacent bulkheads. In cases where no adjacent bulkhead or
bulkheads exist, a wing wall or wing walls shall be constructed from the
bulkhead landward adequate to contain the fill behind the bulkhead constructed

No solid or masonry structure shall be constructed on a bulkhead.

Sirs:
The City of Newport Beach Fire and Marine Department has received a request to
transfer pier permit 2251804-2 for the above-mentioned property. The facility was
inspected on August 3, 1999. We cannot transfer the pier permit until the following
deficiency has/have been corrected and we have been notified of the corrections:
A City -approved anti -syphon device is required at the water connection for the water
to the pier and float. A sketch showing the approved type of device and its installation
is enclosed. This requirement is in accordance with Title 17 of the California
Administrative Code. The State of California Department of Health no longer accepts
the device that is currently on the water line.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

The Executive Director hereby issues a permit for the proposed develop-
ment on the grounds that the deve opment will be in conformity with the
provisions of Chapter 3 of the California Coastal Act of 1976, will not
prejudice the ability of the local government having jurisdiction over
the area to prepare a Local Coastal Program conforming to the provisions
of Chapter 3 of the Coastal Act, is located between the sea and the
first public road nearest the shoreline and is in conformance with the
public access and public recreation policies of Chapter 3 of the Coastal
Act, and will not have any significant adverse impacts on the environment
within the meaning of the California Environmental Quality Act.

A. Project Description. Relocation of an existing private boat
dock ed in conjunction with a single-family residence. The existing
dock, pier, ramp and pilings will be used to reconstruct the dock in
its new location.
B. Public Access. The project is located on Balboa Island between
the nearest public road and the sea. The Executive Director determines
that there is,adequate vertical access on the island by street ends
leading to the sandy beach at 300 ft. intervals and lateral access
by a public bayfront boardwalk adjacent to the beach around the
perimeter of the island.
C. Local Coastal Program Consistency. The Executive Director determines
tha e proposed project is consistent with the conditionally
certified Newport Beach Land Use Plan.

Discussion:
This application is before the City Council as required by Sections
5.C. and 23.V of the Harbor Permit Policies which state:
5.C.."Prior approval of the City Council will also be required
before issuing a permit for shore -connected structures when:
(1) The abutting upland property is a dedicated public
ri ght of way. . .. ".
23.V. "Balboa Island. All new piers shall be subject to special
permits approved by the City Council. Revisions to existing
piers will be permitted providing they do not lessen the
use of either the immediate water or land areas."
The applicant is the owner,, of the property at 1808 South Bay Front, which
is made Lip of Lots 3, 4 and 5. The pier and float at this address is
situated bayward of Lots 3 and 4. The applicant plans (see letter attached)
to sell Lots 3 and 4 and retain Lot 5 as his personal residence. He also
wishes to retain an interest in the pier and float. To do this he proposes
the attached revision whichwould consist of:
1. Relocating the pier from the common property line between
Lots 3 and 4 to the common property line between Lots 4 and 5.
2. Relocating the existing float, keeping it bayward of Lot 4
but moving it so it is at least 5 feet from the common property
line between Lots 3 and 4.
Once the above revision was accomplished, the following would occur: when
Lot 3 was sold, since now none -of the Oier-and float were-attachdd.to or
bayward of Lot 3, the new owner of Lot 3 would have no interest in the
pier and float; when Lot 4 was sold, the new owner of Lot 4 would become
a joint permittee with the owner of 'lot 5.
The applicant has submitted his proposal to both the Balboa Island Improve-
ment Association and the Little Balboa Island Property Owner's Association,
both of which have approved. (See letters attached)
The staff, in reviewing the proposed revision, feel that it would not lessen
the use of either the immediate water or land areas.

Thank you for your courteous and enlightening telephone call last Tuesday.
The situation involving the I'liveaboards" on your dock space located between
Rempel and Holleman homes on South Bay Front, Little Island, evidently just
grew like Topsy without the knowledge of the community until we were con-
fronted with a total problemt As we discussed the problem on the phone,
and as I later talked to one of3our tenants, Madeline (she phoned me), living
aboard boats in this harbor as a regular procedure is just not legal and
may well result in cancellation of the dock permit if the tenant insists
on continuing the practice.
Madeline indicated in her discussion with me that Bob Hill, the owner of
the boat, had the phone installed in the event that an emergency should occur
with hi's aging parents. Bob and Madeline were only involved in the rehab
and repairs to the vessel. I have since heard from other sources that Mr.
Hill had made additional plans to accommodate yet another couple for a month
on the boat. I was assured by Madeline that there was a holding tank on
board. My source of information indicated that this tank was pumped out after
dark. A philosophy of "no see, no harm" is evidently in effect here.
One of the unfortunate things about this whole matter is that this situation
could happen to any number of people who have made arrangements for slip
rental. It appears to me that this would be a good time for the Harbor
Department - and local concerned community groups and boaters generally to
again publicize the code pertaining to slip use and in addition more carefully
check docked and anchored boats.. Bay pollution will be an increasing problem -
far exceeding today's critical situation - if we don't act together.
Again, thank you for your attention to the situation in such a prompt fashion
and we hope that we can meet at our next meeting of the Little Island
Association on July 21st at 106 Crystal -- 9:30 A.M. for coffee and the
program which begins at 10:00 A.M.

RECOMMENDATION
If desired, approve the Maintenance Dredging Harbor Permit Applications.
DISCUSSION
These applications require City Council approval under the conditions of approval
of the City of Newport Beach "blanket" permit for maintenance dredging issued
on February 12.. 1974, by the U. S. Army Corps of Engineers.
The locations and applicants for the proposed maintenance dredging are:
225-1804 - W. P. Ritter, 1804 S. Bayfront, Balboa Island
171-921 - Eugene Yeager, 921 Via Lido Soud
The staff has reviewed the proposed dredging and has determined that the work
to be done is within the parameters of the Corps of Engineers permit. There is
no anticipated adverse affect on proximity beaches or contiquoug bulkheads.
Shellmaker, Inc., the dredging contractor, will minimize turbidity as much as is
possible and will barge the dredged material to the Environmental Protection
Agency's designated disposal site, four miles at sea.

If desired, approve the Harbor Permit Application subject to the approval of
the Army Corps of Engineers, or deny the permit.

This application is being brought to Council for action in accordance with the
City Council's Harbor Permit Policies, Section 5 C I which states:
"Prior approval of the City Council will also be required before issuing
a permit for shore -connected structures when:
The abutting upland is a dedicated public right-of-way except
along the Grand Canal on Balboa Island."
Additionally, Section 22 of the Policies specifically addresses the S'ituation
on Balboa Island as follows:
"No new, non-commercial piers on Balboa Island shall be recommended
unless it is in the public interest or unless it is at such a
location that it is not usable for swimming or bathing.
Piers presently in use may be repaired but recommendations for any
additions or remodeling shall be restricted to such changes that
do not lessen the use of eitherthe immediate water or land areas."
The applicant desires to revise the existing pier and float by relocating the
pier on the common property line (between Lot 3 and Lot 4) and to provide a
single "U" shaped slip in place of an existing single "U" shaped slip and
attached rectangular float. The square footage of the proposed structure will
be less than the existing structure and will also encumber less total water
area. The usable beach area between the new structure and�the bulkhead should
not be affected. The proposed relocation will provide more usable beach between
the relocated pier and an existing pier to the west.
The proposed structure will comply with all other provisions of the Harbor
Policies such as configuration and structural design.

The City Council Harbor Permit Policies are silent with regards to relocating
piers and slips on Balboa Island. If Lot 3, at a future date, is detached or
sold by the applicant as a separate parcel, the harbor permit facility would
become, by City Harbor Permit Policy, a jointly owned structure. In other
zones of the bay, joint pier and slip facilities are encouraged because it
encumbers less beach space than two separate piers.
Because the Harbor Permit Policies prohibit new residential piers on Balboa
Island, there is the possibility that the City Council will receive some future
applications for pier relocations on Balboa Island to provide for a joint
facility. The reason for this is that pier rights have traditionally enhanced
property values. Staff feels obligated to bring this hypothesis to Council s
attention because of the City's past position in retaining a "status quo" type
of attitude toward pier and slip revisions on Balboa Island.
Property owners surrounding the proposed project, as well as the Balboa Island
Improvement Association and Little Island Homeowners Association, have been
notified that the City Council will review this application on February 28, 1977.

RECOMMENDATION
If desired, deny the application. Should the Council consider approving
the application the following conditions of approval are recommended:
a) Subject to the approval of the U. S. Army Corps of Engineers.
b) The resubdivision.of the upland property be completed prior
to the construction of the facility -
DISCUSSION
This application is being brought to Council for action in accordance
with the City Council's Harbor Permit Policies Section 5 C I which states:
"Prior approval of the City Council will also be required before
issuing a permit for shore -connected structures when:
The abutting upland is a dedicated public right-of-way except
along the Grand Canal on Balboa Island."
Additionally, Section 22 of the Policies specifically addresses the situa-
tion on Balboa Island as follows:
"No new, non-commercial piers on Balboa Island shall be recommended
unless it is in the public interest or unless it is at such a
location that it is not usable for swimming or bathing.
Piers presently in use may be repaired but recommendations for any
additions or remodeling shall be restricted to such changes that
do not lessen the use of either the immediate water or land areas.
Whenever any application to install a new, non-commercial pier is:
to be taken under consideration by the City Council, all occupants
within 300 feet of the proposed work shall be notified in writing
by the Marine Department."

Applicant: W. P. RITTER
Mr. Ritter desires to revise the existing pier and float by relocating
the pier on the common property I ine (between Lot 3 and Lot 4) and to
provide two "U" shaped slips in place of an existing single slip and
attached rectangular float.
Since this is a privately owned facility, the proposed revision , would not
be considered to be "in the public interest". There is a beach area between
the structure and the bulkhead which appears to be usable at average and low
tides. However, since the proposed structure would not be placed any closer
to the beach than the existing one, the beach area should not be affected by
the proposed pier and float.
The applicant has submitted calculations (attached) showing square footage
of the existing facility versus the proposed facility and a comparison of
square footage of water area encumbered by the existing and proposed facility.
These comparisons are as follows:

As can be seen by the above comparison, the proposed structure would encumber
461 square feet more of water area than the existing structure.
The proposed structure would comply with all other provisions of the Policies
such as setbacks, configuration and structural provisions.
If is the staff's understanding, as a result of discussions with the applicant's
contractor, that Mr. Ritter plans to split the existing upland parcel into two
parcels. The proposed pier and float revision would provide an additional "new
non-commercial" slip for the new parcel with a jointly owned pier structure.
In the recommendation portion of this report, staff has listed as the first
alternative to "deny the application". This recommendation is based on the
staff's understanding of the intent of the first paragraph of Section 22 of
the Harbor Policies as quoted above.
Property owners, within 300' of the proposed project and the Balboa Island
Improvement Association, have been notified in writing of this application
and the date for City Council disposition.

Recommendation:
If desired, approve the requestsubject to:
.1; Approval of the Planning/Building Departments to the issuings of
building permits to construct residences on lots 3, 4, and 5 of
Section 5, Block 4 of Balboa Island.
2. Close of escrow on the sale of the lots and proof of ownership
of the new joint permittees.
Discussion:
The prior approval of the City Council is required on this request as outlined
in Section 17.,24.030 of the Newport Beach Municipal Code, which states in part:
"Transfer of Permit. ' No person shall transfer a permit for a pier,
float or similar structure granted under the provisions of this
Chapter without prior written approval of the City ............. The
Marine Director is authorized to approve transfers of permits, or
in his discretion may refer the same to the City'Council for approval."
The current permittee for Harbor Permit #225�1804 for the property at 1804 S.
Bay Front, plans to demolish the existing residence, which is currently on three
(3) lots; lots 3, 4, and 5 (see attached permit drawing and letter). Once this
has been accomplished, three (3) new residences will be constructed, one on each
of the above lots.
The existing harbor structure will remain the same. However, the current permittee
wishes t . o include the two new property owners (created.from the sale of two of the
lots) as permittees on the existing permit.
The net result would be that property owners of lots 3, 4, and 5 would be joint
permittees of the existingpier and float nowin front of the property at 1804
S. Bay Front.

Al) The letter to the City Manager suggested that the shore
mooking owners be contacted and their written consent be obtained
prior to approval of this installation,
(2) The City Council re -consider the permit -until such time that:
the shore mooring owners consent in order to avoid a potential
conflicting navigational problem.
I contacted Ralph Moss* the marine contractor for Mr, Ritter,,
Friday morning June 23, lie stated that Mrs Ritter was reconsider-
ing his applioation with reference to repositioning his slip, pri-
marily because he does not want his vessel moored perpendicular
and exposed to the surge generated by Southeasterly winds and storm
conditionso Should Mr. Ritter decide to pursue the Harbor Permit
that Council approved he will submit in writing letters from the
shore mooring owners giving their consent. This material will be
resubmitted to the Joint Harbor Committee before we will issue
the permit.
Based on my conversation with Ralph moss this morning, I don't
expect the applicant to pursue the repositioning of the slip.
Your memo to the City Manager dated June 13 expkained in brief
the Joint Harbor Committee s action.

However, they were concerned with widening the slip by 5 feet as this

point in the channel, they felt a 'Longer boat should not be used.

RECOMMENDATION: If desired,,.approve Harbor Permit Application No. 225-1804.
SITUATION: A. The existing harbor facility bayward of 1804 South
Bay Front consists of a pier, platform,.ramp,.
(201 x 14') float with an attached (26' x 541) slip.
Mr. Ritter desires to revise�the facility by turning
the float so that the 20' dimension of�the float is
aligned with pier and the slip will be attached
parallel to the bulkhead andipierhead lines. (See
attached drawing.)
B. The reason for repositioning the slip is to allow
Mr. Ritter deeper water for docking his 50' Grand Banks..
The vessel is currently tied across the front of the
slip and float.
C. The repositioning would eliminate the need for dredging.
Dredging in this area has historically been undesirable
because of the adverse effects to�surrounding beach pro-
perty.,
DISCUSSION: A. The harbor permit policies require�prior approval of the
City Council -for pier and floats, abutting the City owned
property surrounding Balboa Island,,and that revisions
to existing piers may be granted if the change does not
lessen the use of the immediate land or water area.
